I. CALL TO ORDER.
Meeting called to order by Chairperson Waters at 6:00 PM.
II. APPROVE MINUTES OF THE MARCH 9, 2000, SPECIAL CALLED REGULAR
MEETING AND WORKSHOP MEETING.
Motion by Sandie George to approve the Minutes of March 9, 2000. Motion seconded by
Dottie Kaminski. All were in favor and the motion carried.
III. APPROVE MINUTES OF THE MARCH 16, 2000, REGULAR MEETING AND
PUBLIC HEARING.
Motion by Sandie George to approve the Minutes of March 16, 2000. Motion seconded by
Dottie Kaminski. All were in favor and the motion carried.
IV. APPROVE MINUTES OF THE APRIL 13, 2000, WORKSHOP MEETING.
Motion by Sandie George to approve the Minutes of April 13, 2000. Motion seconded by
Dottie Kaminski. All were in favor and the motion carved.
V. CONSIDER REQUEST BY NORTHRUP ASSOCIATES AND DAETWYLER
ENTERPRISES FOR A TIME EXTENSION FOR SPECIAL CONDITIONAL
USE PERMIT #98-001 GRANTED TO DAETWYLER ENTERPRISES
CORPORATION; LA PORTS 81, LTD.; LA PORTS 82, LTD.; AND LA PORTS
115, LTD. FOR THE TEXAS IMPORT/EXPORT PARS.
City Planner Brad Ellis presented stafFs report. La Porte 81, Ltd.; La Porte 82, Ltd.; La
Porte 115, Ltd., by Stuart Haynsworth, General Partner, and Daetwyler Enterprises
Corporation received approval from City Council on March 15,1999, for Special
Conditional Use Permit #98-001 for the proposed Texas Import/Export Park. Failure to
begin construction within one year after issuance voids the permit, unless a time extension is
applied for and granted by the Planning and Zoning Commission. The applicants are, at this
time, requesting aone-year extension for Special Conditional Use Permit #98-001.

Motion by Sandie George to grant cone-year extension for Special Conditional Use Permit
#SCU98-001. Motion seconded by Dottie Kaminski. All were in favor and the motion
carried.
VI. OPEN PUBLIC HEARING TO CONSIDER ZONE CHANGE REQUEST #R00-
003 FOR THE PROPERTY LOCATED AT 3600 UNDERWOOD ROAD, LA
~PORTE, HARRIS COUNTY, TEXAS. THE PROPERTY IS FURTHER
DESCRIBED BY THE HARRIS COUNTY APPRAISAL DISTRICT AS TRACT
813 & N 300 FT OF LOTS 698 & 699; LA PORTE OUTLOTS. THE APPLICANT
IS SEEffiNG A ZONE CHANGE FROM MID DENSITY RESIDENTIAL (R-2)
TO NEIGHBORHOOD COMMERCIAL (NC) TO ALLOW CONSTRUCTION
OF A BOAT & RV STORAGE FACILITY.
Chairperson Waters opened the Public Hearing at 6:08 PM.
Mr. Ellis presented staff's report. Reverend Oliver Stillwell, of First Assembly of God
Church, requested a zone change from R 2 to NC for property located in the 3600 Block of
Underwood Rd. in order to sell the property to a buyer wanting to construct a boat and RV.
storage facility.
1. PROPONENTS
Reverend Oliver Stillwell addressed the Commission. Rev. Stillwell, pastor of
First Assembly of God Church, located at 316 E. Fairmont Pkwy., stated the
property in question was acquired through a merger with the church on
Underwood that burned, Fairmont Assembly of God Church. Selling this
land would give the church an opportunity to continue doing things at their
location on Fairmont Pkwy.
2. OPPONENTS
Fred Young, who resides in the Summer Winds Subdivision, addressed the
Commission. Mr. Young does not want the property to be rezoned because
he feels that aboat/RV storage facility is an undesirable business to be
located next to a residential subdivision. Increased traffic, excessive lighting,
and a decrease in surrounding property values, were all reasons Mr. Young
gave for being opposed to the rezoning. He brought 17 signatures from area
neighbors also opposed.
Russell Hargett, who resides at 3617 E. Desert Drive, addressed the
Commission. Mr. Hargett doesn't like the idea of having a business located
behind his home. He expressed his opposition to the rezone.
Mike Mazariegos, who resides at 9501 Old Desert Rd., addressed the
Commission. Mr. Mazariegos researched the area before he purchased his
home and liked the fact there were no businesses nearby.

VII. CLOSE PUBLIC HEARING.
Chairperson Waters closed the Public Hearing at 6:25 PM.
VIII. CONSIDER RECOMMENDATION TO CITY COUNCIL FOR ZONE CHANGE
#R00-003.
Motion by Sandie George to recommend to City Council, denial of Zone Change Request
#R00-003. The motion was seconded by Dottie Kaminski. All were in favor and the
motion carried.
IX. STAFF REPORTS
There were no reports from staff.

Recently, you received a copy of a letter dated April 28, 2000, from Betty Waters,
Chairperson of the Planning and Zoning Commission. The letter informed you of
action taken by the Commission on April 27, 2000, to recommend to City Council,
denial of a rezone request that was submitted by Reverend Oliver Stillwell, of the
First Assembly of God Church. The property Reverend Stillwell was seeking to
have rezoned is located in the 3600 block of Underwood.
Rev. Stillwell, in a letter dated May 17, 2000, withdrew his request. This matter
will no longer be forwarded to Council for consideration.

Section III, First Amending Plat
Requested By: Earl W. Wilburn, Jr.
Requested For: Lots 27,28, and 29 of the previously approved and recorded final plat of
Summer Winds, Section III, consisted of 10.1878 Acres of land being Outlot
697 and portion of Outlot 698 in the W. B. Lawrence Subdivision, described
in Volume 83, Page 344 of the Harris County Deed Records, out of the
William M. Jones Survey A~82, City of La Porte, Harris County, Texas
Present Zoning: Low Density Residential (R-1)
Requested Use: Residential Subdivision
Background: Summer Winds is a residential subdivision located on the north side of
Fairmont Parkway and west of Underwood Road.
The Commission during their February 18, 1999 meeting approved the
General Plan for this subdivision.
The Commission during their March 3, 1999 meeting approved the
Preliminary Plat for Section III.
The Commission during their May 20, 1999 meeting approved the Final Plat
for Section III of this subdivision.
Analysis: In accordance with the City's Development Ordinance #1444, Section 4.06,
an Amending Plat may be filed for record in the County Map Records to
correct dimensional errors, notational errors or other erroneous information
as defined and provided for under Article 978a V.T.C.S. Section 5, provided:
• The signed Amending Plat Certificate (Enclosure 4, Appendix D) is
placed upon the face of the Amending Plat; and
• The Planning and Zoning Commission Certificate (Enclosure 4,
Appendix D) is placed upon the face of the Amending Plat; and
• Commission approval of said Amending Plat is reflected by Commission
execution of said certificate.
In the case of Summer Winds, Section lIi; there was a 16' utility easement
on Lots 27, 28 and 29 of Block 1, which has been requested to reduce it to
8'(Exhibit A). The applicant is correcting this error with this submittal in
order to provide the potential buyers with more space in their backyards.

The reduction of this utility easement does not affect the City's ability to
operate and maintain ow utility systems. Water, sanitary sewer and
drainage pipes are typically placed within the street right-of-way.
However, we have received responses fmm HL&P, Entex, SWBT, and
Time Warner Communications that each is in agreement with this
amendment to the size of the utility easement.
Conclusion: In reviewing the Summer Winds, Section III Amending Plat, staff finds it
complies with all ordinance requirements. Staff recommends the Summer
Winds, Section III Amending Plat be approved at this time.
