MINUTES
PLANNING & ZONING COMMISSION MEETING
JULY 18, 1991

1) CALL TO ORDER
Meeting was called to order by Chairman Inge Browder at 6:05 PM.
2) ADMINISTER OATH OF OFFICE TO RE-APPOINTED PLANNING & ZONING
COMMISSION MEMBERS
City Secretary Cherie Black admistered the Oath of Office to Commissioner Eugene
Edmonds.
3) APPROVE MINUTES OF THE JUNE 27, 1991, REGULAR MEETING
A motion was made by Lola Phillips and seconded by Paul Schaider to approve the
minutes as submitted. All were in favor and the motion passed.
4. CITIZEN INPUT
Gary Groda restated his position being in favor of carports.
Ed Matuszak gave a report detailing his opposition to front yard carports and spoke
briefly in favor of the existing sign regulations currently in the Zoning Ordinance.
David Kaup, representing the Fairmont Park East Homeowner's Association, gave
a report stating opposition to front yard carports (being the general concensus of the
residents in the Homeowner's Association).
After further discussion, Gary Groda stated that he had misunderstood the carport
issue and wanted to retract all of his previous comments.

5) DISCUSS ITEMS RELATING TO THE 1991 REVIEW OF ZONING ORDINANCE

Carports
The Planning & Zoning Commission, during its June 27, 1991 meeting directed staff
to prepare ordinance language permitting residential front and side yard carports
with a setback of five feet (5').
Joel Albrecht in his report to the Commission detailed the requested ordinance
language that staff had prepared.
After discussion, the Commission took a straw vote and were in favor of tabling the
carport issue until the return of Commissioners Doug Martin and Betty Waters.
Section 4-400.1 Zoning of Annexed Property
Under current ordinance requirements, newly annexed property MAY be zoned as
R -1 Residential. Staff suggested a change in ordinance wording to make R -1 Zoning
automatic. Commission agreed to the proposed change.

Main Street
Joel Albrecht gave an overview of the zoning regulations as they apply to the
Mainstreet downtown area.
The following citizens all contributed to the Main Street discussion:
Judy Roelof Primary goal is to uplift the area. Sees the area as a pedestrian,
specialty shopping area.
Pat Muston Encourages zoning to be changed to allow their plan to work.
Would like to see things sped up.
Imogene Pulleine Wants to see the area revitalized and reconditioned such as
other cities who have participated in "Main Street America".
Lisa Honeycutt Noted that La Porte's Centennial is next year and would like
to have something done about the area before the celebration.
After lengthy discussion, Mr. Albrecht stated more work needed to be done defining
the goals for Main Street.

6) ADJOURN
A motion to adjourn was made by Eugene Edmonds and was seconded by Wayne
Anderson.
The next meeting will be August 1, 1991 at 6:00 PM.

CONTINUED DISCUSSION AND ANALYSIS
FOR THE JULY 18, 1991 MEETING
INTRODUCTION
The Planning and Zoning Commission, during its June 27, 1991
meeting directed staff to prepare ordinance language permitting
residential front yard and side yard carports with a setback of.
five feet. The provisions for this are included in this report.
Also to be discussed is the language of Ordinance Section 4-400
which deals with the zoning of newly annexed property and
portable sign regulations. Finally, included, but under separate
cover, is a report dealing with the Main Street area.
I. Carports: Staff, as directed by the Commission has prepared
ordinance language which will permit front and side yard carports
with a setback of five (5) feet from property lines. The first
step in developing regulations is to define the term carport in
order to distinguish it from other types of structures. Staff
would suggest the following definition for inclusion in Section
3-100.

4. Front and side yard carports shall be permitted for single
family detached and single family large lot homes subject to the
following requirements:
a. Carports in a required front or side yard shall not be
locared closer than five (5) feet from any front or
side property line.
b. Carports located on corner lots shall not be located
closer than twenty five (25) feet from an intersection.

The second paragraph of this section deals with detached garages
and carports. The paragraph presently reads:
A detached private garage, or carport, as
defined, may be permitted in side yards,
provided: (1) they comply with all the
requirements of this section; (2) they shall
be five feet (5') or more from side lot
lines; and (3) the side yard does not abut a
street right-of-way.
In order to prevent a conflict with footnote #11, this
paragraph should, be amended to read: A detached private garage,
as defined, may be permitted in side yards... Eliminating the
word carport from this paragraph should eliminate conflict
between ordinance sections.

Section 4-400.1 Zoninq of Annexed Property (pp 22): This
paragraph, in part, states: All territory annexed hereafter to
the City of La Porte may be temporarily classified as R-1, Low
Density Residential, only until permanently zoned by the La Porte
City Council...
The word "may" in this paragraph allows property to be
annexed into the City without any zoning classification. This
can lead to confusion as well as a variety of complications,
legal and otherwise. Substituting the word "shall" will
eliminate this problem and satisfy the Zoning Ordinance's intent
that newly annexed property be held in the most restrictive
zoning classification until permanent zoning is assigned. The
amended paragraph would read: All territory annexed hereafter to
the City of La Porte shall be temporarily classified as R-l Low
Density Residential....
