Chairperson Janet Graves called the meeting to order at 7:00 PM
'~.2) A motion was made by Charles Boyle and seconded by Eugene Edmonds
to approve the minutes of the November 17, 1988 meeting as
• submitted. Vote was unanimous.
3) The Public Hearing was called to order to consider the Special
Conditional Use Permit Request No.88-013. This request is for the
Jennie Riley Civic Center, 322 N. 4th Street, La Porte, Texas.
Joel Albrecht began the discussion by informing the Commission
-.that the Zoning Ordinance does require civic centers to receive a
Special Conditional Use Permit. The existing center which is
loca't.ed on 4th Street is considered a legal non-conforming use
because it existed prior to the adoption of the Zoning Ordinance
No. 1501. The expansion process requires coming before the
Commission to get a Special Conditional Use Permit approved and a
recommendation to pass on to the City Council.
The proposed facility meets or exceeds each of the setback
requirements, the building height requirement and the landscaping.
Section 10-609 of the ordinance regulates parking facilities and
the current parking lot contains thirty two (32) spaces, this is a
total of .one space in excess of the required minimum.
This request meets all pre-requisite requirements necessary for
the granting of a Special Conditional Use Permit. The
recommendation from Staff is to approve the Special Conditional
Use Permit No. 88-013. Motion was made by Eugene Edmonds and
seconded by Charles Boyle to approve the Special Conditional Use
Permit No. 88-013. Vote was unanimous.

6) Discussion of the Sign Regulation and develop an outline of issues
which should be addressed by a permanent sign ordinance.
A proposed time line was presented to the Commission for their
approval and discussion. (See attached). Staff does recognize
that other issues relating to signs may arise during the process,
they therefore ask the Commission to consider this outline as a
starting point for discussion. Issues, which in staffs opinion,
should be addressed by a comprehensive set of sign regulations
are: off-premise signs, sign area height, limitations on number of
signs allowed in a given location, regulation of portable
signs, public service and community information signs,
regulation of type of signage and survey requirements.
Mr. Albrecht informed the Commission that staff is ready to assist
them in any way possible during the course of this project.
7) A motion was made by Charles Boyle and seconded by Eugene Edmonds
to adjourn. The meeting adjourned at 8: 10 PM.

ZONING: R-1, Low Density Residential

BACKGROUND:
The Jennie Riley Civic Center is an existing community center
(S.l.C. #8322) which is located in a R-1 zoning district. The
City is proposing to construct a new building which is to be
located immediately behind the existing center. The new building
will front on West Tyler Street (See Exhibit B).
Section 5-600, Table A of Ordinance 1501 lists community centers
located within R-1 zones as conditional uses. The original civic
center predates the requirements of Ordinance 1501. However, the
expansion of these facilities will require a Special Conditional
Use Permit.
ANALYSIS:
Zoning Ordinance Section S-700, Table B, specifies building
setbacks for community centers as 30 ft. front; 20 ft., rear; 10
ft. side. As indicated on Exhibit B, the proposed facility meets
or exceeds each of these setback requirements.
This same table also specifies a maximum building height of 45
ft. and a 6% landscape requirement. The proposed height of the
new building in 18 ft. A landscape plan (which will require
approval by the Director of Community Development) will be filed
in conjunction with either the Certified Site Plan or building
plans.

Section 10-609 of the ord inance regulates park ing fac i li ties.
Community centers are required to have a minimum of ten parking
spaces plus one additional space for each 200 sq. ft. of floor
area in excess of 2000 sq. ft. The proposed facility will
require thirteen spaces. These are in addition to the eighteen
spaces required for the existing civic center.
The Jennie Riley Center is presently served by a parking lot
containing thirty two spaces. This is a total of one space in
excess of the required minimum.
Section 5-800 sets forth additional conditions which must be met
before a Special Conditional Use Permit may be granted. They are
as follows:

caused any traffic problems in the surrounding
neighborhood. In Staff's opinion, this condition has
been met and further controls are not required for

wholly owned by the City of La Porte. The entire block
is devoted to community and recreational facilities
There is in addition to the Jennie Riley Center, a large
basketball pavilion and a baseball field. In Staff's
opinion, the proposed building is compatible with the
existing facilities and will serve to compliment the
surrounding neighborhood.

SUBJECT: Comprehensive Size Regulations
The attached packet includes the following information.
1. Time line index and exhibits covering the development of
La Porte's sign regulations dating from October 1987 to
the present.
2. Adoption and Development Time Line
3. Outline of issues to be addr'essed during the development
of a comprehensive series of sign regulations.
Presently, the City's sign regulations are contained in Section
10-1000 of the Zoning Ordinance. In staff's opinion, the present
regulations and the format in which they are presented should not
be discarded. Present regulations are fair, reasonable and
provide an excellent "skeleton" from which a comprehensive set of
regulations can be fully developed. These regulations are
included in this packet as Exhibits 'C' Cdefinitions) and
'D'CSection 10-1000 of Zoning Ordinance).
The attached outline of sign issues to be addressed contains a
list of issues which, in staff's opinion should be addressed by
the comprehensive regulations. Staff does recognize that other
issues relating to signs may arise during the development
process. We would therefore ask the Commission to consider this
outline as a starting point for discussion. As always, staff is
ready to assist the Commission in any way possible during the
course of this project.

overrule a Planning and Zoning Commission ruling.

The regulations should limit the number of signs which are
permitted. Opposes deposits required for political signs and
the assessment of permitting fees. Further opposes the 3/4
vote necessary to overrule a Planning and Zoning Commission
ruling.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council of the City of La Porte hereby
finds, determines and declares that heretofore, to-wit, on the 19th
day of November, 1987, at 7:00 P.M., a public hearing was held
before the Planning and Zoning Commission of the City of La Porte,
Texas, pursuant to due notice, to consider the question of the
possible amendment of the Zoning Ordinance as herein described.
There is attached to this Ordinance as Exhibit "A", and incorporated
by reference herein and made a part hereof for all purposes, the
Publisher's Affidavit of Publication of Notice of said hearing.
Section 2. Subsequent to such public hearing, the City of La
Porte Planning and Zoning Commission met in special session on
February 11, 1988, at 7:00 P.M., to consider the ordinance
amendments which were the subject of such public hearing. The City
Council of the City of La Porte is in receipt of the written
recommendations of the City of La Porte Planning and Zoning
Commission, by letter dated February 19, 1988, the original of which
letter is attached hereto as Exhibit "B", incorporated by reference
herein, and made a part hereof for all purposes.
Section 3. The City Council of the City of La Porte hereby
finds, determines and declares that on the 14th day of March, 1988,
a public hearing was held before the City Council of the City of La
Porte, Texas, pursuant to due notice, to consider the recommendation
of the City of La Porte Planning and Zoning Commission. There is
attached to this ordinance as Exhibit "C", and incorporated by

reference herein and made a part hereof for all purposes, the
Publisher's Affidavit of Publication of Notice of said public
hearing before the City Council of the City of La Porte.
Section 4. The City Council hereby finds, declares, and
determines that all prerequisites of law have been satisfied, and
hereby determines and declares that the amendments to City of La
Porte Ordinance No. 1501, the Zoning Ordinance of the City of La
Porte, are desirable and in furtherance of the goals and objectives
stated in the City of La Porte's comprehensive plan.
Section 5. Article 3, of the Zoning Ordinance of the City of
La Porte is hereby amended, adding the definitions contained on
Exhibit "D" in proper alphabetical sequence to said Article 3, and
incorporated by reference herein and made a part hereof for all
purposes
Section 6. Article 5, Section 5-600, Table A Residential;
Article 5, Section 5-700, Table B ResidentIal; Article 6, Section 6-
400, Table A Commercial; Article 6, Section 6-500, Table B
Commercial; Article 7, Section 5-700, Table A Industrial; and
Article 7, Section 7-600, Table B Industrial are hereby amended to
reflect the addition of sign regulations as set forth in sequence in
Exhibit "E", attached hereto and fully incorporated by reference
herein.
Section 7. A new section is hereby added to the Zoning
Ordinance of the City of La Porte, being Article 10, Section 10-
1000, Interim Sign Regulations. The entirety of Exhibit "E",
attached hereto and incorporated by reference herein, is hereby
included in the Zoning Ordinance of the City of La Porte as interim
sign regulations.
Section 8. Any person, as defined in Section 1.02(27), Texas
Penal Code, who shall violate any provision of this ordinance, shall
be deemed guilty of a misdemeanor and upon conviction shall be
punished by a fine not to exceed One Thousand Dollars ($1,000.00).
Each day any violation of this ordinance shall continue shall
constitute a separate violation.

Section 9. If any section, sentence, phrase, clause, or any
part of any section, sentence, phrase, or clause, of this Ordinance
shall, for any reason, be held invalid, such invalidity shall not
affect the remaining portions of this Ordinance, and it is hereby
declared to be the intention of this City Council to have passed
each section, sentence, phrase, or clause, or part thereof,
irrespective of the fact that any other section, sentence, phrase,
or clause, or part thereof, may be declared invalid.
Section 10 Resolution 88-3 is repealed as of the effective
date hereof.
Section 11. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
Civil Statutes Annotated; and that this meeting has been open to the
public as required.
Section 12. This Ordinance shall become effective fourteen
(14) days after its passage and approval. The City Secretary shall
give notice of the passage of the ordinance by causing the caption
to be published in the official newspaper in the City of La Porte at
least twice within ten (10) days after the passage of the ordinance.

ARTICLE THREE: DEFINITIONS
Freestanding Sign or Ground Sign: Any sign supported by one (1) or more
columns, poles, uprights, or braces anchored in or on the ground and not
attached to any building.
Identification Sign: Any sign which carries only the firm, business or
corporate name, the major enterprise on the premises, or the principal
products offered for sale on the premises.
Off Premise Sign: Any sign which directs attention to any business,
commodity, service or entertainment offered elsewhere than on the
premises where such sign appears.
On Premise Sign: Any sign which directs attention to a business,
commod i ty, serv ic e or enterta inment offered on the same premise s where
such sign appears.
Setback, Sign Measurement: The closest point to any property line which
may be occupied by any sign, as defined by this Ordinance. This point
shall be determined by measuring perpendicularly from adjacent property
lines.
Sight Trian~le: Triangular shaped area of clear visibility located at
all intersections including private driveways. The area of the triangle
shall be determined by engineering standards.
Sign: Any word, number, figure, device, design
anything is made known, as used to designate
profession, business, or a commodity and which
public street. Refer to S.B.C.C.I. for additional
purpose of this ordinance, a sign is a structure.

Controlled Access Highwav Corridor: A corridor extending five hundred
feet (500') to either side of the right-of-way (R.O.W.) of a controlled
access highway as designated on the City of La Porte's Land Use Map.
NOTES:
The definition of Controlled Access Highway (with some
minor rephrasing) was taken from Volume One, Section 1.3
of the City's Comprehensive Plan.
Controlled Access Highway Corridors are established on the
City's Land Use Map and designated by a cross hatched
high-light. State Highway 225 and New State Highway 146
are the only thoroughfares within the City presently
designated as Controlled Access Highways.
Interim Sign Regulations: Signs located within a
Controlled Access Highway Corridors shall be limited to a
maximum height of sixty-five feet (65').

which exceed 8 ft. in height and have a
sign face area in excess of twenty square
feet must be engineered. In staff's
