CALL TO ORDER. The meeting was called to order by Chairperson Waters at 6:00 PM. II. APPROVE MINUTES OF THE MARCH 19, 1998 REGULAR MEETING AND PUBLIC HEARING. A motion was made by Melton Wolters to approve the minutes. The motion was seconded by Sandie Staniszewski. All were in favor and the motion passed. III. OPEN PUBLIC HEARINGS Chairperson Waters opened the Public Hearings at 6:01 PM. A. DISCUSS REPLAT FOR A 0.6516 ACRE TRACT BEING PART OF COMMERCIAL RESERVE TRACT 4 OF TRACT 31 OF THE W. JONES SURVEY, A-482, WHICH IS ALSO KNOWN AS 10335 FAIRMONT PARKWAY. THE REPLAT HAS BEEN REQUESTED TO ESTABLISH THE DEVELOPED PROPERTY AS ONE UNRESTRICTED RESERVE IN BLOCK ONE OF THE SNIDER SUBDIVISION. Mr. Rankin stated that the replat was requested by Greg Snider, of Snider Transmission, for a 0.6512 acre tract of land out of the W.M. Jones Survey. Three public notices were mailed to adjacent property owners. No responses were received by staff. Staff reviewed the replat request and recommended Commission approval. Mr. Snider told the Commission that he planned to open a transmission repair business, similar to the ones he already has in Texas City, Santa Fe, Alvin, and League City. 2. OPPONENTS There were none. B. DISCUSS REPLAT FOR A 0.8453 ACRE TRACT WHICH IS PART OF COMMERCIAL RESERVE "E" "NOT PART OF SUBDIVISION", FAIRMONT PARK EAST, SECTION I, WHICH IS ALSO KNOWN AS 10819 FAIRMONT PARKWAY. THE REPLAT HAS BEEN REQUESTED TO ESTABLISH THE DEVELOPED PROPERTY AS ONE LOT IN THE ISH SUBDIVISION. Mr. Rankin reported that Abe Messing, owner of the property in question, requested the replat for 36,819 square feet of land out of the W. Jones Survey, A-482, Staffs review of the replat found it to be in order. Staff recommended approval. Mr. Rankin noted that 14 public notices were mailed to adjacent property owners. No responses were received in favor of the replat, none opposed, and two were returned undeliverable. 1. PROPONENTS Eddie Gray, Developer of Fairmont Park, addressed the Commission. Mr. Gray told the Commission that he would like to work with Mr. Rankin to come up with a plat for the remaining property he has for sale on Fairmont. 2. OPPONENTS There were none. IV. CONSIDER REPLAT OF PART OF A 0.6516 ACRE TRACT BEING PART OF COMMERCIAL RESERVE TRACT 4 OF TRACT 31 OF THE W. JONES SURVEY, A-482. A motion was made by Sandie Staniszewski to approve the Replat of a 0.6516 acre tract being part of Commercial Reserve Tract 4 of Tract 31 of the W. Jones Survey, A-482, with the condition that it not be released for recordation until the following item has been satisfied. The applicant must pay public hearing costs of $36.80. The motion was seconded by Jim Zoller. All were in favor and the motion passed. VI. CONSIDER REPLAT OF A 0.8453 ACRE TRACT, WHICH IS PART OF COMMERCIAL RESERVE "E" "NOT PART OF SUBDIVISION', FAIRMONT PARK EAST, SECTION I. A motion was made by Melton Wolters to approve the Replat of a 0.8453 acre tract which is part of Commercial Reserve "E" "Not Part of Subdivision", Fairmont Park East, Section I. with the condition that the plat not be released for recordation until the following item has been satisfied. The applicant must pay public hearing costs of $36.80. The motion was seconded by Dottie Kaminski. All were in favor and the motion passed. VII. CONSIDER PRELIMINARY PLAT FOR PECAN CROSSING SUBDIVISION, SECTION THREE. Mr. Rankin reported that Section Three of Pecan Crossing Subdivision is located approximately 1,800 feet west of Underwood Road. Staff has reviewed the plat, and with everything found to be in order, recommended Commission approval. A motion was made by Melton Wolters to approve the Preliminary Plat for Pecan Crossing Subdivision, Section Three. The motion was seconded by Jim Zoller. All were in favor and the motion passed. VIII. CONSIDER GENERAL PLAN FOR FAIRMONT PARK EAST SUBDIVISION, SECTIONS FIVE, SIX, SEVEN, EIGHT, AND NINE. Mr. Rankin reported that the property in question is located on the east side of Driftwood, between Spencer & Fairmont. Mr. Gray asked the Commission to approve the General Plan as submitted but would like there to be additional discussion regarding detention. He suggested the City consider a regional detention center, approximately 10-15 acres south of Fairmont, somewhere in the Bayport Industrial District that could be used to detain water draining to Clear Lake. He feels this would eliminate the need to have so many smaller detention sites scattered all around. Staff recommended approval of the General Plan. A motion was made by Sandie Staniszewski to approve the General Plan for Fairmont Park East Subdivision, Sections Five, Six, Seven, Eight, and Nine. The motion was seconded by Jim Zoller. All were in favor and the motion passed. IX. STAFF REPORTS Mr. Rankin gave developments. X. ADJOURN the Commission an update of new/proposed Chairperson Waters declared the meeting duly adjourned at 6:56 PM. As part of the proposed development, Ordinance #98-2233 was passed by the La Porte City Council on April 27, 1998. The ordinance closed the existing alleys in the 800, 900 and 1,000 Block of San Jacinto as well as the adjoining East " 17% East "H" and 5 h (Arizona) Street rights -of -way. As part of the ordinance closing, specific easements were retained by the City to ensure access for proper maintenance of water and sanitary sewer lines and drainage channels. A sheet showing those easements is attached as Exhibit "A." Note there are three existing structures located on the north end of the property (previously known as Block 276). One building does not comply with current front setback regulations; however, when built the residential structure met regulations in effect at that time. The pre-existing, non- conforming structure has since been converted to a school related museum building and the proposed replatting will increase the current encroachment by five feet (5'). The proposed building line setbacks and easements will not impact any of the other existing structures. Analysis: The applicant has requested the replat of these properties to establish a single lot of record to facilitate future expansions. Once recorded, the new lot of record will be known as the "LaPorte I.S.D. Instructional Support Center". The plat showing the configuration of the lot with all easements in place is attached as Exhibit `B". Under the terms of Section 4.07 of Development Ordinancel444, a replat of all or a portion of a subdivision may be released for recordation and deemed valid and controlling when the following conditions have been satisfied: LPISD Replat — Instructital Support Center • 05/21/98 P & Z Meeting Page 2 of 3 • The plat has been signed and acknowledged by only the owners of the particular property, which is being replatted or resubdivided. • The replat does not attempt to alter, amend, or remove any subdivision covenants or restrictions. • There is compliance with Sections 212.014 and 212.015 of the V.T.C.A. Local Government Codes. • The replat has been approved by the Commission after being prepared and filed as though it were an original plat as specified in Section 4.04 of the Development Ordinance. • All expenses incurred by the City or the subdivider in the replat process shall be borne by the subdivider, including the cost for notice of public hearing. Section 5.02 of the Development Ordinance addresses the need for sidewalks, where required by the Comprehensive Plan or by the Commission. The Pedestrian System Plan in Volume I of the Comprehensive Plan does not show future sidewalk plans along San Jacinto Street. There has not been recent development in this area and sidewalks are not currently in place on neighboring properties. The Commission may choose to require sidewalks. In keeping with this standard, staff recommends no sidewalk requirement for this replat.
