PUBLIC HEARING AND REGULAR MEETING
MAY 19, 19$8
Chairman Doug Latimer called the meeting to order at 7:00 P.M.
Members Present: Commissioners Charles Boyle, Inge Browder, Janet
Graves, and Lola Phillips
Members Absent: Bobby Blackwell and Jack Gresham
City Staff Present: Joel H. Albrecht, Director of Community
Development; Ervin J. Griffith, Building Official/Zoning
Administrator; Nina Bergeron, Community Development Secretary; Bob
Speake, City Engineer; John Armstrong, Assistant City Attorney;
and John Joerns, Assistant City Manager
Others Present: Ronald Flood and Russell Wilson, incoming
Commander and Member of V.F.W. Post ~~8251
First item on the agenda was to consider approving the minutes of the
April 21, 1988 Regular Meeting. Inge Browder made an amendment to the
minutes changing the word "and" to "as" on the first page, third
paragraph, last sentence. There was a motion by Charles Boyle and a
second by Inge Browder to approve the minutes with the amendment. The
vote was unanimous and the motion carried.
Public Hearing was called to order.
Second item on the agenda was to consider a Special Conditional Use
Permit Request by the V.F.W. Post No.8251 to allow a fraternal
organization to be located within a R-3, High Density Residential Zone
on Lots 16-19; Block 305; La Porte.
Ronald Flood, incoming Commander of Local V.F.W. Post 48251, came
forward and described to the Commission what the V.F.W. would like to
do. He explained that they would like to tear down the one building
that is in very bad repair and then bring the other building up to
code using the restaurant area for meetings and the bottom floor of
the adjacent building for storage.
Mr. Flood was asked if he was familiar with the requirements for
parking and landscaping. He replied that he was aware of the
requirements and would comply with these as soon as possible.

Ervin Griffith gave Staff's report stating that prerequisites have
been met and that the Zoning Ordinance allows organizations of this
type to locate within a R-3 zone subject to the granting of a Special
Conditional Use Permit.
The other factors to consider were:
1. Parking.
2. Demolition and Repair
3. Landscaping
In conclusion, Staff recommends approval of a Special Conditional Use
Permit subject to the above listed conditions.
After more discussion on these requirements, Public hearing was
closed.
Next item was to consider recommendation to City Council regarding the
Special Conditional Use Permit for Lots 16-19; Block 305; La Porte.
There was a motion by Inge Browder and a second by Janet Graves to
• grant the Special Conditional Use to the V.F.W. Post X68251 with the
recommendation that work be started within one (1) year and completed
in two (2) years on all aspects. The vote was unanimous and the
motion carried.
Doug Latimer read into the minutes a letter from Chem-Coast,
Incorporated who was on the original agenda. The letter dated May 17,
1988 read as follows:
Dear Sirs:
We would appreciate it, if you would postpone the hearing,
per our request, for a zoning change until further notice.

Next on the agenda was to discuss the Development Ordinance. Joel
Albrecht presented the history of the ordinance. He stated that Staff
feels the revisions would be another significant step to furnish
quality services to the community. The document to be reviewed
contained three parts as follows:

Mr. Albrecht went on to say that basically, the document was being
updated and eliminating some of the wordiness. No major changes are
planned.
After more discussion, the next meeting was scheduled for June 23,
1988 to continue discussing the reviewed changes to the Development
Ordinance.
Joel Albrecht handed out Requests for Proposals (RFP's) for an
Economic Development Plan. Staff is asking for proposals from various
individuals who work in this area. Planning and Zoning Commission
will be working with the individuals selected to prepare plans. Staff
has requested the RFP's to be returned by June 15, 1988 so City
Council can take action.
There was a motion by Charles Boyle and a second by Lola Phillips to
adjourn. The vote was unanimous and the meeting was adjourned at 8:25
P.M.

Background:
The Veterans of Foreign viars (V.F.W.) is classed by the City's
Zoning Ordinance (1501) as a Civic, Social or Fraternal Organization
with an S. 1. C. use number of 8641. The Zon ing Ord inance allows
organizations of this type to locate within R-3 zones, subject to the
granting of a Special Conditional Use Permit.
The V. F . W . is propos ing to locate the ir new post home in an
existing commercial building located at 1039 San Jacinto Street. This
building which is situated at the corner of San Jacinto and Park
Streets (see Exhibit B), has in the past been used as a restaurant and
club. As such, the building appears to be suited to an assembly use.
Analysis:
As noted above, the basic zoning prerequisites for granting a
Special Conditional Use Permit of this type have been met. Other
factors applying to the consideration of this request are as follows:
A) Parking: Based on building square footage, this facility will
require twenty (20) parking spaces. Exhibit A
indicates eighteen (18) spaces to be located on the
site. The demolition of the garage apartment will
provide adequate area for additional required parking
~spaces. Of the eighteen shown, twelve (12) are layed
out to meet current ordinance standards. The remaining
six (6) spaces are layed out in existing parking areas
that, while located on site, do not have on site
maneuvering room. Backing out of these spaces does not
involve backing in to street traffic lanes. All parking
areas must be surfaced to control dust and all parking
spaces must be striped in accordance with Section 10-605
of the Zoning Ordinance. Further, parking areas must
be screened from abutting residentially zoned property
in accordance with this same section. Screening
requirements will apply to the portion of the site
abutting the alley and lot 20 (Exhibit B).

B) Buildings: The buildings on this site are quite old and some of
them are somewhat dilapidated. One of these, a garage
apartment is partially demolished.
All buildings to remain on this site should be brought
up to current building codes standards. This will
include structural repair as well as any necessary of
repair of the plumbing and electrical systems.
Further, demolition of the garage apartment and any
other structure to be removed should be completed in a
timely manner.
All repair and demolition must be subject to normal City
permitting and inspection procedures. Finally, all work
noted above must be completed and approved by the City
prior to issuance of a Certificate of Occupancy and
occupation of the facility.
C) Landscaping:' Section 10-508 of the Zoning Ordinance requires 6%
of the open site area to be devoted to landscaping.
Based on an open site area of 12,125 square feet, a
total of 728 square feet of landscape area will be
required. Section 10-600.10 allows required screening
to be applied towards required landscaping.

This request meets all prerequisite requirements necessary for
granting a Special Conditional Use Permit.

2) All buildings to remain on site must be brought up to current code
standards. BUildings to be removed must be completely demolished
prior to occupancy of the facility.
3) A minimum of 728 square feet of landscaped area must be developed.
Recomm~ndation:
Recommend approval of this Special Conditional Use Permit subject

NOTICE OF MEETING
In accordance with Ordinance 1501, the City of La Porte Zoning
Ordinance, notice is hereby given that the La Porte Planning and
Zoning Commission will conduct a public hearing at 7:00 P.M. on the
19th day of May~ 1988, in the Council Chambers of the City Hall,
604 West Fairmont Parkway, La Porte, Texas. The purpose of the
Public Hearing is to consider the request of the Veterans of
Foreign Wars Post #8251 for a Special Conditional Use permit to
establish a Fraternal organization in an R-3 High-Density
Residential Zone at 1039 San Jacinto, Block 305, Lots 16-19, La
Porte Tract.
A regular meeting will be held following the public hearing
for the purpose of acting upon the public hearing item and conduct
other matters pertaining to the Planning and Zoning Commission.
Citizens wishing to address the Commission pro or con during
the Public Hearing will be required to sign in before the meeting
is convened.
