I. CALL TO ORDER
Meeting was called to order by Chairman Waters at 6:10 PM.
• Note: Meeting was delayed approximately ten (10) minutes because Municipal Court
was being held in the Council Chambers.
II. APPROVE MINUTES OF THE DECEMBER 17, 1992 PUBLIC HEARING AND
REGULAR MEETING
A motion was made by Inge Browder and seconded by Dottie Kaminski to approve
the minutes as submitted. All were in favor and the motion passed. Wayne
Anderson abstained from voting due to his absence from the previous meeting.
III. OPEN PUBLIC HEARING TO CONSIDER SPECIAL CONDITIONAL USE
PERMIT REQUEST SCU93-001. THIS SPECIAL CONDITIONAL USE PERMIT
IS REQUESTED TO ALLOW CONSTRUCTION AND OPERATION OF A
CONCRETE BATCH PLANT IN A LIGHT INDUSTRIAL ZONE. THE TRACT IN
QUESTION IS A 1.726 ACRE TRACT OUT OF THE ENOCH BRINSON SURVEY
WHICH IS ALSO DESCRIBED AS 12803 OLD LA PORTE ROAD.

Mr. Patton Caldwell whose business address is 5111 Woodway, Houston 77056,
addressed the Commission as a representative of Houston Shell and Concrete. Mr.
Caldwell stated that he proposed to move one of his ready mix batch plants to the
property located on Strang Road at 146 and 225.
• There will be a small building (app. 10'x20') which will be a control room and
another small building (app. 10'x20') which will contain cement additives and a
restroom.
• There will also be a silo for cement and another one for flash (a cementitious
material that is a by product from power plants).
• A front end loader will be used to transfer wash sand .and gravel from stockpiles.
The sand and gravel will come from the Victoria area to Sims Bayou by barge and
will be trucked the rest of the way.
• The Air Control Board has given their approval, however, the stockpiles must be wet
down occasionally for the products to remain damp in an effort to minimize dust.
• The cement will be transferred into the silos by pneumatic trucks so the cement is
not exposed to the air.
• On the top of the silos there will be large dust collectors to reduce emissions.
• Their water supply will come from an existing well from Mr. Angel's property which
is located directly across the road.
• Aseptic system will be installed.
• This is not expected to be a permanent location.

Mr. Harrington stated that staff recommends approval of Special Conditional Use
Permit #SCU93-001 subject to the following conditions:
I. Applicant shall install an on site septic system to
accommodate sanitary waste.
I. All areas currently surfaced with calcium sulfate shall be topped
with a material suitable for control of dust.

IV. CLOSE PUBLIC HEARING
The Public Hearing ended at 6:22 PM.

V. CONSIDER RECOMMENDATION TO CITY COUNCIL REGARDING SCU93-001
A motion was made by Wayne Anderson to approve Special Conditional Use Permit
#SCU93-001 subject to the conditions set forth by staff. The motion was seconded
by Inge Browder. All were in favor and the motion passed.

• CORONET ESTATES SUBDIVISION
PLAT REVIEW

Staff Report Coronet Estates Subdivision February 11, 1993
Background:
The Preliminary Plat of the proposed Coronet Estates Subdivision, filed with the City of La
Porte on February 4, 1993, is to occupy a 50.30 acre tract located at the northeastern corner
of the North "P" Street, Robinson Road intersection. Exhibit "A" is a reduced copy of the
proposed plat. Full sized copies will be available at the February 18, Planning and Zoning
Commission meeting.
Under the terms of Development Ordinance 1444, Coronet Estates is classified as a major
subdivision. A major subdivision is any subdivision comprised of 10 or more acres.
Development Ordinance Sections 4.03 and 4.04 require a two phase approval process for
major subdivisions. This requires the Planning and Zoning Commission to first review and
act on a Preliminary Plat followed by subsequent review and action on a Final Plat.
Although this subdivision is relatively large, it is comprised of only 13 lots. There are no
• internal streets, alleys, or utility easements (an existing drainage easement will be
maintained). Neither will there be any internal public utility lines. Water, sewer, electricity,
etc. will be provided from existing lines located along Robinson Road, North "P" Street, and
if necessary the Battleground Estates Subdivision. Lot 1, a single homesite, is the only lot
which might draw utilities from the abutting subdivision.
The proposed subdivision is situated on land that was previously platted as Coronet Park
Subdivision Section I. This plat was formally vacated on August 23, 1984.
Availability of utility service must be verified from existing City of La Porte infrastructure
and franchised utility companies. Staff is working with the applicant to achieve this.
Analysis:
In reviewing the Coronet Estates Subdivision plat for compliance with City Ordinances, staff
has noted the following:
I. Proposed Hams County Flood Control District
(HCFCD) Unit F101 Channel Improvements will
affect Lots Number 1, 10, 11, 12, and 13 of the
• subdivision. The ultimate improvements will
require additional right-of--way. This additional

right-of--way needs to be dedicated to the public
and shown as such on the plat to be recorded.
II. Note that all structures to be constructed within the
subdivision must be within 500 feet of a City of La Porte
fire hydrant in order to meet requirements of the local
fire code.
III. The phrase "Laws of the State of Texas" is not the
proper language to be used in this context. It should be
removed from the Preliminary and Final Plat (see
Exhibit A).
IV. Deed Restrictions must be reviewed by staff and
approved by the City Attorney's office.
V. No property contours or physical features are shown on
• the plat. This is a requirement of the Development
Ordinance, Appendix D. The applicant has requested
that this requirement be waived. Due to the absence of
internal streets easements and utilities, all lots shall be
graded to drain from back to front discharging at
Robinson Road and/or North "P" Street roadside
ditches.
VI. Applicant must provide the City a title certificate
verifying property ownership.
VII. No park land is proposed for this subdivision. Under
the terms of the Development Ordinance Article 12.00,
a payment of $175.00 per homesite must be made to the
City in lieu of dedicated park land. In the case of
Coronet Estates, this will be $2,255.00. Also, it should
be noted that under the terms of the Development
Ordinance, this money can only be utilized to either
acquire new park land or improve existing parks.
Furthermore, the money can only be used within the
same park zone which the subdivision is located. These

funds must be deposited with the City of La.
Porte as a condition of final approval.
VIII. Utility connection or front foot fees will be assessed on
each lot upon application for building permits based on
the current rates at that time.
IX. Section 6.01 of the Development Ordinance requires at
least one (1) City of La Porte survey monument be
accurately tied down by angle and distance to one or
more subdivision property corners and a permanent
control monument be constructed within the subdivision.
The nearest City of La Porte monument (No. 82) is
located at the intersection of Robinson Road and North
"P" Street, therefore, there is no need for installation of
a new one in this area.
X. Section 5.02 of the Development Ordinance requires
construction of sidewalks within a subdivision when
required by the Comprehensive Plan or by the Plan
Commission. As no facilities are required by the
Comprehensive Plan and there are no sidewalks in the
area, the Staff recommends waiver of this requirement.
XI. Section 11.04 of the Development Ordinance requires
installation of street lighting within new subdivisions. In view
of the rural nature of the proposed subdivision, Staff is
reviewing the requirement for possible waiver. Staff proposes to
bring back additional data prior to the final plat including
recommendations for a policy in rural areas.
XII. Appendix D of the Development Ordinance requires
building lines to be shown on the plat.
Conclusion:
The Coronet Estates subdivision, as proposed, is in substantial compliance with applicable
City Ordinances. Staff, therefore, recommends granting conditional approval to this
• preliminary plat.

PRELIMINARY PLAT: ACTION BY THE APPROVING AUTHORITY
All Preliminary Plats require final approval from the Commission. Following review of the
Preliminary Plat, the Commission shall, within thirty (30) calendar days of the filing date,
take one of the following actions:
1. Approve the Preliminary Plat as filed;
2. Conditionally approve the Preliminary Plat as filed, provided, the reasons are
stated in writing and a-copy of the statement is signed by the Chairman of the
Planning Commission.
3. Disapprove the Preliminary Plat as filed, provided, the reason for such
disapproval are stated in writing and a copy of the statement is signed by the
Chairman of the Planning Commission.
Commission action shall be noted on three (3) copies of the Preliminary Plat, which shall
• be distributed to the developer, Department, and official files of the Commission. Unless
stipulation for additional time is agreed to by the subdivider, the failure of the Planning
Commission to act within thirty (30) days from the date of the filing of the plat by the
developer, will cause the plat to be deemed approved.
PRELIMINARY PLATS: EFFECT OF APPROVING AUTHORITY ACTION
1. Approval: Commission approval of the Preliminary Plat authorizes the
subdivider to file a Final Plat.
2. Conditional Approval: Commission conditional approval requires submission
of an amended Preliminary Plat and additional documentation as specified by
the Planning Commission for final commission approval.
3. Disapproval: Commission disapproval of a Preliminary Plat requires
submission of a new Preliminary Plat.
In the event the subdivider fails to file a Final Plat within one year of Approving Authority
approval of said Preliminary Plat shall terminate upon written notice to the subdivider or
owner. The subdivider or owner may request in writing a one year extension specifying the
reasons why a Final Plat has not been filed.

Background:
The preliminary plat of the proposed Denim & Diamonds Subdivision, filed with the City
of La Porte on February 4, 1993, is to occupy a 31.92 acre tract of property which is located
on the north side of North "P" Street, immediately across from the Meadow Park
Subdivision. This is the property that at one time was being developed as Meadow Park
Section II. More recently this tract was being considered for development as the Briargrove
Park subdivision. Exhibit A is a reduced copy of the plat currently under consideration.
Full sized copies of the plat will be available at the February 18, Planning and Zoning
Commission meeting.
Under the terms of Development Ordinance 1444, Denim & Diamonds Subdivision is
classified as a major subdivision. A major subdivision is any subdivision comprised of 10
or more acres. Development Ordinance Sections 4.03 and 4.04 require a two phase
approval process for major subdivision. This requires the Planning the Planning and Zoning
Commission to review and to act on a Preliminary Plat and subsequently review and take
• action on a Final Plat.
Although this subdivision is relatively large, it is to be comprised of only 41ots. There will
be no internal streets, alleys, or utility easements. Water and sewer lines installed as part
of the earlier development proposal are to be abandoned in place, plugged at any
connection to existing City of La. Porte utilities and capped off within the subdivision.
Service to the four (4) lots shall be from existing City of La Porte utilities located on North
"P" Street. Should the applicant choose to provide additional fire protection to the lots by
utilizing the existing facilities on site, easements would need to be dedicated to the City of
La Porte and the lines would need to be retested prior to acceptance. The City Attorney
is to prepare wording which will be addedto the plat and will eliminate public drainage
easement located on the west side of the subdivision which drains private property.
Analysis:

stipulation for additional time is agreed to by the subdivider, the failure of the Planning
Commission to act within thirty (30) days from the date of the filing of the plat by the
developer, will cause the plat to be deemed approved.
PRELIMINARY PLATS: EFFECT OF APPROVING AUTFIORITY ACTION
1. Approval: Commission approval of the Preliminary Plat authorizes the
subdivider to file a Final Plat.
2. Conditional Approval: Commission conditional approval requires submission
of an amended Preliminary Plat and additional documentation as specified by
the Planning Commission for final commission approval.
3. Disapproval: Commission disapproval of a Preliminary Plat requires
submission of a new Preliminary Plat.
