NOTICE OF MEETING
In accordance with Ordinance 1501, the City of La Porte Zoning
Ordinance, notice is hereby given that the La Porte Planning and
Zoning Commission will conduct a public hearing at 7:00 P.M. on the
17th day of March, 1988, in the Council Chambers of the City Hall,
604 West Fairmont Parkway, La Porte, Texas. The purpose of the
Public Hearing is to consider the request of the Bayshore Aerie
~~2753 of the Fraternal Order of Eagles for a Special Conditional
Use Permit to allow for construction of a parking lot to be located
on Lots 25-32, Block 149, La Porte.
A regular meeting will be held following the public hearing
for the purpose of acting upon the public hearing item and conduct
other matters pertaining to the Planning and Zoning Commission.
Citizens wishing to address the Commission pro or con during
the Public Hearing will be required to sign in before the meeting
is convened.

Chairman Doug Latimer called the meeting to order at 7:02 P.M.
Members Present: Commissioners Jack Gresham, Janet Graves, Inge
Browder, Bobby Blackwell, Charles Boyle and Lola Phillips
Members Absent: None
City_ Staff Present.: Joel H. Albrecht, Director of Community
Development; Ervin J. Griffith, Building Official/Zoning
Administrator; Nina Dye, Inspection Secretary; John Armstrong,
Assistant City Attorney
Others Present,: Dick McDuff, Representative for Eagles, Charlie
Young and two (2) other interested citizens
• Public Hearing was called to order at 7:05 P.M.
City Council has asked the Planning & Zoning Commission to do some more
research regarding this request by the Order of the Eagles and try to
find some way to grant this Special Conditional Use Permit. John
Armstrong looked closely into the State law and found out we do not
have an actual C listing use in certain instances for Special
Conditional Use Permit procedures. Therefore, the Commission has the
authority for the Special Conditional Use Permit to be granted and sent
on to City Council. The zoning classification would remain as R-1 with
the Special Conditional Use Permit for the parking lot onl According
to the language of the ordinance, there two (2) instances when a
Special Conditional Use Permit will be necessary. The first being when
the application has a use that is listed in the SIC Manual but does not
appear in our ordinance and the second one being the Special
Conditional Use Permit (Section 10-201) may be granted by Planning &
Zoning and City Council.
Second item on the agenda was to consider a Special Conditional Use
Permit Request by the Bayshore Aerie ~~2753 of the Fraternal Order of
the Eagles to build a parking lot on Lots 25-32 of Block 149; La Porte
Tract.
Dick McDuff, Representative for the Eagles spoke in favor of this
request. He explained that the current parking lot has 80 to 85 spaces
available. The building itself holds at least 500 people. The new
parking lot will give them approximately 50 more spaces. McKey
Construction will be the contractor for the parking lot.

There was some discussion regarding the 7th Street entrance which was
shown on the site plan. Mr. McDuff reassured the Commission that that
entrance has been changed and the only entrances to the parking lot
will only be on $th Street.
Public Hearing was closed at 7:15 P.M.
There was a motion by Jack Gresham and a second by Janet Graves to
approve the minutes from the Regular Meeting of February 11, 1988. The
vote was unanimous and the minutes were approved as read.
Next item was to consider recommendation to be presented to City
Council regarding the Special Conditional Use Permit for Lots 25-32 of
Block 149; La Porte Tract.
Staff's report indicates there were 18 notices sent to the surrounding
properties owners within 200 feet, as is required. There were three
(3) replies, all in opposition. Two (2) of them were concerned with
dust control and one (1) requesting his own property be rezoned.
The Eagles request meets all prerequisite conditions necessary for the
issuance of this Special Conditional Use Permit with the following
conditions:
1) Parking surface, including existing on site parking, must be
surfaced to control dust as per Section 10-605(7). Surfacing
must be approved by the Director of Community Development.
2) Parking surface must be setback 25 feet from the front property
and 10 feet from the exterior side property line as per Section
10-607(5).
3) The 7th Street and "G" Street face of the lot must be screened from
public view as per Section 10-605(11.). The screening plan must be
approved by the Director of Community Development.
4) Any surfacing of the alley of Block 149 must be approved in advance
by the Director of Public Works.
5) The final suggested condition is that no parking lot entrances be
allowed onto 7th Street.
6) The alley will not be used for primary access to the parking lot.
7) A Release to be prepared by the Fraternal Order of the Eagles
stating that the City of La Porte will not be held responsible
for any repairs to the paved surface of the alley should the City
need to repair any utilities located therein. The Fraternal Order
of the Eagles will also hold the City harmless of any injuries
occurring on said alley. This letter must be acceptable to the
City of La Porte Attorney's Office.

Lola Phillips read a letter received from Jim Brady, as area resident.
His primary concern is the current problem of dust control with the
existing parking lot they have now. He has no objection with the
construction of the new parking lot as long as the entire parking area
is paved to eliminate this dust control problem.
The seventh (7th) condition was added at the request of John Armstrong
to release the City of all responsibility to that alley as stated in
the condition above.
Following discussion, there was a motion by Jack Gresham and a second
by Charles Boyle to grant the Special Conditional Use Permit to the
Bayshore Aerie ~~2753 of the Fraternal Order of the Eagles to build a
parking lot on Lots 25-32 of Block 1~+9; La Porte Tract with the seven
(7) special conditions recommended by Staff. The vote was unanimous
and the motion carried.
The Commission has formed a committee consisting of Janet Graves, Inge
• Browder and Charles Boyle. City Staff will be contacting the Downtown
Merchants to organize a meeting with this committee and Staff to
discuss the restoration and zoning of the downtown area.
The Commission is requesting they meet more than one time per month.
This would give them a chance to discuss upcoming events. As it is,
they only meet when Staff has called a meeting to handle certain items
which requires their recommendation.
There was a motion by Jack Gresham and a second by Charles Boyle to
adjourn.

Background:
The Bayshore Aerie #2753 of the Fraternal Order of the Eagles is
requesting a Special Conditional Use Permit to allow development of a
58 space park ing lot to be located on Lots 25-32 of Block 149; La
Porte. (exhibit A). The purpose of this parking lot is to provide
accessory off site parking for their 8th Street meeting hall. This
permit is being requested under the guidelines of Section 10-200 of
Ordinance No. 1501.
A special conditional use permit may be granted by the City Council
for the construction of a building and/or the establishment of a use as
described in this or any other section, upon a tract of land in single
ownership or under unified control. (Section 10-201[1])
Analysis:
The parking lot, as proposed, is to be built using a single course
asphaltic sealer over a calcium sulfate base. This will satisfy,
subject to the approval of the Director of Community Development, the
requirements of Section 10-605[7] for dust free parking surface. Lot
setbacks are to be 25 feet on the front (7th Street) face of the
property and 10 feet on the exterior ("G" Street) face. Setbacks will
be measured from property lines rather than from street surfaces.
These proposed setbacks meet the requirements of Section 10-607(5). As
is also indicated on Exhibit "A", a landscape screen has been proposed
for the 7th Street and "G" Street faces of the property. This
landscape plan, subject to final approval by the Director of Community
Development, will satisfy the requirements of Section 10-605 (11).
Finally, surfacing has been proposed for the alley separating the
parking lot from the existing meeting hall. Any type of alley
surfacing will require the written approval of the Director of Public
Work s.

The conditions listed above reflect requirement of City Ordinance.
A final suggested condition is a prohibition of parking lot egress on
the 7th Street face of the property. This recommendation is not based
on ordinance requirements but rather on the number of residences
located in this block of 7th Street. The Eagles are not proposing a
7th Street entrance at this time.
