CALL TO ORDER. The meeting was called to order by Chairperson Waters at 6:09 PM. 11. APPROVE MINUTES OF THE APRIL 16, 1998 REGULAR MEETING AND PUBLIC HEARING. A motion was made by Melton Wolters to approve the minutes. The motion was seconded by Sandie Staniszewski. All were in favor and the motion passed. III. OPEN PUBLIC HEARING TO DISCUSS A REPEAT FOR ALL OF BLOCKS 276, 295 AND 304 AND THE ADJOINING RIGHTS-OF-WAY OF EAST "I', EAST "H" AND 5T" (ARIZONA) STREETS, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS. THE PROPERTY IS ALSO KNOWN AS THE 800, 900, Sz 1,000 BLOCK OF SAN JACINTO STREET AND THEIR ADJOINING RIGHTS-OF-WAY. LA PORTE INDEPENDENT SCHOOL DISTRICT, PROPERTY OWNER, HAS REQUESTED THE REPEAT TO ESTABLISH A SINGLE LOT OF RECORD THAT WILL BE KNOWN AS "LA PORTE I.S.D. INSTRUCTIONAL CENTER". Chairperson Waters opened the Public Hearing at 6:10 PM. Mr. Rankin reported that the school district has a permit to construct an Instructional Support Center building at 1002 San Jacinto Street. He noted that on April 27, 1998, City Council passed Ordinance #98-2233, which closed the existing alleys in the 800, 900 and 1,000 Block of San Jacinto as well as the adjoining East "1", East "H" and 5"' (Arizona) Street rights-of--way. If approved, the replat will establish a single lot of record to facilitate future expansions. Staff recommended approval of the replat. M Planning and Zoning C~nission • Minutes of May 21, 1998 .. Page 2 of 3 Mr. Rankin noted that staff mailed 21 public notices to adjoining property owners. No replies were received either in favor or opposed to the replat. Four were returned undeliverable. 1. PROPONENTS There were none. 2. OPPONENTS There were none. IV. CLOSE PUBLIC HEARING. Chairperson Waters closed the Public Hearing at 6:14 PM. V. CONSIDER REPEAT FOR ALL OF BLOCKS 276, 295 AND 304 AND THE ADJOINING RIGHTS-OF-WAY OF EAST "I", EAST "H" AND 5T" (ARIZONA) STREETS, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS. A motion was made by Sandie Staniszewski to approve the Replat of Blocks 276, 295, and 304 and the adjoining rights-of-way of East °IU, East "H" and 5~' (Arizona) Streets, Town of La Porte, Harris County, Texas, with the following conditions: 1. All signatures on the plat are obtained prior to formal recordation. 2. The applicant must pay public hearing costs of $56.40. 3. The language on the plat concerning City of La Porte utility easements shall be moved to the dedication section. The motion was seconded by Melton Wolters. All were in favor and the motion passed. VI. STAFF REPORTS Mr. Rankin informed the Commission that staff expects to receive resubmittals for zone changes on Fairmont Parkway and the 1500 block of Main Street. The Texas Import-Export Center will soon submit a General Plan and a request for a Special Conditional Use Permit. Mr. Rankin announced that the City had selected Wilbur Smith Associates and Rust Environment and Infrastructure to perform the update of the Comprehensive Plan. VII. Gray, Trustee Reauested For: A 25.0012 Acre Tract out of the William M. Jones Survey, Abstract No. 482, Harris County, Texas and being a part of a 266.154 Acre Tract described in Film Code 184-69-2052 in the Office of the County Clerk of Harris County, Texas. Present Zoning: High Density Residential (R-3) Reauested Use: Residential Subdivision -(Note: Single Family Dwellings aze an allowable use in a High Density Residential (R-3) Zone.) Background: Fairmont Park East is a residential subdivision off Driftwood Drive and located between Spencer Highway and Fairmont Parkway. The General Plan for Fairmont Park East, Sections Five, Six, Seven, Eight and Nme was reviewed and Approved by the Commission during their April 16, 1998 meeting. (See Exhibits A and B). As required by the Development Ordinance, the mylaz of the approved General Plan has been received by the City. Section VI is being considered for Preliminary Plat approval at this time. (See Exhibit C). As shown, this is a 3 block and 82 lot section. You may note that the General Plan originally depicted 3 blocks and 801ots; however, once this section was surveyed and designed, Block 44 and 46 each had one additional lot. Also, as part of the general plan, the developer had set aside ten (10) acres in Section VI for detention to ensure adequate land azea. However, once calculations were completed, the developer's engineer determined that only 8.1510 acres were needed to satisfy minimum requirements. These drainage calculations have been submitted to the city and aze being reviewed along with the utility plans. By submittal of the Final Plat staff will review the calculations and ensure that the proposed detention azea is properly sized. Fairmont Park East, S. preliminary Plat 6/18/98 - P & Z Meeting Page 2 of 3 Analysis: Staffwould note that Section 5.02 of the Development Ordinance empowers the Commission to require pedestrian sidewalks when it feels their inclusion will serve the public interest. Staffrecommends the inclusion of sidewalks within the Fairmont Park East Subdivision. Responsibility for construction of the walks should be specified by covenant as well as stated in writing on the front of the final plat document for each section. For general information purposes, staff has listed items below that need to be addressed by the developer with the submittal of the final plat. • A reference that the detention pond ownership and maintenance by the Homeowner's Association shall be stated in writing on the final plat. Language in the convenants and on the face of the plat shall dedicateJtransfer ownership of the detention reserve to the Homeowners Association. • A reference that the developer is responsible for construction and installation of sidewalks within the subdivision should be stated in writing on the front of the final plat. (If sidewalks are required by the Planning &Zoning Commission) • A HL&P street light layout plan and letter stating costs from HL&P is provided for review by the City. • Payment for street lighting cost should be made to the City. • Approval from the franchise utilities regarding the size and location of the proposed utility easements are provided for City review and approval. • Payment to the City for street sign installation costs. Sign locations and costs shall be determined by the City's Public Works Department. • On Section VI, a payment of $14,350.00 is due the City in lieu of parkland dedication. This figure is based on a $175.00 per dwelling unit basis. The money will be placed in an escrow account and will only be used for the acquisition or improvements of public park land or facilities located in Park Zone 6, the zone in which Fairmont Park East is located. • Subdivision covenants/deed restrictions for Section VI are provided to the City for review and approval. • Subdivision construction plan review is completed by the City and any changes are made prior to the submittal of the final plat. Preliminary Plat • 6/18/98 - P & Z Meeting Page 3 of 3 • Confirmation that the aviation easement and Southwestern Bell easement mentioned in the Title Report does not effect Section VI. If these easements affect Section VI, they should be properly noted on the final plat. Conclusion: Development Ordinance, Section 4.03.B requires that "following review of the Preliminary Plat, the commission shall ... Take one of the following actions." 1. Anyrove the Preliminary Plat as filed; 2. Conditionally Approve the Preliminary Plat as filed, provided, the reasons are stated in writing and a copy of the statement is signed by the Chairman of the Planning Commission. 3. Disapprove the Preliminary Plat as filed, provided, the reasons for such disapproval are stated in writing and a copy of the statement is signed by the Chairman of the Planning Commission. Using Appendix D of Development Ordinance No. 1444, staff has reviewed the preliminary plat and finds it substantially complies with applicable ordinance requirements. The completed checklist and the title report are attached and follow this report. Staff therefore, recommends Approval of the Fairmont Park East, Section VI Preliminary Plat. If the Planning and Zoning Commission approves the Preliminary Plat we recommend the motion include the following: • Confirmation by the Planning and Zoning Commission that sidewalks aze required in Fairmont Pazk East, Section Vi. • The Planning and Zoning Commission requests that staff notify the developer of the items referenced in this report that need to be addressed with submittal of the final plat. As the Commission is aware, the development of a P.U.D. project involves numerous steps that include action by the Commission and City Council. The Bayou Forest Apartments will now be known as the Legends of Bayou Forest Apartments. The applicant's submittal of the final plat and the Commission's review/approval of this document would be the last step in this P.U.D. process. ~ Page 1 • • The applicant is very close to submitting the final plat and all required documentation. However, the Special Conditional Use Permit #SCU 97-001 will expire on 7-1498 unless an extension is granted. A copy of #SCU 97-001 is included for your reference. The property is also known as 10720 Spencer Highway Present Zoning: General Commercial (G.C.) Background: The owner, Mr. Meadows, has a building permit for the construction of a new automotive repair business that will be known as 10720 Spencer Highway. This tract of land was originally part of a larger tract and the selling of this property created an opportunity for the owner to plat this tract into a single lot of record. To ensure access for proper maintenance of utilities, the three (3) existing utility easements (two located in the front and one in the rear of the property) are shown•and will be retained by the recordation of the new plat. These easements are identified on Exhibit A attached. Analysis: The applicant's request will establish this property as a single lot of record and once the plat is recorded, the new site will be known as the Meadows Automotive Enterprises Subdivision.. The plat showing the configuration of the lot with the pre-existing easements shown in place is attached and identified as Exhibit A. Under the terms of Section 4.07 of Development Ordinance 1444, a replat of all or a portion of a subdivision may be released for recordation and deemed valid and controlling when the following conditions have been satisfied: • The plat has been signed and acknowledged by only the owners of the particular property, which is being replatted or resubdivided. • The replat does not attempt to alter, amend, or remove any subdivision covenants or restrictions. ::.. Section 5.02 of the Development Ordinance addresses the need for sidewalks, where required by the Comprehensive Plan or by the Commission. The Pedestrian System Plan in Volume I of the Comprehensive Plan does not show future sidewalk plans along this portion of Spencer Highway and sidewalks are not currently in place on neighboring properties. The Commission may choose to require sidewalks. In keeping with the standard in this area, staff recommends no sidewalk requirements for this replat. Conclusion: Staff has reviewed the requested plat for Meadows Automotive Enterprises and finds it does satisfy applicable provisions of State Law and City Ordinance. We, therefore, recommend the Commission Approve the Replat with the understanding that the items shown below must be satisfied prior to the plat being released for recordation. 1.
