CALL TO ORDER. The meeting was called to order by Chairperson Waters at 6:05 PM. II. APPROVE MINUTES OF THE FEBRUARY 19, 1998 REGULAR MEETING AND PUBLIC HEARING. A motion was made by Melton Wolters to approve the minutes. The motion was seconded by Sandie Staniszewski. All were in favor and the motion passed. III. CONSIDER APPROVAL OF THE PRELIMINARY PLAT FOR SPENCER LANDING SUBDIVISION, SECTION 11. Mr. Rankin stated that Spencer Landing Subdivision is located in the 11,400-11,500 Block of Spencer Highway. Section I has been completed and accepted by the City. Section II is the final phase of this subdivision. Staff reviewed the Preliminary Plat and found it to be in order. Approval of the Preliminary Plat was recommended by staff. A motion was made by Sandie Staniszewski to approve the Preliminary Plat for Spencer Landing, Section II. The motion was seconded by Jim Zoller. All were in favor and the motion passed. IV. OPEN PUBLIC HEARINGS Chairperson Waters opened the Public Hearings at 6:10 PM. A. DISCUSS REPLAT FOR A PART OF LOT 10, BLOCK 2, W.J. PAYNE SUBDIVISION WHICH IS ALSO KNOWN AS 2627 UNDERWOOD ROAD. THE REPLAT HAS BEEN REQUESTED TO ESTABLISH THE DEVELOPED PROPERTY AS BLOCK 1, GRY SUBDIVISION. Mr. Rankin stated that the property in question is located on Underwood Road just north of Gringo's Restaurant. The owner of Planning and Zoning Aission Minutes of March 19, 1998 Page 2 of 5 Gringo's is planning to construct a strip center over two pieces of property and has requested the replat to establish one lot of record. Three notices were mailed to adjacent property owners. No responses were received. Staff reviewed the replat request for part of Lot 10, Block 2, W.J. Payne Subdivision and found it to be in order. Approval of the replat was recommended by staff. Mr. Jetty asked if the property in question is the same that Gringo's is now using for overflow parking. Mr. Rankin confirmed. 1. PROPONENTS There were none. 2. OPPONENTS There were none. B. DISCUSS REPLAT FOR A PART OF COMMERCIAL RESERVE "E" NOT PART OF SUBDIVISION", FAIRMONT PARK EAST, SECTION I WHICH IS ALSO KNOWN AS 10815 AND 10817 FAIRMONT PARKWAY. THE REPLAT HAS BEEN REQUESTED TO ESTABLISH THE DEVELOPED PROPERTY AS LOTS 1 AND 2 WITH COMMON AREA, BLOCK 1, FT & MC SUBDIVISION. Mr. Rankin noted that 15 notices were mailed to adjacent property owners. One reply was received in favor of the replat; none opposed, and two returned undeliverable. Mr. Rankin stated that Mark Woods and Frank Fidelibus have requested the replat for a 0.8302 acre tract of land located at 10815 and 10817 Fairmont Parkway. Staffs review of the replat found it to be in order. Staff recommended approval. V. CLOSE PUBLIC HEARING Chairperson Waters closed the Public Hearings at 6:15 PM. A motion was made by Sandie Staniszewski to approve the Replat of Part of Lot 10, Block 2, W.J. Payne Subdivision with the condition that it not be released for recordation until the following items have been satisfied. 1. As required by Section 4.07, language on the plat shall be amended as follows: a. Delete paragraph (4) — does not apply. b. Delete paragraph (5) — does not apply. C. Show name of secretary in acknowledgement execution. d. Add name of county and amend language of notary acknowledgement to comply with Appendix F, Enclosure 2, Pg. 3. e. Add name of county and amend language of lienholders statement to comply with Appendix D, Enclosure 2, Pg. 10. f. Add Harris County Clerk Filing Statement per Appendix D, Enclosure 6, Pg. 15. g. Correct county clerk's name in recorded map return agreement. 2. All signatures required on the plat shall be obtained prior to formal recordation. 3. The applicant shall pay a $50.00 fee to the City for the county filing of the 24" x 36" plat. 4. The applicant shall pay public hearing costs of $36.80. 5. Include a statement requiring the installation of a sidewalk upon development of the lot. - The motion was seconded by Melton Wolters. All were in favor and the motion passed. VII. CONSIDER REPLAT OF PART OF COMMERCIAL RESERVE "E" "NOT PART OF SUBDIVISION", FAIRMONT PARK EAST, SECTION I. A motion was made by Melton Wolters to approve the Replat of Commercial Reserve "E" "Not Part of Subdivision", Fairmont Park East, Section I, with the condition that it not be released for recordation until the following items have been satisfied. Delete paragraph (5) — does not apply. C. Add the name of the county on the notary acknowledgements. d. Add the Recorded Map Agreement Certificate per Appendix D, Enclosure 7, Pg. 16. 2. All signatures required on the plat shall be obtained prior to formal recordation. 3. The applicant shall pay a $50.00 fee to the City for the county filing of the 24" x 36" plat. 4. The applicant shall pay public hearing cost of $41.40. The motion was seconded by Jim Zoller. All were in favor and the motion passed. VIII. STAFF REPORTS Mr. Rankin informed the Commission that Friday, March 20th is the deadline for consultants to submit their Request for Qualifications for the upcoming Comprehensive Plan update. Plans have been approved for an apartment complex located at the corner of Spencer and Luella. The project will be Grade A with 134 units. Pecan Crossing, Section III will soon be submitted. Spencer Landing Section I is underway. Eddie Gray has submitted a sketched General Plan for the east side of Driftwood in Fairmont Park. Several major commercial projects are underway. An updated New Commercial Business List for 1997 and to date will be distributed at the next meeting. The in fill homebuilders are doing well. A lawsuit has been brought against the City of La Porte regarding a Flood Variance. Planning and Zoning Commission Minutes of March 19, 1998 Page 5 of 5 IX. Jones survey, A-482, City of La Porte Requested BX: Greg Snider, Snider Transmission Service, property owner Requested For: 28,385 square feet of land of the W. Jones survey, A-482, City of La Porte, Harris County, Texas. Location: Farrington and Fairmont Parkway Present Zoning: General Commercial (G.C.) Background: The applicant is proposing a development and has requested a replat of the property to establish his lot of record. The lot will be identified as Block One (0.6516) acres of land out of the W.M. Jones Survey. Analysis: Under the terms of Section 4.07 of Development Ordinance1444, a replat of all or a portion of a subdivision may be released for recordation and deemed valid and controlling when the following conditions have been satisfied: • The plat has been signed and acknowledged by only the owners of the particular property, which is being replatted or resubdivided. This requirement has been satisfied. • The replat does not attempt to alter, amend, or remove any subdivision covenants or restrictions. No subdivision covenants or restrictions are in effect. • There is compliance with Sections 212.014 and 212.015 of the V.T.C.A. Local Government Codes. These are the sections of State Law dealing with platting and replatting. These provisions have been satisfied. • The replat has been approved by the Commission after being prepared and filed as though it were an original plat as specified in Section 4.04 of the Development Ordinance. Staff finds the replat document meets most of the applicable ordinance requirements. However the required changes listed in this report would not preclude approval by the Commission. INC. 0 Pecan Crossing, Section Three Preliminary Plat Staff Report Pecan Crossing, Section III April 16,1998 Preliminary -.Plat Pecan Crossing is a residential subdivision located on the north side of Fairmont Parkway, approximately 1,800 feet west of Underwood Road. A General Plan of the subdivision was approved by the Commission on February 17, 1994. (See Map Exhibit A). Section III, which is being considered for preliminary plat approval at this time, is a forty-six (46) lot section of the overall subdivision. Referring to Appendix D of Development Ordinance No. 1444, Staff has reviewed the Preliminary Plat (See Map Exhibit B) and found it to be deficient in areas. A checklist detailing the items reviewed is attached and follows this report. An additional consideration is maintenance access to the subdivision's detention pond. The original submittal for the Preliminary Plat of Section I included a reserve dedicated to use as a private subdivision recreational area. This area was subsequently reconfigured as two lots for additional homesites. This eliminated the original maintenance access path to Spring Gully and the detention pond. This access is important for two reasons: Unless an additional easement is dedicated by a subsequent section plat, the Spring Gully drainage right-of-way will provide the only access to the subdivision's detention pond. In the future, the Spring Gully right-of-way may be included in a proposed system of pedestrian paths that will connect various recreational facilities. While these issues do not necessarily need resolution in conjunction with the Section III approval, they will ultimately need to be addressed. Staff feels this is an appropriate time to address this matter. Staffs recommendation is to obtain a fifteen foot (15') right-of-way designated for access and maintenance of the detention pond and the fifteen foot (15') public drainage easement. This could be done as part of Section IV and in alignment with the Choctaw Drive street right-of-way. Finally, staff would note that Section 5.02 of the Development Ordinance empowers the Commission to require pedestrian sidewalks when it feels their inclusion will serve the public interest. Staff would recommend the inclusion of sidewalks within the Pecan Crossing Subdivision. Responsibility for construction of the walks should be specified by covenant. Development Ordinance, Section 4.03.B requires that "following review of the Preliminary Plat, the Commission shall ... take one of the following actions." 1. Approve the Preliminary Plat as filed; 2. Conditionally approve the Preliminary Plat as filed, provided, the reasons are stated in writing and a copy of the statement is signed by the Chairman of the Planning Commission. 3. Disapprove the Preliminary Plat as filed, provided, the reasons for such disapproval are stated in writing and a copy of the statement is signed by the Chairman of the Planning Commission. The Preliminary Plat does comply with applicable ordinance requirements. Staff therefore, recommends approval of Pecan Crossing, Section III. However, before a positive recommendation of Final Plat approval the following items must be addressed. 1. Reference of detention pond ownership and maintenance by the Homeowner's Association shall be noted on the final plat. 2. An HL.&P street light layout plan and letter stating costs from HL&P is provided for review by the City. 3. Payment for street lighting costs should be made to the City. 4. HLAP easements should be shown on the Preliminary Plat. 5. The City receives approval from the four (4) franchise utilities regarding the size and location of the proposed utility easements. 6. Payment to the City of the street sign installation costs. Sign locations and costs shall be determined by the City's Public Works Department. 7. A total payment of $8,050 is due to the City in lieu of parkland dedication. This money will be placed in an escrow account and only be used for the acquisition or improvements of public park land or facilities located in Park Zone I, the zone in which Pecan Crossing is located. 8. Survey monument tie-in and control monuments should be shown on the Preliminary Plat. 9. Title certificate document is submitted for review by the City. 10. Subdivision construction plan review is completed by the City and any changes are made prior to the submittal of a revised Final Plat. 11. Subdivision covenants/deed restrictions for Section III is provided to the City for review and approval. Present Zoning: High Density Residential (R-3) Requested Use: Residential Subdivision (R-1) Background: The proposed Fairmont Park East addition is a major subdivision to be located on the east side of Driftwood, located between Spencer and Fairmont Parkway. (See Exhibit A) The General Plan includes three phases and five sections, three residential sections and two commercial sections. The general plan consist of two commercial reserves, 204 residential lots on 12 blocks totaling 77.16 acres. Analysis: The developer of Fairmont Park East sections 5, 6, 7, 8, and 9 has met the requirements of the Development Ordinance. Although, there have been several amendments to the proposed plan. The developer has agreed to construct the detention requirements during phase one (section six) of the development. Moreover, the developer has agreed to develop a multipurpose detention pond, which will include a jogging trail and soccer field. This amenity is to maintained by the homeowners association and does not preclude the developer from the $35,350 of parkland fees associated with this project.
