PLANNING AND ZONING COMMISSION
MINUTES OF NOVEMBER 21, 2002

I. CALL TO ORDER
Chairperson Waters called the meeting to order at 6:05 PM.
II. APPROVE MINUTES OF THE OCTOBER 17, 2002, REGULAR MEETING AND
WORKSHOP.
Motion by Dottie Kaminski t6 approve the minutes of October 17, 2002. Second by
Ralph Dorsett. The motion carried with all in favor.
III. CONSIDER PRELIMINARY PLAT FOR SAN JACINTO ESTATES. -
City Planner Gwen Goodwin presented staffs report. Dean Lawther submitted the
preliminary plat for San Jacinto Estates Subdivision. Mr. Lawther plans to develop a 16
lot single-family residential subdivision at the southeast corner of Scotch Moss Lane and
Oakhaven Road. A new 50' street will be constructed as part of the development.
Motion by Ralph Dorsett to approve the' preliminary plat for San Jacinto Estates
Subdivision, with the following conditions:
1. Construction drawings shall indicate off -site drainage improvements to
. ensure proper drainage of the adjacent properties.
2. The developer shall be responsible for installation of sidewalks along both
sides of the public street within the proposed subdivision ' and a portion of
the Scotch Moss Lane and Oakhaven Road Rights -of -Way.
3. The homeowner's association or the developer shall be responsible for
maintenance of the detention pond within the subdivision.
Second by Doretta Finch. The motion carried with all in favor.

IV. OPEN PUBLIC HEARING TO CONSIDER SPECIAL CONDITIONAL USE
PERMIT REQUEST #SCU02-003 FOR FAMILY FACILITY AND SENIOR'S
ASSISTED LIVING TO BE LOCATED AT THE NORTHWEST CORNER OF
MCCABE ROAD AND S. BROADWAY (OLD HIGHWAY 146). THE APPLICANT
IS SEEKING THIS DEVELOPMENT WITHIN HIGH DENSITY RESIDENTIAL (R-
3) ZONING DISTRICT.
Chairperson Waters opened the public hearing.
1. STAFF PRESENTATION
Ms. Goodwin presented staffs report. Pastor Karen Wilhelm and Associate
Pastor Diane Archer of Christ Lutheran Church have requested a Special
Conditional Use Permit to expand the church's activities to include a lodging
retreat center/family shelter and senior's assisted living complex. The property is
located at the northwest corner of McCabe Rd. and S. Broadway in a high -
density residential zoning district.
Of the 23 public hearing notices mailed to property owners, four responded in
favor of the request and one responded in opposition.
2. PROPONENTS
The following citizens spoke in favor of the request: Pastor Karen Wilhelm,
Diane Archer, Pete Felcher, and Connie Fortune. Pastor Wilhelm noted the
church was amending their original request to no longer include a senior's
assisted living complex and family shelter with the project. Pastor Wilhelm
spoke of the church's plans to operate a school on the premises, which is an
allowable use in an R-3 Zone not requiring a special conditional use permit.
Paul Berner, representing the Old Hwy. 146 Committee, signed up to speak in
opposition of the request, but eventually came to favor the request after hearing
about the church's amended plan.
3. OPPONENTS
No opposition was presented.
V. CLOSE PUBLIC HEARING.
Chairperson Waters declared the public hearing closed at 6:40 PM.
VI. CONSIDER RECOMMENDATION TO CITY COUNCIL REGARDING SPECIAL
CONDITIONAL USE PERMIT REQUEST #SCU02-003.
Staff recommended the item be tabled until additional information can be provided to
the Commission.
Motion by Ross Morris to table Special Conditional Use Permit Request #SCU02-
003. Second by Ralph Dorsett. The motion carried with all in favor.
VII. STAFF REPORTS
Ms. Goodwin asked the Commission if they wanted to change the regular December
meeting date (Dec.19th) to another day. The Commission opted to stay with Dec.19t'.
Planning Director Doug Kneupper spoke briefly about several projects that are getting
underway, such as the wastewater treatment plant and the alignment study for Sens Rd.
VIII. ADJOURN
Chairperson Waters declared the meeting duly adjourned.

Requested for: 20.7 acres of land •being lots 17-32, block 438, block 439, lots 1-16,
block 974, lots 1-32 of blocks 975 thru 979, and adjoining alleys within
these blocks and portions of 10t', I lth2 IPAvenues, Brownell, Nugent,
Holmes and Carroll Streets, out of the Johnson Hunter League,
Abstract-35, City of La Porte, Harris County, Texas.
Location: E. Barbour's Cut Boulevard (near the City of La Porte's city limits)
Present Zoning: Business Industrial. (BI)
Requested Zoning: Planned Unit Development (PUD)
Background' This site consists of 20.7 acres located on East Barbour's Cut
Boulevard. The City of La Porte limit lines run parallel to the property
lines along Barbour's Cut Boulevard. (See Exhibit A.) The Port of
Houston Authority's container facilities are located on the north of the
said property across Barbour's Cut Boulevard.
Currently, the property is designated as Business Industrial (BI) zoning.
The Port of Houston Authority is requesting that the property is rezoned
from BI to Planned Unit Development (PUD). The Port is proposing a
truck pre -check facility with a combined total of 14 truck lanes. The
facility would have two entry points and an exit gate along Barbour's
Cut Boulevard: (See Exhibit B.) This proposed facility would not be
permitted in the BI zone. .
The Commission is asked to consider this request as it represents the
Port's ' first step that must be taken prior to developing this facility. The
Port understands that additional approvals must be obtained. These
steps include securing the closure of several streets and alleys from City
Council. and obtaining approval of a Special Conditional Use Permit
(SCUP) and site plan from the Commission and City Council.
Analysis: Section 106-656 provides the purpose and intent.of the PUD district.
A PUD offers more flexibility in design, open spacelbuffenng, and
activities through conditional use provisions. This section also notes
that the PUD designation requires the approval of a SCUP and a
development site plan.

To determine if this requests meets the requirements for PUD staff
reviewed the following:
Land Use — The City's Comprehensive Plan shows- this area
developing with. industrial . uses. The existing land - uses of nearby
properties are primarily industrial (the Port Authority main facility);
however, there are single-family residences south of the undeveloped
"E" Street right-of-way. See Exhibit C.
In general, high intensity uses should be adjacent to each other. When
higher uses abut residential uses buffering must occur to protect the
health, safety, and general welfare neighborhood. As a part of the Port's
site plan, they will incorporate a berm, landscaping, and a masonry wall
to protect the adjacent residential from the activities of the proposed
pre -check facility. (See Landscaping/screening section.)
Transportation — Being located along Barbour's Cut Boulevard, a
primary arterial road and major truck route, provides more than
adequate accessibility for circulation of truck traffic. There should be
very limited impact on traffic flow within the vicinity even after full
implementation of the proposed project.
The two private drives and truck parking areas will be designed and
constructed in conformance with City Standards. Since trucking
movement is the primary function of the facility, access management
and circulation should be the top priority while designing the whole
project. Driveways connecting directly onto the roadway should be
minimized .to avoid traffic congestion and other delays caused by
turning movements for the eighteen -wheelers entering and existing the
facility.
Utilities — Public facilities and services - are sufficient' to handle the
supply . of potable water and fire protection in the area. In addition,
provisions will have to be made to ensure that sufficient utility
extensions are made to serve this development. Storm water drainage
will require on -site detention to mitigate any adverse impacts associated
with this proposed development.
Landscaping / Screening - Barbour's Cut Boulevard is the main truck
route to and from the Barbour's Cut Terminal facility. As a result,
numerous trucking services related businesses are located along this
corridor. There is a small residential zoned undeveloped area to the
southeast ' of the property across North "E" Street. An unimproved
ROW adjacent to this property can serve as a buffer between trucking
activities along Barbour's Cut Boulevard and residential area. In
addition, the proposed development will be screened from the

Conclusion:
neighboring residential with a proposed landscape berm along south
property line. In addition, the Port is planning an integrated themed
landscape along Barbour's Cut Boulevard. These issues will be
discussed in detail when the Commission receives a request for a
Special Conditional Use Permit (SCUP).
Based on the above analysis, Staff finds the requested change is
compatible with the zoning and uses of nearby properties. The tract in
question is suitable for the requested change to PUD making an
environment conducive for the Port of Houston Authority's expansion
project. It would not have a significant impact on traffic conditions in
the area and utilities would not be affected. Development within the
subject tract should not negatively impact the surrounding properties
and should not harm the value of nearby properties.
By acting on this item, the Commission is simply approving or denying
the rezone request and forwarding their recommendation to the Council
for consideration. The Commission's action does not approve the
facility. The Port must still obtain approval from the Council to close
various streets and alleys:. In addition, the Port must also receive
approval from the Commission and Council for the SCUP. When the
project.progresses to the .SCUP and site plan process, the Commission
may take additional steps to ensure that land uses, landscaping, lighting,
setbacks, and other items are considered.
In reviewing this request the Commission should consider the following
points:
• There -was no apparent error in assigning the present'zoning (BI)
designation to the tract in question.
• The applicant's requested - zoning to PUD provides some
flexibility for the developer while at the same time allowing the
City to review specific uses and site layouts at the various stages
of the proposed development.
Options available to the Commission are:
• Recommend to Council approval of this rezoning request from
BI to PUD.
• Recommend to Council denial of this rezoning request from BI
to PUD.
• Continue the public hearing at the Commission's next regular
meeting to allow additional testimony and further study of this
item: This results in tabling any action on this item.
