CALL TO ORDER Meeting was called to order by Chairman Waters at 6:00 PM. II. OPEN PUBLIC HEARING FOR THE PURPOSE OF CONSIDERING A PARTIAL • REPEAT OF GLEN MEADOWS, SECTION II. Chairman Waters opened the Public Hearing at 6:00 P.M. Mark Lewis reported that 4.9026 acres of Glen Meadows, Section II is being considered for replat as a portion of Glen Meadows, Section VII. This replat will complete a land exchange that was initiated several years ago and should be beneficial to both the Ciry and Glen Meadows Partners, the developer. Mr. Lewis noted the following sequence of events that have occurred. They are: • In November 1992, the Planning and Zoning Commission approved an exchange of park land within the subdivision. This was done in order to: a. Create a larger park in an improved location. b. Facilitate the future extension of Farrington Boulevard. c. Provide area for additional runway protection zone that is required adjacent to the City's airport. • On November 18, 1993, the Planning and Zoning Commission, with approval of the Glen Meadows, Section V Final Plat, accepted the new 8.13 acre park site. • • On November 13, 1995, City Council passed Ordinance #95-2077 (see Exhibit B). This ordinance authorizes the City Manager to issue a special warranty deed • . Page 2 of 4 Planning & Zoning Commission Minutes of December ?, 1995 to Glen Meadows Partners, Inc. The deed, conveying the 4.9026 acre tract is to be issued following Commission approval of the Section II replat. Staff reviewed the replat request and found it satisfied applicable State Law and Development Ordinance provisions. Staff recommended approval of the replat request. Mr. Lewis noted that approval of the replat will authorize the City Manager to issue a Special Warranty Deed to the applicants. The replat will not be filed for recordation until the Final Plat for Section VII has been released. Mr. Lewis added that public notices were mailed to 23 property owners. Two replies were received in favor of the replat request, none in opposition. A. PROPONENTS John Garner, of Municipal Engineering, informed the Commission that he was available for questions. B. OPPONENTS • There were none. III. CLOSE PUBLIC HEARIAIG Chairman Waters closed the Public Hearing at 6:10 P.M. IV. CONSIDER APPROVAL OF A PARTIAL REPEAT OF GLEN MEADOWS, SECTION II. A motion was made by Chuck Engelken to approve a partial replat of Glen Meadows, Section II. The motion was seconded by Melton Wolters. All were in favor and the motion passed. V. CONSIDER APPROVAL OF THE PRELIMINARY PLAT OF GLEN MEADOWS, SECTION VII (WHICH INCLUDES A PARTIAL REPEAT OF GLEN MEADOWS, SECTION II). Mr. Lewis presented staff's report for the Glen Meadows Subdivision, Section VII, Preliminary Plat. Glen Meadows is designated a Major Subdivision and this section will • be comprised of 87 single family home lots. Staff reviewed the plat and found it to be in substantial compliance with Development • • . Page 3 of 4 Planning & Zoning Commission Minutes of December 7, 1995 Ordinance requirements. Several items will need to be addressed prior to Final Plat approval. They are 1) locations for placement of survey control monuments located on the plat; and 2) filing and recordation of a Special Warranty Deed with Harris County Deed Records, completing the Section II land transfer. A setback variance from the Board of Adjustment will not be needed for the Glenbay cul-de-sac. Mr. Lewis assured the Commission that staff would work with the Engineer for the project and the City Attorney's office to prepare the correct language that should be noted on the Final Plat. It will indicate that the reduced setback is in accordance with the direction of the Commission. Staff recommended conditional approval of the Preliminary Plat. A motion was made by Melton Wolters to approve the Preliminary Plat of the Glen Meadows, Section VII, Preliminary Plat with the following conditions: 1. Locations for placement of survey control monuments must be noted on the Final Plat. 2. A Special Warranty Deed, completing the Section II land transfer must be filed and recorded with the Harris County Department of Deed Records. 3. A note should be made on the Final Plat stating that the Commission has considered and approved the 20 foot setback for the Glenbay Court cul-de- sac. The motion was seconded by Dottie Kaminski. All were in favor and the motion passed. VI. CONSIDER APPROVAL OF THE REVLSED PRELIMINARY PLAT OF PECAN CROSSING, SECTION I, WHICH IS TO BE LOCATED IN THE 9200 BLOCK OF FAIRMONT PARKWAY. Mr. Lewis reported that Preliminary Plat approval had previously been granted for Section I of the Pecan Crossing Subdivision in April, 1994. However, the Development Ordinance specifies that Preliminary Plat approvals are only valid for one year. Since no Final Plat was submitted within the one year period, the original Preliminary Plat approval has expired. The developer has since made minor revisions to the Section I plat, so instead of filing for an extension of the first approval, he is seeking a new approval for the revised plat. • Staff has reviewed the Preliminary Plat and found it to be in compliance with applicable ordinance requirements. Several items will need to be addressed prior to Final Plat approval. They are 1) survey monument locations be noted on the Final Plat; 2) access to Spring Gully and the detention pond; 3) inclusion of sidewalks. A motion was made by Eugene Edmonds to approve the Preliminary Plat for Pecan Crossing, Section I, subject to the conditions noted in staff's report. The motion was seconded by Maggie Anderson. All were in favor and the motion passed. VII. DISCUSS CONCEPTUAL DEVELOPMENT PLAN FOR AREA WEST OF ffiGHWAY 146 BETWEEN WEST "D" STREET AND FAIRMONT PARKWAY. Mr. Lewis stated to the Commission that the Executive Summary provided in their packet was presented to City Council at their November 27, 1995, meeting. It is a summary of a plan that is intended to facilitate development along the SH 146 business corridor. After familiarizing the Commission on the subject, staff informed the Members that they would be soliciting input from property owners located within the targeted area. Once this is done, staff will then bring this item back before the Commission for further • consideration. VIII. STAFF REPORTS There were none. IX. W ters Planning and Zoning Commission Chairman • • • • Coronet Estates Subdivision Replat of Lot 5 • • Staff Report • Replat of Coronet Estates January 18, 1996 Requested For: Lot 5; Coronet Estates Subdivision Requested By: Danny Hays, Teresa Hays, and Linda Alvarez, property owners Location: 1200 Block of Robinson Road Zoning: R-1, Low Density Residential Background Lot 5 is a 4.1560 acre lot located in the Coronet Estates Subdivision. The applicants are, as illustrated on Exhibit A, proposing to divide the property into two equally sized lots. Each of the new lots will be used as a site for a single family home. AnalKsis: Under the terms of Section 4.07 of Development Ordinance 1444, a replat of all or a portion of a subdivision may be released for recordation and deemed valid and controlling when the following conditions have been satisfied: A. The plat has been signed and acknowledged by only the owners of the particular property which is being replatted or resubdivided. • The replat document has been properly prepared for signature by the owners of the property in question. B. The replat does not attempt to alter, amend, or remove any subdivision covenants or restrictions. • The replat will in no way impact or violate the deed restrictions currently adopted for the Coronet Estates Subdivision, nor will the replat abrogate any restrictions noted on the original Coronet Estates plat document. C. There is compliance with Sections 212.014 and 212.015 of the V.T.C.A. Local Government Codes. . • These are the sections of State Law dealing with platting and replatting. The provisions relevant to this request require that for • the previous five yeazs, zoning designation and deed restrictions limiting development to no more than two dwellings per lot have been in place. The City's R-1, Low Density Residential designation, which has been in place for well over five years, satisfies this requirement. As noted in the preceding section of this report, deed restrictions satisfy this requirement and are not at issue. D. The replat has been approved by the Commission after being prepazed and filed as though it were an original plat as specified in Section 4.04 of the Development Ordinance. • Staff finds the replat document to have been prepared in accordance with applicable ordinance requirements. There is nothing regazding the form or content of the plat document that would preclude approval by the Commission. E. All expenses incurred by the City or the subdivider in the replat process shall be borne by the subdivider, including the costs for notice of the public heazing. • The costs of public heazing have been tabulated and will be paid • by the applicants prior to the replat being released for recordation. The cost of notice for this hearing totals $42.06. A final issue to consider is payment by the applicant, of money in lieu of pazk land dedication. These fees were paid when the original Coronet Estates plat was approved by the City. This replat will, however, create a new residential homesite. Under the terms of Development Ordinance, Section 12.05, a $175 fee will be due to the City. The money will be escrowed and may only be spent to acquire or upgrade public park facilities. The money may only be spent within Pazk Zone V, the zone in which Coronet Estates is located. The applicants have been made aware of this fee and understand that it must be paid prior to the replat being released for recordation. Conclusion Staff finds the requested replat of Lot 5 of the Coronet Estates Subdivision to satisfy all applicable provisions of State Law and City Ordinance. We, therefore, recommend Commission approval with the condition that the replat not be released for recordation until all fees specified in this report have been paid. • • • • Fairmont Park East, Sections N-B & IV-C Preliminary and Final Plats Gray Enterprises January 9, 1996 Mrs. Betty Waters Chairman of Planning & Zoning Commission City of LaPorte P. O. Box 1115 LaPorte, Texas 77572 Dear Mrs. Waters: The City of LaPorte has previously approved Section IV, Fairmont Park East Subdivision. This original subdivision contained 252 lots. With the turn-down in the home building economy in the mid-1980's, we came back to Planning & Zoning and got approval to divide Section IV into Section IV, Phase A, 112 lots, Section IV, Phase B, 74 lots, and Section IV, Phase C, 66 lots. No changes were made to Section IV except doing a smaller number of lots at a time. Section IV, Phase A was completed in 1991. Since that time we have had four different home builders at different times in Phase A. During the late 1980's and early 1990's, many homes and lots were repossessed and sold at less than their replacement costs. This made the sale of new homes very difficult. At the present time we are ready to build additional new lots in Fairmont Park East, and request an update on the approval of Section IV, Phase B and Section IV, Phase C. No changes have been made in Section IV since our original approval. We also request a re-approval of the subdivision general plan. If you need any additional information, please let me know. Boz 638 707 Memorial Drive Biytowe, TX 7752E 713.4EE-3077 Faz: 713.428.1689 • • • Staff Report January 18, 1996 Fairmont Park East, Sections IV-B and IV-C Background Review and approval of the Fairmont Park East Sections IV-B and IV-C plats has been requested by the developer. Copies of each of these plats, respectively identified as Exhibits A and B, are attached and follow this report. Also attached and identified as Exhibit C is the November 8, 1991, Staff Report to the Commission regarding approval of subdivision Section IV-A. This report contains an overview history of Section IV as a whole. It should be noted that the original Section IV Final Plat was approved under the terms of a previous "Development" Ordinance (#705). This ordinance did not contain the one year "sunset" provisions for plat approvals that is found in Ordinance 1444. For this reason, the original Section IV approval is technically still valid. It is, as noted in the final paragraph of the 1991 Staff Report, on the advice of the City Attorney's office, that Sections IV-B and IV-C (as with IV-A in 1991) have been presented as separate plats. In evaluating the IV-B and IV-C submittals, staff has utilized the standards in effect at the time of the original 1983 Section IV approval. The Section IV-A Final Plat which was approved by the Commission on November 12, 1991, is nearing buildout. The developer is now ready to construct Sections IV-B and IV-C. Section IV-B will be comprised of 74 homesites (see Exhibit A). Development of this section will include extension of Fleetwood Drive to connect with West Main Street. Section IV-C will consist of 16 homesites (see Exhibit B). Although staff has chosen to address Sections IV-B and IV-C in a single report, they are separate submittals. The Commission must act on them as separate items. Each of these subdivision sections is designated as a Major Subdivision requiring both Preliminary and Final Plat approvals. Given the prior approvals granted to the original Section IV, there is no useful purpose to be served by requiring the applicant to submit separate Preliminary and Final Plat documents. The Commission should, however, note that any action taken on the plats will be as both preliminary and final documents. Analysis As noted, Sections IV-B and IV-C are "sub-sections" of a previously approved Final Plat. Staff has reviewed the original Section IV plat and supporting documentation. Sections IV-B and IV- Cwill conform exactly to the original Section IV specifications as approved by the City in 1983. There are certain specific elements of staff's review that we would like to bring to the Commission's attention. • Subdivision Covenants: Covenants were prepared, filed, and recorded for Section IV in its entirety. When Sections IV-B and IV-C are recorded, the existing • • • covenants will become valid and controlling. A copy of the Section IV covenants has been provided to the City Attorney's office for review. The covenants satisfy all applicable ordinance requirements. • Park Land Dedication: Park land dedicated in conjunction with the Section II plat satisfied ordinance requirements in effect in 1983. • Street Lighting: The applicant has submitted a copy of the plat to H.L.& P. for a street light layout and cost estimate to be approved by the City once it is completed. The developer will be required to pay construction cost and electrical service cost for one year. These monies will be deposited with the City in an escrow account until such time as construction installation is complete. This payment shall be made prior to the Final Plat document being released for recordation. Once complete, the City will make payment to H.L.& P. • Street Signs: The City of La Porte will, at the developer's expense, install street signage in the subdivision. The Public Works Department is currently preparing a cost estimate for installation of signage in Sections IV-B and IV-C. Release of the plats for recordation must not take place until the fees have been paid to the City. Conclusion The Commission is at this time being asked to approve the plats of Fairmont Park East, Sections IV-B and IV-C. As noted, the plats simply comprise portions of a larger plat that is already approved. Approving these plats will authorize the developer to proceed with construction of streets and utilities. When these infrastructure improvements are completed and accepted by the City, the plat, subject to the provisions noted below, may be released for recordation. Based on our review, staff recommends approval of the Fairmont Park East, Sections IV-B and IV-C plats with the provision that the plats not be released for recordation until fees for street lighting service and street signage installation have been paid to the City. Please note, Sections IV-B and IV-C should be acted upon separately and action on each should note that it is being considered as both a Preliminary and Final Plat. • • STAFF REPORT Y1/8/91 FAIRMONT PARK EAST SECTION 4, PHASE A The purpose of this meeting is to consider approval of the subdivision plat for Fairmont Park East, Section 4, Phase A. Attached is a chronological review of the status of the subdivision. 9/3/80 Original approval by City Council of Fairmont Park East Sections 1 through 4. 9/8/80 Original approval by Planning & Zoning Commission of Fairmont Park East Sections 1 through 4. 11 /3/83 Planning & Zoning Commission approval of Fairmont Park East Sections 3 & 4. After approval, Section 3 was constructed and recorded; Section 4 was not constructed or recorded. 9/19/89 City received revisions to the plat and construction plans that reflected phasing Section 4 into three (3) phases. Staff reviewed for completeness and approved. 10/19/89 Phase 4A presented to Planning & Zoning Commission for information only (see staff report attached). No action by the Planning & Zoning Commission requested. 10/18/91 Completion of water, sewer, storm sewer and street improvements; accepted by City (see letter dated 10/31 /91 to Mr. Gray). Since the originally approved Section 4 replat was never built or recorded, the City Attorney's office advises the Planning & Zoning Commission to approve as Section 4, Phase A to avoid future confusion with the approval in 1983. See letter dated 10/31 /91 to Mr. Gray regarding completion of remaining improvements prior to issuance of building permits. • EXHIBIT (~ • C~ Glen Meadows, Section VII Final Plat n u Staff Report January 18, 1996 • Glen Meadows, Section VII -Final Plat Background Glen Meadows, Section VII is an 87 lot addition to the Glen Meadows Subdivision (see Exhibit A). The Section VII Preliminary Plat was conditionally approved by the Planning and Zoning Commission on December 7, 1995. The conditions of approval are as follows: • A variance to front setbacks was granted for the lots located on the Glenbay Court cul-de-sac. Terms of the variance were to be noted on the Final Plat. This has been done. • Survey monument locations were to be noted on the Final Plat. Locations for three monuments have been noted on the original (reproducible) Final Plat document. • The Special Warranty Deed completing the Section II land transfer was to be filed and recorded with the Harris County Department of Deed Records. The warranty has been executed and filed for recordation. The City has, as of this date, not yet received a copy of the filed and recorded deed. • Analysis Staff, using Section 4.04 and Appendix D of the Development Ordinance as a guide, has reviewed the Section VII plat and found it to be in substantial compliance with applicable Development Ordinance requirements. The checklist attached to this report, as Exhibit B, details the items included in staff's review.. As noted on the checklist, there are certain items still pending. • The City's franchised utility companies have not yet returned letters approving location of easements within the subdivision. The location and sizing of easements is very typical for residential subdivisions. Staff does not anticipate the need to change the proposed easement layout. Should the Commission approve the Final Plat, it should be specified that the plat not be released for recordation prior to the City's receipt of all utility company letters. • Staff has verified that the warranty deed discussed in the background section of this report has been filed for recordation. Should the Commission approve the Final Plat, it should be specified that the plat not be released for recordation until the City has received a copy of the recorded deed. Additional items that have been considered as part of the review are as follows: • Subdivision Covenants: The covenants for Glen Meadows, Section VII, have been reviewed by the City Attorney's office and found to satisfy ordinance requirements. • Street Light The applicant has submitted a cop} the plat to H.L.& P. for a street light layout and cost estimate to be approved by the City once it is completed. Disapprove the Final Plat as filed. Approval of a Final Plat as filed and all accompanying documentation by the Commission, together with approval of Public Improvement Construction Documents by the Director shall result in issuance of a Development Authorization by the Department which permits the developer to begin construction of subdivision improvements. Disapproval of a Final Plat requires filing of a new Final Plat. A Final Plat shall not be recorded until executed by the Director and by the Commission. Before the Final Plat is executed, the developer shall follow the procedure provided for in the Development Ordinance, Section 4.04, and construct the proposed improvements according to the approved plans and specifications. The Planning and Zoning Commission, at its December 7, 1995, meeting, conditionally approved the subdivision's Preliminary Plat. The conditions of approval were as follows: • Responsibility for installation of sidewalks is to be specified by covenant. • It is to be specified by the covenants that the subdivision's detention pond is owned by the homeowner's association and that maintenance of the pond is the association's responsibility. • Survey monument locations are to be shown on the Final Plat. As noted on the attached checklist, there is one item still pending (see Exhibit B). There are also items that warrant additional discussion. • Utility Easements: As of the date on which this report is being written, not all of the City's franchise utilities have returned letters approving the location of easements within the subdivision. The location and sizing of easements is very typical for residential subdivisions. The utilities that have replied (H.L.& P., Prime Cable) have approved the easement plan. Staff does not anticipate a need to alter the proposed easement plan. Should the Commission approve the plat, it should be with the provision that the plat not be released for recordation prior to the City's receipt of all utility company letters. • ~ecial Approvals: Plans for the proposed Fairmont Parkway crossover and turn lanes have received Harris County approval. • Money in Lieu of Park Land: A total payment of $10, 850 (for Section I) is due to the City in lieu of park land dedication. This money will be placed in an escrow account and may only be utilized for the acquisition or improvement of public park land or facilities located in Park Zone I. This is the zone in which Pecan Crossing is located. These fees must be paid prior to the plat being released for recordation. Additional items that have been considered as part of the review are as follows: • Subdivision Covenants: The covenants for Pecan Crossing have been reviewed by the City Attorney's office and found to satisfy ordinance requirements. The • covenants do~ontain provisions requiring sidewalks~be installed as homes are constructed on lots. The covenants also specify that the detention pond is owned by the homeowner's association and that the association is responsible for maintenance of the pond. • Street Lighting: On 5/12/94, the City reviewed and approved a street lighting plan for Pecan Crossing, Section I. H.L.& P. has been authorized to construct 20 street lights within the subdivision. The applicant will be responsible for payment of one year's electrical service; the cost to be determined by H.L. & P. There will be no construction costs related to the construction installation of the lights. • Street Signs: The City of La Porte will, at the developer's expense, install street signage in the subdivision. The Public Works Department has prepared a cost estimate for Section I. Release of the Final Plat for recordation should not take place until the fee of $412.88 has been paid to the City. • Utility Construction Plans: These plans have been submitted, reviewed, and approved by staff. • Conclusion Development Ordinance, Section 4.04.B states that following review of the Final Plat, the Commission shall take one of the following actions: • Approve the Final Plat as filed. • Disapprove the Final Plat as filed. Approval of a Final Plat as filed and all accompanying documentation by the Commission, together with approval of Public Improvement Construction Documents by the Director shall result in issuance of a Development Authorization by the Department which permits the developer to begin construction of subdivision improvements. Disapproval of a Final Plat requires filing of a new Final Plat. A Final Plat shall not be recorded until executed by the Director and by the Commission. Before the Final Plat is executed, the developer shall follow the procedure provided for in the Development Ordinance, Section 4.04, and construct the proposed improvements according to the approved plans and specifications. These standards include regulations regarding • setbacks • fence height • use of barbed wire These standards are, in staff's opinion, reasonable and workable. To date, no input has been provided regarding any of these standards. An issue in which there does appear to be a need for more stringent regulation is that of acceptable fencing materials. Presently, the Zoning Ordinance does not provide a great deal of regulation or guidance in this area. Although, to date, the problem has only arisen occasionally. The City has received complaints regarding certain types of fencing; most notably the use of corrugated metal for residential fencing. Staff would recommend against creating a list of specific materials that can be utilized as fencing. This would be overly limiting. Two possible alternatives are as follows: • Prohibit the uses of corrugated material as fencing outside of Industrial Zones. • Establish a list of specific materials that can be used for construction of privacy or screening fences. There are other options for addressing this issue and staff would welcome input and suggestions from the Commission. The issue is, at this time, being presented to the Commission as a discussion item.
