• • PLANNING AND ZONING COMMISSION MINUTES OF JUNE 17, 1999 Members Present: Betty Waters, Jim Zoller, Michael Jetty, Dottie Kaminski, Hal Lawler, Melton Wolters, Sandie Staniszewski Members Absent: City Staff Present: City Planner Masood Malik, Assistant City Attorney John Armstrong I. CALL TO ORDER. The meeting was called to order by Chairperson Waters at 6:02 PM. II. APPROVE MINUTES OF THE MAY 20, 1999, REGULAR MEETING AND PUBLIC HEARING. Motion by Melton Wolters to approve the minutes of May 20, 1999. Second by Sandie Staniszewski. All were in favor and the motion passed. III. CONSIDER APPROVAL OF THE FINAL PLAT OF FAIRMONT OAKS APARTMENTS, WHICH IS TO BE LOCATED AT 9801 WEST FAIRMONT PARKWAY. Masood Malik presented staff s report and recommended Commission approval of the plat. Motion by Melton Wolters to approve the Final Plat of Fairmont Oaks Apartments with the provision that the plat not be released for recordation until the following items have been completed. 1. All public improvements are complete. 2. Payment of $32,900 shall be made to the City in lieu of parkland dedication. The figure is based on an $175.00 per unit basis. The money will be placed in an escrow account and will only be used for the acquisition or improvements of public parkland or facilities located in Park Zone II, the zone in which Fairmont Oaks Apartments will be located. Motion by Sandie Staniszewski to approve the site plan for Fairmont Oaks Apartments including sidewalks. Second by Melton Wolters. All were in favor and the motion passed. V. STAFF REPORTS Mr. Malik briefly updated the Commission on the progress of the Comprehensive Plan Steering Committee. VI. ADJOURN Chairperson Waters declared the meeting adjourned at 6:26 PM. Lots 17 thru 32, Block 335 629 N. 8'h Street General Commercial (GC) Requested Zoning: Business Industrial (BI) Background: The property in question is located at the southwest comer of North 8'h Street and Barbours Cut Boulevard (Exhibit A). The property was developed in 1989 and included a temporary office building and a yard. The property is zoned general commercial and has not been developed for several years. Analysis: The area in which the subject tract is located is one that, based on the criteria established by the City's Comprehensive Plan, is suitable for either the present General Commercial (GC) or the requested Business Industrial (BI) zone. The request appears to be compatible with the goals and objectives of the Comprehensive Plan. A zone change would result in one-half of Block 335 being rezoned to Business Industrial, while the other half block along State Highway 146 remains General Commercial (Exhibit B). In addition, Staff has included lots 1-16 of Block 334 to the request because we feel this provides for better land use opportunities along Barbours Cut Boulevard. The applicant seeks to expand an existing business, known as Port Plaza across the street (Barbours Cut Boulevard) by developing truck service, maintenance, and repair facilities. Staff, in reviewing the applicant's request, has found it to be compatible with the Land Use Plan, Zoning, and uses of the nearby properties. The tracts in question are suitable for the requested change. As the tracts are bounded by Business Industrial to the north and east, and General Commercial to the south and west. The development within the subject tracts should not have any adverse impact on the surrounding area. A change from General Commercial to Business Industrial should not negatively impact the surrounding properties and should not harm the value of the nearby properties. • Port Properties, Inc. 7/15/99 — P & Z Meeting Page 2 of 2 Staff, in reviewing the applicant's request found it to be reasonable. The current land use shows the area to be intended for business or industrial development. Public infrastructure, however, should not be affected with this requested change. The overall impact on public services will be minimal. Moreover, the change would not adversely impact the public health, safety, and welfare of the City. Conclusion: Based on the above analysis, Staff recommends approval of the zone change request. The requested change would represent the highest and best use of the property. Toups) Requested for: Tract 13 D out of Enoch Brinson League, A-5 Location: State Highway 146, La Porte Present Zoning: Light Industrial (LI) Requested Zoning: Heavy Industrial (HI) Background: The property in question is located on north side of State Highways 146 & 225 and comprises 26.720 acres (1, 163, 928 square feet) situated in the Enoch Brinson League, Abstract No. 5, Harris County, Texas. All of the undeveloped property is facing Highway 146 on the east and Strang Road on the west within the corporate limits of the City of La Porte (Exhibit A). The Light Industrial zoning designation of the tract was assigned in September, 1989, when the City adopted the current Zoning Map, in conjunction with the Zoning Ordinance. PRAXAIR and DUPONT facilities are located on the west and north of the property across Strang Road in the Extraterritorial Jurisdiction of the City of La Porte, which is also known as the Battleground Industrial District. Analysis: The applicant, Mr. Doyle Toups, is seeking this rezoning to provide for development of a trucking operation with tank truck cleaning, truck maintenance, warehousing, distribution, and container storage on the property. The tank truck cleaning requires a HI zoning, whereas a trucking operation without tank truck cleaning may be developed in an LI zone. Conformance of a zoning request with the Land Use Plan is one consideration among several criteria to be considered when approving or denying an application. Other criteria may include: • Zoning and uses of nearby properties; • Suitability of the property for the uses permissible within the zoning designation; • Extent to which approval of the application would detrimentally affect or substantially harm the value of nearby properties; • Extent to which the proposed use would adversely affect the carrying capacity of existing public infrastructure; and, 0 Hwy. 146 & 225, L.P. 7/15/99 P&Z Meeting Page 2 of 2 Conclusion: • The gain, if any, to the public health, safety, and welfare of the City. Based on the siting criteria noted above, the tract in question is suited for an LI zone, which is a reasonable designation per aesthetic visual environment of the City. The proposed zone change will not create a visually appealing monument at the entrances and corridors of the City. One of the principle goals and objectives of the Comprehensive Plan is to develop entrance and scenic corridors, establish a first impression, enhance the appearance of major thoroughfares, and create a recognizable identity for LaPorte. The gateways establish a sense of arrival to an area, and create a first impression and lasting identity. The zoning regulations and districts as herein established have been made in accordance with a Comprehensive Plan for the purpose of promoting health, safety, morals, and general welfare of the City. Under the circumstances, the question at issue is whether there have been any changes in the area (development pressure, infrastructure changes, etc.) that warrant a rezoning. There has been, since the time of plan implementation, no change to the tract in question or the surrounding area that warrants either a rezoning or an amendment to the Comprehensive Plan. Furthermore, individual land development proposals should be considered for approval at the scale of neighborhood, sub -area, and development project planning, which are to be considered in subsequent zoning and rezoning actions by the City. • This request does not conform to the intent or recommendations of the Comprehensive Plan. • There have been no changes within the area in question that warrant an amendment of the Comprehensive Plan. • A change to the LI zone would be contrary to the goals and objectives of the Comprehensive Plan. Unless the applicant is able to demonstrate that the requested HI zone would be appropriate, the Commission should not grant the zone change request. The zone change would be in contrast to the Comprehensive Plan and contrary to the redevelopment strategy of the City.
