• • PLANNING AND ZONING COMMISSION MINUTES OF MAY 20, 1999 Members Present: Betty Waters, Jim Zoller, Michael Jetty, Dottie Kaminski, Hal Lawler, Melton Welters, Sandie Staniszewski Members Absent: City Staff Present: Planning Director Doug Kneupper, City Planner Masood Malik, Engineer I Roxann Hayes, City Attorney Knox Askins, Planning Secretary Peggy Lee I. CALL TO ORDER. The meeting was called to order by Chairperson Waters at 6:00 PM. II. APPROVE MINUTES OF THE APRIL 15, 1999, REGULAR MEETING AND PUBLIC HEARING. Motion by Jim Zoller to approve the minutes of April 15, 1999. Second by Sandie Staniszewski. All were in favor and the motion passed. III. OPEN PUBLIC HEARING TO CONSIDER SPECIAL CONDITIONAL USE PERMIT REQUEST #99-002, SEEKING APPROVAL TO OPERATE AN ON-SITE RECOVERY, FREON RECLAMATION, AND REFRIGERANT SALES WITHIN A LIGHT INDUSTRIAL ZONE. THE PROPERTY IS LOCATED IN THE 300 BLOCK OF NORTH 16T" STREET. Chairperson Waters opened the Public Hearing at 6:01 PM. A. PROPONENTS Holly Sincox, tenant of the building owned by Ken Higginbotham, addressed the Commission. Ms. Sincox stated that the explosion that occurred in the building back in February was determined by Engineers to be caused by tank failure, most likely in the manufacturing of the tank and not by their negligence. New tanks have since been purchased and they have received certification on the tanks. A two- hourfire wall that was requested by the Fire Marshal has been completed. Ms. Sincox also stated that the refrigerant handled at this location is non-hazardous and non- flammable. The business is EPA certified and is an approved reclaimer. B. OPPONENTS There were none. City Planner, Masood Malik, presented staff s report. The applicant, Holly Sincox is requesting a Special Conditional Use Permit to operate a refrigerant recovery and reclamation business known as Alliance Recovery Services at 320 N. 16~' Street. Staff recommended approval of the permit with several conditions. Seven notices of public hearing were mailed. The City received two replies in favor and one in opposition. IV. CLOSE PUBLIC HEARING. Chairperson Waters closed the Public Hearing at 6:12 PM. V. CONSIDER RECOMMENDATION TO CITY COUNCIL FOR SPECIAL CONDITIONAL USE PERMIT REQUEST #99-002. Motion by Jim Zoller to recommend City Council approval of Special Conditional Use Permit #99-002 with the following conditions: 1. A minor development site plan, prepared in accordance with the requirements of Development Ordinance 1444, shall be submitted for review and approval by the City. 2. EPA permit complying with refrigerant recycling rules under Section 608 of the Clean Air Act, 1990 shall be furnished to the City. 3. Landscaping of parking lot shall be required. 4. The applicant shall pay public hearing costs. Second by Dottie Kaminski. All were in favor and the motion passed. VI. CONSIDER FINAL PLAT OF SUMMER WINDS SUBDIVISION, SECTION III. Mr. Malik presented staffs report. Earl Wilburn made application with the City for the Final Plat of Section III of the Summer Winds Subdivision. Section III consists of three blocks, 37 lots, and two restricted reserves. Planning and Zoning Ct~ission Minutes of May 20, 1999 Page 3 of 5 Staff recommended Commission approval. Motion by Melton Wolters to approve the Final Plat of Summer Winds Subdivision, Section III with the provision that the plat not be released for recordation until the following items are completed. 1. All construction improvements shall be complete. 2. Payment to the City in the amount of $6,475.00 in lieu of parkland dedication. 3. Payment to the City in the amounts of $2,498.88 for street lighting and $200.75 for street sign installation. 4. Installation of sidewalks shall be required. Second by Sandie Staniszewski. All were in favor and the motion passed. VII. PRESENTATION BY THE DEVELOPER OF FAIRMONT OAKS APARTMENTS PROJECT, WHICH IS TO BE LOCATED AT 9801 WEST FAIRMONT PARKWAY. Chairperson Waters suspended the Agenda and moved to the next item to allow more time for all presenters to arrive. VIII. REVIEW DRAFT OF FLOODPLAIN MANAGEMENT PLAN AND RECEIVE CITIZEN'S COMMENTS. Doug Kneupper stated the City has been participating in the National Flood Insurance Program (NFIP) since 1972. The program makes affordable flood insurance available to residents and business owners. In tum, there are minimum development standards the City must enforce. A supplementary program, known as the Community Rating System (CRS), is designed to reward communities that go above and beyond the minimum NFIP standards. One of the requirements of the CRS is to have a Floodplain Management Plan in place. Mr. Kneupper introduced Roxann Hayes, of the City's Planning Department. Ms. Hayes reviewed the draft Floodplain Management Plan with the Commission and asked for their comments prior to May 31 ~. Chairperson Waters thanked Ms. Hayes for her presentation. PRESENTATION BY THE DEVELOPER OF FAIRMONT OAKS APARTMENTS PROJECT, WHICH IS TO BE LOCATED AT 9801 WEST FAIRMONT PARKWAY. Dewayne Henson addressed the Commission. He noted that the Commission has granted Preliminary Plat approval, with conditions, for the Fairmont Oaks Apartment Project. Mr. Henson provided the Commission with copies of the proposed landscape layout and passed around photos of similar apartment projects they have done in the past. Mr. Henson introduced the architect for the project, Mark Mucasey. Mr. Mucasey described the layout of the project. All of the conditions of Preliminary Plat approval were discussed. The project layout does not allow for ingress/egress from Underwood Road. The Commission requested the design of the project be changed to show an Underwood entrance with card access. Mr. Mucasey stated that could be done and suggested a layout that addressed the Commission's concerns. IX. REVIEW DRAFT DRAINAGE CRITERIA CHAPTER FOR INCLUSION IN PUBLIC IMPROVEMENT CRITERIA MANUAL. Mr. Kneupper reviewed with the Commission, the draft drainage criteria chapter being proposed for inclusion in the Public Improvement Criteria Manual (PICM). Eddie Gray addressed the Commission. Mr. Gray asked for the opportunity to review the criteria with Mr. Kneupper, especially Sections 5.5.1 and 5.7. Knox Askins suggested the Commission take another look at the drainage criteria at the Commission's June meeting, prior to sending a recommendation to City Council. Mr. Kneupper will prepare additional information for review at the next meeting. X. STAFF REPORTS Mr. Malik updated the Commission on the status of the election and noted there would be a benefit barbecue at Little Cedar Bayou Park on May 22"d to raise money to help the family of a City employee, Domingo Cisneros, who was injured while on the job. Present Zoning: High Density Residential (R-3) Requested Use: Multifamily Residential Subdivision (188 Units) Background: Fairmont Oaks Apartments is a residential subdivision off Fairmont Parkway and Underwood Road (Exhibit A). The Preliminary Plat for Fairmont Oaks Apartments was approved by the Commission during their April 15, 1999 meeting with the following conditions: 1. Sidewalks are deemed necessary along Underwood Road and Fairmont Parkway and should be noted on the Final Plat. 2. Landscaping is required along all four perimeters of the property. 3. Provide sufficient recreational facility within the development for the tenants. 4. Investigate the possibility of constructing a deceleration lane along Fairmont Parkway. Analysis: Staff, using Development Ordinance 1444, Section 4.04 and Appendix D as a guide, has reviewed the Fairmont Oaks Apartments Final Plat and found it to be in substantial compliance with applicable ordinance requirements. Staffhas also reviewed the plat for conformance with zoning regulations and the goals and intents of the City's Comprehensive Plan. As indicated by the zoning designation, the proposed subdivision is compatible with the underlying "High Density Residential (R 3)" for Multifamily Residential Subdivision. As proposed, Fairmont Oaks Apartments has 188 units, which is 16 units per acre. Zoning regulations allow up to 27 units per acre. Fairmont Oaks Apts. - Fin•lat 6/17/99 - P & Z Meeting Page 2 of 2 Fairmont Parkway and Underwood Road are both major thoroughfares. The main entrance to the complex is along Fairmont Parkway. The project will have anentrance/exit and a separate exit only on Fairmont Parkway. There is also anentrance/exit on Underwood Road. The Development Project Section of the Harris County Engineering Department is currently reviewing a deceleration lane along Fairmont Parkway and sidewalks along Underwood Road and Fairmont Parkway rights-of--way. The developer has committed to the construction of these facilities. However, coordination with Harris County is required. The Fairmont Parkway storm water system at the said location will require on-site detention. The applicant has received approval from the Hams County Flood Control District. There is adequate potable water existing in the area to serve the subdivision. The easements proposed are adequate for the proposed services within the subdivision. Landscaping along with a landscape buffer 4' wide along the northerly properly line has been proposed within the development. An amenity center with a pool and a playground has also been proposed for the tenants as recreational facilities within the subdivision (Exhibit B). Responsibility for construction of the sidewalks should be specified by the covenants as well as stated in writing on the front of the final plat. Detention pond ownership and maintenance by the developer shall be stated on the final plat. The proposed subdivision will be located in Park Zone II. The City's Development Ordinance prohibits the dedication of parkland less than one acre in size; therefore, money in lieu of parkland would be required. Conclusion: Staff, based on its review, finds the Fairmont Oaks Apartments Final Plat to be in substantial compliance with all applicable City regulations. Staff recommends approval of Fairmont Oaks Apartments Final Plat with the provision that the plat not be released for recordation until; 1. All public improvements are complete. 2. Payment of $32,900 is made to the City in lieu of parkland dedication. The figure is based on a $175.00 per unit basis. As proposed, the subdivision will have frontage on both Fairmont Parkway and Underwood Road (Exhibit A). Under the terms of Development Ordinance 1444, the proposed development is considered to be a major subdivision. This is based on the size of the development (in excess of 10 acres). The Development Ordinance requires atwo-stage approval process for major subdivisions. The first stage is preliminary plat review and approval followed by submittal of a separate final plat, along with the construction drawings and other applicable documents. The Planning and Zoning Commission at its April 15, 1999 meeting, conditionally approved the Preliminary Plat of this subdivision. The conditions of approval were as follows: ' Installation of Sidewalks along Underwood Road and Fairmont Parkway. ' Landscaping along all four perimeters of the property. ' Provision of sufficient recreational facility within the subdivision. ' Construction of a deceleration lane along Fairmont Parkway. Analysis Staff, using Development Ordinance 1444, Section 4.04 and a site plan checklist as a guide, has reviewed the development site plan for the Fairmont Oaks Apartments and found it to be in substantial compliance with applicable ordinance requirements. Staff has reviewed the plat document and found it satisfies Development Ordinance criteria for graphic contents. Staff has also reviewed the construction plans and found them to be in accordance with the Development Ordinance. As proposed, the subdivision utility plan is satisfactory. The title letter submitted by the applicant satisfactorily documents property ownership; it verifies that no delinquent City or County taxes are due on the property. As a condition of Preliminary Plat approval, the Commission required public sidewalks in accordance with Section 5.02 of the Development Ordinance. Sidewalks are to be installed along Underwood Road and Fairmont Parkway rights-of--way abutting the perimeter of the proposed subdivision. The Fairmont Oaks Apartments will be located in Fairmont Oaks Apts. Site Plan Page 2 of 2 Pazk Zone II. The City's Development Ordinance prohibits the dedication of pazkland less than one acre in size; therefore, money in lieu of pazkland would be required. As proposed, Fairmont Oaks Apartments has 47 buildings with 188 units, which is 16 units per acre. Zoning regulations allow up to 27 units per acre. The required front yazd setback is 25' and the side yard setback is 20'. A utility easement 16' wide along the most northerly property line adjacent to Fairmont Park Subdivision, Section IV is granted to the City of La Porte. City water and sanitary sewer easement 16'wide is located along Fairmont Pazkway. Recommendation Staff has reviewed the major development site plan of Fairmont Oaks Apartments and found it complies with Section 4.09 of the Development Ordinance 1444.
