I. CALL TO ORDER.
The meeting was called to order by Chairperson Waters at 6:00 PM.
II. APPROVE MINUTES OF THE AUGUST 20, 1998 REGULAR MEETING
AND PUBLIC HEARING AND THE SEPTEMBER 3, 1998 SPECIAL
CALLED MEETING AND PUBLIC HEARING.
A motion was made by Jim Zoller to approve the minutes of August 20
and September 3, 1998. The motion was seconded by Michael Jetty. All
were in favor and the motion passed.
III. CONSIDER FINAL PLAT FOR SUMMER WINDS, SECTION 2
SUBDIVISION.
Mrs. Wilmore presented staffs report. Earl Wilburn, Secretary for
Summer Winds, LLC requested a Final Plat for Summer Winds, Section 2.
The Preliminary Plat was approved by the Commission on September 3,
1998.
Staff reviewed the Final Plat and determined that it substantially complied
with all ordinance requirements. There were several outstanding items
but staff assured the Commission that these items would be completed
prior to recordation of the plat.
A motion was made by Melton Wolters to approve the Final Plat for
Summer Winds, Section 2 contingent upon the following items being
completed prior to releasing the plat for recordation:
1. Coordinate with staff on design of the street light system.
2. Filing of the covenants, conditions and restrictions shall
immediately follow recordation of the approved Final Plat.
3. Payment of street lighting cost and electrical service cost for
one year. An estimate from HL&P is to be provided and the
money is to be deposited with the City in an escrow account
until such time as constructionrnstallation is complete. The
submittal and payment shall occur prior to the plat recordation.

4. Payment for street signs in the amount of $280.89.
5. Payment in the amount of $9,800 in lieu of parkland dedication.

The motion was seconded by Jim Zoller. All were in favor and the motion
passed.

Final Plat for Sam T's Subdivision

Reuested For: A 1.1478 Acre Tract being part of Outlot 410, La Porte Outlots, as per map
or plat thereof recorded in Volume 1, Pg. 53 of the Map Records of Harris
County, Texas and also being located partly in the Mcholas Clopper Survey,
A 198, and partly in the Enoch Brinson League, A 5, City of La Porte,
Harris County, Texas.
Location: 1612 Underwood Road
Present Zoning: General Commercial (G.C.)
Background: The Applicant is platting a 1.1478 Acre tract for the purpose of developing a
proposed commercial business. The plat includes an existing 10' Sanitary
Sewer Easement along the western boundary and a new 10' X 50' Houston
Lighting & Power Easement. The property will be identified as One
Restricted Reserve of the Sam T's Subdivision.
Analysis: The zoning of the property is appropriate for a commercial development.
Section 5.02 of the Development Ordinance addresses the need for
sidewalks, where required by the Comprehensive Plan or by the
Commission. The City's Comprehensive Plan does not call for sidewalks
along Underwood Road; however, sidewalks have been required for recent
developments near Spencer Highway. The Commission may wish to decide
if sidewalks would be desired for the areas further north along Underwood
Road.
Should the Commission require a sidewalk, the plat shall include a statement
that a sidewalk installation, by the owner, is required.
Detention is required for the development. The plat shall include a statement
the detention area shall be owned and maintained by the property owner.
Water and sewer utilities are available to serve this site.
Conclusion: Staff finds the requested plat satisfies applicable provisions of State Law
and City Ordinance. Staff recommends Approval of Sam T's Subdivision.

Outlots 36, 45, 66 and 67, La Porte, Volume 59, Page 313, IiC.D.R,
situated in the Richard Pearsall Survey, Abstract 625, Harris County, Texas
Present Zoning: High Density Residential (R 3) and Low Density Residential (R 1)
Requested Use: Residential Subdivision
Background: Spencer Landing is a subdivision located on the north side of Spencer
Highway in the 11,400-11,500 Block.
The Commission during their April 17, 1997 approved the General Plan for
this subdivision meeting.
The Commission during their June 19, 1997 approved the Preliminary Plat
for Section I of this subdivision meeting:
The Commission during their June 19, 1997 approved the Final Plat for
Section I of this subdivision meeting.
Analysis: In accordance with the City's Development Ordinance #1444, Section 4.06,
an Amending Plat may be filed for record in the County Map Records to
correct dimensional errors, notational errors or other erroneous information
as defined and provided for under Article 978a V.T.C.S. Section 5, provided:
• The signed Amending Plat Certificate (Enclosure 4, Appendix D) is
placed upon the face of the Amending Plat; and
• The Planning and Zoning Commission Certificate (Enclosure 4,
Appendix D) is placed upon the face of the Amending Plat; and
• Commission approval of said Amending Plat is reflected by Commission
execution of said certificate.
In the case of Spencer Landing, Section I, there were some bearings left off
and some were incorrect. The applicant is correcting those errors with this
submittal.
Conclusion: In reviewing the Spencer Landing, Section I Amending Plat, staff finds it
complies with all ordinance requirements. Staff recommends the Spencer
Landing, Section I Amending Plat be Approved at this time.

Subject: Minor Subdivision Piats

You are well aware of the number of minor subdivision plats that have been
presented to the Commission in recent months. Usually these plats contain one
or two lots that front on an existing roadway and utilities are already available.
State law allows for the delegation of approval responsibility to a City employee
for minor plats similar to the ones described above. The law states that the City
may delegate to an employee of the City the ability to approve: 1) amending
plats, and 2) minor plats involving four or fewer lots fronting on an existing
street and not requiring the creation of any new street or the extension of
municipal facilities.
However, the designated employee may, for any reason, elect to present the plat
to the Planning and Zoning Commission to approve the plat. In addition, the
designated employee shall not disapprove the plat and shall be required to refer
any plat, which he refuses to approve to the Planning and Zoning Commission
within the time period specified elsewhere in the statutes.
Staff feels this will be a beneficial tool for both the developers and City staff.
The developers will be required to prepare the exact same documents as before,
but scheduling to meet with the Commission may not be required. Staff will
continue to review all aspects of the plat but may not be required to prepare an
agenda and other material for presentation to the Commission.
At this time staff is requesting direction from the Commission to prepare the
necessary ordinance amendments for adoption by City Council.

Subject: Lay-Down Curbs

Recently, some members of the development community have suggested the
City look at our construction standard for curbs in new subdivisions. The
standard we have and what is seen over most of the city is referred to as a "6-
inch vertical curb". The curb is approximately 6 inches high with a vertical face.
This curb is constructed with the concrete streets and is continuous at first. As
homes are built, the curb is cut and removed to provide for the driveways. Then
there is a small patch placed where the new driveway meets the place where the
curb was cut.
About two years ago, the city allowed the developer of Fairmont Park East to
install, on a trial basis, a different type of curb; a curb that is commonly refen-ed
to as a "lay-down curb". This curb is approximately 4 inches high and has a
sloped face. This curb, like the "6-inch vertical curb'; is constructed with the
streets and is continuous. One major difference is that the "lay-down curb" does
not have to be cut or removed to accommodate driveways.
Staff has prepared a detail, which will be included in the developer's construction
drawings. This detail describes how the "lay-down curb" will be constructed.
One strict provision that will guide the placement of "lay-down curbs" is that
these curbs can only be placed along residential streets. On streets classified as
collector or higher, the "6-inch vertical curb" will have to be installed.
If the Commission so desires, staff will allow the installation of the "lay-down
curb" on residential streets in accordance with the attached detail.
