N. CONSIDER APPROVAL OF FINAL PLAT OF DOLLAR GENERAL STORE TO
BE LOCATED ALONG FAIRMONT PARKWAY AT FARRINGTON
BOULEVARD.
Planning Coordinator Masood Malik, presented staffls report. Donald French, on behalf of
A-TEX, LLC, has submitted a Final Plat for Dollar General, located on a 0.9294 acre tract at
10405 W. Fairmont Pkwy. Most minor plats less than 10 acres can be approved by the
Director of Planning. Since a waterline extension is necessary, the Planning and Zoning
Commission must review the plat. Staff recommended approval of the plat.
The Commission agreed there should be no curbs constructed along the access drive on
Farrington and that future development to the north must be required to install sidewalks.
Motion by Melton Wolters to approve the Final Plat for Dollar General. Motion seconded
by Ralph Dorsett. All were in favor and the motion carved.

A Comprehensive Plan Update community forum will be held at the Sylvan Beach Pavilion

Staff Report Fairmont Park East, Section Eight August 17, 2000
Preliminary Plat
Requested Action: Consideration of Preliminary Plat for Fairmont Park East, Section Eight.
Requested By: Mr. Eddie V. Gray, Trustee
Requested For: A 12.4793 Acre Tract out of the William M. Jones Survey, Abstract No.
482, Hams County, Texas and being a part of a 266.154 Acre Tract
described in Film Code 184-69-2052 in the Office of the County Clerk of
Harris County, Texas.
Requested Use: Residential Subdivision (Single Family Dwellings)
Background: Fairmont Park East is a residential subdivision off Driftwood Drive and
located between West Main Street and Fairmont Parkway (Exhibit A). The
General Plan for Fairmont Pazk East, Sections Five, Six, Seven, Eight and
Nine was approved by the Commission during their Apri116, 1998 meeting.
Per the General Plan, Section Five (18.9±ac.) along Fairmont Parkway and
Section Nine (2.85±ac.) along Spencer Highway aze designated as
Unrestricted Reserves and each is zoned General Commercial. Also as a part
of the General Plan, the developer set aside approximately 10 acres in
Section Six for storm water detention. However, the Final Plat for Section
Six reduced this to 8.5± acres.
Presently, Section Six is neazly built out and all the infrastructure for Section
Seven has been completed per approved construction plans.
Analysis: Section Eight is being considered for Preliminary Plat approval at this time
(See Exhibit B). As shown, this is a 4 block, 56 lot section. The layout
conforms to the approved General Plan. Staff has reviewed the Preliminary
Plat of Fairmont Park East Section Eight and found it to be in substantial
compliance with applicable provisions of both the Development Ordinance
and zoning regulations.
Staff also reviewed the plat for conformance with goals and intent of the
City's Comprehensive Plan and offer the following comments regarding
Sidewalks and Pazkland /Open Space.

Sidewalks
Staff notes that Section 5.02 of the Development Ordinance empowers the
Commission to require pedestrian sidewalks when it feels their inclusion will
serve the public interest. Staff recommends the inclusion of sidewalks along
all roadways in Section Eight including Driftwood .Drive. This would be
consistent with the Commission's actions on Sections Six and Seven.
Responsibility for construction of the sidewalks should be specified by
covenant as well as stated in writing on the Final Plat for Section Eight.
Parkland /Open Space
Attached to & incorporated as part of this staff report are two documents
dealing with the pazkland/open space issues for Fairmont Pazk East.

The Commission may wish to refer to these documents for more details.
However, the following points summarize the pazkland issues and concerns.
• The Fairmont Park East Homeowners Association Board has previously
contacted the City regarding parkland issues.
• Staff contacted the Boazd to see if there might be an opportunity to work
with the homeowner's association in redesigning the detention basin to
be usable park space.
• The homeowner's association was willing to discuss development of the
detention basin into usable parkland/open space. They also expressed
interest in acquiring additional parkland/open space for private use by the
homeowner's association.
• Staffvisited with Mr. Eddie Gray regarding the Association's open space
concerns and the possibility of securing parkland/open space by applying
the parkland/open space provisions of the Development Ordinance to
Sections Six thru Eight. If this provision were applied, the resulting
pazk/open space azea would be approximately 1.28 Ac.
• Mr. Gray indicated that he preferred not to have any pazkland/open space
extracted from Section Eight. He hoped to continue the platting process
for Section Eight without intemzptions or delays, and without changing
the proposed lot pattern.
• Mr. Gray then visited with the Fairmont Pazk East Homeowner's
Association President regazding their concerns.

• Fairmont Pazk East Homeowner's Association (Board) met on Tuesday,
August 1, and discussed this issue. The Board President verbally
reported to Mr. John Joerns the following:
• If the City (by applying its Ordinance) could only secure
approximately 1 Ac. of land in Section Eight, then the
homeowner's association would rather work with Eddie Gray,
the City, and the Association as a team to develop the 8.5 Ac.
detention basin as a park area.
• The homeowner's association requests that anoff-street parking
azea be a part of this effort. They also would like a reasonable
space azound the perimeter of the detention basin for transition to
the basin, landscaping, walking trail, etc.
Note: The staff is also interested in these features along with the
desire to have Mr. Gray's designers look at a lot plan that does
not back homes and fences up to the basin/pazk azea.
Since the August 1, Board meeting, both staff and the Boazd President
verbally communicated these issues to Eddie Gray.
Conclusion /Recommendations:
Staff suggests the Planning and Zoning Commission consider approval of
the Fairmont Park East Section Eight Preliminary Plat, subject to the
following conditions:
• Developer to file an amended General Plan to reflect the concerns of
parking and adequate space around the detention basin.
• Request planning for the residential portion of Section Five (currently
unplanned) to account for additional parking along with the goal to
avoid lots backing up against the detention basin.
• The submittal and approval of an amendment to the General Plan of
Fairmont Pazk East Sections Five thru Eight will be required before
approval of the final plat for Section Eight.
• A reference that the developer is responsible for construction and
installation of sidewalks within the Section Eight (including Driftwood
Dr.) should be stated in writing on the final plat.
Additionally, staff has listed items below that need to be addressed by the
developer with submittal of the final plat.

• HL&P street light plan and letter stating costs from HL&P is provided
for review by the City.
• Payment shall be made to the City for street sign installation. Sign
location and costs shall be determined by the City's Public Works Dept.
• Payment for street lighting cost shall be made to the City.
• Payment of $9,800 shall be made to the. City in lieu of parkland
dedication.
• Approval from the franchise utilities regarding the size and location of
the proposed utility easements shall be provided for City review and
approval.
• Construction drawings for water, sewer, paving & drainage shall be
submitted for review by staff. Preliminary construction plan review is
completed by the City and any changes will be made prior to the
submittal of the final plat.
• Subdivision covenants/deed restrictions for Section Eight shall be
provided to the City for review and approval.

Parkland Consideration
Parkland in Fairmont Park East
The Fairmont Park East Homeowners Association has previously contacted the City regarding parkland issues.
The need and/or desire foradditional parkland/open space in Fairmont Park East Subdivision is a complicated issue
that may soon involve actions by both P&Z and City Council. The following is a rough outline of the key issues.
Recent Events
Looking at the unsightly detention basin and seeing the maintenance challenge that the homeowners association has
with the 8.5+ Ac detention basin, staff contacted them to see if there might be an opportunity to work with the
homeowners association in redesigning the detention basin to be usable and maintainable. The City's benefit or
interest would be the potential to acquire additional public parkland in an area that is parkland deficient. Note: the
City has approximately $26,250 in this park zone fund which will grow to $36,050 if Fairmont Park East Section 8
is approved as proposed.
• The homeowners association (Board) was willing to discuss development of the detention basin into
usable pazkland/open space and they expressed interest in acquiring additional pazkland/open space for
private use by the Homeowners association. It was also noted that this may be an opportunity to
resolve the dispute. regarding payment of taxes on the improvements to the 1.9 Ac owned by the City
and leased to the homeowners association (swmuning pool and park area at Driftwood and Mesquite).
• Staff indicated we would visit with Eddie Gray regazding the possibility of acquiring pazkland/open
space when he develops in Section 8 of Fairmont East. Recently, Eddie Gray's consultant filed, for
review, a Preliminary Plat for Section 8.
• Staff visited with Eddie Gray regarding the association's open space concerns and the possibility of
securing pazkland/open space by applying the pazkland/open space provisions of the Development
Ordinance to Sections 6-8. If this provision were applied the resulting pazklopen space azea would be
approximately 1.28 Ac. Also, the City would have to return the $26,250 collected from Mr. Gray for
fees in lieu of land.
• •
Mr. Gray indicated that he preferred not to have any parkland/open space extracted from Section 8. He
hopes to continue the platting process for Section 8 without interruptions or delays, without changing
the proposed lot pattern and without having to dedicate pazkland/open space out of that section.
• Mr. Gray planned to visit with the Fairmont Pazk East Homeowners Association regazding their
concerns. I believe Mr. Gray tried to interest the homeowners association in the detention basin and/or
land adjacent to the detention basin as options to requesting amini-park/open space out of Section 8.
• Fairmont Park East Homeowners Association (Boadd) met on Tuesday, August 1 and discussed this
issue. The Board president verbally reported to me the following:
• If the City (by applying its ordinance) could only secure approximately 1 Ac of land in Section 8,
then the homeowners association would rather work with Eddie Gray, the City, and the
association as a team to develop the 8.5 Ac detention basin as a pazk area.
• The homeowners association is adamant that off-street pazking area be a part of this effort. They
do not wish to have Driftwood littered with cars. They also would like a reasonable space azound
the perimeter of the detention basin for transition to the basin, landscaping, walking trail, etc.
Note: The staff is also interested in these features along with the desire to have Mr. Gray's
designers look at a lot plan that does not back homes and fences up to the basin/pazk azea.
• The homeowners association would provide in writing their Boazd's position.
Since the August 1 Boadd meeting, both staff and the Board president verbally communicated these issues to Eddie
Gray.
Anticipated Events
Based on these events I anticipate the following:
• Mr. Gray will present a Preliminary Plat of Section 8 as he originally proposed.
Since our ordinance, if strictly enforced, would not result in a pazk/open space greater then 1.28 Ac,
the staff recommendation (pursuant to the homeowner association's position) will be to conditionally
approve the Preliminary Plat. The conditions suggested aze:
1. require the developer to file an amended General Plan to reflect the concerns of parking and
adequate space around the detention basin and;
2. request planning for the residential portion of Section 5 (currently unplanned) to account for
additional pazking along with the goal to avoid lots backing up against the detention basin.
• The submittal and approval of an amendment to the General Plan of Fairmont Park East Sections 5-8
will be required for approval of the final plat for Section 8.
• •
With this approach, the following concerns/benefits could be addressed.

This letter is to follow up our ,conversation on Wednesday, August 2, 2000. The
Fairmont Park East Homeowners Association, Inc. board of directors made a motion to
amend our deed restrictions so that the deed of our existing park area, could be transferred
from the City of La Porte to Fairmont Park East H.O.A. and the association could be
transferred the eight (8) acre retention pond to the City of La Porte to be used as a city
pazk with adequate off-street parking:
I have attached a copy of the motion so that Mr. Eddie Gray can continue his construction
towazd Spencer Highway. We believe this to be, in the best business interest of all
because we would not be able to receive adequate space to maintain another private park
for the homeowners in Section 8 of Fairmont Park East.
