Don Skelton, approximately 20 concerned citizens 1 ) CALL TO 0 RDE R Chairperson Janet Graves called the meeting to order at 7:00 PM. ~) APPROVAL OF MINUTES OF THE APRIL 6, 1989 MEETING A motion was made by Charles Boyle and seconded by Eugene Edmonds to approve the minutes of the April 6, 1989 meeting as submitted. The vote was unanimous. 3) DISCUSSION OF COMPREHENSIVE PLAN ISSUES REGARDING ANNEXED BAYMUD Mrs. Graves told the audience that she appreciated their attendence and interest, but she wanted to clarify that this meeting was a study session and no decisions would be made or any action taken tonight. Tf anyone would like to speak they would be permitted to. Ms. Jan Stevenson, 232 Desire Dr., spoke to the Commission. Mrs. Stevenson stated before the annexation took place on January 1, 1989, La Porte City Officials made certain statements to various people about things that would happen in the BayMUD area. She said that she was assured by these City Officials that in the operation of her small mobile home park, that she caould be permitted to operate as a "non-conforming" status in an "R-1" zoning area. Mrs. Stevenson said she had a Harris County permit, and BayMUD was aware of this, because she had to produce the Harris County permit to BayP9UD before she paid them the total sum of $12,960.00 to get her water and sewer connected to her property. • PLANNING/ZONING MINUTES r9EETItdG OF 4-13-89 :AGE 2 OF 6 C~ • Mrs. Graves told Mrs. Stevenson that the mobile home issue had been turned over to the City attorney and he is taorking on the legal opinion and there is not a great deal that the Commission could discuss or decide tonight. Mrs. Stevenson stated she just wanted to make the Commission aware of the situation. Mrs. Graves turned the meeting over to Mr. Albrecht at this point to give staff's recommendations. r1r. Albrecht stated a Public Hearing had been called for• and scheduled for April 27, 1989, notices have been sent to all property owners in the former BayMUD area, as well as people located within 200 feet of the annexed area. (Required by law). Mr. Albrecht summarized the overall proposal by staff on the land use map bringing the Commission up to date from the last meeting. At this time Mr. Albrecht read into the minutes for the record letters received from Elizabeth Morris and Irene Hardy. (See attached). LAND USE MAP AREA I - Mr. Albrecht opened the discussion with the proposed Land Lase Maps as submitted by staff beginning with Area I. He thought • the Commission might want to consider Business Industrial (BI) rather than the Light Industrial (LI). A good reason for this is because of the highway frontage along the area. Mrs. Graves asked if this could be made a PUD with BI and LI overlayed. Mr. Albrecht said this could be done. Mr. Blackwell stated that he was concerned about PUD's and the fact that this was one of the entrance ways to the City and it should look nice. Mr. Blackwell also stated he would like to see the property along the street coincide with what we have on our map. Mrs. Graves called for a vote for Area I with boundaries as follows: south of McCabe Road, west of Hwy 146 down to Shoreacres north city limits as PUD which will include LI and BI. All were in favor. Tract across Hwy 146 - staff suggested that a portion outside the flood zone be retained in the commercial classification. The remaining portion of this tract was suggested for PUD with low-density and a commercial node. Mrs. Graves called for a vote for the following area with boundaries as follows: a tract bounded by the west branch of Taylor Bayou on the east, the north city limits of Shoreacres on the south, Hwy. 146 on the west and McCabe Rd. on the north as PUD T~~ith the majority being low-density residential use with a • commercial node at the southeast corner of McCabe Rd. and Hwy. 146. Y On the north side of McCabe Road, the proposed land use is mid-density and we suggest an extension of a similiar land use for the south side of McCabe Rd. This will complete the rest of Area I. Mrs. Graves called for a vote for the remaining land in Area I with boundaries as follows: bounded by McCabe Road on the north, the west branch of Taylor Bayou on the west, the north boundary of the Shady River Subdivision on the south, and Old Hwy. 146 on the east. All were in favor. AREA II - Shady River Subdivision - retain the low-density development with a commercial node fronting old Hwy. 146. Vote was called for the land in Area II with boundaries as follows: south of the extension of Bayside Dr., Taylor Bayou on the west, going around the Shady River Subdivision, bacl, to Old Hwy. 146 on the east (Commercial node), to the north continue the "B" designation. All were in favor. AREA III - Pine Bluff - Staff's suggestion was for mid/high-density. Staff was asked if this land use would cause some developing later on and Mr. Albrecht felt sure that re-development would take place in the future. Vote was called for on the area with boundaries as follows: old La Porte city limits on the north, Galveston bay on the east, and Old Hwy. 146 on the west, and going down and including the existing apartments one block north of Desire Dr., then north of there and including the apartments on Falk Court. All were in favor. The remaining portion of Area III, staff is recommending low density with a commercial node at the south west corner. Boundaries are as follows: Pine Bluff Subdivision on the north, Galveston bay on the east, Shoreacres city limits on the south and Old Hwy. 146 on the west. All were in favor. AREA IV - Located on the south side of Shoreacres - Staff has recommended low-density with a bubble of mid-density in the center on both sides of Sunrise Dr. Vote was called for on the area with boundaries as follows: Old Hwy. 146 on the west, City of Shoreacres on the north, Galveston bay on the east and Harris County Navigation District on the south. The area of mid-density will be designated as a PUD as voted on by the Commission. All were in favor. BREAK: 8:20 - 8:35 PM Meeting was called back to order by Mrs. Graves at 8:35. • Mr. Albrecht stated that before beginning on the proposed zoning lines, he would like to bring the Park Zone hiap into the discussion for the Commission to review. PLANNING/ZONING MEETING MINUTES OF 4-13-89 PAGE 4 OF 6 • Using guidelines set by the Comprehensive Plan, La Porte's Official Park Zone Map establishes a ratio of one (1) acre of public area per 22.3 acres of residential zoned property. (See attached). A4rs. Graves called for a vote on the recommendation of staff that we designate an area along the west side of Taylor Bayou, south of McCabe Road as a potential .park site. All were in favor. PROPOSED ZONIAIG MAP AREA IV - Includes the Shady Oaks, Bay Colony Subdivisions, a townhome project, one commercial multi-tenant office building and a tract of predominately undeveloped/agricultural acreage. Staff recommends "R-1" zoning with the exception of the land bound by Boggy Bayou and the Shady Oaks Subdivision on the west, Harris County Navigation District on the south, a line along the western edge of the Bay Colony Subdivision over to Bay Colony Dr., then west ar.d north around Block 1 of Bay Colony Subdivision for the eastern limits, then west along the Shoreacres city limits line to the north eastern corner of the Shady Oaks Subdivision for the northern boundary westerly to Shady Oaks, this area is proposed to • be PUD. Mrs. Graves called for a vote on the proposed zoning for Area IV. This would include a residential PUD for the area bounded on the west and north around Block 1 of Bay Colony Subdivision for the eastern limits, then west along the Shoreacres city limits line to the north eastern corner of the Shady Oaks Subdivision for the northern boundary westerly to Shady Oalss, this area is proposed to be PUD. The remainder of Area IV would be "R-1". All were in favor. AREA II - Primarily comprised of the Shady River Subdivision. AREA III - Pine Bluff, Bayside Terrace, Bay Oaks Subdivisions. The "R-2" zoning out of these areas would be bounded by Taylor Bayou on the west, an extension of the north boundary of Shady River Subdivision on the north extending approximately 340 feet east of Old Hwy. 146, then in a south easterly direction along the west line of 31ock Ito. 5 in the Bayside Terrace Subdivision to the centerline of Bayside Dr., then west along the centerline of Bayside Dr. a distance of approximately 295 feet, then south a distance of approximately 600 feet, then west to the centerline of Old Hwy. 146, then north along the centerline of Old Hwy. 146 a distance of approximately 700 feet, then west to the centerline of Taylor Bayou. • PLANNING/ZONING MEETING ® • MINUTES OF 4-13-89 PAGE 5 OF 6 n U The proposed N.C. zoning in Area II commences at a point located at the centerline of Old Hwy. 146 approximately 150 feet north of the Shady River Road, then west, north and west approximately 1300 feet around flock No. 2 of the Shady River Subdivision to the centerline of Taylor Bayou, then north easterly along Taylor Bayou to a point which is the southeast corner of Lot No. 9, Block No. 4 of Shady River Subdivision, Section II, then east approximately 550 feet to the centerline of Old Hwy. 146, then south along the centerline to the point of commencement. The remaining portion of Area II is comprised of the Shady River Subdivision, staff proposes a "R-1" zoning classification. The proposed N.C. zoning in Area III is bounded by the centerline of Old Hwy. 146 on the west, the north boundary of Bay Oaks Subdivision on the north, the east line of Lot No. 2 in Block No. 1, and Lot No. 2 and No. 15 in Block No. 2 on the east and the centerline of Bay Oaks Dr. on the south. The remaining portion of Area III is comprised of the Bay Oaks, Bayside Terrace and Pine Bluff Subdivisions. Staff proposes a "R-1" zoning classification. The Chairman called for a vote of the proposed zoning lines recommended by staff for Area II and Area III. All were in favor. AREA I - An approximate 225 acre tract which is primarily undeveloped. Staff has proposed PUD with B.I. and L.I. and a commercial node with the remaining area to be zoned "R-2". The Chairman asked for a vote on the tract with the boundaries being as follows: Bounded by the north right-of-way of McCabe Road on the north, the west branch of Taylor Bayou on the east, the north city limits line of Shoreacres on the south, and the railroad on the west. The "R-2", bounded by the north right-of-way of McCabe Road on the north, the centerline of Old Hwy. 146 on the east, the north boundary of Shady River Subdivision on the south and the west branch of Taylor Bayou on the west. The Chairman called for a vote on the proposed zoning for Area I as described by staff. All were in favor. Mr. Albrecht stated to the Commission and citizens present that maps will be ready for public viewing Monday morning at City Hall. Mrs. Graves called for a motion approving the Land Use, Park Zone • and Zoning Maps to go to Public Hearing as a preliminary report. A motion was made by Inge Browder and seconded by Bobby Blackwell. All were in favor. For some months previous to January 1, 1989 my husband and I, as well as most of our neighbors, loo}red forward with anticipation to being a part of the city which has always been the base for our activities. These past months we have not been disappointed: your services, such as new street signs, trash and garbage pickup, street sweeping, and good surveillance by your police department, dependable ambulance service (we can vouch personally for that experience); and k~zowing our fire protection has increased, have all given us a sense of well being. We thank you. Just recently, however, we discovered to our dismay that new • trailers were being brought into the former BayMUD area. This was after the assurance at public meetings by the La Porte City officials that no NEW trailers would be brought into the area after December 31, 1989. It was also stated that those already here would be "grandfathered," but could not be handed on to new owners or tenants. We understand that one of the goals set out by the City of La Porte recently is to enhance the present environment within its boundaries so as to attract more of the employees of the companies now here or~'planning to work here so that they would not leave the community to purchase their homes. Faced with the option of investing their money in a strictly residential area such as are found closer to Clear Lake, or buying property close to a trailer settlement, one need not guess at their choice! Paragraph six (6) of the BayMUD service plan which was adopted as part of Annexation Ordinance X1626 states: Parka, Plavarounds and S immin~ Pools. These services can be provided by using existing• capital improvements. Additional capital improvements are not necessary at this time to provide such service to the Tract. However, the Tract will be included with other territory in connection with planning for new, revised or expanded parks, playgrounds and swimming pools. While there are presently no public recreation facilities located in BayMUD, there are several private neighborhood parks. For the purpose of this report, these facilities are factored into the ratio formula used to determine required BayMUD park area. As in the rest of the City, BayMUD will be broken into park zones. Each zone should meet the established 1/22.3 ratio. For the • purpose of this report, two (2) tentative zones have been established. They are as follows: 1. North BayMUD which encompasses the area north of the City of Shoreacres 2. south BayMUD which encompasses the area south of the City of Shoreacres The park facility break down for each zone is as follows: North Bay I.~UD Additional Total Acres Residential Acres Existing Park(Private) Required Area 249.4 Acres 226 Acres 4.69 Acres 5.4 Acres South BayMUD Additional Total Acres Residential Acres Existing Park(Private) Required Area 123 Acres 123 Acres 2.82 Acres' 2.7 Acres This yields a total park area deficit of 8.1 acres. The pedestrian trail discussed for the west side of the Shady River Subdivision will alleviate some of this deficit but without more detailed information the amount of property available for trail development cannot be determined. ® o BayMUD Park Facilities • Page -2 As a final note, the residential acreages specified in this report were established by scaling off of a BayMUD map. They are therefore approximations. Also, the amount of undeveloped residential property may vary depending on the zoning line configuration of the final approved zoning map. Discussion will center on material covered in these documents. Should any Commission member have questions or comments regarding BayMUD proposals made to date, please note them on the "clean" BayMUD map included in the April 6 agenda packet, highlight the area of concern and forward the map to my office. Staff will then research the matter and respond to the commission. Staff would again like to thank the Commission for the time and effort they are devDting to this project and as always we stand ready to assist to the best of our abilities.
