PLANNING AND ZONING COMMISSION
MINUTES OF DECEMBER 17, 1998

I. CALL TO ORDER.
The meeting was called to order by Chairperson Waters at 6:05 PM.
II. APPROVE MINUTES OF THE NOVEMBER 19, 1998, REGULAR
MEETING.
A motion was made by Melton Wolters to approve the minutes of
November 19, 1998. All were in favor and the motion passed.
III. OPEN PUBLIC HEARING TO CONSIDER ZONE CHANGE REQUEST
#R98-003, WHICH HAS BEEN REQUESTED FOR THE PROPERTY
LOCATED IN THE 1600 BLOCK OF SENS ROAD. THE APPLICANT IS
SEEKING A ZONE CHANGE TO ALLOW FOR THE CONSTRUCTION
OF A STORAGE BUILDING.
Chairperson Waters opened the public hearing at 6:05 PM.
Mr. Kneupper presented staffs report. Joe Furlow, made application for a
zone change for the property he owns in the 1600 Block of Sens Rd.
Current property zoning is Mid Density Residential (R-2). Mr. Furlow
requested this be changed to General Commercial (GC) to allow for the
construction of a storage building for the expansion of an existing
business.
Mr. Kneupper noted that the City has been consistent in providing a
portion of general commercial zones along major roads within city limits.
Staff s review of the request determined, by virtue of location and
underlying land use designation, the request satisfied criteria established
for general commercial zoning. Staff recommended approval of the zone
change.
Public notices were mailed to six owners of property that surround the
tract in question. The City received one response in favor and two
responses in opposition of the zone change.

A. PROPONENTS
Joe Furlow, owner of Furlow Services, located on Sens Rd., stated
that he thought this tract of land would be sufficient for his needs
when it was developed several years ago. Since that time his
business has tripled and if he is unable to expand the current
facility, he will be forced to sell the property and move to another
location.
Darrell Henderson, 10534 N. "L" St. addressed the Commission.
Mr. Henderson stated that when the proposed drainage ditch is
completed it would cut off the back half of his property that is zoned
residential. When that happens it will be next to impossible for him
to build a house on the back half of his property.
B. OPPONENTS
Joe Berry, 11814 Avenue "P", addressed the Commission. Mr.
Berry owns property on the north side of the tract in question. He
distributed photographs to the Commission that show the view from
his backyard with equipment being visible. The presence of this
business has increased noise levels and expansion of the facility
will increase vehicular traffic. Mr. Berry noted that his property has
flooded twice during the last year. He concluded by requesting the
Commission disapprove the request.
Lisa Berry, 11814 Avenue °P", believes she lives in a residential
area that should not be turned into a commercial area.
IV. CLOSE PUBLIC HEARING.
Chairperson Waters closed the public hearing at 6:17 PM.
V. CONSIDER RECOMMENDATION TO CITY COUNCIL FOR ZONE
CHANGE REQUEST #R98-003.
A motion was made by Melton Wolters to recommend City Council
approval of Zone Change Request #R98-003. Jim Zoller seconded the
motion. The motion passed by majority vote with Mr. Jetty voting in
opposition.
VI. CONSIDER FINAL PLAT OF ZELDA WRIGHT SUBDIVISION, WHICH IS
TO BE LOCATED AT 2201 UNDERWOOD ROAD.
Mr. Kneupper presented staff s report. Otis and Zelda Wright, property
owners, made application for the Final Plat of Zelda Wright Subdivision,
located at 2201 Underwood Road.

Staff recommended approval of the plat stating it complied with applicable
City regulations.
A motion was made by Melton Wolters to approve the Final Plat of the
Zelda Wright Subdivision with the inclusion of sidewalks. Dottie Kaminski
seconded the motion. All were in favor and the motion passed.
VII. CONSIDER FINAL PLAT OF PECAN CROSSING SUBDIVISION,
SECTION IV, LOCATED ON THE NORTH SIDE OF FAIRMONT
PARKWAY.
Mr. Kneupper reported that staff received application for the Final Plat of
Pecan Crossing Subdivision, Section IV on Thursday, December 10"'.
Section 4.04 of the Development Ordinance requires the Final Plat and all
required documentation be submitted at least two weeks prior to
consideration by the Planning and Zoning Commission. The documents
provided were incomplete. Staff reviewed the public improvement
construction documents and found several items that need to be modified
or corrected.
Staff recommended disapproval of the plat.
A motion was made by Dottie Kaminski to disapprove the Final Plat of
Pecan Crossing Subdivision, Section IV. Michael Jetty seconded the
motion. All were in favor and the motion passed.
VIII. STAFF REPORTS
Mr. Kneupper reported that City Council approved an amendment to the
Development Ordinance that allows staff approval of Minor Plats (involving
four or fewer lots fronting on an existing street and not requiring the
creation or the extension of municipal facilities). A ten-acre limit on the
size of lot or acreage was imposed.
Mr. Kneupper gave a brief update on the progress that has been made
updating the Comprehensive Plan.
Mr. Kneupper noted that he really enjoyed visiting with everyone during
the recent Volunteer Appreciation Banquet hosted by the City.
Mr. Kneupper introduced the newly hired City Planner, Masood Malik. Mr.
Malik acknowledged Mr. Kneupper's introduction.
IX. ADJOURN
Chairperson Waters adjourned the meeting at 6:28 PM.

Final Plat for JCF Subdivision
Requested BX: Mr. Joe Camp, President of Joe Camp, Inc., property owner.
Requested For: A 6.7744 Acre Tract known as all of Block 124 and 117, the
residue of Block 123, a 16 foot alley in Block 124, a portion of
South 9a' Street between Blocks 123 and 124, the north one-half of
West F Street between South 8a` Street and State Highway 146,
a portion of West E Street between South 8a' Street and State
Highway 146 and a 16 ft. alley in Block 117, Town of La Porte,
Hams County, Texas.
Location: 621 Highway 146 South.
Present Zoning: General Commercial (G.C.)
Background: The owner, Joe Camp Inc., has a building permit for the renovation
and addition to three existing buildings currently known as 621
Highway 146 South. The same permit also covers the construction
of two new buildings, which will be known as 501 and 521
Highway 146 South.
As part of the proposed development, Ordinance #98-2228 was
passed by the La Porte City Council on March 30, 1998. Exhibit A
shows the specific street and alley rights-of--way closed by this
Ordinance. The passage of this recent Ordinance along with the
previous closings by Ordinance #826 has created an opportunity
for the owner to replat these tracts into a single lot of record.
Analysis: The applicant has submitted the final plat of these properties to
establish a single lot of record to facilitate future expansions.
Once recorded, the new lot will be known as JCF Subdivision. ---"
The plat showing the configuration of the lot with all easements in
place is attached and identified as Exhibit B.
Section 5.02 of the Development Ordinance addresses the need for
sidewalks, where required by the Comprehensive Plan or by the
Commission. The Comprehensive Plan does not require sidewalk
plans along State Highway 146. The Commission may choose to
require sidewalks. In keeping with the standard in this area, Staff
recommends no sidewalk requirements for this final plat.

Staff has reviewed the final plat and found it to be in substantial
compliance with applicable Ordinance requirements. Staff has also
reviewed the plat for conformance with zoning regulations and
goals and objectives of the City's Comprehensive Plan. Staff has
reviewed existing utilities and found them to be adequate to
facilitate the subdivision.
Conclusion: Staff, based on its review, finds the final plat to be in substantial
compliance with applicable City regulations. Staff recommends the
approval of the final plat.

Final Plat
Requested ~: Glenn Angel for Legna Land Development Company.
Requested For: A 19.9236 Acre Tract being part of Outlots 694, 696, 714 and
Outlots 695, 704, 705, and 715, La Porte Outlots, as recorded
in Volume 83, Page 344 of the Deed Records of Harris
County, Texas and located in the William M. Jones Survey
Abstract-482, City of La Porte, Harris County, Texas.
Present Zoning: Low Density Residential (R-1)
Requested Use: Residential Subdivision
Background: Pecan Crossing is a residential subdivision located on the
north side of Fairmont Parkway, approximately 1,800 feet west
of Underwood Road (See Exhibit A). The General Plan for the
subdivision was approved by the Commission on February
17,1994 and the Preliminary Plat for Section IV was approved
by the Commission during their November 19, 1998 meeting.
Analysis: Staff, using Development Ordinance Section 4.04 and
Appendix D of the Development Ordinance as a guide, has
reviewed the Pecan Crossing Section N Final Plat and found
it to be in substantial compliance with applicable Development
Ordinance requirements.
The covenants for Section IV have been reviewed by the City
Attorney's office and found to satisfy Ordinance requirements.
Utility Construction Plans have been reviewed and approved
by Staff.
Conclusion: Staff has reviewed Pecan Crossing Section IV Final Plat and
found it complies with the Development Ordinance.
Staff recommends approval of the Pecan Crossing Section
IV Final Plat with the provision that the plat not be released
for recordation until;
Payment in the amount of $15, 575 is made to the City in
lieu of Park Land dedication.
Payments of $6,247 and $225.13 are made to the City for
street lighting service and street signage installation
respectively.
