Meeting called to order by Chairperson Waters at 6:05 PM. II. APPROVE 1bIINUTES OF THE JANUARY 17, 2002 REGULAR MEETING. Motion by Melton Wolters to approve the Minutes of January .17, 2002. Second by Dottie Kaminski. Minutes approved as presented III. OPEN PUBLIC HEARING. Chairperson Waters opened the public hearing at 6:05 PM. DISCUSS REZONE REQUEST #R02-0Ol FOR SEVENTEEN ACRES OF LAND THAT INCLUDES TR 13A, IN THE W.M. JONES SURVEY, AT THE NORTI~AST CORNER OF DRIFTWOOD AND FAIRMONT PARKWAY. THE APPLICANT IS SEEKING TO REZONE FROM GENERAL COMMERCIAL (GC) TO LOW DENSITY RESIDENTIAL (R 1) FOR SINGLE- FAMILYDWELLINGS. Ms. Goodwin presented staffs report. Eddie Gray, of Fairmont Pazk Joint Venture, has requested a zone char4ge from GC to R 1 to provide zoning for additional single family dwellings in the Fairmont Park East Subdivision. The rezoning consists of 17.2 acres, excluding 5.15 acres along Fairmont Parkway that would remain GC. Staff recommended that "Reserve A" (.40 acres) be included in the rezoning to R 1, noting it would represent the highest and best use of the property. Staff also recommended that during General Plan review, increased setbacks and deeper lots be considered to make R-1 more compatible with GC. Public hearing notification was mailed to 17 property owners. The City received one response in opposition to the rezoning. Planning and Zoning Commis~n • Minutes of February 21, 2002 Page 2 1. PROPONENTS Eddie Gray, developer of Fairmont Pazk Subdivision, addressed the Commission. Mr. Gray has been working closely with the Homeowner's Association. In response to a question posed by Commission Member Wolters about drainage, Mr. Gray stated the detention pond was designed to serve the subject area and drainage will improve once the area is worked and streets are constructed. Mr. Gray requested the zone change be considered without the changes recommended by staff. Dave Klingman addressed the Commission. Mr. IClingman has lived in the Fairmont Park East Subdivision for 11 years, sat on the homeowner's association boazd for 7 years, and currently serves as vice-president. He agrees with Mr. Gray's plans for the rezone. 2. OPPONENTS No opposition was present. IV. CLOSE PUBLIC HEARING. Chairperson Waters closed the public hearing at 6:30 PM. V.. CONSIDER RECONIlVIENDATION TO CITY COUNCIL REGARDING REZONE REQUEST #R02-001. Motion by Melton Wolters to recommend City Council approval of Rezone Request #R02-0O1, as originally submitted by the applicant, rezoning approximately 16.617 acres of land out of the W.M. Jones Survey, A-482 (Fairmont Pazkway @ Driftwood) from General Commercial (GC) to Low Density Residential (R-1). Second by Dottie Kaminski. All were in favor and the motion carried. VI. DISCUSS RESOLUTION N0.2002-20 REGARDING A 180-DAY MORATORIUM ON NEW CONSTRUCTION IN THE MID AND HIGH DENSITY RESIDENTIAL ZONING DISTRICTS. Assistant City Attorney John Armstrong explained the 180-day moratorium on the issuance of building permits for mid and high density residential projects. The purpose is to give the Commission time to develop new regulations relating to matters such as building height, setbacks, density, etc. Planning and Zoning Commi~n • Minutes of February 21, 2002 Page 3 Chairperson Waters read a letter to the Commission from the City Manager, dated February 14, 2002, on the following: City Council's directive for the Planning and Zoning Commission to review and make recommendations regarding the City's current regulations dealing with all structures considered mid and high-density residential, in particular, current setback requirements for multi- family developments that are multi story. Ms. Goodwin provided Commission Members color copies of the Zoning Map and described the percentages of land area designated to each zoning district. Staff will compile an inventory of existing apartriient complexes. The Commission designated Hal Lawler and Dottie Kaminski as members of a subcommittee that will work with City staff and prepare recommendations for the Commission to consider. Mr. Gray commented that development costs are greater in R-3 than in R-1 and there is virtually no demand for R-2. He mentioned several locations around town zoned R 3 that he intends to develop as R-1. VII. STAFF REPORTS Ms. Goodwin informed the Commission of four residential projects currently under review. They are Pelican Bay, Bay Forest, Gardenwalk, and Churchill Place Apts. The Board of Adjustment recently granted a special exception for parking and a variance for reduced setbacks for the Churchill Place Apts. Chairperson Waters encouraged everyone to mark their calendars Oct. 2-5 for the APA Conference in El Paso. Planning Coordinator Masood Malik reminded the members of the monthly activity report included in their packet. He informed the Commission of the recent bond election. VIII. General Plan ,. • • it Staff Report March 21, 2002 AMENDED GENERAL PLAN FOR FAIRMONT PARK EAST, SECTIONS 5-9 nest: Consideration of an amended General Plan for Fairmont Park East Section 5 only Requested By: Mr. Eddie V. Gray, Trustee Present Zoning: Low Density Residential (R-1) Background: During the August 17, and September 21, 2000 meetings, the Commission required that the general plan reflect the following items: a) Show parking and adequate open space around the detention basin for residents using the detention/park area. b) A minimum of 12' of open space is, needed around the perimeter of the detention pond to perform maintenance and provide amenities, e.g. walking trails and landscaping. 2. Re-arrange lots to avoid backing up to the detention/park area. 3. Establish guidelines in the General Plan for future driveways for General Commercial tract adjacent to Fairmont Parkway. 4. On November 29, 2001, the Commission required dedication of a pedestrian easement along the Exxon/Mobile pipeline as part of the . approval for Fairmont Park East, Section 10. Analysis: On February 2002, an amended General Plan was submitted. Staff reviewed the General Plan based on directives from the Commission and City General Plan submittal requirements. Commission Directives The submitted General Plan only fully addressed Item #1 of the Commission's directives. The City's Development Ordinance requires dedication of parkland equal to one acre for each 160 proposed dwelling units. Here, 0.481 acre is required for park purposes. Whereas, only 0.358 acre of land has been shown for park area. Item #3 expresses the Commission's intent to reduce the number of driveways along Fairmont Parkway. The applicant sold these parcels in March 2001. The amended General Plan shows the new owners of the General Commercial property along Fairmont Parkway; however, staff does not know the Commission's restrictions were conveyed to the new owners. Commission's directives #2 & 4 were not addressed. Fairmont Park East General Plan March 21, 2002 Page 2 of 2 Submittal Requirements Staffreviewed the General Plan subject to Zoning, Development Ordinance, and City's Comprehensive Plari and found it complies with applicable requirements. Streets - To improve circulation, staffrequested a second entrance to provide additional access to the subdivision by residems and emergency vehicles. Sidewalks -The developer agreed to provide sidewalks within the subdivision, along Driftwood.Drive connecting Section 5 to Section 6, and from the subdivision entrance towards Fairmont Parkway. Zone Change -During the February 21, 2002 meeting, the Commission recommended City Council approval of the zone change request for approximately 16.617 acres for this proposed subdivision. This will be considered by Council on March 18'x. Drainage -Staff reviewed the drainage calculations and found that existing detention area is properly sized and can easily accommodate this development However, staff will work closely with the developer and engineer to ensure that developing this section will not adversely affect the adjoining properties. Conclusion: Using the Development Ordinance, staff reviewed the General Plan and found it complies with applicable ordinance requirements. Staffrecommends approval with conditions: • Lots are re-arranged to avoiding backing up to the detention area.. • Driveway guidelines ~ are established for tracts adjacent to Fairmont Parkway. • A pedestrian easement is dedicated along the Exxon/Mobile pipeline to provide access between Fairmont Park and Fairmont Park East.
