PLANNING & ZONING COMMISSION MEETING
AUGUST 1, 1991

1) CALL TO ORDER
Meeting was called to order by Chairman Inge Browder at 6:00 PM.
2) APPROVE MINUTES OF JULY 18,1991 REGULAR MEETING
A motion was made by Wayne Anderson and seconded by Doug Martin to approve
the minutes as submitted. All were in favor and the motion passed. Betty Waters
abstained from voting since she was not present for the last meeting.
3) CITIZEN INPUT
Dennis Dunham - Restated his position being in favor of carports for all residents
of La Porte.
City Councilman Deotis Gay - Feels that the carport subject should not be a
-"Fairmont Park" vs. "Old La Porte" issue.
Teresa Lomar - Restates her position being in favor of carports for anyone who
wants to construct one.
R. W. Smith - Felt confused about where the carport issue stands at present. Mr.
Albrecht stated that a straw vote was taken to put the item on the agenda for a
Public Hearing.

Joe Burkhart - Wants to be allowed to install a carport to protect his car.
Roland Rocha - Spoke in favor of carports.
Jimmy Spradling (speaking as a citizen of La Porte, not as Fairmont Park
Homeowner's Association President) - Spoke against carports. Feels that carports
contribute to the devaluation of property.
Ed Matuszak - Believes carports should not be allowed outside the required setbacks.
Opposes sign advertisement.
Gary Groda - (rebuttal) Defends his position being in favor of carports and signs.
City Councilman B. Don Skelton - In favor of carports outside the current required
setbacks. His business is suffering from the sign ordinance. Would like to be able
to advertise his business through portable signs.
Kenny Pierce (Cowboys Restaurant) - Needs to be able to advertise his business with
signs. Feels his business is suffering due to lack of advertisement. Can't afford other
forms of advertisement.
4) DISCUSS ITEMS RELATING TO THE 1991 REVIEW OF ZONING ORDINANCE

Mr. Albrecht supplied the Commission with the requested ordinance language
permitting residential front and side yard carports with a setback of five feet (5').
Betty Waters recommended that the Commission approve the verbiage. Doug
Martin seconded. A straw vote was taken. All were in agreement with the exception
of Eugene Edmonds who was opposed.

Main Street
Citizens present from the Main Street Association were Judy Nieuwenhuis, Imogene
Pulleine, and Pat Muston.
Mr. Albrecht began Main Street discussion by emphasizing the importance of
designating specific goals for this project. City Council has already approved funding
for the renovation and/or construction of curbs, sidewalks, and wheelchair ramps for
the area from Broadway Street, west thru 2nd Street.
Assistant City Attorney John Armstrong suggested the creation of a committee to
review and monitor new businesses so they may conform to imposed criteria (which
shall be set forth).

Everyone in attendance felt it necessary to take a walking tour down the street to
get a better idea of the existing structures, vacant lots, uses of buildings, and possible
zoning boundaries. After discussion, a time for the tour was set for Thursday
afternoon (August 8) at 5:30 PM with everyone meeting at Judy Nieuwenhuis' shop.
5) ADJOURN
A motion to adjourn was made by Wayne Anderson and was seconded by Doug
Martin.
The next meeting will be September 5, 1991 at 6:00 PM.

CONTINUED DISCUSSION AND ANALYSIS FOR
AUGUST 1, 1991 MEETING
INTRODUCTION
The Planning and Zoning Commission, at its June 27, 1991
meeting, decided to take additional citizen input regarding the
City's sign regulations. As the Commission's expressed intent is
solely to take input, no backup material relating to signs is
included in this report. The City's sign regulations are located
on pages 90-92c of the Zoning Ordinance (Section 10-1000).
At its July 18, 1991 meeting, the Commission after receiving
citizen input regarding front yard carports, tabled further
discussion of this issue until the full Commission could be
present. The portion of the staff report (July 18, 1991 agenda
packet) which dealt with carports is also included in this
report.
Also, at the July 18, 1991 meeting, the Commission began
discussion of zoning issues relating to Main Street. This
discussion will continue at the August 1, 1991 meeting. The
emphasis, at this meeting, will be on further defining goals for
the Main Street area and determining types of uses which might be
appropriate for a "Downtown Commercial District." Staff requests
that the Commission bring the "Main street Report" and exhibits
(July 18, 1991 agenda packet) to the August 1, 1991 meeting.
Maps of the Main Street area and excerpts from the Standard
Industrial Classification (S.I.C.) manual will be available at
the meeting. No additional backup material regarding Main Street
is enclosed in this packet.
I. Carports: Staff, as directed by the Commission has prepared
ordinance language which will permit front and side yard carports
with a setback of five (5) feet from property lines. The first
step in developing regulations is to define the term carport in
order to distinguish it from other types of structures. Staff
would suggest the following definition for inclusion in Section
3-100.

Should the Commission recommend approval of the proposed
footnotes, it will also be necessary to amend Section 10-301.1.
The second paragraph of this section deals with detached garages
and carports. The paragraph presently reads:
A detached private garage, or carport, as
defined, may be permitted in side yards,
provided: (1) they comply with all the
requirements of this section; (2) they
shall be five feet (5') or more from side lot
lines; and (3) the side yard does not abut a
street right-of-way.
In order to prevent a conflict with footnote #11, this
paragraph should be amended to read: A detached private garage,
as defined, may be permitted in side yards... Eliminating the
word carport from this paragraph should eliminate conflict
between ordinance sections.
