HomeMy WebLinkAbout05-16-1996 Special Called Meeting and Public Hearing of the La Porte Planning and Zoning Commission (2)• MINUTES PLANNING & ZONING COMMISSION MEETING MAY 16, 1996 Members Present: Acting Chairman Howard Ebow, Commission Members Chuck Engelken, Mazgazet Anderson, Dottie Kaminski, Melton Wolters Members Absent: Chairman Betty Waters, Vice-Chairman Eugene Edmonds City Staff Present: Director of Planning Guy Rankin, City Attorney Knox Askins, Planning Secretary Peggy Lee I. CALL TO ORDER Meeting was called to order by Howard Ebow at 6:00 PM. II. APPROVE MINUTES OF THE APRIL 11, 1996, SPECIAL CALLED PUBLIC HEARING AND REGULAR MEETING. A motion was made by Maggie Anderson to approve the minutes. The motion was seconded by Chuck Engelken. All were in favor and the motion passed. VI. CONSIDER FINAL PLAT APPROVAL OF THE KROGER-FAIRMONT PARKWAY CENTER SUBDIVISION, WHICH IS TO BE LOCATED AT 1300 FAIRMONT PARKWAY Howazd Ebow asked if there was any objection to suspending the agenda for consideration of Item VI prior to opening the public hearing for Item III. No objection was presented. Mr. Rankin reported that the Kroger-Fairmont Pazkway Final Plat is in substantial compliance with applicable ordinance requirements. The applicants have satisfied all of the conditions of Preliminary Plat approval. Staff recommended withholding Final Plat recordation until all sites have been built out. A motion was made by Chuck Engelken to approve the Final Plat of the Kroger-Fairmont Pazkway Final Plat with the condition that recordation of the plat be withheld until all sites have been built out. The motion was seconded by Dottie Kaminski. All were in favor and the motion passed. III. OPEN PUBLIC HEARING TO CONSIDER ZONE CHANGE REQUEST #R96-003, WHICH HAS BEEN REQUESTED FOR THE PROPERTY LOCATED AT 201 N. 3RD STREET. THE APPLICANTS ARE SEEKING A ZONE CHANGE TO ALLOW FOR THE CONSTRUCTION OF MINIWAREHOUSES. Page 2 of 3 . • Planning & Zoning Commission Minutes of May 16, 1996 Mr. Ebow opened the Public Hearing at 6:05 PM. Mr. Rankin reported that Bryan and David Moore (applicants) have applied to rezone Lots 17-32; Block 64, from Low Density Residential to General Commercial. The property currently has four warehouses with concrete drives within a fenced area. The applicants would like to rezone the north side of the property. Mr. Rankin noted that the applicants would like to expand apre-existing, non-conforming use by building five new miniwarehouses on the northern twenty feet of Lot 24 and Lots 25-32. If approved, General Commercial zone will be extended into a residential single family neighborhood. Mr. Rankin noted that the applicants feel that the expansion of a non-conforming use would have no impact on the community. Mr. Rankin informed the Commission that the City had recently received a $250,000 grant from the Harris County Community Development Agency to build single family housing on the north side of the City. The recommendation from staff was to deny the rezoning request. A. PROPONENTS Peter Barnhart, on behalf of Byzance, Inc. , the company interested in purchasing the property, spoke in favor of the request. Jim Johnson, real estate broker representing Byzance, Inc., noted that the proposed use conforms well within a residential setting. David Moore, the applicant, stated the property was originally zoned Commercial. When the Zoning Ordinance was adopted, he failed to protest the zoning that was assigned to the property. Mr. Moore feels that renovation and expansion of the miniwarehouses would be an asset to the community. H. Carlos Smith spoke in favor of the request. B. OPPONENTS Councilman Deotis Gay asked the Commission not to grant the rezoning. Johnny Vann, of 216 N. 3rd, lives across the street from the property in question. Mr. Vann does not want the property to be commercial. He wants it to remain residential. Ernest Brown asked that the property remain residential. Page 3 of 3 • • Planning & Zoning Commission Minutes of May 16, 1996 IV. CLOSE PUBLIC HEARING. Howard Ebow closed the public heazing at 6:37 PM. V. CONSIDER RECOMMENDATION TO CITY COUNCIL FOR ZONE CHANGE REQUEST #R96-003. Mazgazet Anderson asked if the rezoning would interfere with the grant. Mr. Rankin said it would not, however, a rezoning would limit the amount of available residential space. Staff mailed meeting notices to twenty adjacent property owners. One reply was returned in favor of the request and four were returned opposed to the request. No notices were returned undeliverable. A motion was made by Chuck Engelken to deny Zone Change Request #R96-003. The motion was seconded by Melton Wolters. Commission Members Melton Wolters, Chuck Engelken, and Howard Ebow voted to deny the request. Commission Members Dottie Kaminski and Mazgazet Anderson voted in opposition. The motion passed. VII. STAFF REPORTS There were none. VII. ADJOURN A motion was made by Chuck Engelken to adjourn. The motion was seconded by Melton Wolters.
