CALL TO ORDER Meeting called to order by Chairperson Waters at 6:00 PM. II. APPROVE MINUTES OF THE SEPTEMBER 20, 2001, REGULAR MEETING. Motion by Dottie Kaminski to approve the Minutes of September 20, 2001. Second by Pamela Baldwin. Motion carried with all in favor. III.. CONSIDER REQUEST FOR A TIME EXTENSION ON A SPECIAL CONDITIONAL USE PERMTI #SCU00-001 GRANTED TO EDDIE •DUTKO, • GENERAL PARTNER, FOREST HOLDINGS, LTD. FOR PARK FOREST APARTMENTS SUBDIVISION. - City Planner Gwen Goodwin presented staff's report. On October 9, 2000, City Council granted Special Conditional Use Permit #SCU00-001 to Eddie Dutko for development of Park Forest Apartments Subdivision in the 1200 Block of McCabe Road. Terms of the Permit require construction to commence within one year.from the date of issuance and failure to do so, voids the permit. The Planning and Zoning Commission may grant a one-year extension at the applicant's request. Mr. Dutko has requested an extension citing unforeseen reasons for the delay. Staff recommended approval of the one-year extension. Motion by Melton Wolters to grant Eddie Dutko a one-year extension for Special Conditional Use Permit #SCU00-001. Second by Ralph Dorsett. All were in favor - and the motion carried. IV. CONSIDER PRELIMINARY PLAT FOR SPENCER LANDING, SECTION 4. Ms. Goodwin presented staff's report. Thy proposed Spencer Landing, Section 4, is located south of North "D"Street and consists of two blocks and 421ots. The Preliminary Plat has been reviewed by staff and found to comply with Development Ordinance requirements. Staff recommended approval of the plat. Planning and Zoning Commiss~ ~ • Minutes of November 29, 2001 Page 2 Motion by Ralph Dorsett to approve the Preliminary Plat of Spencer Landing, Section 4, with the following condition: - Sidewalks shall be installed along both sides of all public streets and the south side of "D" Street continuing along to Section 3: . ~ ~ ..' Second by Melton Wolters. All were in favor and the motion carried V. CONSIDER FINAL PLAT FOR FAIRMONT PARK EAST, SECTION 10. 'Ms. Goodwin presented staff's report. On July 19, 2001, the Commission approved the Preliminary Plat for Fairmont Park East, Section 10. Staff has reviewed the Final Plat and found it complies with Development Ordinance requirements. Staff recommended approval of the plat with items to be addressed prior to recordation. Eddie Gray, Developer of Fairmont Park Subdivision, addressed the Commission. Mr. Gray asked the Commission to omit staff's recommendation, which would require dedication of a pedestrian easement along the pipeline easement, prior to recordation of the Final Plat. Mr. Gray introduced a letter he had written to Exxon Mobile Pipeline Company informing them of the City's plans to build a pedestrian walkway from Fairmont Parkway to Spencer Highway along the pipeline easement. In the letter he asked Exxon Mobile if they had any jurisdiction that would prohibit the City from locating a pedestrian walkway along the easement. He is awaiting their response. Mr. Gray agreed to provide a letter of commitment stating his willingness to work with the City to make the pedestrian walkway a reality. When the time comes; he will more than likely deed afifty-foot strip to the City rather than provide an easement. Motion by Ralph Dorsett to approve the Final Plat of Fairmont Park East, Section 10, subject to the following items being addressed prior to recordation of the plat: - All construction improvements shall be completed at site. - Sidewalks shall be constructed in the following places: 1. Build sidewalks to connect the development with the adjacent school property. (e.g. From the development, begin sidewalks along the south side of Spencer Highway leading into the school's driveway to connect into the school's existing internal pedestrian pathway.) 2. Build sidewalks eastbound to connect with existing sidewalk on Spencer Highway (e.g. Begin at the subdivision's entrance (Eagle Nest Drive), and connect with sidewalk at the Chevron gas station). Planning and zoning Gommiss~ Minutes of November 29, 2001 Page 3 - Payment shall lie made to the City in the amount of $341.27 for street sign installation. • ~ . - Payment shall be made to the City in the amount of $2,760.00 and $255.84 for installation of twelve (12) streetlights and one-yeaz service cost, respectively. ~ ~ . ~ . _~ - Payment shall be made to the City in the amount of $10,500.00, in lieu of parkland dedication. Second by Dottie Kaminski. All were in favor and the motion carried. VI. CONSIDER GENERAL PLAN FOR FAIRWOOD OFFICE PARK. Ms. Goodwin presented staff's report. The proposed Fairwood Office Park . comprises approximately 8.2 acres located south of Caniff Road at the northwest corner of Underwood Road and Fairmont Parkway. The property is zoned Planned Unit Development, which requires a Special Conditional Use Permit for Development. The applicant has submitted a General Plan for afour-phased project to build an office park with a small retaiUshopping area. A Special Conditional Use Permit will be required for each phase of development. The first phase will be 2.8 acres that will include a 26,000 sq. ft. detention/landscape area and a bank facility and other administrative'offices in a 32,006 sq. ft. building. Staff recommended approval of the General Plan noting several conditions. Motion by Melton Wolters to approve the General Plan for Fairwood Office Pazk with the following~conditions: 1. A Special Conditional Use Permit must be approved by the Planning and Zoning Commission and by City Council for each phase of development Upon approval, the Permit information will need to be reflected on the General Plan. 2. Any development along Caniff Road requires additional landscaping to buffer single-family subdivision from~PUD. 3. Sidewalks shall be added along Caniff Road and Underwood to provide a safe pedestrian path. 4. Vehicular access points shall be limited to two on Caniff Road 5. A Minor Site Plan shall be submitted following approval.of'the General Plan, per the City's Development Ordinance. Second by Ralph Dorsett. OPEN PUBLIC HEARING TO CONSIDER SPECIAL CONDITIONAL USE PERMIT REQUEST #SCU01-004 FOR FAIRWOOD OFFICE PARK (PHASE I) TO BE LOCATED AT THE NORTHWEST CORNER OF UNDERWOOD ROAD AND FAIRMONT PARKWAY. APPLICANT IS SEEKING TO DEVELOP OFFICE BUILDING WITHIN PLANNED UNIT DEVELOPMENT Chairperson Waters opened the public heazing at 6:40 PM. 1. STAFF PRESENTATION ~Ms. Goodwin presented staff's report. The request by Louis Stranahan, on behalf of Summer Winds, L.L.C.; for a Special Conditional Use Permit for Phase 1 of Fairwood Office Park, has been submitted in conjunction with the General Plan for the entire development. Fairwood Office Park is to be located at the northwest corner of Underwood Road and Fairmont Pazkway just south of Caniff Road. The proposed uses aze listed in Exhibit A (attached). Staff recommended City Council approval of SCU01-004 for Phase 1 noting conditions. Staff also recommended deleting SIC Codes 791-799 from Exhibit A and adding language to Exhibit B to limit on-site signage. 2. PROPONENTS Dan Dompier, real estate broker with Remax Southeast, addressed the Commission. Mr. Dompier stated he submitted Exhibit A was compiled to comply with existing neighborhood allowable uses and to expand uses . typically directed toward specific tenants. 3. OPPONENTS Bill Athey,102 Summer Winds Drive, addressed the Commission. If Phase 4 of the development includes.a restaurant, Mr. Athey would like the Commission to make sure that food odors emitted~from.cooking vents are kept to a m;n;mum, since his neighborhood is located down wind from the development. VIII. CLOSE PUBLIC HEARING Chairperson Waters closed the public heazing at 6:55 PM. IX. CONSIDER RECOMMENDATION TO CITY COUNCIL REGARDING SPECIAL CONDITIONAL USE PERMIT REQUEST #SCU01-004. Motion by Ralph Dorsett to recommend City Council approval of Special Conditional Use Permit #SCU01-004 with the following conditions: Planning and Zoning Commission Minutes of November 29, 2001 Page 5 1. Permitted uses in Phase I shall be limited to those shown on Exhibit A, excluding SIC Codes 791-799. 2. The Developer shall use the covenants and restrictions listed in Exhibit B with added language limiting on-site signage. ~ ~ ~ ~ ~ ~' Second by Melton Wolters. STAFF REPORTS Planning Coordinator Masood Malik briefly spoke about the APA Conference in Houston attended by several staff and Commission Members in November. While at the conference, Mr. Malik received some literature on detention pond designs, which he shared with the Commission. Chairperson Waters asked if there was anything the Commission could do in the future to insure detention facilities are an asset to the community rather than an eyesore. Director of Planning Doug Kneupper noted that most of the detention ponds in the City were constructed prior to adoption of our drainage criteria. manual. Chairperson Waters noted the City should be more diligent in the future about detention ponds designed for easy maintenance and multi-uses. xI.
