The workshop was called to order by Chairperson Waters at 5:43 PM. II. ADJOURN WORKSHOP MEETING. The wori~shop was adjourned by Chairperson Waters at b:55 PM. III. CALL TO ORDER PUBLIC HEARING AND REGULAR MEETING. The regular meeting and public hearing were called to order by Chairperson Waters at 7:06 PM. IV. ADMINISTER OATH OF OFFICE TO NEWLY APPOINTED MEMBER, HAL LAWLER. Mr. Lawler was not present at the meeting. V. APPROVE MINU`fES OF THE JUNE 19,1997, WORKSHOP AND REGULAR MEETING. A motion was made by Dottie Kaminski to approve the minutes of June 19, 1997. The motion was seconded by Eugene Edmonds. All were in favor and the motion passed VI. CONSIDER APPROVAL OF THE FINAL PLAT FOR BONCOSKY TRUCKING TERMINAL, PHASE I, LOCATED AT 1706 SOUTH 16'H ST. Guy Rankin presented staff s report. The request for Final Plat approval was reviewed by staff and all conditions of Pttiliminary Plat approval have bees satisfied. Covenants (reviewed and approved and mylar have been received. Staff recommended Final Plat approval A motion was made by Sandie Staniszewski to approve the Final Plat. The motion was seconded by Dottie Ii:aminski. All were in favor and the motion passed • • Planning and Zoning Commission l~iinutes of July 17, 1997 Page 2 of 5 VII. CONSIDER APPROVAL OF THE PRELIlVIINARY PLAT FOR SUMMER WINDS SUBDIVISION. Mr. Rankin presented staff s report. The request for Preliminary Plat approval of Section I was reviewed by staff and they recommended approval. A motion was made by Eugene Edmonds to approve the Preliminary Plat for Section I of the Summer Winds Subdivision. The motion was seconded by Sandie Staniszewski. All were in favor and the motion passed John Armstrong noted he had reviewed the proposed covenants and restrictions. Their form is acceptable, however the content should include a provision for the ownership and maintenance of the subdivision's detention area. This should be done prior to Final Plat approval VIII. CONSIDER APPROVAL OF THE PRELIlVIINARY PLAT FOR THE BAYOU FOREST APRA'IIVIENTS, PHASE I. Mr. Rankin presented staff's report. The request for Preliminary Plat approval was reviewed by staff. Staff recommended approval, but noted it should be clear that the developer would be responsible for entering into a Utr7ity Emeasion Agreement with the City prior to Final Plat approval. A motion was made by Sandie Staniszewski to approve the Preliminary Plat for the Bayou Forest Apartments, Phase I. The motion was seconded by Eugene Edmonds. All were in favor and the motion passed IX. OPEN PUBLIC HEARINGS. A. DISCUSS ZONE CHANGE REQUEST #R97-003, WHICH HAS BEEN REQUESTED FOR TWO PROPERTIES LOCATED IN THE 9,000 BLOCK OF FAIRMONT PARKWAY. THE APPLICANT IS SEEKING A ZONE CHANGE FROM MID DENSITY RESIDENTIAL (R-2) TO PLANNED UNIT DEVELOPMENT (PUD). 1. PROPONENTS 2. DISCUSS SPECIAL CONDITIONAL USE PERMIT #SCU97-002, WHICH HAS BEEN REQUESTED FOR PROPERTY LOCATED IN THE 9,000 BLOCK OF FAIltMONT PARKWAY. THE APPLICAN'T' IS SEEKING TO DEVELOP A GOLF DRTVIlrtG RANGE W1THIN A PLANNED UNIT DEVELOPMENT ZONE. 1. PROPONENTS 2. OPPONENTS There were no discussions regarding this item. C. DISCUSS REPEAT OF LOTS 1-9 AND 17-32, AND TRS.10,11, AND 12 OF BLK 165, TOWN OF LA FORTE, WHICH IS LOCATED IN THE 900 BLOCK OF SOUTH 8m STREET. THE REPEAT HAS BEEN REQUESTED FOR THE PURPOSE OF RECONFIGURING THE LOTS INTO ONE TRACT OF LAND KNOWN AS I;INRESTRICTED RESERVE A. Mr. Rankin presented staff's report. The request for a Replat of Block 165 was reviewed by staff. The applica:rt requested the Replat for the purpose of consolidating flanking lots into one lot to be identified as Unrestricted Reserve A. The Replat would promote development of a 67 unit hotel/motel located between Little Cedar Bayou and South 8`~ Street. Notices were waded to six adjacent property owners. One response was received in favor of the Replat; none opposed Staff recommended approval of the Replat with several conditions. i. PROPONENTS Paul Mayeux, an architect for the project, addressed the Commission. An upscale motel is proposed for the site. They are working with the Harris County Flood Control District to meet their requirements for draining of the site. 2. OPPONENTS There were none. X. CLOSE PUBLIC HEARINGS. CONSIDER RECOMMENDATION TO CTf Y COUNCIL FOR ZONE CHANGE REQUEST #R97-003. No action was taken on this ixem Staff received a letter from Herbert L. ~~liams requesting #R97-003 be withdrawn from the agenda. XII. CONSIDER RECOMMENDATION TO CITY COUNCIL FOR SPECIAL CONDITIONAL USE PERMIT #SCU97-002. No action was taken on this item Special Conditional Use Permit #97-002 was requested in conjunction with Rezone Request #97-003, which has been withdrawn from the agenda. XIII. CONSIDER REPEAT OF LOTS 1-9 AND 17-32, AND TRS.10,11, AND 12 OF BLB 165, TOWN OF LA FORTE. A motion was made by Eugene Edmonds to approve the Replat of Lots 1-9 and 17- 32, and Trs.10,11, and 12 of B1k.165, Town of La Porte with the following conditions 1. All signatures required on the plat shall be obtained prior to formal recordation. 2. A recorded mylar shall be provided to the City. 3. Public Hearing costs of $37.95 shall be paid by the applicants. The motion was seconded by Sandie StanisLewski. All were in favor and the motion passed. XIV. STAFF REPORTS Mr. Raskin reviewed several items with the Commission. ^ June 30,1997, letter to Chairperson Waters from City Manager Robert T. Herrera regarding Planning & Zoning Commission review of subdivision marketing signs. ^ July 17,1997, letter from Assistant City Manager John Joerns regarding shipping containers in residential zones. Commission Members that were presern all agreed that shippng containers should not be allowed in residential zones. Mr. Rankin noted this would be enforced by staff when • • Planning and Zoning Commission Minutes of July 17, 1997 Page 5 of 5 dealing with citizens at the front counter. Mr. Armstrong also agrees with the Commission. It is his recollection that the Zoning Ordinance contained specific regulations prohibiting shipping containers in residential zones. He wrdl research further to see if this wording was lost due to a clerical error. A request by Melton Wolters for a description of the City's Capital Improvemern Program. Aa exhibit was distributed to the Commission and w~l be discussed during the nest meeting. Mr. Rankin talked about several commercial developments within the City. Babb, President, Hickham Industries, Inc. Requested For: A 29.0543 acre tract divided by a lot line, creating two tracts, located in Lot 9, F.A. Staashen Subdivision, Enoch Brinson Survey, A-5, Harris County, Texas. Location: 11518 Old La Porte Road Present Zoning: Light Industrial (L.I.) Background: The applicant, Eric Stivender, has requested a Replat of the property in question for the purpose of consolidating tract one and tract two of Lot 9. The applicant is simply requesting the removal of a lot line that divides the property into two individual developable portions of property. The applicant seeks to have the 29.0543 acres of property under one description. Analysis: Under the teens of Section 4.07 of Development Ordinance1444, a replat of all or a portion of a subdivision may be released for recordation and deemed valid and co~olling when the following conditions have been satisfied: • The plat has been signed and acknowledged by only the owners of the particular property that is being replatted or resubdivided. This requirement has been satisfied. • The replat does not attempt to alter, amend, or remove any subdivision covenanrts or restrictions. No subdivision covenants or restrictions are in effect. • There is compliance with Sections 212.014 and 212.015 of the V.T.C.A. Local Government Codes. These are the sections of State Law dealing with platting and replatting. These provisions have been satisfied. • The replat has been approved by the Commission after being prepared and filed as though it were an original plat as specified in Section 4.04 of the Development Ordinance. Staff finds the replat document does comply with all applicable ordinance requirements. Hickham Industries R lat ep Planning & Zoning Mtg. 8/21/97 Page 2 of 2 • All expenses incurred by the City or the subdivider in the replat process shall be borne by the subdivider, including the cost for notice of public hearing. The costs of public hearing have been tabulated and will be paid by the applicants prior to the replat being released for recordation. The cost of notice for this hearing totals $43.08. Conclusion: Staff finds the requested repiat of a 29.0543 acre tract located in Lot 9, of the F.A. Staashen Subdivision, satisfies applicable provisions of State Law and City Ordinance. We, therefore, recommend Commission approval with the condition that the replat not be released for recordation until the following items have been satisfied: All signatures required on the plat are obtained prior to formal recordation. 2. P. spa a, P ~ ~,r d tar. _ ~ ~• yj ~J r Ir Subdivision Marketing Signs • Ordinance No. 1501- AN ORDINANCE OF THE CITY OF LA PORTE, TEXAS AMENDING ORDINANCE NO. 1501, THE ZONING ORDINANCE OF THE CITY OF LA PORTE BY AMENDING SECTION 10-1006 - SUBDIVISION MARKETING SIGNS, PROVIDING FOR A PENALTY FOR VIOLATIONS; PROVIDING A SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. WHEREAS, on June 23, 1997, the City Council of the city of La Porte, Texas instructed the Planning and Zoning Commission to provide recommendations regarding the use, placement, number and permitting of temporary advertising signs on weekends only within the city of LaPorte. WHEREAS, discussion of concerns for the marketing of residential homes in La Porte by the Planning and Zoning Commission the following recommendations were made to City Council: Section 10-1006 Subdivision Marketing Signs 1. For the purpose of marketing a recorded subdivision, one (1) on premise freestanding sign of not more than one hundred fifty (150) squaze feet for each road abutting the respective subdivision shall be permitted, provided that such sign shall not be placed within any required yard nor within twenty-five (25) feet of any property line abutting a street or road right-of--way, and further provided that such sign shall not exceed twenty (20) feet in height. 2. For the purpose of marketing a recorded subdivision, one (1) off premise sign of not more than one hundred fifty (150) square feet may be permitted for each recorded subdivision in any zoning district. Such sign shall not be placed within twenty-five (25) feet of any property line and shall not exceed twenty (20) feet in height. The permit for such sign shall expire, unless renewed, two (2) years after the date of issuance of such permit, and provided that each request for permit shall be accompanied by a license and permit fee posted by the respective sign hanger in the amount of three hundred (300.00) dollars for the purpose of ensuring proper location, maintenance, and removal of the respective sign. 3. For the purpose of mazketing a recorded subdivision within the jurisdiction of the city of La Porte, temporary signs advertising the sale of said residential property shall be: A. Limited in number per site to , and a maximum of within the city. B. Limited to key intersections as listed below: 1. Highway 146 North City Limits 2. Barbours Cut 3. Spencer/Main 4. Fairmont Park 5. Worton Weems 6. McCabe 7. South City Limits 8. Highway 225 Underwood 9. Sens Road 10. Spencer Sens Road 11. Farrington 12. Underwood 13. Valley Brook 14. Driftwood 15. Luella 16. Fairmont Pkwy. Luella 17. Underwood 18. Farrington 19. Driftwood 20. Park 21. South Broadway Fairmont Pkwy. 22. South City Limits 23. McCabe 24. Worton Weems 25. Main 26. North L. Sens Road 27. Underwood 28. Bay Area Blvd. Fairmont Pkwy. 29. South Broadway Shady Lane C. Signs must be professionally made. D. Signs will be placed and removed by a bonded, licensed professional company who has been permitted by the city of La Porte. E. Temporary subdivision marketing signs shall be placed between the hours of 5:00 p.m. on Friday unti17:00 p.m. on the following Sunday. The city may remove and destroy any and all signs remaining after that time. The permit and bond of the professional company will be automatically forfeited. F. The signs shall not be located within five (5) feet of the edge of the pavement nor shall they be placed within twenty-five (25) feet of a driveway. G. No balloons, banners or streamers may be attached to signs. H. Prior to placing temporary subdivision marketing signs, the licensed professional shall post a bond in the amount of and secure a permit. 2
