PLANNING AND ZONING COMMISSION MINUTES OF AUGUST 17, 2000 Members Present: Melton Wolters, Hal Lawler, Dottie Kaminski, Ross Morris Members Absent: Betty Waters, Ralph Dorsett City Staff Present: Planning Director Doug Kneupper, Assistant City Attorney John Armstrong, Planning Secretary Peggy Lee I. CALL TO ORDER. Meeting called to order by Vice-Chairperson Wolters at 6:05 PM. II. APPROVE MINUTES OF THE MAY 24,2000, REGULAR MEETING. Motion by Dottie Kaminski to approve the Minutes of May 24, 2000. Motion seconded by Ross Morris. All were in favor and the motion carried. III. APPROVE MINUTES OF THE JUNE 15, 2000, REGULAR MEETING, Motion by Ross Morris to approve the Minutes of June 15,2000. Motion seconded by Dottie Kaminski. All were in favor and the motion carried. IV. CONSIDER APPROVAL OF THE PREUMINARY PLAT OF FAIRMONT PARK EAST SUBDIVISION, SECTION EIGHT. Planning Director Doug Kneupper presented staffs report. The preliminary plat for Section Eight of Fairmont Park East was submitted by Eddie Gray. Section 8 consists of 4 blocks and 56 lots on a 12.4793 acre tract. Mr. Kneupper reported that the General Plan, which included Sections 5,6, 7, 8, & 9, was approved by the Commission in April 1998. At that time, approximately ten acres were set aside for storm water detention in Section 6, but the Final Plat for Section 6 reduced that amount to approximately 8.5 acres. The following issues were noted regarding parkland concerns: · The Fainnont Park East Homeowners Association Board has previously contacted the City regarding parkland issues. · Staff contacted the Board to see if there might be an opportunity to work with the homeowner's association in redesigning the detention basin to be usable park space. . . Planning and Zoning Commission Minutes of August 17, 2000 Page 2 . The homeowner's association was willing to discuss development of the detention basin into usable parkland/open space. They also expressed interest in acquiring additional parkland/open space for private use by the homeowner's association. . Staff visited with Mr. Eddie Gray regarding the Association's open space concerns and the possibility of securing parkland/open space by applying the parkland/open space provisions of the Development Ordinance to Sections Six thru Eight If this provision were applied, the resulting park/open space area would be approximately 1.28 Ac. . Mr. Gray indicated that he preferred not to have any parkland/open space extracted from Section Eight He hoped to continue the platting process for Section Eight without interruptions or delays, and without changing the proposed lot pattern. . Mr. Gray then visited with the Fairmont Park East Homeowner's Association President regarding their concerns. . Fairmont Park East Homeowner's Association (Board) met on Tuesday, August 1, and discussed this issue. The Board President verbally reported to Mr. John Joems the following: · If the City (by applying its Ordinance) could only secure approximately 1 Ac. of land in Section Eight, then the homeowner's association would rather work with Eddie Gray, the City, and the Association as a team to develop the 8.5 Ac. detention basin as a park area. · The homeowner's association requests that an off-street parking area be a part of this effort They also would like a reasonable space around the perimeter of the detention basin for transition to the basin, landscaping, walking trail, etc. Staff is interested in these features along with the desire to have Mr. Gray's designers look at a lot plan that does not back. homes and fences up to the basin/park area. These issues were verbally communicated to Mr. Gray. The Commission asked Mr. Kneupper to clarify whether or not the residents were in favor of developing the. detention basin to also serve as a park area. Mr. Kneupper and Paul Rone, (president of the homeowner's association) indicated that was correct Staff recommended approval of the plat subject to certain conditions. Motion by Ross Morris to approve the Preliminary Plat of Section Eight of the Fairmont Park East Subdivision with the following conditions: · Developer to file an amended General Plan to reflect the concerns of parking and adequate space around the detention basin. . Planning and Zoning Commission Minutes of August 17, 2000 Page 3 . · Request planning for the residential portion of Section Five (currently unplanned) to account for additional parking along with the goal to avoid lots backing up against the detention basin. · The submittal and approval of an amendment to the General Plan of Fainnont Park East Sections Five thru Eight will be required before approval of the final plat for Section Eight. · A reference that the developer is responsible for construction and installation of sidewalks within the Section Eight (including Driftwood Dr.) should be stated in writing on the final plat. Motion seconded by Dottie Kaminski. All were in favor and the motion carried. v. STAFF REPORTS Mr. Kneupper encouraged the Commission to review the "Highlights Report" included in their packet. The report shows recent development activities within the community. The efforts of the City and the consulting firm of Hawes Hill & Patterson to create a plan that focuses on improving various aspects of the neighborhoods on the north side of town are nearing completion. The Northside Neighborhood Plan will eventually be forwarded to City Council for their consideration. Commission Members will receive a copy of the fmal document. The consulting firm for the Comprehensive Plan Update, Wilbur Smith Associates, is in the process of preparing a report from the comments received from citizens during the Open House/Reception held on June 20th at the Sylvan Beach Pavilion. Staff Report September 21, 2000 COMPREHENSIVE PLAN UPDATE PUBLIC HEARING AND RECOMMENDATION TO CITY COUNCIL Bacqround: The Comprehensive Plan Update was initiated with the Community Forum that was held at the Sylvan Beach Pavilion in October 1998. Citizens attending the Forum were asked to provide their thoughts and comments about the City. A steering committee was appointed by City Council that reviewed the list of comments generated from the Forum. With the help of a facilitator, the comments were divided into common themes. Staying with these themes or chapters, the steering committee prepared Goals and Objectives that addressed different areas of concern within the community. The city's planning consultant, Wilbur Smith Associates, took the goals and objectives prepared by the steering committee and began fonnulating the different chapters that make up the Comprehensive Plan. Each chapter contains Goals, Objectives, Policies, and Actions. As the planning consultant prepared chapters of the Plan, the steering committee would review the documents and make comments. Additionally, the City's Executive Staff would review the chapters as they became available. The task of reviewing the chapters was completed by December, 1999. The consultant incorporated comments from the steering committee and city staff and submitted a second draft of the Plan by the end of February, 2000. The Commission began their fonnal review of the document on March 9, 2000. Members of the Steering Committee were present and provided comments to the Commission. Staff and the consultant were on-hand to present the following Chapters to the Commission. 1. Introduction 2. Community Vision 3. Community Profile 4. Land Use On March 16, 2000 the Commission reviewed two more Chapters: 5. Transportation 6. Utility Systems On April 13, 2000 the Commission reviewed: 7. Parks and Recreation 8. Beautification and Conservation On May 24, 2000 the Commission finalized their revIew of the Comprehensive Plan by reviewing Chapters 11. Public Safety 12. Redevelopment Strategy 13. Implementation On the evening of June 20, 2000 the City hosted an Open House at the Sylvan Beach Pavilion. The purpose of the event was to infonnally present the Comprehensive Plan to the citizens and stakeholders of the community. . Attendees were asked to provide specific written comments regarding any and all chapters of the Plan. The planning consultants have assembled the comments into a report that is attached for your infonnation. Although the Commission reviewed and commented on all chapters of the Comprehensive Plan, the City's past practice has been to have the Commission host a Public Hearing regarding the Plan and then forward a recommendation to City Council. . . REGARDING Chairperson Waters announced the resignation of Jim Zoller. She stated that Mr. Zoller was an asset to the Commission and his absence will be sincerely regretted III. ADMINISTER OATH OF OFFICE TO ROSS MORRIS, NEWLY APPOINTED FROM DISTRIcr 3. Peggy Lee administered the Oath of Office to Ross Morris. IV. CALL TO ORDER WORKSHOP MEETING. Chairperson Waters called to order the workshop at 6:08 PM. A. RECEIVE OPENING STATEMENT FROM COMPREHENSIVE PLAN STEERING COMMITl'EE CHAIRMAN. The Steering Committee Chairman was unable to attend the meeting, therefore, Committee Member Pat Muston addressed the Commission. Mrs. Muston said a lot of long hours and hard work went into the draft Comprehensive Plan the Commission is now reviewing. While preparing the plan, they took into consideration everyone's comments from the Town Meeting held at the Sylvan Beach Pavilion on October 27, 1998. The Committee's best efforts were given to this project and they are very pleased with their accomplishment B. RECEIVE COMMENTS FROM COMPREHENSIVE PLAN STEERING COMMITI'EE MEMBERS. Committee Members present were Pat Muston, Imogene Pulleine,John Tomerlin, NIartha Love, and Peter Griffiths. . . Planning and Zoning Commission .Minutes of March 9, 2000 Page 2 of2 Committee Member Imogene Pulleine reminded the Co~sion that this is not a short-term plan, but rather a plan to last for twenty years. Committee Member John Tomerlin added he would like City Council to consider the comments made by the citizens at the Town Meeting and s12rt by first providing the basic services our city needs and expand from there. C. BEGIN REVIEW OF THE DRAFT COMPREHENSIVE PLAN UPDATE. Chris Bryce, of Wllbur Smith Associates, reviewed Chapters 1 through 4 with the Commission. 1. CHAPTER1-INTRODUcnON 2. CHAPTER 4 - LAND USE The only change the Commission recommended Was a new objective for Goal 4.5 in Chapter 4; to consider creating a large lot residential zoning district and provide the associated regulations for that type of zone. THE APPUCANT IS SEEKING A ZONE CHANGE FROM HIGH DENSITY RESIDENTIAL (R-3) TO GENERAL COMMERCIAL (Ge) TO ALLOW CONSTRUCTION OF A STORAGE BUILDING WITH AN ADDmONAL PARKING AREA FOR TIlE BUSINESS KNOWN AS TWO CAJUNS' CAFE. City Planner Brad Ellis presented staff's report for Rezone Request #R99-005. Zdda Wright, applicant and owner of Two Cajuns Cafe, and co-applicant Eddie Gray, have requested a zone change from High Density Residential to General Commercial for 5.08 acres, which includes La Petite Academy, Two Cajuns Cafe, , . . A restaw:ant is not an allowable use in a High Density Residential zone and Two Cajuns Cafe is a non-confonning use. Ms. Wright intends to construct a new building to the north with additional parking to the east of the existing building. Staff recommended approval of the zone change. THE APPUCANT IS SEEKING A ZONE CHANGE FROM GENERAL COMMERCAL (GC) TO BUSINESS INDUSTRIAL (BI) TO ALLOW CONSTRUcnON OF A TRUCK SALES CENTER. City Planner Brad Ellis presented staff's report for Rezone Request #ROO-001. The applicant, Amyn Nars~ requested a zone change from General Commercial to Business Industrial in order to open a used ttuck sales center in the 300 Block of Barbour's Cut Blvd. Truck. sales are not an allowable use in a General Commercial zone. In addition to the applicant's request to rezone Block 329, the City requested that Blocks 328, 330, and 331 be considered as part of the rezone request in order to provide a more uniform zoning district along Barbour's Cut Blvd. \ L PROPONENTS Davis Wilson, an Architect with Wtlson Zetty Associates, stated that in addition to used truck sales, the proposed business would also sell new ttucks. There will be an indoor showroom, as well as an outdoor showroom. 2. OPPONENTS There were none that spoke in opposition to the request V. CLOSE PUBUC HEARINGS. CONSIDER RECOMMENDATION TO CITY COUNCIL FOR ZONE CHANGE #R99-005. Motion by Melton Wolters to recommend City Council approval of R99-00S. Second by Sandie George. All were in favor and the motion passed. VII. CONSIDER RECOMMENDATION TO CITY COUNCIL FOR ZONE CHANGE #ROO-OOl. Motion by Dottie Kaminski to recommend City Council approval of ROO-001. Second by Melton Wolters. All were in favor and the motion passed. VIII. REVIEW DRAFT OF COMPREHENSIVE PLAN UPDATE. Chapter 5 - Transportation Thorovghfare S.ystem , Bret Keast led discussions regarding'transportation planning. Mr. Keast nored that the proposed Farrington Road extension has been a significant issue for numerous residents in the Lomax area. Residents from the area attended a steering committee meeting and stated their objection to the road extension. Wtlbur Smith Associates, addressing the technical aspects of extending Fatrington Blvd., prepared a technical memorandum for city staff. Mr. Keast reviewed with the Commission, the advantages and disadvantages that were listed in the memorandwn. Fire Chief Joe Sease addressed the Commission. Chief Sease described a need for north to south connector roads within La Porte. Cross streets are not present in the subject area possibly due to the fact that the Lomax area originally was a city unto itself. The location for the proposed Fire Station 3 remains undecided until such time that a decision is made regarding Farrington Blvd. Other streets to consider as north to south connectors might be Airport Blvd., on the east side of the airport, and Valleyview, between 'CP and "L" Streets. A major incident occurred during the last year at the railroad overpass on Spencer Hwy. Sens Rd. was shut down and the only way to move ambulances out of the area, because they were located down \Vind of the spill, was via Underwood Rd. Chief Sease also nored that a unit responding from Fire Station 2 to North "Rn Street at Lomax School Road currently travels 3V2 miles. The distance would be reduced to % mile if Farrington were extended. Extra starts and stops for fire trucks mean longer response times. Police Chief Richard ReEf addressed the Commission. Chief ReEf stared that a crime study was recently conducted to determine where activities were occurring within the City. With this information, the Police Dept is better able to deploy officers with quicker response times. The subject area had the second highest number of activities reported in 1999. When comparing response times, this area had a considerable delay due to the fact there are only two ways to gain access. The connection to Lomax School Road would allow easier access with lower response times. OUef ReEf agreed with Chief Sease that additional north to south . .. Planning and Zoning Commission Minutes of Match 16,2000 Page 4 of 5 connections, such as Airport Blvd. and VaIleyview, would also help f.J.cilitate the demand for easier access with quicker response times. Mike Claussen, Director of Operations for the La Porte School District, addressed the Commission. Mr., Claussen stated he lives one block off Farrington and travels Farrington to go home. There is a problem routing school buses in northwest La Porte-because of the limited north to south routes. Mr. Claussen favors the extension of Farrington to help alleviate the district's transportation problem. There is a safety concern for buses and parents that must travel the busy roads of Underwood and Spencer in order to transport children to and from schooL As a member of the LEPC, quick evacuation of a school might be necessary and this roadway would help in that situation. The district could realize a savings since shorter bus routes cost less money. Director of Public Works Steve Gillett addressed the Commission. Mr. Gillett is sympathetic to the need for north to south roadways. Responding to comments made previously about utilizing Airport ~lvd. for a north to south route, Mr. Gillett infonned the Commission that Airport Blvd. is located on airport property, therefore can not be considered. He added that airport activities have slowed down considerably since the departure of the flight school that operated from there. In order to attract a new tenant to that location, approximately six acres in the center of the airport, previously leased by the Texas Air National Guard, will soon have a looped 'road with utilities constructed up to the paved ramp. When asked about the possibility of future airport expansion, Mr. Gillett ' answered that the surrounding residential development has limited the chances for runway expansion. Mr. Keast noted that at the time the last Comprehensive Plan was prepared, it was anticipated that the Lomax area would develop with a higher density. Since this is not the case, the City may wish to consider establishing a roral residential designation for the area, which would limit density to large residential lots. If a collector roadway is constructed then the city should conduct a review of the future land use plan in order to control and manage growth in that area. Chairperson Waters stated that the steering committee, as well as the Planning and Zoning Commission, during previous meetings, discussed and were in favor of designating a large lot rural residential designation for the northwest area of La Porte. The consultant and staff will work on creating a new zoning district for large rural residential lots for the Commission to consider at a future meeting. The Commission recommended the extension of Farrington Blvd. to North "R" St be included in the Thoroughfare Plan. Neither the Commission, nor the consultant recommended the extension of Farrington Blvd. from North "H" Street to SH225 be included. . . Planning and Zoning Commission Minutes ofMaxch 16,2000 Page 5 of 5 The Commission discussed the extension ofValleyview between "H" and "L" Streets as another north to south connector. It was noted there is a pipeline conidor that runs somewhere along that route. The Commission recommended Canada Rd., between Fairmont Pkwy. and Spencer Hwy., also be included in the Thoroughfare PIan. Chapter 6 - Utility Infrastructure System Bret Keast led discussions regarding the Utility Infrastructure System. Mr. Gillett described the existing condition of the City's utility infrastructure system. The Commission was pleased with the contents of this chapter and did not recommend any changes or additions. The consultant and staff will try to schedule this meeting for the third or fourth week in June. Mr. Kneupper informed the Commission there might be slight modifications made to the Implementation Plan, such as updating the Capital Improvement PIan. Chairperson Waters requested a report be prepared that shows projects from our current Comprehensive Plan that have been completed, as well as projects that are being carried over to the new Plan. Everyone agreed this was a good idea. VI. STAFF REPORTS Mr. Ellis reported that Reverend Stillwell withdrew his rezoning request, therefore the recommendation of the Planning and Zoning Commission will not be forwarded to City Council. Open House Public Comment La Porte Comprehensive Plan Update On June 20, 2000, the City held an open house for the purpose of presenting the draft proposed Comprehensive Plan Update. The following comments were offered to the City concerning the Transportation, Land Use and Parks and Recreation Elements as well as a few general comments and requests for copies of the plan. Where provided, the authors of the comments are identified with names and addresses. Transportation Comments 1) Collector Street indicated on map does not exist between P and H. No name given. 2) I am opposed to the plan for North H Street to be made a through street: We asked at City Hall if the bridge would ever be put in on North H Street before we built our home there and were told it would never happen. Now you want a 4-lanel Janice Meekins, 10315 North H. Street. 3) I am opposed to the Farrington Street extension. This creates safety problems with the airport. This does not seem reasonable to me. Clarence Morgan 4) I am opposed to Lomax School Rd. becoming a through street because it would induce a traffic intensive environment and create more activity, creating more neighborhood problems. Nolan Allen, 10834 North "C" Street. 5) Ladies and Gentelmen: My name is James C. Adams, a citizen of La Porte, Texas since 1983, residing at 1606 Lomax School Rd. On the subject of Farrington being connected to Lomax School Road, I am totally against this. Right now my house is surrounded on three sides; one by a gas pipeline, the other by a city-owned lot, and the other by the rodeo arena, with Lomax School Road in between. The pipeline is a continuous danger due to its nature. The city-owned lot is not cut on a regular basis, therefore it has become a mosquito breeding ground and a thoroughfare for motorcycles and horses from the soccer fields. As for the rodeo arena, we used to have a quiet neighborhood, but now this arena is used by every cowboy within 75 square miles. We lost our softball fields because of this arena. Now after all this, the city wants to put this road through, connecting Farrington with Lomax School Rd. Folks, I moved here to get away from all this heavy traffic and have really enjoyed this area. However, the thought of this road going through almost makes me ill. At present, my two children are 10 and 13. I hate to think of them riding their bikes to neighbors with what will definitely be a very heavy used road. I had dreams of retiring here in Lomax in 10 years, but the thought of the danger to the children and all of the horseback riders using Lomax School road is stuck in my mind. To my knowledge, I know of no child or rider every hurt on Lomax School Road by vehicular traffic. Mark my word, this will change if this road is connected, dumping Fairmont and Spencer workers and students through Lomax. I really hope that our city council and planners will reconsider this move. After all, Lomax I considered outlots of sizeable portions, not a subdivision. This connection will destroy what we have worked so hard for here: quietness, safety and peace of mind. People can live here in La Porte and go to work somewhere else. b. Bay Area water, the Gulf area is our biggest asset, but people get scared when they see a bunch of trucks moving around and parked around. I think the City of La Porte should not allow "Truck Stop" related operations where people get turned off and don't get a very good impression about the City. Truck stop operation creates lots of problems, air pollution, noise, too many lights around the stop. This kind of business must be stopped in order to create a nice commerciaVresidential type impression. c. One more thing, the City should encourage the owner of metal buildings around 146 (on both the sides) to have them freshly painted. Maybe the City should consider providing them a can of fresh paint. d. Another thing is to do palm tree landscaping around Barbour's Cut, Main/Spencer and Fairmont Parkway intersections. e. Change the name of "Barbour's Cut Blvd." to something like "International Blvd., Commerce Blvd., Bayshore Blvd., etc. to appeal to the outsiders. It is hard to spell Barbour's Cut Blvd. I do not know why we have to constantly say we do not want Farrington to have any extension across Spencer Highway to 225. We do have a school with children that could be endangered by this! I teach my school children that the government can be trusted and a vote does count. Your council members were told what the voters wanted. Then you get a subcommittee and do exactly the opposite. The plan for Farrington is not immediate, according to you. Just delayed. STOP IT! I may have forgotten my glasses, but I will not forget your actions! 12) I believe that the City should seriously reconsider "opening up Lomax with the Phase I Farrington connections as well as proposed H Street extensions and roads to the north of P Street. This is a restricted neighborhood - not a dumping ground for through traffic and container trucks. I have talked with TxDOT officials and studied the FAA. 150-5300-13 Regulations and Standards and this road going through the RPZ goes against the safety standards established in that document. As far as safety goes, the video going to council says it all. Putting this road through an area of no sidewalks, deep ditches, and heavy, fast, traffic isn't just a bad idea, it is a serious violation of public safety. Please view the video. We are on a less traveled road now than L St. and P St. and that is why we bought on H St. If you open that up, you will double the traffic on N. H. St. This is a rural neighborhood community with lots of children and livestock and the Lomax residents enjoy use of this road for riding, exercising, FFA events, etc. This proposed cut-through the City is trying to push through is illegal. It is clearly against FAA regulations, and airport transportation regulations. The City is highly aware of this and is trying to circumvent the rules underhandedly. Clearly there is an ulterior motive for all this skullduggery. The people of Lomax have protested this for years. This is unnecessary use of our tax powers. The city is feverishly trying to find reasons to justify this road. Something stinks! ALSO - NO bridge connecting subdivision to N. H St. this is also totally unnecessary and will only provide non-Lomax residents a means to cut through our rural neighborhood and run it!! We are not a highway but a way of life in Lomax!! Stop ignoring the deepest wishes of the people you are supposed to represent. - 18) I am "STRONGLY" opposed to connecting Lomax School Road to Farrington. This issue has been opposed by the neighborhood. Our opposition has been expressed verbally to City Council and in writing and before the steering committee. Traffic is heavy and fast already. If you turn Lomax School Rd. into a connecting thoroughfare and/or a 4-lane road, it will be impossible to get in and out of our driveways and become "very" dangerous for our children and livestock. When you connect H St. through to Underwood, you compound the traffic and safety issues for all of us that live there. These are large lots and there are MANY horse ranches and people with livestock. I've been told there are fire, police and school transportation issues, but have been unable to see any data/research that has been done by these departments. The former Lomax area is one where children raise animals, learn how to farm and generally enjoy being able to walk, ride bicycles and horses. People move to this area to have the land to do these things. Less houses means less traffic; however, another through road will generate more cars in this neighborhood. If there is data on the response time, number of deaths caused by a delay in response time or any other explanation for why our tax dollars will be used on a project that so many people in the area oppose, ,I would greatly appreciate having access to that data. La Porte has many other areas which could use improvement - roads in the main part of La Porte, senior citizen transportation, etc. I would gladly agree to my tax dollars being used for necessary improvements. I'm not surprised the City of La Porte holding this informal meeting where you don't have to meet the people in person. You heard the people at the last open hearing and you didn't listen to the people who don't want their home and lives destroyed. We own property here in La Porte because we want to have a few animals. My family has owned property in La Porte since 1955 and wanted to make this our home because it was the closest thing to country, but also be able to make a living. There were people trying to get involved in the planning works and none of you listened. This meeting to get the people's input was the BIGGEST JOKE! No name given. 26) Per your "redevelopment strategy" you list Heritage, Neighborhoods and Small Town Atmosphere as ASSETS - yet your transportation plans concerning H Street (Farrington Rd. connection and H bridge) are going to destroy those very assets you brag about. Gray Low Density Residential (R-l), and General Commercial (GC) At your meeting on August 11, 2000, the Commission approved the Preliminary Plat for Fairmont Park East, Section 8 with the following conditions. 1. The developer shall file with the City an amended General Plan for the area east of Driftwood that would reflect the concerns of parking and adequate open space around the detention pond. 2. As part of this amended General Plan, show a general layout of the residential area south of the detention pond. Account for additional parking along with the goal to avoid lots backing up against the detention basin. 3. The submittal and approval of an amendment to the General Plan of Fairmont Park East, Sections Five through Eight will be required before approval of the final plat for Section Eight. The applicant has submitted an amended General Plan. The amended General Plan does address the fIrst part of condition number 1. An area has been reserved for the future creation of a parking lot. The area is roughly 00' x 00' and could accommodate approximately 00 cars. This facility would eventually serve patrons visiting the detention /park area. The second part of . condition number 1 has not been addressed. There is not enough detail shown on the General Plan to indicate the area between the detention pond boundary and the top of the detention pond slope. The City's Drainage Criteria Manual, which was adopted after the construction of this detention pond, requires a minimum 12' of open space around the perimeter of detention ponds. The goal here is to provide enough usable area around the perimeter of the detention pond to be able to perform maintenance and provide amenities such as a walking trail and landscaping, etc. The amended General Plan addresses the first part of condition number 2. A single family residential layout is shown. However, the second part of condition number 2 has not been addressed. No attempt has been made to avoid lots backing up against the detention basin. The Plan shows 12 residential lots backing up against the detention / park area. Fainnont Park East Amended General Plan September 21, 2000 Page 2 of2 Summary and Recommendation: . . The City, Developer, and Fainnont Park East Homeowner's Association (Board) have had preliminary conversations regarding improvements to the detention pond to create parkland / open space. All three parties are in favor of this action and it appears some future improvements will be made to the detention / park area if approved by City Council and the Homeowner's Association. Chapter 7 Parks and Recreation, which is part of the City's updated Comprehensive Plan, provides some park site selection criteria. One of the criteria listed is that desirable views into and out of the park site should be optimized. Constructing wood fences along the entire length of the southern park / detention boundary does not optimize the views into or out of the park site. It has been the City's experience that parks with low street visibility are not aesthetically inviting and are not well utilized. Another item to consider is access to the commercial area adjacent to Fainnont Parkway. The Commission may want to consider an internal access system for that area that would limit and reduce the number of future driveways directly connected to Fainnont Parkway. This would reduce the number of driver intenuptions along this major arterial roadway. The City, Homeowner's Association, and the Developer are interested in creating a park and recreation area within the existing detention pond. The City and the Homeowner's Association have a desire to construct a quality park environment with a feeling of openness that attracts park patrons. The Commission, at the August 17, 2000 meeting, was clear in stating that this amended General Plan achieve the goals to avoid lots backing up against the detention basin and provide additional open space around the perimeter of the detention pond. The submitted amended General Plan does not achieve these goals. In addition, it is staffs recommendation that efforts be made to plan for future driveways within the commercial area adjacent to Fainnont Parkway. Based on the above statements, staff does not recommend approval of the submitted amended General Plan for Fainnont Park East, Sections Five through Eight. It is recommended that the Developer follow the guidelines established by the Commission when the Preliminary Plat for Section 8 was given conditional approval. Present Zoning: High Density Residential (R-3) General Commercial (GC) Requested Use: Single-family dwelling Background: Fairmont Park East is a residential subdivision located north of Fairmont Parkway and west of Driftwood Drive (Exhibit A). The General Plan for Fairmont Park East, Sections Five, Six, Seven, Eight and Nine on the east of Driftwood Drive, was approved by the Commission on April 16, 1998. The Commission during their August 17, 2000 meeting conditionally approved the Preliminary Plat for Section Eight. One of the conditions is an amendment to the General Plan of Fairmont Park East Section Five thru Eight prior to the approval of the Final Plat for Section Eight. Item VII of this agenda reviews the amended General Plan. Analysis: Staff, using Development Ordinance 1444, Section 4.04 and Appendix '0' as a guide, has reviewed Fairmont Park East Section Eight Final Plat and found it to be substantial compliance with applicable Ordinance requirements. Section 5.02 of the Development Ordinance empowers the Commission to require pedestrian sidewalks when it feels their inclusion will serve the public interest. Staff would recommend the inclusion of sidewalks within the subdivision. Responsibility for construction of the sidewalks should be specified by covenant. As proposed, Section Eight has 4 blocks and 56 lots (Exhibit B), equals 4.4 dwelling units per acre, conforms to the City's Code of Ordinances. A density of about four dwelling units per acre also conforms to the intents of the City's Comprehensive Plan. . Fainnont Park East, Section Eight Final Plat P&Z (9/21/00) Page 2 of 2 . The proposed subdivision will be located in park zone six. The City's Development Ordinance prohibits the dedication of parkland less than one acre in size; therefore, money in lieu of parkland would be required. The covenants for Section Eight have been reviewed by the City Attorney's office and found to satisfy ordinance requirements. Paving, drainage, and utility construction plans have been reviewed and approved by Staff. Conclusion I Recommendation: There are still outstanding issues with regard to the Amended General Plan for Fairmont Park East, Sections Five through Eight. None of these issues directly affect the layout of Section Eight. Staff suggests the Planning and Zoning Commission consider approval of the Fairmont Park East Section Eight Final Plat subject to fulfilling all conditions of the prelim inary plat approval with the exception of the Amended General Plan. Staff recommends that the City and Developer continue to work to resolve the issues with the Amended General Plan and that an Amended General Plan be finalized and approved by the City prior to the recordation of the Final Plat for Section Eight. Mr. Edward Dutko, General Partner, Forest Holdings Ltd., L.L.P. A 107 acre tract out of the W. P. Harris Swvey, A-30, La Porte, Harris County, Texas (Exhibit A). This property is further described as being located in the 1200 Block of McCabe Road. The project is identified as the Park Forest Apartments. Neighborhood Commercial (NC), Planned Unit Development (PUD), and Low Density Residential (R-l) Multi-Family Residential This property is located at the southwest comer of SH 146 and McCabe Road. It is bounded on the east by Shady River Subdivision and on the south by Shoreacres. Mr. Ed Dutko made a presentation of his proposed General Plan to the Planning and Zoning Commission on August 19, 1999. This General Plan, which was a modification from previous development submittals, demonstrated that 75.7 of the 107 acres would need to be preserved based on a permit he received from the US Army Corps of Engineers. ,The permit states that a Conservation Easement will need to be established that will preserve the 75.7 acres in perpetuity. In addition, the permit states that noxious plant species such as Chinese tallow, cattail, and willow will be controlled for a period of 5 years. The remaining developable acreage shows 28.5 acres as high-density residential and 1.35 acres as a commercial comer (Exhibit B). The Commission was receptive to this plan , and suggested Mr. Dutko proceed with formal submittals for Phase 1 which is approximately 16 acres in the existing PUD zoning district. Development in a PUD zoning district requires ,that a General Plan (for the entire proposed project) and a Special Conditional Use Permit (SCUP) (for the initial phase of development) be submitted and processed simultaneously. Upon approval of the General Plan and SCUP the applicant would be authorized to submit a Major Development Site Plan. This Site Plan would be reviewed and acted upon by the Commission. Approval of the Site Plan would allow the applicant to submit building plans for review and then to begin construction of the project. Section 106-659 of the Code of Ordinances establishes the following criteria for review of development projects within a PUD zoning district: Park Forest Apts. , Phase I SCUOO-OO 1 September 21,2000 Page 2 of 3 . . . Uses - Review of the City's adopted Land Use Plan indicates this 107 acre area was envisioned as developing as low density residential with a small corner for commercial uses. Although the Forest Park Apartments is not considered to be low density residential, if you take into consideration the 75.7 acre Conservation Easement, the overall 107 acre tract yields dwelling units per acre that is comparable to low density residential. The proposed high-density residential use should not be detrimental to the use and enjoyment of surrounding properties. With the 75.7 acre Conservation Easement, this development will be well buffered. During review of the site plan, staff and the Commission should look for sufficient open space, adequate parking, and a good mix of recreational amenities. With regard to the commercial area, the proposed commercial corner is an ideal location for a convenience type activity. . Streets - Being located at the corner of SH 146 and McCabe Road provides more than adequate accessibility into and out of this site. Access into Phase 1 and Phase 2 of this development will be provided by a private drive that is shown on the General Plan. At the south boundary of this General Plan . the developer has shown a road right-of-way to serve existing lots in the City of Shoreacres. Although the road will need to be constructed at some time in the future, it should not fall under the maintenance responsibility of La Porte. . Topography - this area is relatively flat and stable and should not be an obstacle to this type of development. . Density - staff utilized the Land Use Plan as a guide. With the designated land use as Low Density Residential and applying a development ratio of 4.8 units per acre (Section 106-333) to 107 acres, this property may have, at one time, yielded approximately 514 dwelling units. This current plan designates only 26 acres to be developed as residential. If we applied a density of 19.7 units per acre, this would yield the same number of total dwelling units. This density is considerably less than the 27 units per acre allowed in R-3 zoning districts. Other examples of multi-family residential projects are the Fairmont Oaks Apts. that has a density of approximately 16 units per acre and the Plaza at San Jacinto Park on Luella Blvd. that has a density of 24 units per acre. . Utilities - there are sufficient water distribution facilities along McCabe Road to supply potable water and fIre protection to this proposed project. Provisions will have to be made to ensure that sufficient utility extensions can be made to serve Phase 2. Sanitary sewer service is not readily available to this site. There is a sewer force main located along the south line of this property that transports sewer to the Gulf Coast Waste Disposal Authority plant. A tie-in can be made to this force main but the City will need to make improvements to a nearby lift station in order to accommodate the additional flow from this project. The City has anticipated upgrading this lift station and funds are budgeted to . . . Park Forest Apts. , Phase I SCUOO..oO 1 September 21,2000 Page 3 of3 accomplish this. The applicant, through a Sewer Service Agreement, should commit to paying for the lift station improvements needed to provide sewer service to his project and be responsible for the on-site improvements needed to serve this project. The City has prepared a plan for providing sewer service to unserved areas of southeast La Porte. The plan calls for a regional lift station to be constructed in, the vicinity of McCabe Road and Taylor Bayou. This General Plan should show a 50' x 50' lift station site adjacent to McCabe Road and Taylor Bayou. The dedication of this site may be negotiated in the Sewer Service Agreement. . Drainage - this property lies within the Taylor Bayou watershed. There are not sufficient channel improvements ta directly receive stann water runoff from this project. The simplest solution would be for the applicant to provide stonn water detention within his project. Recommendation: Based on items discussed under Analysis, staff recommends approval of the General Plan covering 107 acres and the Special Conditional Use Pennit covering 16.2 acres with the following conditions: 1. The overall density of the project (phases 1 and 2) shall not exceed 19.7 dwelling units per acre. 2. Paragraph 306 specifies OFZ standard dimensions. (4) Threshold. The threshold obstacle clearance surfaces, defmed in Appendix 2, paragraph S, require clearing of object penetrations. (5) NA V AIDs. The FAA, normally, limits aeronautical studies of existing objects to obstructions to air navigation which are Dot included in the criteria cited in paragraphs 211a(1) through (5). (7) ,Runway.. Protection ZOne. (RPZ). The RP~earing of incompatible objects and activities as specified in paragraphs 2118(I)(a) and 212a(2). (8) General. Other objects which require clearing are those which generally can have an adverse effect on the airport. These include objects in the inner part of the approach area (coinciding with the RPZ) such as fuel handling and storage facilities, smoke and dust generating activities" misleading lights, and those which may create glare or attract wildlife. Other objects which are desirable to clear, if practicable, are objects which do not have a substantial adverse effect on the airport but, if removed, will enhance operations. These include objects in the controlled activity area and obstructions to air navigation which are not covered in paragraph 211.a, especially those penetrating an approach surface. On a paved runway, the approach surface starts 200 feet (61 m) beyond the area usable for takeoff or landing, whichever is more demanding. On an unpaved runway, the approach surface starts at the end of the area usable for takeoff or landing. 212. RUNWAY PROTECTION ZONE (RPZ). The RPZ's function is to enhance the protection of people and property on the ground. This is achieved through airport owner control over RPZs. Such control includes clearing RPZ areas (and maintaining them clear) of incompatible objects and activities. Control is preferably exercised through the acquisition of sufficient property interest in the RPZ. a. Standards. (1) RPZ Confil!urationlLocation. The RPZ is trapezoidal in shape and centered about the extended runway centerline. The controlled activity area and a portion of the Runway OFA are the two components of the RPZ (see figure 2-3). The RPZ dimension for a particular runway end is a function of the type of aircraft and approach visibility minimum associated with that runway end., Table 2-4 provides standmI.4im~*..:RPZs.' Other than with a ~ application of dec1ared distances, the RPZ ~ 200 feet (60 m) beyond the end of the area usable for takeoff or landing. With a special application of declarcd-distances, see Appendix 14, separate approach and departure RPZs are required for each nmway end. . (a) The Runwav OFA. Paragraph 307 contains the location, dimension, and clearing standards for the Runway OFA. (b) The CoatroUed Activity A!g. The controlled activity area is the portion of the RPZ beyond and to the sides of the Runway OFA. Chap 2 (2) Land Use. In addition to the criteria specified in paragraph 211, the following land lIse criteria apply within the RPZ: (a) While it is desirable to clear all objects from the RPZ, some uses are permitted, provided they do not attract wildlife, are outside of th~ Runway OFA, and do not interfere with navigational aids. Golf courses (but not club houses) and agricultural operations (other than forest!)' or livestock farms) are expressly permitted under this proviso. Automobile parking facilities, although discouraged, may be pennitted, provided the parking facilities and any associated appurtenances, in addition to meeting all of the preceding conditions, are located outside of the object free area extension (as depicted in figure 2-3). Fuel storage facilities should not be located in the RPZ. (b) Land us rohibited om the RPZ are: residences .and places of pu ic assembly. (Churches, schools, hospitals, office buildings, shopping centers, and other uses with similar concentrations of persons typify places of public assembly.) We think that for those P &Z commission members who live in subdivisions with sidewalks, curbs, and quiet streets, it may be hard to see the traffic dangers in Lomax where the main streets are our sidewalks and they fall off into deep ditches. If a picture is worth a 1000 words; then this video speaks volumes about the negative safety impact the Phase 1 Road will have on the children and citizens of our residential neighborhood. For those members that already live under the conditions you see on the video, We think you'll understand our safety concerns. The video was filmed from a mail box located in the North half of Lomax School Road; 3 ft. from the road edge, looking North. The junction at the stop sign is "P" street. The Rodeo Arena, Fire Station # 3, the ball field, and the Old Lomax City Hall are on the right. A section of North West Park is on the left. The video is compressed from 6 hrs. of taping. The video segments are "the middle of the road" concerning traffic volume and speed. There are times with no traffic for a few minutes, and there are times during special events at the Rodeo Arena when traffic is much heavier than in the video. The segment from minute 7:45 to 15 is continuos. Most of the traffic you see whizzing by the stop sign is traveling 50 + miles an hour... through a residential area where residents have to back out onto the road; children ride their bikes and walk 4H animals; and residents ride their horses to the arena...all on the same narrow roads with the heavy fast traffic you see in the video. Minute 2: 10 captures our greatest safety concern. When the child on the bicycle darts into the road, the car moves into the on coming lane to avoid hitting the child. A White Cross stands by the road just 60 ft. from where the child was almost run over. That White Cross belongs to a young man that was hit and killed by a vehicle. Moving into the oncoming lane is the safety net that lets us cope with a very dangerous traffic situation in Lomax and it is repeated many times every day. You will see the safety net used 3 more times, just in this video. Richard Wong's July 27, 1999 technical report on the Phase 1 Road emphasis's that the Phase 1 Road will increase cut through traffic in the Glen Meadows and Lomax Neighborhoods. Under Recommendations, Mr. Wong States that Not having the Phase 1 Road, "...significantly burdens other area roadways including arterial, collector and local residential streets." The other roadways he speaks of are Sens Road and Underwood Road. If that is true, then the small 2 lane Phase 1 Road through a residential neighborhood would have to have bumper to bumper high speed traffic in the effort to relieve the "significant burden" on the two major commercial roads of Sens and Underwood. The Dangerous traffic on Myrtle Creek that has been a major issue for so long also emphasizes the Phase 1 Road will increase traffic. In the Myrtle Creek issue drivers were cutting through the Creekmont residential area on Myrtle Creek to avoid the 1 signal light at Spencer/Underwood. Myrtle Creek is a 2 .. winding road with 2 stop signs. Would drivers choose to avoid that same Spencer/Underwood signal light. . . PLUS 3 more congested signal lights by traveling down Farrington to P street, then to Underwood through what would probably be 3 stop signs? Myrtle Creek has already given us the answer to that question. Traffic will increase greatly and our safety net would vanish. After viewing the video We think you'll understand why We believe the Phase 1 Road is not just a bad Idea; It is a serious disregard for the public safety of our citizens. We apologize for the Video being out of focus near "P" Street. The camera was focused short range to help you see what it is like to be close to the road with fast traffic whizzing by a few feet away; but it really did not accomplish that. It seems that that experience needs to be first hand so we invite you spend a little time in our neighborhood and get the first hand feel of what it is like to ride a horse, bike, or walk intermingled with fast traffic on narrow roads with steep ditches, and in many areas, no road shoulders. We'll gladly supply the bike or horse for your experience. Mrs. Waters; We have studied the audio tape of the 3-16-00 P&Z meeting about the Phase 1 road and we would like to present the following facts about statements made in that meeting. We have provided an audio tape of the meeting for your reference: 1. Consultant Project Manager, Consultant Bret Keast introduced Fire Chief Joe Sease &, Police Chief Richard Reff as,"..the City staff members here tonight; They want to kind of present an objective overview of pros & cons I guess" of extending some form of connection between the Farrington Rd. & Lomax School Rd." Mike Clausen with the School District Transportation also spoke. Joe Sease, Richard Reff, & Mike Clausen, whose jobs are our safety, presented NO cons on the Phase 1 road. They were not objective, and many of their statements were not correct. I talked with Mr. Sease & Mr. Clausen in 98' about the safety concerns of the 574 citizens signing the petition to stop all 3 phases of the proposed Highway, so they were well aware of the "cons" & yet they did not say one word about the "cons". Fire Chief Sease stated that the EMS (ambulance) needs Phase I; but he had to admit in our last talk that because EMS is located near Sens at Spencer; Phase 1 could only be an advantage in response time if an ambulance was returning on Spencer empty, if it was just opposite Phase 1, and if it was re-routed to an emergency in Lomax that was just opposite Phase 1 at that very moment; and that is a lot of ifs. Mr. Sease has admitted in writing in response to an Open Records request that he has not done any study or data analysis to prove his opinion that Phase 1 would lessen Citizen's exposure to fire damage. Mr. Reft's speech centered on "considerable delays in response times" and "comparing response times" for the police. I have studied Mr. Reft's data through several meetings with 3 r him and he has had to admit that he has NO data about response times and can not even begin to "compare response times." Mr. Reff also failed to state that the police were short 6 patrol officers and that was the major reason for any delayed response that might occur. Mr. Clausen stated that he wants Phase 1 because busing on Underwood and Spencer are a safety concern... but he plans to bus children through an Airport Runway Protection Zone and an Airport Object Free Zone. He said Lomax children are bused because we "don't have a whole lot of sidewalks and nice places for children to walk to school". The fact that Mr. Clausen so carefully avoided, is that most Lomax streets are so dangerous and such a safety hazard that most adults won't travel on them on anything less than a vehicle and so he has to bus the students. He also spoke about shorter bus routes to Glen Meadows. He did NOT state the fact that if Phase 1 is built, there will not be any bus routes through Glen Meadows to Lomax Elementary because L.P.I.S.D. will not bus within a 2 mile travel radius of a school. And remember; these people were introduced as objective staff that would give the con$ as well as the pros. I could spend several more pages exposing the deceptions and incorrect statements presented in that 3-16-00 meeting....but I think you get the point. For those few at City Hall who have repeatedly shut their eyes and ears to the dangers; we'll state it again. There are deep ditches and NO side walks on the main traveled H, L, P and LSR streets of Lomax. Children and adults, who ride horses, ride bikes, jog, walk, exercise 4H projects, etc. , have to mix with high volume, high speed traffic in the street and the only safety net we have to cope with this already dangerous situation is the ability of vehicles to pass into the oncoming lane. As traffic increases; this safety net goes away, and the probability of another White Cross like the one belonging to young Joseph Mann at Lomax School Rd. & P street, increases dramatically. While Mr. Sease's and Mr. Reft's excuses for building Phase 1 are nothing but ifs & maybes that they can't even quantify; the danger from traffic on Lomax streets is real and it occurs many times every day.
