Meeting was called to order by Chairman Waters at 6:02 PM.

John Armstrong administered the oath of office to all of the Commission Members
simultaneously.

John Armstrong administered the oath of office for Chairman to Betty Waters.
IV. APPROVE MINUTES OF THE JUNE 18, 1992 PUBLIC HEARING AND
REGULAR MEETING
A motion was made by Doug Martin and seconded by Eugene Edmonds to approve
the minutes as submitted. All were in favor and the motion passed.

V. CALL PUBLIC HEARING TO ORDER
SPECIAL CONDITIONAL USE PERMIT REQUEST #SCU92-001 WHICH IS
REQUESTED FOR LOTS 36-47; BLOCK 3; BATTLEGROUND ESTATES
SECTION I. THE PURPOSE OF THE REQUESTED PERMIT IS TO ALLOW
THE ABOVE DESCRIBED PROPERTY TO BE USED FOR AGRICULTURAL
PURPOSES, RAISING LIVESTOCK.
Chairman Waters called the Public Hearing to order at 6:08 P.M.
Mr. Harrington briefed the Commission regarding SCU92-001. The applicants,
Ronnie and Melody Elledge own the property located in the 11000 Block of
Monument Road (Lots 36-47; Block 3; Battleground Estates, Section I). They are
proposing to utilize this property for raising livestock for their children's 4-H and
F.F.A. projects. The proposed improvements would consist of a barn and fencing.
This request satisfies ordinance prerequisites and is eligible for the requested Special
• Conditional Use Permit, therefore, staff recommends approval of the request, subject
to the following conditions:
I. Fencing shall be setback at least 25 feet from side property lines.
II. A maximum of two (2) head of livestock shall be housed on this
property at any time.
III. No animal which could be classified as wild or dangerous under the
provisions of Ordinance 1401 shall be housed on this property at any
time.
Twenty-two (22) notices were mailed to adjacent property owners. Eight (8) were
returned in favor of the request, and three (3) were returned in opposition to the
request. Two (2) were returned undeliverable.
Mr. Lewis stated that staff had not found anything in the subdivision's deed
restrictions which would preclude this activity.
Mr. Ebow expressed concern for the adjacent property owners who may not desire
this type of activity in their subdivision. Mr. Harrington stated that the Northwest
• part of La Porte is typically a rural area and that a number of the people who live
there do so to have the opportunity to raise livestock. It was also noted that the

Zoning Ordinance was written with the intention of allowing the property owners in
the area to raise livestock if they so desired. Mr. Ebow was satisfied with Mr.
Harrington's reply.
A. PROPONENTS
Melody Elledge wanted the Commission to know that this subdivision isn't a
typical subdivision and that there are existing barns and various animals
throughout the neighborhood. She stated that she and her husband moved to
the area so they could raise their children in a country atmosphere. Mr.
Elledge stated there would not be a barbed wire fence.
B. OPPONENTS
There were none.
• Chairman Waters reminded the Commission that the Ordinance was originally
written to allow this sort of activity on land which was divided into acreage. Since
these parcels of land are lots instead of acreage, a great deal of trust would be given
to the applicants to take care of the property and livestock as a consideration to
adjacent property owners.
VI. CLOSE PUBLIC HEARING
Chairman Waters closed the Public Hearing at 6:30 PM.
VII. CONSIDER APPROVAL OR DENIAL OF SPECIAL CONDITIONAL USE PERMIT

A motion was made by Doug Martin and seconded by Eugene Edmonds to approve
the Special Conditional Use permit SCU92-001 with the conditions recommended by
staff. All were in favor and the motion passed.

VIII. STAFF REPORTS
Mr. Harrington encouraged the Commission Members to attend Saturday morning's
breakfast with the Mayor, in an effort to establish good communication between the
Planning and Zoning Commission and City Council.
Chairman Waters asked Mr. Harrington if there was plans for the Commission to
begin review of the Zoning Ordinance in the near future. Mr. Harrington stated that
staff has already begun review of a few items which may require further
consideration.
IX. ADJOURN
A motion was made by Howard Ebow to adjourn and was seconded by Dottie
Kaminski. All were in favor and the motion passed.

BAYFOREST GREEN SUBDIVISION

• Staff Report Bayforest Green Subdivision Plat October 1, 1992
Item No. 3 on the agenda is to consider plat approval for Bayforest Green
Subdivision. This is fora 3.74 acre tract of land to be subdivided into eight (8) large lots
along Broadway.
The staff has reviewed the above referenced subdivision and associated covenants for
compliance with La Porte's Development Ordinance. As a result of this review, the staff
recommends conditional approval of the subdivision subject to the following requirements
and corrections being completed:
A. The title of the plat needs to state "Final Plat".
B. The date of the plat should reflect the date of formal presentation to the
Planning and Zoning Commission.
• C. The owner of the property immediately adjacent to the north should be
shown.
D. The language used in acknowledgements, certification, etc., should utilize the
same language specified in the Development Ordinance.
E. Payment in lieu of parkland dedication in the amount of $1,400.00 is required.
F. A private easement holders consent letter from Hams County Flood Control
District must be submitted.

Staff Report Planning and Zoning Meeting Schedule 9-28-92
Staff has prepared a Planning Schedule for Planning and Zoning Commission and
Board of Adjustment meetings. This schedule covers meeting dates from the present
through the end of 1992. A copy of the schedule is attached.
New schedules will be prepared on a quarterly basis. Copies will be provided to all
Board and Commission members as they are prepared.

Permit Conditions
Failure to begin construction within one (1) year after issuance or as scheduled under the
terms of a special conditional use permit shall void the permit as approved, except upon an
extension of time granted after application to the Planning and Zoning Commission.
If construction is terminated after the completion of any stage and there is ample evidence
that further development is not contemplated the ordinance establishing such special
conditional use permit may be rescinded by the City Council, upon it's own motion or upon
the recommendation of the Planning and Zoning Commission of the City of La Porte, and
the previous zoning of the entire tract shall be in full effect on the portion which is
undeveloped.
