CALL TO ORDER. The meeting was called to order by Chairperson Waters at 6:05 PM. II. APPROVE MINUTES OF THE OCTOBER 15, 1998, REGULAR MEETING. A motion was made by Sandie Staniszewski to approve the minutes of October 15, 1998. All were in favor and the motion passed. Ill. CONSIDER FINAL PLAT FOR SPENCER LANDING, SECTION 2 SUBDIVISION. Mr. Kneupper presented staffs report. Brad Dill, of B.D. Realty Advisors, made application for the Final Plat of Spencer Landing, Section II, an 89 lot, 4 block section, located in the 11,400 -11, 500 Blocks of Spencer Highway. Staff recommended approval of the plat stating it satisfied ordinance requirements. A motion was made by Jim Zoller to approve the Final Plat for Spencer Landing Subdivision, Section 11 with the stipulation that the following items are completed prior to recordation of the plat. Coordinate with staff on design of the street light system. Payment of street lighting installation cost and electrical service cost for one year. An estimate from HL&P is to be provided and the money is to be deposited with the City in an escrow account until such time as construction/installation is complete. This submittal and payment shall occur prior to the plat recordation. 2. Payment of signage installation costs (to be determined) prior to plat recordation. (Park Zone 5 Escrow Account) 4. Payment of additional $39 for filing fee. 5. Statement on plat that sidewalks will be installed adjacent to all roadways. The motion was seconded by Melton Wolters. All were in favor and the motion passed. IV. CONSIDER PRELIMINARY PLAT FOR PECAN CROSSING, SECTION 4 SUBDIVISION. Mr. Kneupper presented staffs report. Glenn Angel, President of Legna Land Development Company, made application for the Preliminary Plat of Pecan Crossing, Section 4, a 19.9236 acre tract located on the north side of Fairmont Parkway, approximately 1,800 feet west of Underwood Road. Staff recommended approval of the plat stating it satisfied ordinance requirements. A motion was made by Sandie Staniszewski to approve the Preliminary Plat of Pecan Crossing Subdivision, Section 4, with the stipulation that the following items be completed: 1. Payment of additional $39 filing fees. 2. Submit updated Title Report or previous Title Report with Affidavit. 3. Confirmation by the Planning and Zoning Commission that sidewalks are required in Pecan Crossing, Section IV. The motion was seconded by Jim Zoller. All were in favor and the motion passed. V. CONSIDER FINAL PLAT FOR FUNCARE-FAIRMONT PARKWAY SUBDIVISION. Mr. Kneupper presented staffs report. John Caldwell, of the Alidade Group, for the owner Andy Tanguay, made application for the Final Plat of Funcare-Fairmont Parkway Subdivision, a 0.650 acre tract located at 10325 Fairmont Parkway. Staff recommended approval of the plat stating it satisfied ordinance requirements. Planning and Zoning Covission • Minutes of November 19, 1998 Page 3 of 4 A motion was made by Sandie Staniszewski to approve the Final Plat of Funcare-Fairmont Parkway Subdivision contingent upon installation of sidewalks by the owner. The motion died for lack of a second. A motion was made by Jim Zoller to approve the Final Plat of Funcare- Fairmont Parkway Subdivision. The motion was seconded by Melton Wolters. All were in favor and the motion passed. VI. CONSIDER FINAL PLAT FOR G.S.L. SENS SUBDIVISION. Mr. Kneupper presented staff s report. E.G. Mylonas, for the owner GSL Investments, Inc., made application for the Final Plat of G.S.L. Sens Subdivision, a 2.0418 acre tract located at 1434 Sens Road. Staff recommended approval of the plat stating it satisfied ordinance requirements. A motion was made by Sandie Staniszewski to approve the Final Plat of G.S.L. Sens Subdivision contingent upon installation of sidewalks by the owner. The motion was seconded by Michael Jetty. All were in favor and the motion passed. VII. PRESENTATION BY BROOKHOLLOW CORPORATION REGARDING PROPOSED TAX INCREMENT REINVESTMENT ZONE (TIRZ) John Joems gave a brief overview of the creation of a Tax Increment Reinvestment Zone (TIRZ). Introductions were made for the following people (Please note that names of people and companies may be misspelled): Dan McCullough, of Texas Industries (a NYSE company in business for approximately 40 years), Glenn Opal, of Vincent & Elkins (law firm in Dallas), Charles Jennings, of Legg -Mason (investment broker), and Brian Jordan, of Jones & Carter (civil engineering). Don Grandeus (specializing in single family developments) was not present for the meeting. Glenn Opal described the workings of a TIRZ while answering questions from the Commission. David Hawes commented that the City is working with the applicants to prepare a preliminary finance plan, which City Council will review and eventually make a determination as to whether or not the City will create a reinvestment zone. MINOR PLATS AND AMENDING PLATS Mr. Kneupper discussed a proposed amendment to the Development Ordinance that would allow staff to approve minor plats (involving four or fewer lots fronting on an existing street and not requiring the creation or the extension of municipal facilities). He informed the Commission that the amendment was sent to Council for their consideration on October 26, 1998, at which time Council tabled the item and directed it back to the Commission to look at a size of lot or acreage restriction. Staff recommended imposing a ten -acre limit on the size of lot or acreage to the proposed amendment. The Commission agreed with staffs recommendation. The item will be sent to the next Council meeting. Mr. Kneupper gave a brief update on the progress that has been made updating the Comprehensive Plan. Eddie Gray took a few moments to ask the Commission several questions he thinks should be answered before the City makes a decision to create a TIRZ. IX. Furlow, Owner Requested for: Tracts 302A and 302B; LaPorte Outlots cation: 1600 Block of Sens Road Present Zoning: Mid Density Residential (R-2) Requested ZoninE: General Commecial (GC) Background: The property in question is located in the 1600 Block of Sens Road, La Porte, Harris County, Texas. The said property is further described by the Harris County Appraisal District as tracts 301A, 302A and 302B, La Porte outlots. An, alysis: The purpose of rezoning is to allow construction of a storage building for the expansion of an existing business. The staff in reviewing the applicant's request found it to be reasonable. The current land use shows the area to be intended for commercial use. However, the city has been consistent with providing a portion of general commercial along the major roads within the city limits. However, the following aspects should be considered for granting a rezoning request. • Ability of infrastructure to support the permitted use. • Impact on the surrounding land uses. The area in which the subject tract, based on the criteria established by the city's comprehensive plan, is suitable for either present use or the requested general commercial. The zoning change would not have a significant impact on traffic conditions in the area. Moreover, utilities would not significantly be affected. Furthermore, the tract is bounded by an existing residential and general commercial. A storm sewer of HCFD, which can serve as a buffer zone, is running on the west of the said tract. The change from R2 to GC have no impact on the future development within the general commercial zone. The development within the subject tract should not impact the viability of the surrounding area. • u Conclusion: There was no apparent error in assigning the present zoning designation to the tract in question. By virtue of location and underlying land use designation, it does satisfy the criteria established for general commercial zoning. If the applicant is able to demonstrate that the requested zoning would represent the highest and best use of the property, granting the requested change would not be contrary to the goals and objectives of the Comprehensive Plan. Given the fact that the subdivision will be comprised of a single lot, a property owner's association will not be required. Neither will covenants or deed restrictions be necessary. Based on its designation as a commercial subdivision, dedication or payment in lieu or space for park will not be required. Staff has reviewed the final plat and found it to be in substantial compliance with applicable ordinance requirements. staff has also reviewed the plat for conformance with zoning regulations and the goals and objectives of the city's comprehensive plan. Staff reviewed existing utilities and found them to be adequate to facilitate the subdivision. Conclusion: Staff based on its review find the final plat to be substantial compliance with applicable city regulations.
