PUBLIC HEARING AND REGULAR MEETING
DECEMBER 10~ 1987
Chairman Doug Latimer called the meeting to order at 7:03 P.M.
Members Present: Jack Gresham, Charles Boyle, Lola Phillips, Janet
Graves, Inge ;Browder

City Staff Present: Joel Albrecht, Director of Comm. Development; Mark
Lewis, City Inspector; Ervin Griffith, Building Official/Zoning
Administrator; John Armstrong, Asst. City Attorney; Nina Dye,
Inspection Secretary; John Joerns, Asst. City Manager; Janie Luna,
Asst. to the City Manager

First item on the agenda was approving the minutes from the November 5,
1987 Public Hearing. There was a motion by Charles Boyle and a second
by Jack Gresham to approve the minutes as read. The vote was unanimous
and the motion carried.
Next item was to call to order the public hearing to consider a Special
Conditional Use Permit Application for St. Mary's Catholic Church for
the construction of a Pavilion and parking facilities at 816 Park
Street.
Tippy Boudreaux, Representative for St. Mary's Catholic Church spoke in
favor of this request for construction.
Ed Wolf, Property Owner - he has property abutting St. Mary's proposed
area for construction. His only concern is the drainage or runoff
causing flooding for the area homes.
Carlos Smith, Church Member - As a member of the church, he is in favor
of this new construction and as an Engineer, the drainage is adequate
for this site.

Staff is recommending that this application for St. Mary's Catholic
Church be granted and include a special condition that the parking be
screened from the adjoining residences.
Doug Latimer called for discussion regarding this permit. John Joerns
pointed out that the drainage system should be delt with by the City
and County, not the Church. The City and Church needs to preserve a
working relationship should there be any future problems with the
drainage.
There was a motion by Charles Boyle and a second by Jack Gresham to
grant St. Mary's Church the Special Conditional Use Permit for the
construction of the pavilion with there being two provisions. First,
the drainage system problem should be resolved and second, there should
be adequate screening for the parking area. The vote was unanimous.
Public Hearing closed.
Staff recommended Block 93 be reclassified from R-1 Low Density
Residential to General Commercial.
• There was a motion by Inge Browder and a second by Janet Graves to
grant this reclassification from R-1 to GC in Block 93. There being no
opposition, the motion carried.
Staff recommended reclassifying the 2.984 acre and the 1.239 acre tract
out of the 198.898 acres of land in the W.M. Jones Survey to
Neighborhood Commercial.
There was a motion by Jack Gresham and a second by Inge Browder to
grant this reclassification to Neighborhood Commercial. There being no
opposition, the motion carried.
Doug Latimer opened the floor to the Commission for any discussion on
any property to be considered under the six month review. There was
none.

Mark Williams, Owner of Sylvan Drugs: More research necessary on the
portables signs, HL&P requirements and freestanding and roof signs.
His personal concerns-ordinance will decrease new businesses coming
into the La Porte area; the sign above the roof at his store is
considered a non-conforming sign and would cost him an excessive amount
of money to replace it from storm damage according to the proposed sign
ordinance; each merchant should be able to have at least one on site
sign.
Joe Camp Jr., Joe Camp Ford: Portable signs are very successful for
his business due to interest rates and rebates changing almost daily.
Without this type of advertisement, revenues for his dealership would
drop drastically. He is no longer advertising on billboards mainly
because of the cost involved to maintain them but feels they are
necessary. He has a roof top sign on the rent car building
approximately 40 to 45 feet off the road and has been very effective.
For the month of November, a survey was taken by Joe Camp Ford and
results are as follows:

3~ of business based on phone
After taking this survey, he relates the signage to his location which
is the reason for such a high percentage. He further states that when
Ford Motor Company comes to do an on site survey, Joe Camp Ford is
required to have certain signs of certain size on their premises in
order to maintain their franchise. More research necessary.
Janet Warhlich~ Gray n rpr~ses: Addressed over regulation on signs.
Only necessary to deal with certain sign areas that need more
regulation and not all of them. Specifically, General Homes need signs
to inform people where to buy their houses. At this time General Homes
are permitted to advertise with a Temporary Sign Permit for a limited
amount of time that the Development is selling houses. She objects to
the removal of temporary .signs and feels they should be able to keep
their signs until all of the homes are sold by changing the 90~ to 100
subdivision built out. She feels that signs which are damaged by
weather conditions should not have to be replace with different signage
and should be Belt with on a case by case basis. She is in agreement
with removing portable signs off of vacant properties.

and opposes portable signs because they are mostly located in the wrong
• areas and are not well maintained.

L.~nda Westergren. Chamber President: Requesting more research on sign
ordinance. Her opinion on portable signs on vacant lots and
thoroughfares should be seriously reviewed.
Paul Felmer ~ President, Fairmont Park Homeowner Assoc: With additional
time and work, an ordinance can be agreed upon for both the City and
the Business Community.
Rob Schmerler, Patrick Media Groun: Concerned about the issue on total
prohibition of billboards. These signs should be able to remain in the
commercial areas in which they belong. With proper regulations, these
billboards can be a great asset for the area. This prohibition of
billboards invades freedom of speech. Specific towns that have
adequate regulations ,for the billboards are the City of Pasadena and
the City of Baytown. Yet in Baytown, the permit fee is very steep. Use
incentives such as tax abatements to get businesses to cooperate with
the proposed sign ordinance.
Charlie Young, Interested Citizen: He feels that if the merchants
would treat their customers like they want their business, this would
increase their sales. Portable signs are not the reason for poor
business.
