CALL TO ORDER PUBLIC HEARING AND REGULAR MEETING. The meeting was called to order by Chairperson Waters at 6:05 PM. II. APPROVE MINUTES OF .THE NOVEMBER 20, 1997 REGULAR MEETING. A motion was made by Melton Wolters to approve the minutes. The motion was seconded by Sandie Staniszewski. All were in favor and the motion passed. III. OPEN PUBLIC HEARING Chairperson Waters opened the Public Hearing at 6:05 PM. Mr. Rankin stated that the general purpose of the ordinance is to regulate the placement, construction, and modification of towers, antennas, support structures, and telecommunications facilities. Specifically, to regulate the location of towers and telecommunication facilities within the City, to protect residential areas and land uses from potential adverse impact of towers and telecommunication facilities, to minimize adverse visual impact of towers and telecommunication facilities through careful design, siting, landscaping, and innovative camouflage techniques, to promote and encourage shared use/collocation of towers and antenna support structures, to promote and encourage shared utilization of technological designs that will either eliminate or reduce the need for erection of new tower structures, to avoid potential damage to property caused by towers and telecommunication facilities, and to ensure that towers and telecommunication facilities are compatible with the surrounding land uses. This Ordinance provides for the towers to be allowed in the Heavy Industrial zoning district, as well as conditional is Light Industrial and Business Industrial zoning districts. CLOSE PUBLIC HEARING • Chairperson Waters closed the Public Hearing at 6:10 PM. V. CONSIDER A RECOMMENDATION TO CITY COUNCIL REGARDING AMENDMENTS TO CHAPTER 106 OF THE CODE OF ORDINANCES REGARDING TELECOMMUNICATION TOWERS, ANTENNAS, SUPPORT STRUCTURES AND TELECOMMUNICATION FACILITIES. A motion was made by Sandie Staniszewski to recommend City Council approval of the amendments to Chapter 106 of the Code of Ordinances regarding telecommunication towers, antennas, support structures and telecommunication facilities. The motion was seconded by Melton Wolters. All were in favor and the motion passed. VI. PRESENTATION BY DEVELOPER FOR PROPOSED TEXAS IMPORT- EXPORT PARK. Tom Northrup introduced himself and then introduced Doyle Toups, with Grubb & Ellis. Mr. Toups noted he was employed by the property owner, Stuart Haynsworth, to market the property. Attempts were made to re-design the development to satisfy the needs of the City and a major developer. Several issues have now been addressed, such as ingress/egress, utilities, drainage, detention and rail transportation. A problem is recognized with the Union Pacific Railroad's crossing at Fairmont Parkway and attempts are being made to design a project that will not have an adverse affect on the situation. Mr. Toups explained that users have been identified for the top portion of the property, however a zone change to HI will be necessary to facilitate the tenants. One of the prospective tenants is A&R Transport (also represented by Mr. Toups). The initial development will create a synergetic atmosphere attracting retail, commercial, and office businesses. • • Planning and Zoning Commission Minutes of February 19, 1998 Page 3 of 6 Working on the project with Mr. Toups are a land planner, civil engineer and a rail consultant. Mr. Toups introduced the rail consultant, Mr. Dick Schieffelbein. Mr. Schieffelbein explained that the impact of this project on the railroad crossing would be relatively minor. Mr. Schieffelbein wanted to explain the difference between Strang Yard and the industrial lead that this project will be, as well as, explain what is likely to happen when Union Pacific gets its congestion problems corrected and diverted traffic returns. Mr. Schieffelbein noted that the Federal Railroad Administration maintains an inventory of all railroad grade crossings in the country and the data held on this crossing indicates there are 25,590 daily vehicles passing over the crossing. The rail traffic is 14 trains, broken evenly, 7 during the day and 7 during night. Overall, this intersection has high vehicular traffic and relatively low train traffic. The operating speed of the crossing is 20 mph. The crossing is not considered to be unsafe, with only one accident reported during the last five years. Mr. Schieffelbein explained that the line that comes out of Strang Yard crossing Fairmont Parkway stub ends in Seabrook. The Bayport Complex generates approximately 400 cars of product daily, equating to 400 empty cars coming into the complex to be loaded and 400 loaded cars leaving the complex. The average train length is between 55-60 cars. At 20 mph, a 60-car train would occupy the Fairmont Crossing for two minutes, depending on the speed of the train. The effect of adding the proposed Texas Export-Import Center would be approximately 25 additional cars per day. At 70 tons per carload, the project would handle 1750 tons of product. Twenty-five additional loads would not be enough for Union Pacific to add an additional crew, meaning an additional train would not be crossing Fairmont Parkway. In total 25 additional cars would add about 55 seconds to the time it takes for a train to cross Fairmont. Mr. Schieffelbein added that the portion of the project located behind the warehouses, next to the Union Pacific Railroad Track are some tracks that could serve this project. The use of four of those tracks would probably be offered to Union Pacific allowing them to preposition empty cars for loading all at once at non-peak hours instead of throughout the day. Mr. Schieffelbein explained that this project is nothing like Strang Yard. Strang Yard switches over 1000 cars daily and this project, including loads and empties would only amount to approximately 50. Strang switches 24 hrs. per day, the work in this facility would only take one hour per day. Strang is a hump yard. This project will only have an industrial lead type of switching operation. • • Planning and Zoning Commission Minutes of February 19, 1998 Page 4 of 6 Mr. Toups introduced Stuart Haynsworth. Mr. Haynsworth, general partner of the property owners. The land was purchased approximately 30 years ago and was not located in the City of La Porte. During annexation proceedings, an agreement was made between the property owners and City officials, that if they did not oppose the annexation proceedings, they could be assured that they would have sewer and water facilities within 3 years and zoned Heavy Industry. Neither has happened. Mr. Haynsworth assured the Commission that they are committed to cooperating fully with the City. The development is anticipated to be a first class operation with restrictions on the type of construction and the activities that will take place. Mr. Northrup addressed the Commission. Mr. Northrup appreciates the help he has received from the City. He noted that Mr. Schieffelbein works for Wood Harbor Associates consulting a great deal with the Port Authority. Mr. Northrup added that figures obtained from Harris County and the TXDOT do not indicate a great deal of justification for construction of a grade separation on Fairmont Parkway. The proposed interchange on SH 146 at Wharton Weems Blvd. will help out. This project has been designed with land use compatibility in mind. They have looked at bringing Powell Rd. into the intersection of the freeway at Wharton Weems, as a collector road (in accordance with the Comprehensive Plan). A landscaped bermed buffer area would be against the west side of Powell Rd. The buildings would be approximately 200,000 sq. ft. with 20 ft. roofs and serve as buffers from the rail operation in the back. Utilities can be worked out by the developer and the City. Drainage is in place to some extent and detention will be required. The drainage facility would be widened to include drainage, detention, and probably trail systems. Melton Wolters asked Mr. Schieffelbein where he got his railroad statistics. Mr. Schieffelbein answered he got them from the nationwide grade crossing inventory of the Federal Railroad Administration (1996 data). Ms. Staniszewski asked why it would behoove the City to accept their proposal since her concerns are the same as when this project was first presented to the Commission. Mr. Schieffelbein answered that the one thing that is different this time is that tracks will be made available to Union Pacific so that it could preposition cars during off-peak hours. Mr. Northrup added that since the new bridge has been completed, there has been a 30-40% increase in vehicular traffic on SH 146. Regardless of whether this project happens or not, it should be a long or short-term goal of the City to have an interchange built across the Fairmont rail crossing. One of Mr. Northrup's projects he is currently working on is 2100 acres in size and called Glenlock Farms just south of Tomball in Houston's ETJ on • Planning and Zoning Commission Minutes of February 19, 1998 Page 5 of 6 Spring Cypress Road. The project is located next to a railroad track. On the west side of the property will be an industrial project and the east side will be residential. Mr. Northrup noted that they have cut the project rail size down on the north side from 60 rails to a maximum of 22 and specific proposals have been provided for the landscaping. Mr. Jetty stated that Texas Export-Import Center indicates a logistic operation. Will this deal predominately with the petrochemical products in this area or will there be container cargo or imports-exports through Barbour's Cut, the Port of Houston or the Port of Galveston? Mr. Northrup responded there would be containerized cargo consisting of plastic pellets produced locally, brought to their facility, then transported to Barbour's Cut. Mr. Haynsworth asked the Commission to keep in mind that they have not had any interest at all in this area from any homebuilders since 1983. They are currently paying $16,000 per year in taxes. He anticipates that this development could generate approximately $100 million in taxes plus the jobs that will be created. Chairperson Waters mentioned they had previously told the Commission they would only be handling pelletized plastic. That was confirmed. Mr. Rankin asked Mr. Schieffelbein if he worked for the Port of Houston. He answered that he was a consultant for the Port of Houston. Mr. Schieffelbein added that when the Port Authority decided to support the Union Pacific merger, they reached an agreement with Union Pacific that the Port Authority would be able to build its own track from Deer Park to Barbour's Cut and from Strang down to Bayport, along this right-of-way. In that agreement, Union Pacific made it clear that the Port Authority would not have access to any shippers and could use the line only to reach the Port Authority's property at Bayport. It is possible that in the future we will see the Port's locomotives go by but you won't see them stopping. Mr. Rankin asked when the agreement expired. Mr. Schieffelbein's answer was that there was no expiration date. Mr. Lawler asked, if approved, how long it would take for the rail facility to be operational? It would take approximately one year. For the record, Mr. Rankin added that the statement made earlier that the average train crossing Fairmont Parkway should take approximately two minutes is untrue. On a regular basis, trains take upwards of 17 minutes to cross. • Planning and Zoning Commission Minutes of February 19, 1998 Page 6 of 6 Mr. Schieffelbein offered to provide the City with the name of a contact person that could be called to complain about the lengthy time for train crossings. Analysis: By approval of the Section II Final Plat, payment of the $15,575.00 remaining balance of money in lieu of parkland fees will need to be made. As noted in previous reports, this figure was calculated on a $175.00 per lot basis and the total for the entire subdivision was $24,500.00. With the development of Section I, payment of the original $8,925.00 fee was made by the developer. Upon submittal of the Section II Final Plat, the developer will be responsible for providing covenants or deed restrictions.. Specific terms of the covenants should include the following: • Clear responsibility for maintenance of landscaping, screening, fencing and undeveloped portions of property. • Clear responsibility for maintenance of all stormwater drainage systems located on site including swales, channels and detention facilities. • The funding mechanism to be used to provide for maintenance items specified by covenants. • A clear statement specifying the parties responsible for administration and enforcement of convenants. • Spencer Landing, S. They should not be released for recordation until such time as the City deems them to be satisfactory in terms of form and content. No building permit for the project should be approved or released until the approved covenants have been filed for recordation with Harris County Deed Records. Conclusion: Staff has reviewed the Spencer Landing, Section II Preliminary Plat and found it complies with most of the requirements of the Development Ordinance. A copy of the Section II Preliminary Plat Checklist follows this report. Commission approval would authorize the developer to file the Final ' Plat. Staffrecommends that the Preliminary Plat of Section II be "Approved" with the condition that the developer comply with the list of deficient items shown on the checklist, prior to the submission of the Final Plat. • Amend the Preliminary Plat as per checklist. Jones Survey, Abstract 482, La Porte, Harris County, Texas. Location: 2627 Underwood Road Present Zoning: General Commercial (G.C.) Background: This 1.741 acre tract is part of the W. J. Payne Subdivision as recorded in Volume 384, Page 161 of the Hams County Map Records. The applicant is proposing a development and has requested a replat of the property to establish his lot of record. The lot will be identified as Block One of the GRY Subdivision. To ensure access to utilities and fire protection, utility easement has been incorporated into the lot. See Exhibit A Analysis: Under the terms of Section 4.07 of Development Ordinance1444, a replat of all or a portion of a subdivision may be released for recordation and deemed valid and controlling when the following conditions have been satisfied: • The plat has been signed and acknowledged by only the owners of the particular property, which is being replatted or resubdivided. This',requirement has lieen satisfied. • The replat does not attempt to alter, amend, or remove any subdivision covenants or restrictions. __ __ No subdivision covenants or'restrictions are'in effect. There is compliance with Sections 212.014 and 212.01 of the V.T.C.A Local Government Codes. These are the sections of State Law dealing; with platting and replatting. M. Jones Survey, Abstract 481, La Porte, Harris County, Texas. Location: 10815 and 10817 Fairmont Parkway Present Zoning: General Commercial (G.C.) Background: This 0.8302 acre tract was filed with Fairmont Park East, Section I as recorded in Volume 306, Page 69 of the Harris County Map Records. The applicants are, as illustrated on Exhibit A, proposing to divide the property into two equal lots with a common area provided for access. The lots will be identified as Lot 1 and 2 of Block One of the FT & MC Subdivision. Analysis: Under the terms of Section 4.07 of Development Ordinance1444, a replat of all or a portion of a subdivision may be released for recordation and deemed valid and controlling when the following conditions have been satisfied: • The plat has been signed and acknowledged by only the owners of the particular property, which is being replatted or resubdivided.
