Cumentiy, there one no action items for the Commission's consideration at the July 18, 2002 meeting.
However, StaTf warrts to take this opportunity to continue last morrth's brainstorming session on
potential amendmerrts/adjustmerrts to the zoning map.
In addition, 51ag is oommi8ed to informing the Commission of new projects. During the meeting, Staff
will drsc~ss a few projects currently under n:view. This is only an informational discussion and r+equirss
no format action.

I. CALL TO ORDER
Chairperson Waters called the meeting to order at 6:04 PM.
II. OPEN PUBLIC HEARING TO CONSIDER AMENDING ORDINANCE NO.1501
OF THE CITY OF LA PORTS, PERTAINING TO MID TO HIGH DENSITY
RESIDENTIAL DEVELOPMENT. THE CITY OF LA PORTS IS SEEKING THIS
AMENDMENT BASED ON RESOLUTION N0.02-20 ADOPTED BY THE CITY
COUNCIL
Chairperson Waters opened the public hearing at 6:04 PM.

City Planner Gwen Goodwin led the discussion. The Commission compared existing
ordinance provisions with the subcommittee's recommended revisions. During
discussions, the Commission noted the following Zoning Ordinance and Map changes
they would like to see regarding mid-high density residential development:
Location
Remove the General Commerrial ~'oning Districts as permissible locations for mid-density
and multi-family residential developments.
No additional duplexes, townhomes, quadraplexes, or multi-family units allowed along
South Broadway.

Duplexes, townhomes, and quadraplexes may be located along Canada Rd. (from the
extension towards Fairmont Pkwy.).
On the Zoning Map, change R-2 (Medium Density Residential) zoning (located south of
North "H" St. and adjacent to the airport) to R-1(Low Density Residential).
Multi-family (apartments) may be located along Bay Area Blvd. between Fairmont
Parkway and Spencer Highway.
Distance/Spacing Requirements
Complexes with 50+ units must be at least 2,500-feet from other multi-family complexes
of 20+ units.
Density (units per acre
Multi-family (apartments) should be reduced from. 27 apartment units per acre to 14
apartment units per acre.
J Total units per development should be limited to a maximum of 180 apartment units
within a complex.
Buffering
When apartment complexes are located adjacent to single-family residential
developments, an additional 25-foot buffer shall be provided in addition to setback.
Within the increased buffer, a 10-foot opaque screen, including opaque fencing and/or
plantings, shall be required.
Landscaping and open space, as well as buffering and/or screening shall be increased
from 6°~ to 35°~.
Height Restrictions
Multi-family dwellings adjacent to single-family residential developments shall be
limited to two-stories in height: Any three-story buildings must be located in the center
of the apartment complex.
Screening/Fencing/Gates
Opaque screening shall be provided between multi-family and single-family residential
developments. Fencing shall be utilized and limited to 6-feet in height plus the rot
board. Fencing materials shall be made from 1° x 4" wood board of redwood, cedar, fir,
pine, wrought iron, or a combination thereof.

Multi-family residential developments shall include perimeter fencing on all sides of the
development.
Access gates shall be set back from the street far enough to prevent traffic congestion
from vehicles traveling on the right-of--way adjacent to the access gates. A means of
access shall be provided for emergency vehicles, including Fire, EMS, Police and Utilities.
Open space/amenities
Open space for townhomes to quadraplexes and multi-family dwellings shall be
increased to 35% of the development.
Open space and amenities shall include a combination of trails, playgrounds (except in
the case of °seniors only" apartment complexes), clubhouse, and on-site detention.
Playgrounds shall be provided for in developments housing children. Playgrounds shall
not be located within the detention area.
Building Setbacks
Setbacks for duplexes shall be increased from 20-feet front, l0-feet rear, and 5-feet side to
25-feet front, 20-feet rear, and 20-feet side.
Setbacks for townhomes to quadraplexes shall be increased from 20-feet front, 10-feet
rear, and 5-feet side to 25-feet front, 20-feet rear, and 20-feet side.
Setbacks for multi-family developments shall remain the same.
An additional 25-foot buffer zone is required when apartment complexes are located
adjacent to single-family residential development, plus a 10-foot opaque screen. The 10-
foot opaque screen may be located within the setback adjacent to single-family
residential development..
Miscellaneous
In the case of 90-degree angle parking, the maneuvering isle must be at least 28-feet.
Distance between the exterior of garages must be at least 28-feet.
All apartment complexes must have at least two points of entry.
All apartment complexes must have a designated area for school bus pickup and/or drop
off. This area shall be accessible with the correct driveway/road width for LPISD school
buses to maneuver. Developers of apartment complexes must obtain from the School
District, the standards that provide for school bus ingress-egress, and maneuvering
within the complex.

Increase all standard parking spaces from 9-feet wide by 18-feet long to 10-feet wide by
18-feet long. In the case of handicap parking spaces, increase from 13-feet wide by 20-feet
long to 14-feet wide by 20-feet long.
In the case of "senior" apartment complexes, 90-degree angle or °head-in" parking shall
be prohibited.
All parking lots in multi-family residential developments shall be a minimum 10-feet
away from single-family residential developments.
Bond and Insurance
A bond and/or irrevocable letter of credit shall be required for apartment complexes
and/or developers. The bond and/or irrevocable letter of credit shall be at least one
million dollars ($1,000,000) payable to the. City of La Porte as a guarantee of compliance
of upkeep and maintenance of the apartment complexes; and further, as a guarantee of
compliance with applicable laws, including necessary demolition of buildings that have
fallen into disrepair, and other remedial measure as may be necessary to keep apartment
complexes maintained and up to standards. The bond and/or irrevocable letter of credit
shall be in effect for at least one hundred (100) years.
All apartment complexes shall have an effective comprehensive, general liability
insurance policy, with the City of La Porte being named as an additional named insured
in the amount of one million dollars ($1,000,000) for the life of the structures within the
apartment complex, and/or the apartment complex itself.
III. CLOSE PUBLIC HEARING.
Chairperson Waters closed the public hearing at 8:30 PM.
IV CONSIDER RECOMMENDATION TO CITY COUNCIL REGARDING AN
AMENDMENT TO ORDINANCE NO. 1501, PERTAINING TO MID TO HIGH
DENSITY RESIDENTIAL DEVELOPMENT.
Motion by Hal Lawler to recommend City Council approval of an amendment to
Ordinance 1501, with the changes recommended by the Commission pertaining to
Mid to High Density Residential Development. ~ Second by Ross Morris. All were in
favor and the motion carried.
V. STAFF REPORTS
At future meetings, the Commission will begin to address amending the Zoning Map
along with revisions to the Zoning Ordinance pertaining to landscaping, parking, etc.
