PLANNING & ZONING COMMISSION MEETING
APRIL 19, 1990
Members Present: Chairman Janet Graves, Commissioners Inge Browder, Lola
Phillips, Eugene Edmonds, Jack Gresham, Charlie Boyle.
Members Absent: Commissioner Bobby Blackwell.
City Staff: Director of Community Development Joel Albrecht, Building
Official Ervin Griffith, Inspector Mark Lewis, Community
Development Secretary Nina Browning, Assistant City
Attorney John Armstrong.
Others Present: Rev. Lewis of Confrontation Church of God in Christ,
Scott Brinks and Harley Martin with International Cargo
Network, John Black of the Bayshore Sun and approximately
100 citizens.
1) CALL TO ORDER
Meeting was called to order by Janet Graves at 7:04 PM.
2) APPROVE MINUTES OF MARCH 22, 1990 PUBLIC HEARING AND REGULAR MEETING.
A motion was made by Inge Browder and seconded by Lola Phillips to approve
the minutes of the March 22, 1990 meeting as submitted. All were in favor
and the motion passed.
3) CALL PUBLIC HEARING TO ORDER
Public Hearing was called to order at 7:05PM.
CONSIDER SPECIAL CONDITIONAL USE PERMIT REQUEST SCU90-003, SUBMITTED BY
THE CONFRONTATION CHURCH OF 60D IN CHRIST FOR THE PURPOSE OF ALLOIiIN6 THE
CONVERSION OF AN EXISTING BUILDING TO USE AS A SHELTER FOR THE HOMELESS.
THE BUILDING BEING CONSIDERED IS LOCATED ON LOTS 15-26 OF BLK. 41, TONN
OF LA PORTE, MHICH IS FURTHER DESCRIBED AS 130 SOUTH 4TH STREET.
Mr. Albrecht gave the Commission the staff's report concerning the Special
Conditional Use Permit (SCU) requested by the Confrontation Church of God
in Christ. The purpose of the request is to allow the conversion of an
existing bui 1 di ng (1 ocated at 130 South 4th) to be converted into a shel ter
for the homeless.
Staff completed a preliminary review of the floor plan submitted by the
applicants and came to the conclusion that the proposed design and layout
can be made to comply to applicable code requirements. It should be
stressed that staff's review thus far, is only preliminary, a complete
~~ set of construction plans will be necessary for a comprehensive review.

In considering this request, the Special Use Performance Standards of
Section 5-800 are applicable. As a homeless shelter is a type of
residential occupancy, certain residential standards will be applicable.
The Residential Performance Standards are as follows:
A. Required screening - not applicable
B. Traffic Control - not a major factor
C. Compatibility with surrounding area -architectural compatibility
does not appear to be a serious consideration
D. Required licenses obtained - no State/County license required
E. Compatible alterations and adequate parking -does not appear to
pose a problem
F. Manufactured housing criteria - not applicable
G. Density bonus - not applicable
Section 10-202 sets the three (3) following conditions which must be met
before any SCUP may be granted.
(1) That the specific use wi 11 be compatible with and not i n juri ous
to the use and enjoyment of other property, nor significantly
• diminish or impair property values within the immediate
vicinity.
(2) That the conditions placed on such use as specified in each
district have been met by the applicant.
(3) That the applicant has agreed to meet any additional conditions
imposed, based on specific site constraints, and necessary to
protect the public interest and welfare of the community.
The first of these conditions, that a use be "compatible with and not
injurious" to surrounding property is a serious consideration in regards
to this request, and as such should be carefully considered.
This request appears, with the possible exception of compatibility, to
comply with the applicable Special Use Performance Standards of Section
5-800.
The final condition, deals applicant compliance with additional conditions.
Staff has noted conditions which the Commission may wish to attach to this
permit should a favorable recommendation be made.
This request appears to satisfy basic Zoning Ordinance prerequisites and
is therefore eligible to be considered for a Special Conditional Use
Permit.

Rev. Lewis of the Confrontation Church of God in Christ.
Rev. Lewis stated he felt like he had done everything the City has
requested of him and now he was here to answer any questions and
concerns of the Planning & Zoning Commission. Rev. Lewis also wanted
to clarify that he had not begun any work on the building as stated
in the Bayshore Sun without proper permission.
Rev. Lewis stated that as a preacher he felt i t was hi s duty, as wel 1
as church members, to provide a place for the homeless and needy.
He stated that there was not a place/home in the immediate area for
the homeless and felt like this was a good location and was on the
church property.

At this point, Mrs. Graves called for a recess. - 8:00 PM
Reconvened meeting - 8:10 PM
Mrs. Graves called on Rev. Lewis, who had stated that he wished to speak
again to the Commission. Rev. Lewis wanted everyone to understand that
the place he was proposing was not anything like the Jordan Industries that
most of the citizens were referring to in their concerns against the
shelter.
4. CLOSE PUBLIC HEARING

5. CONSIDER APPROVAL OR DENIAL OF SPECIAL CONDITIONAL USE PERMIT SCU90-003.
A motion was made by Inge Browder and seconded by Eugene Edmonds to deny
the Special Conditional Use Permit Request SCU90-003. The vote was 5 in
favor of denial, with Lola Phillips abstaining. Motion carried and the
Special Conditional Use Permit was denied.

Commissioner Charles D. Boyle was excused at this time in the meeting due
to conflict of interest on the next item to be brought to the Commission.
6. REVIEW AND CONSIDER APPROVAL OR DENIAL OF THE INTERNATIONAL CAR60 NETWORK
MAJOR DEVELOPMENT SITE PLANT WHICH HAS BEEN SUBMITTED AS A CONDITIONAL OF
SPECIAL CONDITIONAL USE PERMIT SCU90-002.
Mr. Albrecht stated that on April 9, 1990, the City Council granted the
Special Conditional Use Permit requested by International Cargo Network.
• This permit authorized ICN to develop an industrial PUD. Once an SCU
permit is granted, the next stage of the PUD approval process is "site
plan" review. Under the terms of City Development Ordinance No. 1444,
PUD•s consisting of over 10 acres are considered to be "Major
Developments".
The Planning & Zoning Commission is the approving authority for all Major
Development plans. Following review of the site plant, the Commission
shal 1, wi thi n thirty (30) days of the fi 1 i ng date, take on of the following
actions:
(1) Approve the Major Development site plan as filed;
(2) Conditionally approve the site plan as filed, provided, the reasons
for such conditional approval are stated in writing and a copy of
the statement is signed by the Chairman of the Planning Commission;
(3) Disapprove the site plan as filed, provided, the reasons for such
disapproval are stated in writing and a copy of the statement is
signed by the Planning Commission.
City staff has an established Site Plan Review Committee to review and
approve development site plans. This Committee is made up of
representatives of Public Works, Fire Department, Community Development
and Code Enforcement. This Committee conducted a site plan review on the
ICN project and based on their review the Committee made several
suggestions. All of the suggestions have been incorporated into the site
® plan being considered by the P & Z Commission.

Staff at this time would recommend conditional approval of the Major
Development Plan submitted by ICN subject to the following conditions:
(1) Harris County Flood Control approval of the drainage plans.
(2) Street and alley closing completed as specified by Ordinance 1693
and 1694.
(3) Engineering plans submitted and approved for the relocation of the
waterline located currently in Madison Street.
Mrs. Graves ask if these conditions had been discussed with the developers
and Mr. Albrecht said they had. Mr. Albrecht told Mrs. Graves that
representatives from ICN are at this meeting to answer any questions or
concerns the Commission might have at this point.

Mr. Harley Martin, President of ICN, addressed the Commission at this time.
He stated the one issue of concern for ICN was whether or not the above
ground water tank is required. ICN has addressed that problem and they
have run flow tests in cooperation with the City. With those tests the
flow and pressure at the required rates was more than adequate to meet the
requirements of the fire codes both by the State and the insurance company.
Mr. Martin stated they would like to avoid putting up a tank (eye sore)
if at all possible, but if it was required ICN would comply.

PM.
