CALL TO ORDER Chairperson Waters called the meeting to'order at 6:12 PM. II. ADMINISTER OATH OF OFFICE TO RE -APPOINTED MEMBER, RALPH DORSETT. Chairperson Waters administered the Oath of Office to Ralph Dorsett. III. APPROVE MINUTES OF THE SEPTEMBER .191H REGULAR MEETING AND WORKSHOP. Motion by Dottie Kaminski to approve the minutes of September 19, 2002. Second by Ralph Dorsett. All were in favor and the motion carried. IV. REVIEW LAND USE AND ZONING MAPS. Chairperson Waters agreed to hear comments from a member of the audience. Reverend Oliver Stillwell requested the Commission, during their review of the Zoning Map, consider the : possibility of changing the zoning classification of a parcel of land his church owns, currently zoned_ R-2. The property has 300' of frontage along Underwood Rd. and is located on the west side of Underwood' Rd.,' three blocks south of Spencer Hwy. Mr. Stillwell believes changing the zoning classification to Neighborhood Commercial would increase the property's value. The Commission discussed the need to create a new large lot residential zoning or overlay district. The Commission reviewed the Land Use and Zoning Map revised notes from the June 20`h and July 18`h workshop meetings, as well as additional areas with conflicts noted by Ms. Goodwin. V. Dean Lawther Requested For: A 4.005 acre subdivision of Reserve `B' of Brookglen Subdivision, Section 2, Vol. 167, PG. 115, William Jones Survey, Abstract482, City of La Porte, Harris County, Texas. Location: Scotch Moss Lane at Oakhaven Road in the Brookglen Subdivision Rea nested Use: Residential Subdivision — (Single Family Dwellings) Present Zoning: Low -Density Residential (R-1) Background: Mr. Dean Lawther recently purchased this 4-acre tract to develop a single- family residential subdivision. The property is located at the southeast comer of Scotch Moss Lane and Oakhaven Road. The tract is bounded on the north and east with Brookglen Subdivision, Section Two, the south and west end are adjacent to Oakhaven and Scotch Moss Lane respectively. The plat includes a 50' street to the proposed subdivision from Oakhaven Road. Reserve "A" is restricted -for proposed detention. Generally, minor plats, that meet specific criteria, can be approved by the Director of Planning. In this case, a new street and 16 lots are being created; this requires review and approval by the Commission. Analysis: Section. 4.03 and Appendix D of the Development Ordinance- establish review criteria for the subdivision. Staff reviewed the plat and found it complies with applicable Development Ordinance' requirements, the Zoning Ordinance, and Comprehensive Plan. Land Use — The project's proposed residential use conforms to the character of the surrounding land uses and the R-1 zoning district. Properties adjacent to the site are single-family residential with some duplexeshownhouses along Scotch Moss and Oakhaven Road. The Reserve `A"(0.695 acre) at the southeast corner of the subdivision along Oakhaven Road, is restricted for detention purposes. Preliminary Plat San Jacinto Estates Page 2 of 3 Transportation/Interior Circulation — The proposed project is situated approximately 1500' south of Spencer I-Eghway. The main access to the proposed subdivision is along Oakhaven Road at Scotch, Moss Lane. Spencer Highway, a major thoroughfare with 100' of ROW, should easily accommodate the traffic generated by this development. The proposed subdivision will have one internal cul-de-sac street. The street right-of-way (ROW) will be 50'. Sidewalks — To. ensure safe pedestrian mobility, the developer needs to construct sidewalks along both sides of the public street within the subdivision and along both Scotch Moss Lane and Oakhaven Road ROWs. Currently, sidewalks exist on both sides and stop at this property. Parks and Recreation — Section 12.0 of the City's Development Ordinance requires the developer to provide on -site open space and recreational space at one acre per 160 proposed dwelling units. If necessary, fees in lieu of parkland, at $175 per dwelling unit, may be paid to the City.. This subdivision is proposed with 16 lots. The formula generates an area smaller than one acre. As a result, it is impractical for public park purposes. Utilities — Area water'and sewer facilities can sufficiently provide service to this proposed development. The developer is responsible for providing all necessary public infrastructure (structures or improvements) to accommodate the subdivision's water and. sanitary sewer needs. The design and construction of all water and sewer systems shall be in conformance with the City's Development Ordinance. Drainage The drainage from the Brookglen Subdivision discharges into Willow Spring Gully, which is a tributary of Armand Bayou. Both systems are subject to severe flooding. As . a result, the runoff' from all new developments within this watershed must be discharged without increasing . the existing water surface elevation. The proposed development is designed so that all storm drainage flows directly into an on -site detention (Reserve `A'). The pond's size and capacity are reviewed to ensure that it can adequately serve the proposed development without burdening the existing system. The developer shall provide all the necessary easements required for maintenance -and proper drainage including storm water inlets. • c Preliminary Plat San Jacinto Estates Page 3 of 3. Conclusion and Recommendation: The PreliminaryPlat is in accordance with. 'the. City's development regulations. Staff recommends approval of the Preliminary Plat with the following conditions: • Construction drawings shall indicate off -site drainage improvements to ensure proper drainage of the adjacent properties. • The developer is responsible for installation of sidewalks along both sides of a public street within the. subdivision and portions of the Scotch Moss Lane and Oakhaven Road ROWs. SCUP Staff Report Christ Lutheran Church November 21, 2002 Special Conditional Use Permit #SCU 02-003 R uest: Consideration of a Special Conditional Use Permit ##SCU 02-003 Requested Bv: Christ Lutheran Church (Pastor Karen Wilhelm\ Asst. Pastor Diane Archer) Requested For: Approximately 8.3 acres of land situated in the W. P. Harris, La Porte, Harris County, Texas. This property is located along S. Broadway (Old Highway 146) and McCabe Road. The applicant is seeking approval to expand the church activities to include a lodging retreat center/family shelter and senior's assisted living complex. Present Zoning: High -Density Residential (R-3) Background: The property is located at the northwest corner of McCabe Road and S. Broadway (Old Highway 146). It is bounded on. the west by Forest Vista Mobile Home Park, on the north by an existing church, east and on the south by Broadway and McCabe Road respectively. In October, the Church met with Staff to discuss their future plans. The Church is considering purchasing these tracts to develop a retreat center with meeting space, guest cabins, trails, trust course,. and a labyrinth. The facility will also provide temporary lodging for families in crisis. (This facility is planned for the tract facing S. Broadway.). They also want to develop a' senior assisted living facility. (This facility is proposed on the tract facing McCabe Rd.) During the meeting, Staff stated that these uses within the R 3 zoning district require a Special Conditional Use Permit per City's Code of Ordinances. On November 1; the- Church submitted a request for a Special Conditional Use permit (SCUP). -Although a general plan or site plan is required with a SCUP submittal, only written description with photos were attached to the application. The -Church submitted a sketch/site plan on November 15, 2002 (See Exhibit E). The Church explained that they were not prepared to retain professional services to design a certified site -plan or drawings. The project is a long-term plan that will only be implemented if the Commission grants their SCUP. Analysis: Section 106-217 of the Zoning Ordinance provides certain conditions for.the issuance of a special conditional use permit as follows: Christ Luthern Church SCU 02-003 Page 2 of 2 • That the specific use will be compatible with and not injurious to the use and enjoyment of other property, nor significantly diminish or impair property values in the immediate vicinity.. • That the conditions placed on such use as specified in each district have been met. • That the applicant has agreed to meet any additional conditions imposed, based on specific site constraints, and necessary to protect the public interest and welfare of the community. Specific submittal requirements and provisions that apply to conditional uses in residential zoning districts are found in. Sections 106-216 & 334 of the Zoning Ordinance. These performance standards, as they apply to this request, may include the following: - General plan/site plan/plat —. Per ordinance, all SCUP applications are required to provide a general plan/site plan or plat showing the proposed layout of the buildings, uses, parking, landscaping, and other details. The applicant has submitted a sketch or site plan highlighting the activities proposed at site. Landscapin Screening - — As shown per attached sketch, school is. a permitted use in R-3 zoning district. However, screening of the parking areas for recreational buildings, community. center, religious, -and educational institution shall be required per Section 106-444 (a) of the Ordinances. Compatibility with surrounding area — . Conceptually, . the proposed development is compatible with the existing land uses. However, the project conflicts with the recommendations that the T]RZ board presented to the Commission. The TIRZ board suggests low density residential (R 1) for this area.' (See Exhibit B.) Summary: The Commission has the following options: Options -available to the Commission: • Approve the SCUP as submitted by the applicant • Approve the SCUP with specific conditions to be outlined by the Commission • Disapprove the SCUP • Table consideration of this item. until addition information can be provided to the Commission. A recommendation from the Commission on this Special Conditional Use Permit will be forwarded to City Council for final consideration. On June 20, 2002, I appeared before the Planning and Zoning Commission Board on behalf of Chairman Alton Porter and . requested that while reviewing the City's Zoning and Land Use Maps, the Planning and Zoning Commission consider resolving potential conflicts that may exist between the goals and objectives of th Maps.. e TIRZ and the City's Land Use/Zoning The Zone's Project Plan and its Revenue Projections were based largely on assumptions that property on the east side to State Highway 146 would be developed primarily for residential purposes and the property west of State Highway 146 would be developed primarily for light industrial and mixed commercial uses. The Board met on August 14,.2002 and discussed recommendations for proposed changes, which I am forwarding to the Planning and Zoning Commission on behalf of the La Porte Redevelopment Authority and TIRZ Board. The Board believes making these recommendations regarding potential land uses would support the Zone Project Plan. The recommendations are presented in the following maps: Map l o Recommended land uses west of State Highway 146 based on recent Planning and Zoning and City Council approval and current Land Use:Map. ■ Map 2 o Recommended land uses east of State Highway 146. • Map 3 o Recommended Zoning Map change. Those going in will meet those coming out. Do what feels natural. Evening. Light Community Evening Light Community will offer homes to seniors who need assisted living as an option. There will be four levels ranging from no assistance needed to hospice as the final option. These homes willbe individual one and two bedroom cottages or condo units that are wheelchair assessable. There will be a community center where one meal a day will be provided, an arts and crafts center, a chapel, walking trails leading into the trails in the S46 6 ' Uqq t Gamp anti Retreat Center. Eventually we want to have a space that will include facilities for women with children who are now homeless due to family violence.
