Members Absent: None City Staff Present: Assistant City Manager John Joerns, Chief Building Official Ervin Griffith, Inspector Mark Lewis, Community Development Secretary Peggy Lee 1) CALL TO ORDER Meeting was called to order by Chairman Inge Browder at 5:43 PM. 2) CONSIDER APPROVAL OF SUBDIVISION PLAT FOR FAIRMONT PARK EAST, SECTION IV A Mark Lewis summarized the history of Fairmont Park East, Section IV. The original Fairmont Park East Subdivision was reviewed by the Planning & Zoning Commission in August 1980 and was reviewed by City Council the following month. In 1983 the Planning & Zoning Commission gave formal acceptance of Sections III and IV. Section III was developed and recorded. Section IV was never recorded. In 1989 the City received revisions to the plat and the construction plans which would break Section IV into three (3) phases, A thru C. Staff reviewed those and found they matched the original specifications that have been set up for Section IV replat. In October 1989 the Commission reviewed Section IV A which was presented as an information item with no Commission action taken. Due to the fact that this Section is now being developed in phases and it was not previously recorded, the City Attorney's office has determined that each phase should be approved and filed as a separate plat. Mr. Lewis then pointed out that the streets and utility infrastructure for IV A is in place and has been accepted by the City. The Commission was being asked to approve the plat for Fairmont Park East, Section IV A. This action was required in order for the plat to be filed. Page 2 Planning & Zoning Commission Minutes of the Special Meeting of November 11, 1991 Finally, Mr. Lewis referred to an October 31, 1991 letter to Mr. Eddie Gray, the Developer, from Mr. John Joerns, the Assistant City Manager. This letter which formally accepted the subdivision utility systems also stipulated requirements for such items as street lighting, deed restrictions, etc. Mr. Lewis asked that any motion for approval reference these conditions. A motion was made by Commissioner Eugene Edmonds to approve the Subdivision plat for Fairmont Park East, Section IV A with the condition that the stipulations stated in the October 31, 1991 letter to Eddie Gray from the City of La Porte be met. The motion was seconded by Commissioner Paul Schaider. All were in favor and the motion passed. 3) ADJOURN A motion to adjourn was made by Commissioner Betty Waters and was seconded by Commissioner Paul Schaider. All were in favor and the motion passed. The meeting adjourned at 5:46 PM. The next regular meeting will be November 21, 1991. Discussion followed, Mr. Grey requested P&Z approve the plat subject to later approval by the City departments in order for construction of d~ainage structures be st~rted at this time. - A motion was made by R. J. Blackwell to approve the plat for Fairmont Park East subject to a~proval by all City departments prior to the time the plat would be placed on the agenda for the City Commissions consideration. The motion was second by Dallie Wright, the motion carried 4-ayes and a-nays. Jul. 29, 1986 The city of La Porte gave a one year e~tension to the construction plans as requested. Sept. 19, 1989 The City of La Porte received the construction plans and the plats for Fairmont Park East, section 4, Phase A. Please note section 4 has been broken into 3 separate parcels. Box 638 707 Memorial Drive Bay town, Texas 77522-0638 Re: Fairmont Park East, Section IV, Phase A Dear Mr. Gray, The water, sanitary sewer, storm sewer and street improvements have been completed according to the Plans and Specifications and are hereby accepted by the City of La Porte, Texas. The one (1) year warranty for materials and workmanship shall be effective from October 18, 1991. The City's Planning and Zoning Commission originally approved a replat of Section IV on November 3, 1983. Since that approval, this section has been divided into three (3) phases. Although staff presented this concept to the Planning and Zoning Commission on 10-19-89 it took no action to approve or disapprove of phasing Section IV. The City Attorney's office has advised staff that this should be done at this time to avoid future '> confusion with abstracting in the subdivision since the original replat was approved but never recorded. Prior to presentation to the Planning and Zoning Commission, the following revisions to the Section IV, Phase A plat should be completed. I. Delete the certification by City Council II. Move the Notary signature below the covenants on the upper right corner of the plat. Once the Planning and Zoning Commission has approved and signed the plat, the City will release it for recordation in the Harris County Clerk's office. The next meeting of the Planning & Zoning Commission is set for November 21, 1991. extUB\;rr G r. .. The remaining improvements (ie. street lights, sidewalks, signs, etc.) shall be completed as outlined below prior to any building permit being issued in the Subdivision (Sec.lV-A) 1 . Street lighting shall be completed by Houston Lighting and Power according to their standard design and construction policies and paid for by the Developer (see attached outline regarding H.L.& P. policies). 2. Street signs shall be installed by the City of La Porte Public Works Department and paid for by the Developer. The City will provide an estimate of cost for your use. 3. Sidewalk improvements shall be constructed and paid by the Developer and/or Builder as building progresses. Building permits will require sidewalks. 4. Submission of the subdivision deed restrictions and applicable covenants. . 5. The consulting engineer shall furnish reproducible record drawings of the water, sanitary sewer, storm sewer and street improvements within thirty (30) days from 10-18-91.
