PLANNING & ZONING COMMISSION MEETING
DECEMBER 17, 1992

I. CALL TO ORDER
Meeting was called to order by Chairman Waters at 6:11 PM.
Note: Meeting was delayed approximately ten (10) minutes because Municipal Court
• was being held in the Council Chambers.
II. APPROVE MINUTES OF THE OCTOBER 5,1992 SPECIAL CALLED MEETING
A motion was made by Inge Browder and seconded by Howard Ebow to approve the
minutes as submitted. All were in favor and the motion passed.
III. OPEN PUBLIC HEARING TO CONSIDER SPECIAL CONDITIONAL USE
PERMIT REQUEST SCU92-002 FOR 205 NORTH 11TH STREET. PERMIT IS
REQUESTED TO ALLOW STONE CASTLE INDUSTRIES TO LOCATE AT THIS
FACILITY FOR THE PURPOSE OF MANUFACTURING ARCHITECTURAL AND
ORNAMENTAL TRIM PIECES FROM SYNTHETIC STONE. THIS BUSINESS
ACTIVITY (SIC 3272) IS LISTED AS A CONDITIONAL USE IN LIGHT
INDUSTRIAL ZONES.
Public Hearing was opened at 6:12 PM by Chairman Waters.
Mr. Henry Blair, owner of Stone Castle Industries, resides at 18727 Martinique
Drive, Houston, Texas 77058. Mr. Blair proposes to manufacture architectural and
ornamental trim pieces at the North 11th Street location. He provided the

Commission with pictures that typify the product he intends to manufacture. Mr.
Blair stated that none of the chemicals which would be used are dangerous and that
no byproduct is created. Within twelve (12) months he hopes to have approximately
five (5) people working for him.

• Chairman Waters closed the Public Hearing at 6:18 PM.
IV-A. CONSIDER RECOMMENDATION TO CITY COUNCIL REGARDING SPECIAL
CONDITIONAL USE PERMIT REQUEST #SCU92-002.
A motion was made by Inge Browder to approve Special Conditional Use Permit
#SCU92-002 which would allow Stone Castle Industries to locate their business at
205 North 11th Street for the purpose of manufacturing architectural and ornamental
trim pieces from synthetic stone. The motion was seconded by Eugene Edmonds.
All were in favor and the motion passed.
V. CONSIDER PRELIMINARY PLAT OF GLEN MEADOWS MASTER PLAN
Mr. Hamngton addressed the Commission regarding the undeveloped portion of the
Glen Meadows Subdivision. The General Plan was originally approved on March 28,
1977. Since that time, requirements from the Hams County Flood Control District
have changed. They now require detention of stormwater runoff. This would require
some type of detention facility on the undeveloped land. Furthermore, the airport
is in the process of planning a runway extension which would require that the
Farrington Blvd. extension be adjusted. The developer has met with City staff in an
• effort to develop a revised General Plan and to address the detention problems that
exist. The following is a list of key items which address the problems:

A. The City of La Porte will trade the existing park located in the
northeast portion of the subdivision for a site located adjacent to the
proposed detention facility and Big Island Slough. A trade of 3.97
acres for 8.38 acres of land for the new park site.
B. The detention facility and the new park will be combined to allow for
a shallow detention facility which will be used for park facility during
dry times.
C. The proposed Farrington Blvd. extension can now be made and still
allow for the runway extension.
D. The new street alignment now more closely resembles what is standard
design principles. It has eliminated the straight street concept for the
newer approach of short, non-thoroughfare type streets. This concept
• eliminates houses facing collector or arterial facilities.
E. The new General Plan allows for the phasing of the subdivision which
will be done in conjunction with market conditions.
F. Eight (8) lots shown as fronting on Valley Brook Drive (identified as
Block 2) are to be relocated to the northern boundary of the
park/detention facility. These lots will now front on Glenpark Drive
South and will no longer front on Valley Brook Drive, which has been
designated as a collector street.
Based on the information provided, staff recommends approval of the revised
General Plan. Per the Development Ordinance, this action will serve as
authorization for the developer to file a preliminary subdivision plat on the property.
The developer will have one (1) year to file the preliminary plat for approval or file
for an extension of the General Plan.
Viva Foster, who resides at 3314 Bliss Meadows, Pasadena, works for Municipal
Engineering (engineers for the project). Howard Ebow asked what the depth of the
detention pond would be. Ms. Foster stated that the pond would have a very gentle
slope and estimated the depth to be 1 1/2 feet. Mr. Harrington noted that this
would eventually drain into Big Island Slough. Mrs. Waters complimented the design
of the subdivision.

Eugene Edmonds made a motion to accept the General Plan submitted for Glen
Meadows Subdivision. The motion was seconded by Dottie Kaminski. All were in
favor and the motion passed.

VII. ADJOURN
Inge Browder motioned to adjourn. Chairman Waters declared the meeting duly
adjourned at 6:30 PM.

Requested For: 12803 Old La Porte Road which is further described as a 1.726
acre tract out of the Enoch Brinson Survey (see Exhibit A).
Requested Bx: Mr. Patton H. Caldwell on behalf of Houston Shell & Concrete
Zoning: Light Industrial (LI)
Purpose of Request: A Special Conditional Use Permit is requested to allow
construction and operation of a concrete batch plant (SIC 3273)
in a Light Industrial Zone.
Background: The tract in question is located at the southwestern comer of
the Hwy. 225, Hwy. 146 interchange. It is bounded to the west
by Strang Road and to the south by the Southern Pacific rail
right-of--way (see Exhibit A). The property, which is surfaced
with calcium sulfate, has until recently, been used as a
parking/marshalling yard for heavy trucks and trailers. The
eastern most portion of this tract (the portion which abuts the
Hwy. 146 right-of--way) will remain under separate lease and
continue to be utilized for this purpose. The property to the
north (which is a separate tract) is also used as a trucking
facility. This business will continue to operate as well.
Houston Shell & Concrete is proposing to set up and operate
a "batch plant" at this location (see Exhibit B). The plant will
mix concrete from dry components and water. The wet
concrete will then be loaded into trucks which are dispatched
to job sites. A somewhat more detailed description of this
process has been submitted by the applicant and is attached as
Exhibit C. The tract in question is zoned LI. Zoning
Ordinance Section 7-500, Table A, lists this business activity as
Conditional in LI zones. A Special Conditional Use Permit is,
therefore, required.

Analysis: Zoning Ordinance Section 7-700 establishes "Special Use
Performance Standards" which apply to Conditional Uses.
These standards, as they apply to this request, will be discussed
in this section of staffs report. The text of these standards is
too lengthy to be included in this report in full, but can be
found on Zoning Ordinance pages 63-64.
A. ~affic Control:
The proposed site, as noted, was formerly used as a
truck marshalling yard. With well over an acre of
surfaced area, there is adequate on site parking for both
employee's personal vehicles and concrete trucks. The
section of Strang Road which connects this site with
Hwy. 225 primarily serves industrial traffic; the
Southern Pacific rail yard and the trucking firms
referenced above. This facility should not have a
significant impact on the type or volume of traffic
utilizing Strang Road and the adjoining Section of Hwy.
225.
B. Drainage:
The site in question is already surfaced and graded.
Drainage modifications, should any be required, will be
addressed during the course of the certified site plan
review which takes place prior to issuance of any
building permit for new commercial or industrial
development.
C. Compatibility with Surrounding Area:
The tract in question is zoned for industrial use. It is
located in a somewhat isolated, secluded area (see
Exhibit A). This facility should not cause any
impairment to the value or use of the adjoining trucking
yards or the Southern Pacific rail yard. The location is
isolated enough to preclude impact on other properties.

D. Required Licenses:
Houston Shell & Concrete has applied for and received
a permit exemption for plant operation from the Texas
Air Control Board (see Exhibit D). The supporting
documentation for this letter is in staff's file and is
available for the Commission's review. This letter
constitutes State approval for operation of this plant. If
this request is approved, a City Zoning Permit will also
be required.
E. Availability and Adequacy of Public Services:
There is no potable water or sanitary sewer service to
this tract; nor are there water or sewer lines in a
location to be readily extended to this site. Electric
• service is available. The applicants propose to utilize an
existing 4" well to provide water for process and sanitary
needs. Bottled water is to be provided for drinking.
There is additionally, no water available for fire
protection. The applicant's request has been reviewed
by the City's Fire Marshall and Fire Chief. In their
opinion, the proposed plant and its operation should not
provide a significant degree of fire hazard. They,
therefore, based on fire protection needs, have no
objection to approval of the requested permit.
Regarding sanitary needs, staff would recommend as a
condition of permit approval, the applicant be required
to install an on site septic system for employee restroom
facilities.
F. Loading Berths:
This facility has no loading berths as such. The loading
chute and material silos are located in a manner that
will allow trucks to load, unload, and maneuver on site.
• There should be no interference with traffic on Strang
Road.

Additional Requirements:
As noted, this site is surfaced with calcium sulfate. This
material is very stable and provides an excellent base to support
heavy truck traffic. It is not, however, dust free. Zoning
Ordinance Section 10-605.6 requires driveways, parking lots,
and storage yards to be "surfaced to control dust". Staff would
recommend that as a condition of permit approval, this site be
topped with a material that will provide dust free parking.
Conclusion: This request satisfies Zoning Ordinance prerequisites. Subject
to the following conditions, staff recommends approval of
Special Conditional Use Permit #SCU93-001.
I. Applicant shall install an on site septic system to
• accommodate sanitary waste.
II. All areas currently surfaced with calcium sulfate
shall be topped with a material suitable for
control of dust.

This is in response to your exemption application concerning
your Concrete Batch Plant to be relocated to property
immediately southwest of the intersection of Highways 146 and
225 in LaPorte, Harris County.
After evaluating the information which you provided, we have
determined that this plant is exempt from the permit
procedures under Standard Exemption No. 71 if erected and
operated as described in your application. This exemption was
previously authorized by the Executive Director pursuant to
Texas Air Control Board Regulation VI, Rule 116.6.
Authorization is contingent upon your continued compliance
with the requirements of this exemption. Your operation will
be randomly monitored, and you are reminded that this facility
must be in compliance with all rules and regulations of the

Re: Special Conditional Use Permit Request #SCU93-001
Dear Mayor Malone,
The La Porte Planning and Zoning Commission, at its January 21, 1993, public hearing and
regular meeting considered Special Conditional Use Permit Request #SCU93-001. This
permit has been requested for the purpose of allowing Houston Shell & Concrete, the
applicant, to construct and operate a concrete batch plant in a Light Industrial Zone. The
proposed site for this plant is 12803 Old La Porte Road. The permit has been requested
as required by Section 7-500 of Zoning Ordinance 1501.
The Commission, by unanimous vote of members present, has recommended City Council
approval of Special Conditional Use Permit #SCU93-001. The Commission has also
recommended attaching the following two (2) conditions to this permit.
I. The applicant shall install an on .site septic system to accomodate
sanitary waste.
II. All areas currently surfaced with calcium sulfate shall be topped with
a material suitable for control of dust.
