1. CALL TO ORDER
Chairman Mr. Doug Latimer called the meeting to order at 12:13
P. M.
Those Commissioners present: Chairman Mr. Latimer, Commissioners
Karl Johnston, Lola Phillips, Bobby Blackwell, Charlie Doug Boyle.
Citv Staff present: Chief Building Official/Zoning Administrator
David Paulissen, Code Enforcement Clerk Kelley Anderson,
Administrative Intern Sabrina Delafield.

2. PUBLIC HEARING IN REGARDS TO REZONING A 12.203 ACRE TRACT OF LAi1D
OUT OF RICHARD PEARSALL 1/3 LEAGE, SURVEY.
Their were no puo~~c present. The area to be rezoned was discussed
by Mr. Latimer and P9r. Paulissen.
The motion was made by Karl Johnston in favor of the rezoning and
seconded by Bobby Blackwell. Awl in favor.
It was decided to forward the request to Council for possible
rezoning.
3. COPISIDER APPROVING MINUTES OF THE MEETING HELD ON SEPTEMBER ~4, 1986.
The motion was made by Charlie Doug Boyle and seconded by Karl
Johnston to accept minutes of September 4, 1986. All in favor.
4. DISCUSS THE PROPOSED FINAL DRAFT OF THE ZONING I~9AP TO BE REVIEWED AT
THE NEIGHBORHOOD MEETINGS.
Doug Latimer read a letter to the Planning Commission, from John
Nesheim an attorney, in reference to Jack Phillips piece of land
between P Street and 225 west of Sens. The letter is requesting
changing General Commercial and bringing Light Industrial down to
his area. After the letter was read Mr. Paulissen explained to Mr.
Phillips that the General Commercial category would let them ude the
property for what they intended.
Mr. Phillips indicated to i4r. Paulissen that he would like to put
manufacturing and warehousing in there. In reply to this request,
Mr. Paulissen explained to him that under the current General
Commercial category, manufacturing is not something that is allowed,
and warehousing under the new ordinance will require one of the
industrial zones.
There was also concern that i4r. Latimer discussed, concerning the
fact that their were going to be some citizens that didn't like the
fact of putting any Business Industrial at all in that area, because

they wanted some of the area made residential. tor. Paulissen
mentioned, that what the staff is trying to do is to reach a
workable compromise where by the businesses there are impacted as
little as possible, and yet we still tempered with the fact that
there is still a residential community there as well as a relatively
new subdivision with concrete streets and residents in this area.
Other areas were looked at and discussed. One change was,
that we need to preserve the residents east of S 16th. It is
suggested that we bring the general commercial down one more block
south for a total of 2 blocks it still-lets all the homes stay
within their Residential zoning classification.
5. DISCUSS CHANGE IN PUBLIC HEARING DATE PREVIOUSLY SCHEDULED FOR
OCTOBER 23, 1986.
It was discussed and decided upon to change the public hearing to
November 6, 1986.

seller and Fred E. Westergren, Jr., Trustee, as buyer on the
real property as referenced above and the same being fully
described on Exhibit "A" attached hereto and made a part

All closing documents are in escrow with Ticor Title Insur-
ance and this closing is scheduled for 10 a.m. on Friday,

that certain tract of land conveyed to Friendswood Development Company
by instrument recorded in Volume 6973, Page 503, of the Harris County Deed
Records; said 12.203 acres (531,560 square feet) of land being more
particularly described by metes and bounds as follows (all bearings
referenced to the Texas Coordinate System, South Central Zone):
COMMENCING at Copperweld Rod 3264 found for the southwest corner of
that certain 2.319-acre tract of land conveyed to Cajun Investment by
instrument recorded under File No. H819145 and Film Code 038-85-1662 of
the Harris County Official Public Records of Real Property Hnd also being in
the north right-of-way line of Fairmont Parkway, based on 250 feet in width;
THENCE S 86 deg. 52' 54" W, 344.81 feet, with the north right-of-way line of
said Fairmont Parkway, to a 5/8-inch iron rod set for the PLACE OF
BEGINNING and being the southeast corner of the herein described tract of

SUBJECT: RE-ZONING: 12.203 acre tract Richard Pearsall 1/3 Leage,
Abstract 625, along Fairmont Pkwy.
The Ci ty has received an application from Mr. Fred Westergren to
re-zone the above describe property from i~s temporary "R-1"
Residential classification to an "I" Industrial classification to
allow a medical waste incineration business. The property is located
between Pipe and Valve Inc. and BFI Industries on Fairmont Parkway.
HISTORY
The property under consideration is undeveloped and is the last vacant
tract between the Southern Pacific Railroad track and the commercial
reserves in Fairmont Park East. Section 13-505-(1) of the present
Zoning Ordinance requires "I" Industrial zoning and a special use
permit for all refuse disposal sites.
ANALYSIS
The site faces Fairmont Parkway and currently is served with sanitary
sewer and will be served by water in the near future. The facility
will incinerate medical waste through a high temperature burning
procedure that reaches 2000 degrees F in the final process. Winfield,
the proposed owner, will provide copies of all Federal, State, and
Local permits to the Planning and Zoning Board of Adjustments at the
time of application for their special use permit.
The re-zoning to Industrial would be consistent with the proposed new
zon ing and map. The proposed map sh-ows the property to be "BI" or
Business Industrial Park at this time. The proposed use is consistent
wi th other uses adj acent to it i ncl ud i ng BFI Industries, a waste
disposal company.
RECOMMENDATION
The staff has reviewed this request with respect to the proposed
master plan and find it to be substantially in conformance with it.
The site is surrounded by both light and business industrial uses and
fronts on a truck route. The re-zoning in and of itself will not have
a negative effect on the area. Any Industrial use must have a special
use permit from the P & Z Board of Adjustments so individual uses will
still be reviewed based on their merits.
Based on the above review, staff would recommend that the above
described property be re-zoned to an "I" Industrial classification.
