CALL TO ORDER The meeting was called to order by Vice~~Chairman Edmonds at 6:12 PM. II. CONSIDER APPROVAL OF THE GENERAL PLAN FOR BONCOSKY TRUC~I~TG TERMINAL, A MINOR DEVELOPMENT LOCATED IN THE 1700 BLOCK OF SOUTH 16m STREET. Mr. Rankin presented staff's report. The Commission granted conditional approval of the General Plan at the Apn117`h meeting. An amended General Plan has now been submitted for approval. Staff reviewed the amended General Plan and recommended approval with conditions. A motion was made by Chuck Engelken to approve the General Plan for Boncosky Tnrcking Terminal with the following conditions: 1. Correct the required reference to #SCLJP 96-003 on the face of the plat. This reference should be as follows: On November 11, 1996, City Council considered Zone Change Request #R96-004 and Ordinance 1501-V was approved by Counc~ granting the P.U.D. with Special Conditional Use Permit #SCUP 96-003. 2. Delete condition number six since it was satisfied with the granting of #SCUP 96-003. There wr11 be eleven remaining conditions. 3. Amend General Plan as per checklist. 4. The original approved mylar of the General Plan, signed by the developer and planning consultant, shall be provided to the City for placement in the official files of the Planning & Zoning Commission. This is required prior to the approval of any subsequent plat being approved by the Commission. The motion was seconded by Jim Zoller. All were in favor and the motion passed. • • III. CONSIDER APPROVAL OF THE PRELIMINARY PLAT FOR BONCOSKY TRUCHING TERIVIINAL, PHASE I, PART OF A MINOR DEVELOPMENT LOCATED IN THE 1700 BLOCK OF SOL~i 16m STREET. Mr. Rankin presented staff's report. Staff has reviewed the Preliminary Plat for Boncosky Tnzcl~iag Terminal and recommended conditional approval. A motion was made by Melton Wolters to conditionally approve the Preliminary Plat for Boncosky Trucking Terminal subject to the following. 1. The original approved mylar of the General Plan, signed by the developer and planning consultant, shall be provided to the City for the official files of the Planning & Zoning Commission. 2. Water and sewer routing, construction and design shall be approved by the City. 3. The Final Plat shall reflect the property owner's signature authorizing the platting of the property. 4. Drainage plans shall be approved by Harris County and the City of La Porte. 5. Detention shall be .approved by the City. 6. Proposed landscaping shall be subject to approval by the Director of Plaiuzing. 7. The applicant is responsible for obtaining a zoning permit. 8. See items noted on the Preliminary Plat Checklist. 9. The declaration of P.U.D. covenants, conditions or restrictions or equivalent shall specify that deeds, leases or documents of conveyance affecting buildings, uses, parcels, and tracts shall subject said properties to the terms of said declaration. The property shall be bound by covenants. Specific teams of the covenants should include the following. - Clear responsibility for maintenance of landscaping, screening, fencing and undeveloped portions of property. - Clear responsibility for maintenance of all stormwates drainage systems located on site including swales, channels and detention facilities. - Clear statement specifying and limitixig the future use of undeveloped portions of the property. • - The funding mechanism to be used to provide for maintenance items specified by covenants. - A clear statement specifying the parties responsible for administration and enforcement of covenants. - The covenants shall be submitted for City review and comment. They wi11 not be released for recordation until such time as the City deems them to be satisfactory in terms of form and content. No building permit for the project shall be approved or released until the approved covenants have been filed for recordation with Harris County Deed Records. The motion was seconded by Chuck Engelken. All were in favor and the motion passed. IV. CONSIDER APPROVAL OF THE PRELIMINARY PLAT FOR SPENCER LANDING SUBDIVISION, SECTION 1, PART OF A MAJOR SUBDIVISION LOCATED IN THE 11,400-11,500 BLOCK OF SPENCER HIGHWAY. Mr. Rankin presented staff's report. The proposed Spencer Landing Subdivision is to be located on the north side of Spencer Hwy. in the 11,400-11,500 Block. The Commission granted approval of the General Plan during the April 17'~ meeting. Staff reviewed the Preliminary Plat for Section I of the Spencer Landing Subdivision and recommended conditional approval. A motion was made by Jim Zoller to conditionally approve the Preliminary Plat for Spencer Landing Subdivision, Section I, subject to the following. 1. Amend the Preliminary Plat as per checklist. 2. Delete reference to proposed 8" sanitary sewer in the utility easement of Block 2. 3. Amend plat to reflect a 100' diameter (50' radius) asphalt or paved turnaround which adjoins the cul-de-sac located on the north end of the subdivision. This temporary turnaround will remain in place until Section II is developed 4. The developer needs to provide the City with a mylar of the General Plan, signed by the developer and planning consultant, for the official files of the Commission. Bass, property owners Reauested For: Lot 3; Block 1; Denim & Diamonds Subdivision Location: 10,100 Block of North P Street Present Zoning: Low Density Residential (R-1) Background: Lot 3 is a 9.566 acre lot located in the Denim & Diamonds Subdivision. The applicants are, as illustrated on Exhibit A, proposing to divide the property into two lots. Lot 3-A will be a 9.2215 acre tract while Lot 3-B will be a 0.3444 acre tract. Each of the lots will be used as a site for a single family home. The original Denim & Diamonds Subdivision has been provided for reference and is identified as Exhibit B. Analysis: Under the terms of Section 4.07 of Development Ordinance1444, a replat of all or a portion of a subdivision may be released for recordation and deemed valid and controlling when the following conditions have been satisfied: • The replat does not attempt to alter, amend, or remove any subdivision covenants or restrictions. • There is compliance with Sections 212.014 and 212.015 of the V.T.C.A Local Government Codes. Lot 3 Replat -Denim & Di'~lfionds Subdivision • 5/15/97 - P & Z Meeting Page 2 of 3 • The replat has been approved by the Commission after being prepared and filed as though it were an original plat as specified in Section 4.04 of the Development Ordinance. • All expenses incurred by the City or the subdivider in the replat process shall be borne by the subdivider, including the cost for notice of public hearing. Section 5.02 of the Development Ordinance addresses the need for sidewalks, where required by the Comprehensive Plan. or by the Commission. Subdivision sidewalks are normally required by the Commission. However, a review of the October 21, 1993 staff report and meeting minutes for the original Denim & Diamonds indicate no sidewalks were required. This decision appears to be based on the fact that there are no interior streets in the subdivision and the rural nature of the area. Staff recommends the same consideration for the replat. Utilities are available this portion of N. P Street. Both lot 3-A and 3-B have frontage along N. P Street; therefore, utilities are available. Lot 3 Replat -Denim & Diamonds Subdivision 5/15/97 - P & Z Meeting Page 3 of 3 A final issue to consider is payment by the applicant, of money in lieu park land dedication. These fees were paid when the original Denim & Diamonds Subdivision plat was approved by the City in 1993. This replat will, however, create a new residential homesite. Under the terms of the Development Ordinance, Section 12.05, a $175.00 fee will be due to the City. The money will be escrowed and may only be spent to acquire or upgrade public park facilities. The money may be spent with Park Zone IV, the zone in which Denim & Diamonds Subdivision is located. The applicants have been made aware of this fee and understand that it must be paid prior to the replat being released for recordation. Conclusion: Staff find the requested replat of Lot 3, Block 1 of the Denim & Diamonds Subdivision to satisfy all applicable provisions of State Law and City Ordinance. The applicants are, as illustrated on Exhibit A, proposing to divide the property into two tracts. Tract 37-A will be a 2.568 acre tract while Lot 37- B will be a 0.7920 acre tract. Also, the applicants have provided a 16' common ingess and egress easement for the two tracts. Each of the tracts will be used as a site for a single family home. Analysis: Under the terms of Section 4.07 of Development Ordinance1444, a replat of all or a portion of a subdivision may be released for recordation and deemed valid and controlling when the following conditions have been satisfied: • The plat has been signed and acknowledged by only the owners of the particular property which is being replatted or resubdivided. Payment of $175.00 per lot, of money in lieu park land dedication is required by Section 12.02 of the Development Ordinance since there is more than one residential homesite proposed. However, in this case the owner wishes to sudivide his property to provide a family member with a 115' X 300' tract for the construction of a new single family home. No other home sites are proposed. The existing home on Tract 37-A and the proposed home on Tract 37-B will be accessible by a common 16'ingress/egress easement as well as a frontage on North D Street. Conclusion: Section 5.02 of the Development Ordinance addresses the need for sidewalks, where required by the Comprehensive Plan. or by the Commission. Subdivision sidewalks are normally required by the Commission. However, there are no interior streets in the subdivision and the area is rural in nature. Typically, sidewalks are not required in this situation. Staff recommends the same consideration for this replat. Utilities are available this portion ofN. D Street. Both tract 37-A and 37- B have frontage along N. D Street; therefore, utilities are available. Staff finds the requested replat of Outlots 37, La Porte Outlots satisfies most of the applicable provisions of State Law and City Ordinance. Partners, Ltd, property owner Reauested For: Block 1095; Parts of Lots 6, 7 and 27 and all of Lots 8 thru 26 and the adjacent alley; Town of La Porte Location: 1501 Fairmont Parkway Present Zoning: General Commercial (G.C.) Background: Block 1095 is part of the original plat of La Porte filed March 10, 1892, in Volume 58, Pg. 461, of the Harris County Map Records. The applicant has requested a Replat of the property in question for the purpose of consolidating the alley and flanking lots into two lots that will be identified as Lots 1 and 2. Lot 1 will be 0.5870 acres in size and Lot 2 will be 0.9798 acres in size. See Exhibit A Ordinance No. 96-2123 was approved by La Porte City council. This ordinance vacated, abandoned and permanently closed the alley located in Block 1095. No easement was retained. Analysis: Under the terms of Section 4.07 of Development Ordinance1444, a replat of all or a portion of a subdivision may be released for recordation and deemed valid and controlling when the following conditions have been satisfied: • The plat has been signed and acknowledged by only the owners of the particular property which is being replatted or resubdivided. This requvement has been satisf~d. • The replat does not attempt to alter, amend, or remove any subdivision covenants or restrictions. • There is compliance with Sections 212.014 and 212.015 of the V.T.C.A Local Government Codes. .................... _ ~,_ _ ,; • • Block 1095 Replat -Town of La Porte 5/15/97 - P & Z Meeting Page Z of 2 • The replat has been approved by the Commission after being prepared and filed as though it were an original plat as specified in Section 4.04 of the Development Ordinance. • All expenses incurred by the City or the subdivider in the replat process shall be borne by the subdivider, including the cost for notice of public hearing. Section 5.02 of the Development Ordinance addresses the need for sidewalks, where required by the Comprehensive Plan or by the Commission. For recent development in this area, the Commission chose to require sidewalks. In keeping with this standard, staff recommends a sidewalk requirement for this replat. Conclusion: Staff finds the requested replat of Block 1095, Town of La Porte.satisfies applicable provisions of State Law and City Ordinance. We, therefore, recommend Commission approval with the condition that the replat not be released for recordation until the following items have been satisfied: 1. All signatures required on the plat are obtained prior to formal recordation. 2. A recorded mylar is provided to the City. 3. Public hearing costs of $37.95 must be paid by the applicants. 4.
