CALL TO ORDER. Meeting called to order by Chairperson Waters at 6:00 PM. II. APPROVE MINUTES OF THE NOVEMBER 18, 1999 PUBLIC HEARING AND REGULAR MEETING. Motion by Dottie Kaminski to approve the minutes of November 18, 1999. Second by Hal Lawler. All were in favor and the motion passed. III. OPEN PUBLIC HEARING TO CONSIDER ZONE CHANGE REQUEST #R99-004. THIS REQUEST SEEKS A ZONE CHANGE FOR A 0.512 ACRE TRACT OUT OF THE W.P. HARRIS SURVEY, ABSTRACT 30, AND THE L.T. MOODY 14.484 ACRE TRACT OUT OF THE 200 ACRE W.W. RALSTON TRACT, HARRIS COUNTY, TEXAS, THE SAID PROPERTY, TRACTS 1A & 2A, BLOCK A, IS LOCATED ALONG SUNRISE DRIVE. THE FOLLOWING PROPERTIES WILL BE LOOKED AT AS A COMPREHENSIVE REZONING OF THE AREA. MOODY L.T. U/R: ABSTRACT 30, W.P. HARRIS: SUNRISE TOWNHOUSES: BAY COLONY CONDOS LOTS 3, 4, & 5, BLOCK A, TRACTS 1 B & 26, BLK. A, LOTS 1-5, BLK. B; TR 13C-1, 13C-2, & 13C-3 UNITS 1-25, BLDGS. I, 11, & III; UNITS A-L, BLDGS. A, B, & C. THE PRESENT ZONING IS PLANNED UNIT DEVELOPMENT (PUD) AND THE REQUESTED ZONING IS MEDIUM DENSITY RESIDENTIAL (R-2). Chairperson Waters opened the public hearing at 6:00 PM. Masood Malik presented staffs report. The applicant, Charles Whittenton, on behalf of the property owner, Bernice Polly Whittenton, requested the zone change in order to build a single family dwelling on property along Sunrise Drive. The current zoning is Planned Unit Development (PUD). The requested zoning is Medium Density Residential (R-2). Development of a single-family residence on an existing subdivided lot is not considered to be an effective use of PUD zoning. In addition to the Whittenton's property, some existing subdivided lots, existing townhouses, and condos were included by staff in the rezone request in order to place them in a more appropriate Medium Density Residential (R-2) zone. Planning and Zoning ComFF n Minutes of December 16, 19 Page 2 of 3 • Public notices were mailed to all property owners within 200 feet of the area in question. Staff received one response favoring the rezone and one "no opinion". 1. PROPONENTS Mr. Charles Whittenton, of 6358 Limestone, Houston, Texas, addressed the Commission. Mr. Whittenton has had the property for twenty years and always planned to live there upon retirement. Edith K. Walker, of 3819 Sunrise, addressed the Commission. Ms. Walker was present at the meeting in order to get a better understanding of what the rezone was all about. Chairperson Waters explained the circumstances surrounding the rezone request to Ms. Walker. She was grateful for the information and indicated her approval of the request. 2. OPPONENTS There were none. IV. CLOSE PUBLIC HEARING Chairperson Waters closed the public hearing at 6:12 PM. V. CONSIDER A RECOMMENDATION TO CITY COUNCIL FOR ZONE CHANGE REQUEST #R99-004. Motion by Melton Wolters to recommend City Council approval of zone change request #R99-004 from Planned Unit Development (PUD) to Medium Density Residential (R-2). Second by Dottie Kaminski. All were in favor and the motion passed. VI. DISCUSS ZONING ORDINANCE AMENDMENT REGARDING SHIPPING CONTAINERS. Masood Malik presented staffs report regarding a directive from City Council to staff to assess existing development conditions and future development strategies relating to the outside storage of shipping containers. Chairperson Waters suggested the Commission consider limiting the location for storage of shipping containers to Heavy Industrial zones, with conditions. Mr. Malik showed slides depicting containers currently being stored in several locations throughout the city. Staff proposed three scenarios to address the issue. After some discussions the Commission liked staff's second option, but felt there should be additional requirements as follows: 1. Storage of shipping containers shall be limited to HI zones. 2. All setbacks shall be a minimum of fifty feet (50'); front, rear, and side. Planning and Zoning Comml&n • Minutes of December 16, 1999 Page 3 of 3 3. Minimum landscaping shall be 6%. 4. Screening of storage area shall be achieved by the following: a. A three-foot (3') berm shall be constructed along the front and sides of the storage area. b. Landscaping shall be planted on top of the berm and shall be ten to twelve feet (10'-12') high at the time of planting. c. Landscaping shall be fast growing and green year round, such as Oak and Green Ash with assorted shrubs. 5. Landscaping shall be setback a distance so as not to interfere with overhead utilities. 6. Landscaping shall be maintained by the property owner and/or occupant. Irrigation may be required in order to achieve acceptable maintenance. 7. Stacking shall be limited to four (4) containers high, in a pyramid manner. 8. Security fencing shall be installed. Formal consideration regarding this matter will be at a future meeting. VII. STAFF REPORTS Chairperson Waters announced that Commission Member Michael Jetty had tendered his resignation effective immediately. Mr. Jetty and his wife are moving from La Porte. Mr. Malik thanked the Commission and staff for encouraging and supporting him during the past year and offered well wishes to everyone for the upcoming year. Vill. A 15.4191 Acre Tract out of the William M. Jones Survey, Abstract No. 482, Hams County, Texas and being a part of a 266.154 Acre Tract described in Film Code 184-69-2052 in the Office of the County Clerk of Harris County, Texas. Present Zoning: High Density Residential (R-3) Requested Use: Residential Subdivision (Note: Single Family dwellings are an allowable use in an R-3 (High Density Residential Zone) Background: Fairmont Park East is a residential subdivision located north of Fairmont Parkway and west of Driftwood Drive (Exhibit A). The General Plan for Fairmont Park East, Sections Five, Six, Seven, Eight and Nine on the east of Driftwood Drive, was approved by the Commission on April 16, 1998. The Preliminary Plat for Section VII was approved by the Commission during their November 18, 1999 meeting. Analysis: Staff, using Development Ordinance 1444, Section 4.04 and Appendix `D' as a guide, has reviewed Fairmont Park East Section Vil Final Plat and found it to be substantial compliance with applicable Ordinance requirements. Section 5.02 of the Development Ordinance empowers the Commission to require pedestrian sidewalks when it feels their inclusion will serve the public interest. Staff would recommend the inclusion of sidewalks within the subdivision. Responsibility for construction of the sidewalks should be specked by covenant. As proposed, Section VII has four blocks and 68 lots (Exhibit B), which equals 4.41 units per acre which is less than the maximum 4.8 units per acre established in the Zoning Ordinance. The subdivision is compatible with the underlying residential land use as depicted on the adopted Land -Use Map. The proposed subdivision will be located in park zone six. The City's Development Ordinance establishes an amount of land for parkland dedication equal to 1 acre per 160 lots. The Fairmont Park East, Sectio0I • Final Plat P&Z (1/20/00) Page 2 of 2 development ordinance also prohibits the dedication of parkland less than one acre in size; therefore, money in lieu of parkland would be required. The covenants for Section VI have been reviewed by the City Attorneys office and found to satisfy Ordinance requirements. Utility Construction Plans have been reviewed and approved by Staff. Conclusion: Staff has reviewed Fairmont Park East Section VII Final Plat and found it complies with the Development Ordinance. Staff recommends approval of Fairmont Park East Section' VII Final Plat with the provision that plat not be released for recordation until; 1. All construction improvements are complete. 2. Payment of $11,900.00 is made to the City in lieu of parkland dedication. 3.
