• PLANNING & ZONING COMMISSION MEETING
APRIL 16, 1992

I. CALL TO ORDER
Meeting was called to order by Chairman Browder at 6:10 PM.

II. APPROVE MINUTES OF THE MARCH 19, 1992, REGULAR MEETING
A motion was made by Betty Waters and seconded by Paul Schaider to approve the
minutes as submitted. All were in favor and the motion passed.
III. BED AND BREAKFAST
A. DISCUSS POSSIBLE ZONING ORDINANCE AMENDMENTS
REGARDING BED AND BREAKFAST ESTABLISHMENTS
Mr. Harrington began by stating the proposed Zoning Ordinance
amendments.
1) The word "inn" will be omitted when referring to Bed and Breakfast.
2) "No more than three (3) rental rooms shall be provided" has been
deleted.
3) "Rooms shall be let by reservation only" has been deleted.

4) An amendment allowing one (1), 3'x 3' sign has been temporarily
added pending Commission approval.

5) Under "RESIDEN'T'IAL TABLE A", permitted use in R-3 has been
changed to conditional use in R-1, R-2, and R-3.
6) Under "SPECIAL USE PERFORMANCE STANDARDS", the
following language has been added:
"Bed and Breakfasts shall comply with the Boarding House
requirements of the currently adopted edition of the Standard Housing
Code and Life Safety Code (NFPA 101)."
7) Under "REQUIRED PARKING", the language remains the same
being two (2) parking spaces minimum plus one (1) space for each
additional rental room.
A sample Bed and Breakfast application form (Exhibit A) was included in the
• packet.
B. DISCUSS POSSIBLE DATE FOR PUBLIC HEARING REGARDING BED
AND BREAKFAST AMENDMENTS
Betty Waters made a motion to present the proposed Bed and Breakfast
amendments before a Public Hearing on May 21, 1992. Eugene Edmonds
seconded the motion. All were in favor and the motion passed
IV. CONSIDER CONDITIONAL APPROVAL OF BRIARGROVE SUBDIVISION PLAT
Mr. Harrington stated that Briargrove Park (formerly Meadow Park Subdivision,
Section II), received Final Approval in March of 1984. At that time, the Subdivision
improvements had begun and most improvements, excluding streets, were in place,
prior to it's collapse. This subdivision has had several attempts at resurrection,
however, due to recent storm water detention requirements placed by Hams County
Flood Control (HCFC), these attempts failed. After discussions between HCFC and
the new Owners, HCFC has agreed to withdraw its objections regarding storm water
detention.

The Owners wish to resubmit the original plat for approval. Staff has evaluated the
run-off from the property to its drainage channel and finds that it does not change
the affects of the 100 year flood plain elevation. Staff recommends Commission
grant Conditional Approval of the plat under the old ordinance under which it was
started. The following requirements should be applied:
1) Provide the City of La Porte with "as-built" drawings and construction
specifications on the completed water, sanitary sewer and storm drainage.
2) Provide the City with construction and specifications for the street
construction.
3) Retest the water and sewer lines for compliance with City requirements.
4) Provide the City with a Letter of Acceptance for the constructed water,
sanitary sewer and storm drainage lines.
• 5) Provide engineering reports on the existing water pressures available to the
subdivision, and execute a Utility Extension Agreement for extension of the
12" water line from Underwood Road to the subdivision if necessary.
6) Provide the City with any proposed deed restrictions.
7) Provide the City with copies of any Homeowner's Association Agreements
which should include additional assessment authority.
8) Relocate the 6" water line and the 2" gas line in the drainage ditch on the
north side of "P" Street so that the drainage flow line can be lowered.
9) Provide for street lights and street signs to be located within the subdivision.
10) Mow and reshape the drainage channel between North "P" Street and Big
Island Slough where the City determines it to be necessary.
11) Construct headwalls at the drainage outfalls for the street intersections along
"P" Street.
* If sufficient water pressure to the subdivision is present the City would be
• willing to eliminate the request fora 12" water line extension.

Betty Waters questioned the elevation of the lots. Eugene Edmonds expressed
concern about flooding problems in the Lomax area. John Armstrong suggested we
require Deed Restrictions be submitted for approval as to form by the City. Paul
Schaider expressed the need for enforcing a time frame for completion.
Mr. Doug Konopka, Project Manager for John R. DeBoben Investment Builders,
addressed the Commission. Betty Waters asked what the lot elevation would be
upon completion of the streets and what slab elevation would be upon completion
of the homes. Mr. Sherrington answered they would be preparing a design package
which would include a grading plan, based on the final street elevations.
A motion was made by Eugene Edmonds and seconded by Betty Waters to grant
Conditional Approval of the Briargrove Subdivision Plat. All were in favor and the
motion passed. The motion was amended to include "compliance with staff
recommendations".
V. STAFF REPORTS
No further discussion was necessary at this time.
Prior to adjournment Mr. Armstrong reported to the Commission that the
Stephenson mobile home case had been won by the City. In addition, the City was
involved in a dispute over a Board of Adjustment matter in Lomax which the City
also won.
VI. ADJOURN
A motion was made by Betty Waters and seconded by Lola Phillips to adjourn.
All were in favor and the motion passed. The meeting adjourned at 6:40 PM.
The next meeting will be May 21, 1992.

BED AND BREAKFAST STAFF REPORT
• Staff Report May 21, 1992
Public Hearing Regarding Bed and Breakfast
The Planning and Zoning Commission has, over the course of several meetings,
developed a series of regulations for Bed and Breakfasts. These regulations are proposed
as amendments to the City's Zoning Ordinance.
The Commission, as required by Zoning Ordinance Section II-507, must now conduct
a public hearing regarding the proposed amendments. After closing the hearing, the
Commission will make a recommendation to City Council regarding these amendments.
A copy of staffs April 16, 1992 Bed and Breakfast report is attached. All proposed
amendments are included in this report.

• Staff Report Bed and Breakfasts April 16,1992
The Planning and Zoning Commission, at its March 19, 1992, meeting directed
staff to prepare language amending the Zoning Ordinance provisions that regulate Bed
and Breakfasts (B&B). These regulations, which are located in four (4) separate
ordinance sections, follow. The amending language which has been added to these
sections is highlighted with bold face type. Language presently in the ordinance which
is to be deleted is indicated by strikeovers.
3-100 DEFINITIONS:
Bed and Breakfast ~: A building, the primary use of which is a single family
residence, in which sleeping rooms are available for overnight rental subject to
the following restrictions.
• 1. Bed and Breakfast 1~ shall be operated by resident
homeowners.
2. Bed and Breakfast ~s shall conform to the requirements of
Section 5-800.
3. Parking shall be provided in accordance with the requirements
of Section 10-609.
4. A Bed and Breakfast shall be allowed one (1) sign, not exceeding
three (3) square feet in area and non-illuminated. This sign may
be either mounted on the building or located in a landscaped
portion of the yard. Yard signs shall be located in accordance
with the provisions of Section 10-1000, Residential Sign Table B.

Staff has prepared a Bed and Breakfast application form. The purpose of this
form is to provide staff and in turn, the Commission and Council with information
regarding prospective B&B's. This form would be completed by an applicant and
submitted in conjunction with a Special Conditional Use Permit application. A copy
has been attached for the Commission's review (see Exhibit A). Staff has also, as
requested by the Commission, prepared example B&B signs. These signs will be in
the Council Chambers during the April 16, meeting.
If the Commission is satisfied with these amendments, the next step will be to
conduct a public hearing on this matter. May 21, 1992, is the Commission's next
regularly scheduled meeting date. This would be an appropriate date for the hearing.
