NOTICE OF P~EETING
• Notice is hereby given that the La Porte Planning and Zoning
Commission will meet on the 3rd day of September, 1987, in the
Council Chambers, City Hall, 60b taest Fairmont Parkway, La Porte,
Texas, beginning at 7:00 P. M. A copy of the agenda for said
meeting, sho~aing the subjects of such meeting, is attached
hereto.
I hereby certify that I posted this Notice on the bulletin
board located at a place convenient to the public in the City
Hall of the City of La Porte, at 5:00 P.M. on the 31st day of
August, 1987, and f,hat (1) said Notice was posted for at least 72
hours preceding the scheduled time of the meeting; or (2) if this
tdotice was posted less than 72 hours but more than 2 hours before
the meeting is convened, I hereby certify that said meetin; was
called because of an emergency or urgent public necessity limited
to imminent threats to public health and safety or reasonable
unforseeable situations requiring immediate action by the
Planning and Zoning Commission.

MINUTES
MEETING OF SEPTEMBER 3, 1987
Chairman Doug Latimer called the meeting to order at 7:00 P.M.
Members Present: Chairman Doug Latimer, Commissioners Inge Browder,
Janet Graves, Bobby Blackwell, Jack Gresham, Charlie Boyle
Members Not Present: Lola Phillips
City Staff Present: Mark Lewis, City Inspector, Joel Albrecht,
Director of Community Development, John Armstrong, Asst. City
Attorney.
Others Present: Janet Gray Warlick, Adair Sullivan
Chairman Latimer called on Mark Lewis to begin the review of the City
of La Porte Zoning Ordinance ~~1501.
Mark began with Item No. 1 - Definition - Section ~-100
1) Building line - There is no definition for setback line.
Staff is suggesting - "closest point to any property line or utility
~~ easement which may be occupied by a structure."
This simply gives a definition for setback line.
Commission agreed to definition.
Item No. 2 - Ya d Front - This definition was a simple typo. It
stated rear lot line and the rear of the
principal building; the proper wording
should be " distance between the front lot
line and the fr n of the principal
building.
Commission agreed with changing of typo from rear to front.
Item No. 3 - Larae Lot Residential
This type of lot is referenced as "Single family large lot" in
Section 5-700, Table B and as "lots in excess of 43,560 sq.
ft. in Section 10-302(10). Staff feels there should be a
standard term used through out the ordinance and a definition
in Section 3-100. The suggestion for the definition is:
"Single family residential large lot" - any single tract or
lot comprised of one or more acres (referencing sq. ft.); that
property located in an "R-1" zone whose primary intended use
is for construction of a single family dwelling.

The staff is suggesting a "standard definition" through out the
ordinance be used as stated above. They feel this would cut down on
any confusion that could arise from different definitions in the
ordinance.
Janet Graves asked if the .largest definition of a lot we have up to
6,000 sq. ft.? Mark informed her that that is simply the minimum sq.
ft. required for developing single residential use. Janet then asked,
what is the largest lot we define right now (square footage)? At
present we only have a minimum "large lot" size. Mr. Latimer told the
Commission that a "Large lot" was referred to as one (1) acre. The
definition that the staff is recommending makes a more definitive term
as to what a "Large lot" is. No further questions.
Commission agreed to the standard definition suggested by staff.
Item No. 4 - Light trucks - Mark explained that this had a typo only
in the wording. The word include should
be exclude. John Armstrong stated that
this Was not a typo, he said it Was
changed by City Council so that trucks
With a 1-ton or less capacity could be
included under the definition of °Light
Trucks" .
Item No. 5 - Section ~-100 - Certified site plans required
Mark explained that at the present time we required a certified
site plan for everything, except residential construction, that has
a valuation of under $2500.00. The staff has received a lot of
comments on this, most people feel that this is to stringent and
that we really need to do something about it. What staff would
like to do is to use the survey the people already have, no matter
how old, unless it has been replated/subdivided, this would do away
with having to have a recent certified site plan/survey. This
would apply strictly to residential and not commercial. Staff
would like for the Commission to go with the second option listed
in the Zoning Ordinance Review text; page 3. On inground swimming
pools, a certified site plan will be required in all cases, no
matter the value.
Option ~~2 (A) - going from $2500.00 to $8000.00 or more
(B) - slab foundation containing or more sq. ft.
of floor area. Tabled at present time.
(C) - any building containing 1,000 or more sq. ft. of
floor area.
Commission agreed to changes as made.

Item No. 6 - Section 4-201(2) - Continuance of non-conforming
structures
Mark explained that clarification was needed in this section. For
purposes of clarification the following sections should be
referenced in sub-section 4-201(2):
Section ~4-201(6) - e a'rs and Alterations
Section 11-602(2) - Shpecial Exceptions to be Re iewed/Findi ~
of Facts.
This change is for the purpose of reference only. The Commission
had no problem with this and it was okayed.
Item No. 7 - Section 5-600 - Table A - Residential Page 28)
This deals with the residential use table. It would be helpful to
key the following to the S.I.C. manual:
Group Care Facilities - SIC 835 - ok
836 - Discuss (Halfway houses)
Day Care Centers - SIC 835 - ok - ("R-3"- C (C.D.E.))
Recreational Building
Community Centers - SIC 832 - ok
Religious Institutions- SIC 8661 - ok - add condition "B"
Public or Private
Educational Institutions - SIC 8211 - ok
Convalescent Homes,
Sanitariums, Nursing Homes - SIC 805 - ok
As to the zoning of colleges, Jr. colleges, universities:
Colleges - SIC 8221 - "R-2" - C (A.B.E.)- ok
"R-3" - P
Universities - SIC 8221 - GC - ok
Jr. College - SIC 8222 - "R-2" - C (A.B.E.)
