CALL TO ORDER. The meeting was called to order by Chairperson Waters at 6:05 PM. II. APPROVE MINUTES OF THE JUNE 17, 1999, REGULAR MEETING. Motion by Dottie Kaminski to approve the minutes of June 17, 1999. Second by. Michael Jetty. All were in favor and the motion passed. III. OPEN PUBLIC HEARINGS. A. CONSIDER ZONE CHANGE REQUEST #R99-001, REQUESTED FOR PROPERTY LOCATED AT 629 NORTH 8T" STREET DESCRIBED AS LOTS 17-32 OF BLOCK 335, AND LOTS 1-16 OF BLOCK 334, JOHNSON HUNTER SURVEY, ABSTRACT NO. 35, LA PORTE, HARRIS COUNTY, TEXAS. THE APPLICANT IS SEEKING A ZONE CHANGE FROM GENERAL COMMERCIAL (GC) TO BUSINESS INDUSTRIAL (BI). Staffs report presented by Masood Malik. Port Properties has made application for a change in zoning from GC to BI for their property located at 629 N. a Street. The change would result in one-half of Blk. 335 (Lots 17-32) being rezoned to BI, while the other half block along SH 146 remains GC. Staff has added Lots 1-16 of Blk. 334 to the request to provide for better land use opportunities along Barbour's Cut Blvd. Applicant intends to expand existing business, known as Port Plaza, across the street (Barbour's Cut Blvd.) by developing truck service, maintenance, and repair facilities. • 0 Planning and Zoning Commission Minutes of July 15, 1999 Page 2 of 4 Fourteen public hearing notices were mailed to surrounding property owners. Eight responses were received in favor of the request and none in opposition. Staff recommended approval of the request. 1. PROPONENTS District 5 Councilperson Charlie Young, of 214 Reynolds, addressed the Commission. Mr. Young believes rezoning will create a better mix in the area and will open opportunities for businesses that are compatible with the existing truck stop. 2. OPPONENTS There were none. B. CONSIDER ZONE CHANGE REQUEST #R99-002, REQUESTED FOR TRACT 13D, APPROXIMATELY 26.720 ACRES OF LAND SITUATED IN THE ENOCH BRINSON LEAGUE, ABSTRACT NO. 5, ALONG STATE HIGHWAY 146, LA PORTE, TEXAS. THE APPLICANT IS SEEKING A ZONE CHANGE FROM LIGHT INDUSTRIAL (LI) TO HEAVY INDUSTRIAL (HI). Staffs report presented by Masood Malik. Doyle Toups, on behalf of Hwy. 146 & 225, L.P., has made application for a change in zoning from LI to HI for 26.720 acres on the north side of State Highways 146 and 225, more specifically Tract 13D, Enoch Brinson League A-5. Applicant intends to develop a trucking operation with tank truck cleaning, truck maintenance, warehousing, distribution, and container storage. Tank truck cleaning requires HI zoning. Staff did not recommend approval of the request. 1. PROPONENTS Doyle Toups, part owner of the property in question, stated that a rezone was requested to accommodate tank truck cleaning for Superior Carriers, a company under contract to purchase the property. OPPONENTS District 5 Councilperson Charlie Young, of 214 Reynolds, talked about corridor beautification efforts of neighboring communities along SH 146. The area in question would be a good place for La Porte to begin concentrating on its own beautification plan. Rezoning this area is a bad idea. IV. CLOSE PUBLIC HEARINGS. Chairperson Waters closed the Public Hearings. V. CONSIDER RECOMMENDATION TO CITY COUNCIL FOR ZONE CHANGE REQUEST #R99-001. Motion by, Melton Wolters to recommend City Council approval of Zone Change Request #R99-001. Motion seconded by Hal Lawler. All were in favor and the motion passed. VI. CONSIDER RECOMMENDATION TO CITY COUNCIL FOR ZONE CHANGE REQUEST #R99-002. Motion by Melton Wolters to recommend City Council deny Zone Change Request #R99-002. Second by Sandie Staniszewski. All were in favor and the motion passed. VII. STAFF REPORTS Mr. Malik informed the Commission there would be a reception at City Hall for the new Police Chief Richard Reff on Tuesday, July 20 at 5:30 PM. Mini -Storage Dances is classified as a Analysis: Staff has reviewed this request using La Porte Code of Ordinances Sections 106-216, 106-217, and all applicable elements of the La Porte Comprehensive Plan as a guide. Considerations have been given to the following issues prior to making any land use decisions: • Character of the surrounding and adjacent neighborhoods; • Existing use of nearby properties, and the extent to which a land use classification would be in harmony with such existing uses or the anticipated use of the properties; Mini -storage • SCU99-003 8/19/99 (P&Z) Page 2 of 3 • Suitability of the property for the uses to which would be permissible, considering density, access and circulation, adequacy of public facilities and services, and other considerations; • Extent to which the designated use of the property would harm the value of adjacent land uses; • Extent to which the proposed use designation would adversely affect the capacity or safety of that portion of the road network influenced by the use; • Extent to which the proposed use designation would permit excessive air, water or noise pollution, or other environmental harm on adjacent land use designations; and, • The gain, if any, to the public health, safety, and welfare due to the existence of the land use designation. Staff would note that the tract in question is abutted on front by the major arterial road (West Main Street), the Public Works facility of the City of La Porte on the north, and approximately 300 ft wide utility easements to the east along the Southern Pacific Railroad. One half of the tract in question is located in General Commercial zone while the other half is split between Light Industrial and Business Industrial zones. The proposed use would have minimal impact on the surrounding properties. The transportation system should adequately accommodate through traffic and continue to provide for free flow of people, goods and services. The traffic flow within and between neighborhoods and throughout the community should not be affected by the proposed development. As existing roads are adequate to support the said project. The proposed development is in conformance with the City's Development Ordinance and the Thoroughfare Plan. Staff has reviewed existing facilities and services for each of the component of the utility system for the proposed development. Existing water is adequate for potable and fire protection needs. Sanitary sewer is readily available to the property. However, storm drainage needs to be carefully reviewed. To the south, the property abuts West Main Street. This is the most public face of the tract. Where the applicant should place a substantial portion of the facility's landscaping. The building style coupled with the proposed landscaping and setbacks should result in a facility that is attractive and compatible with surrounding properties. The request is compatible with the goals and objectives of the Comprehensive Plan. The specific use will be compatible with and not injurious to the use and enjoyment of other property, nor significantly diminish or impair property values within the immediate vicinity. Conclusion: Based on the facts and considerations presented above, staff recommends granting Special Conditional Use Permit #SCU99-003 subject to the following conditions: • This permit does not become valid until a formal Minor Development Site Plan has been submitted to the City; reviewed and approved in accordance with the requirements of Ordinance # 1444. • SCUP# 99-003 is specifically limited to the mini -storage warehouse (Phase I) as defined in SIC. # 4225. • The applicant shall pay the public hearing costs. Once the general plan has been approved, it will be followed with a site development plan for the proposed section of the plan. The general plan proposes approximately 4.5 acres of mini -storage warehouse with five proposed buildings and detention pond in the rear. The tract of land south of the Public Works facility of the City of La Porte faces North 23'd Street on the west and S.P.R.R. along with other service companies easements on the east (Exhibit B). Staff has reviewed the plan and found it to be in accordance with the zoning and development ordinance of the City. The plan conforms to the goals, objectives, and policies of the City's Comprehensive Plan. The review is based upon the following policy considerations: • Development should occur only in appropriate areas identified for that use. Appropriate areas include those with good roadway access and minimal impact on residential and recreational uses. Based on the criteria above, the area is suitable for the proposed use. As, it is not directly adjacent to residential area and has a good access to Spencer Highway. Furthermore, the tract is abutted by HL&P, Tennessee Gas Co., Magnolia Pipeline Co., and Coastal Industrial Water Authority easements to the east by the S.P.RR Using Appendix C of Development Ordinance No. 1444, staff has reviewed the general plan and finds it substantially complies with applicable ordinance requirements. Porte ETJ) Underwood Road @ Fairmont Parkway Background: Applicant is platting 156.4962 Acres of land into six restricted reserves for an Industrial Park in the Bayport Industrial District of the City of La Porte .(See Exhibit A). Analysis: Owner/Developer plans to develop the tract for industrial uses. The developer will construct streets and the storm drainageldetention system that will connect with the regional systems in accordance with the policies of the City and Harris County Flood Control District. City's Comprehensive Plan classifies Underwood Road as Primary Arterial, which has four lanes divided with R.O.W. capacity that allows for addition of two lanes. The Thoroughfare Plan proposes extension of Underwood Road into extraterritorial jurisdiction. The plat shows 50' R.O.W. to Underwood Road (See Exhibit B). The City has limited water and wastewater service to offer to this project. However, an agreement will need to be developed which establishes City's commitment for utility service and developer's commitment for other development criteria. 10' wide waterline & sanitary sewer easement, and 15' wide aerial easement have been shown around each restricted reserve. 70' wide strip is dedicated as a drainage easement along southern and northwestern property line. The City of La Porte excludes from the terms, conditions and effects of La Porte Development Ordinance and all amendments hereto, land included within the boundaries of any Industrial District or Districts within the Extraterritorial Jurisdiction of the City of La Porte. The property is located at the corner of Hwy. 146 and McCabe Road (Exhibit A). Background: The tract in question became part of the City of La Porte in December 1988. It was taken into the City as part of the annexation of the former Bayshore Municipal Utility District (Ordinance 1626). Subsequent to annexation, the City updated and amended the Comprehensive Plan in order to apply it to the newly incorporated areas. As a part of this process, zoning classification was assigned to the various tracts and subdivision (Ordinance 1501-J). The zoning designation assigned to the tract in question was P.U.D. On July 15, 1993, La Porte Planning and Zoning Commission considered approval of rezone request #R93-001 for 100.6034 acres to Low Density Residential (R-1) and the remaining 6.7526 acres to Neighborhood Commercial (NC). The Commission recommended approval to City Council. On August 9, 1993, City Council passed and approved Ordinance 1501-Q which authorized the R-1 and NC zoning of the property. These designations were found to be compatible with the goals & objectives of the Comprehensive Plan. The rezoning was requested in conjunction with the submittal of a General Plan for development of a single-family subdivision and a small commercial area. On April 21, 1994, the Planning and Zoning Commission was again asked to look at this tract. The property owners had re-evaluated their development options and asked to rezone of a portion of R-1 property (17 acres) to P.U.D. which opens the possibility of placing Mid to Higher Density Residential (apartments). The rezone request #R94-001 asked that a 17 acres tract be rezoned from R-1 to P.U.D. The rest of the tract would be composed of 83.59 acres zoned R-1 and 6.7526 acres zoned NC. The Commission recommended approval to the City Council. On May 23, 1994, City Council passed and approved Ordinance 1501-R, which authorized the P.U.D. zoning of new 17 acres tract. Bayou Forest Apts. 8/19/99 P&Z Meeting Page 2 of 2 Analysis: A comparison of the P.U.D. tract approved in 1994 and general plan submitted at this time shows that the proposed apartments were not located totally within the P.U.D. property. The proposed site is actually composed of a portion of N.C. and P.U.D. where 276 apartments plus 295 residential lots were proposed. Significant changes from previous plans for this area are as follows: 1. 65 acres of wetlands donated to the City of La Porte for City Park, and 2. A shift from an apartment / single family mix to all apartments (571 units). Conclusion: As noted above, this is a significant change from the previous land use considerations and would require a change in the zoning designation.
