MINUTES OF SEPTEMBER 3, 1998
Members Present: Chairperson Betty Waters, Commission Members Michael

I. CALL TO ORDER.
The meeting was called to order by Chairperson Waters at 6:04 PM.
II. CONSIDER PRELIMINARY PLAT FOR SUMMER WINDS, SECTION 2.
Mr. Kneupper presented staff s report. Earl Wilburn, Secretary for
Summer Winds, LLC requested a Preliminary Plat for Summer Winds,
Section 2. This section is comprised of 56 lots and is located off
Underwood Road between Spencer Highway and Fairmont Parkway.
Staff reviewed and recommended approval of the Preliminary Plat but
noted there were several items that would need to be addressed prior to
Final Plat approval.
A motion was made by Melton Wolters to approve the Preliminary Plat for
Summer Winds, Section 2 contingent upon the following items being
addressed prior to Final Plat approval:
1. Reference on the Final Plat that the detention pond ownership
and maintenance will be by the Homeowner's Association.
Language in the covenants and on the face of the plat shall
dedicate/transfer ownership of the detention reserve to the
Homeowners Association.
2. Reference on the Final Plat that the developer is responsible for
construction and installation of sidewalks within the subdivision.
3. Submit HL&P streetlight layout and letter stating costs.
4. Payment shall be made to the City for streetlight costs.
5. Approval from franchise utilities regarding size and location of
proposed utility easements submitted to the City for its review
and approval.
6. Payment to the City in the amount of $280.89 for street sign
installation.

7. Payment to the City in the amount of $9,800.00 in lieu of
parkland dedication. This money will be placed in an escrow
account and will only be used for the acquisition or
improvements of public parkland or facilities located in Park
Zone I, the zone in which Summer Winds is located.
8. Submit subdivision covenants/deed restrictions for review and
approval
9. Submit subdivision construction plans for review and approval.
10. Submit title certificate for review by the City.
The motion was seconded by Sandie Staniszewski. All were in favor and
the motion passed.
III. OPEN PUBLIC HEARING
Chairperson Waters opened the public hearings at 6:06 PM.
A. DISCUSS SPECIAL CONDITIONAL USE PERMIT #SCU98-002,
REQUESTED FOR PROPERTY LOCATED IN THE 1900 BLOCK
OF AVENUE H STREET AT SOUTH 16T" STREET. THE
APPLICANT IS SEEKING A PERMIT FOR THE DEVELOPMENT
OF A PHARMACEUTICAL UNIT STRUCTURE THAT EXCEEDS
THE MAXIMUM BUILDING HEIGHT ALLOWED IN A HEAVY
INDUSTRIAL (H.I.) ZONE.
Mr. Kneupper presented staffs report. The applicant, Ron Evans,
for PPG Industries, requested a Special Conditional Use Permit for
the development of a pharmaceutical unit at their facility located in
the 1900 Block of Avenue "Hn at 16~' Street.
The new structure will exceed the maximum building height allowed
for structures in Heavy Industrial zones, which is currently 45 feet.
Public notices were mailed to ten surrounding property owners and
the City received two responses favoring the request.
1. PROPONENTS
Ron Evans, Environmental Manager for PPG Industries,
addressed the Commission. Mr. Evans answered questions
several of the Commission members had regarding the
types of drugs that will be manufactured at the new facility.

There were none.
IV. CLOSE PUBLIC HEARING.
Chairperson Waters closed the public hearing at 6:15 PM.
V. CONSIDER A RECOMMENATION TO CITY COUNCIL REGARDING
SPECIAL CONDITIONAL USE PERMIT #SCU98-002.
A motion was made by Dottie Kaminski to recommend City Council
approval of Special Conditional Use Permit #SCU98-002.
The motion was seconded by Jim Zoller. All were in favor and the motion
passed.
VI. STAFF REPORTS
Mr. Kneupper informed the Commission that the City met with Wilbur
Smith Associates and supplied them with the source documents they will
need to assist the City with updating our Comprehensive Plan.
The initial meeting with the public will be held at the Sylvan Beach Pavilion
at 7:00 PM on October 27, 1998.
The Commission discussed some arrangements for the APA Conference
in October.
VII. ADJOURN
Chairperson Waters adjourned the meeting at 6:23 PM.

Final Plat
Requested Bv: Earl W. Wilburn, Jr., Secretary for Summer Winds, LLC
Reauested For: A 15.0780 Acre Tract of land being Outlots 702 and 703 to the W. B.
Lawrence Subdivision, Volume 83, Page 344, H.C.D.R out of the William
M. Jones Survey, A-482, La Porte, Harris County, Texas.
Present Zoning: Low Density Residential (R-1)
Requested Use: Residential Subdivision
Background: Summer Winds is a residential subdivision located off Underwood Road and
located between Spencer Highway and Fairmont Parkway. Section II
includes 4 blocks, 561ots and one restricted reserve.
The Preliminary Plat for Section II of this subdivision was reviewed and
Approved by the Commission during their September 3, 1998 meeting.
Analysis: Approval by the Commission of the Final Plat and all accompanying
documentation will require the developer or owner to commence
construction of improvements within one year of Development
Authorization.
Disapproval of the Final Plat will require the filing of a new Final Plat.
Conclusion: In reviewing Summer Winds, Section II Final Plat, staff finds that it
substantially complies with all ordinance requirements.
The outstanding items are being addressed at this time and staff can ensure
each of the items is satisfied prior to obtaining the signature of the
Commission and staff. Signatures will be required before the plat can be
filed for recordation.

The Commission may wish to Approve the Final Plat with the stipulation
that all items shown below are satisfied prior to the plat recordation.
1. Coordinate with staff on design of the street light system.
2. Filing of the covenants, conditions and restrictions shall immediately
follow the recordation of approved Final Plat.
3. Payment of street lighting installation cost and electrical service cost for
one year. An estimate from I-iL.&P is to be provided and the money is to
be deposited with the City in an escrow account until such time as
construction/installation is complete. This submittal and payment shall
occur prior to the plat recordation.
4. Payment of signage installation costs ($280.89) prior to plat recordation.
5. Payment of money in lieu of parkland ($9.800.00) shall be made prior to
the plat recordation. (Park Zone 1 Escrow Account)
