VIII. DEVELOPER PRESENTATIONS
A. THE PORT OF HOUSTON AUTHORITY — ENTRY PRECHECK FACILITY
Gwen Goodwin, City Planner, summarized the steps staff has taken to assist the Port
with development of the pre -check facility along Barbour's Cut Blvd -
Jimmy Jamison, Terminal Manager for the Port Authority since 1992, described the Port's
plans for the pre -check facility. Mr. Jamison encouraged the Commission to ask
questions about the proposed development, as well as offer their input.
Mr. Jamison introduced:
Don White, with Moffatt &r Nichol Engineers; Jim Bielstein, with the Port Authority's
Engineering Dept., serving as Project Manager; Brenda McDonald, Real Estate Manager
for the Port Authority; Laura Fiffick, Environmental Manager; and Kent Marsh, with
Knudson &t Associates.
Mr. Marsh, Principal Planner for Knudson &r Associates, described numerous aspects of
the project, including meetings the Port held with area homeowners to discuss their
concerns.
After presentations,.the Commission recommended the Port consider the following:
➢ Ensure sprinkler system is in place to care for the landscaping.
➢ Preserve as much of the natural landscape as possible adjacent to the sound wall
and fill-in open spaces with additional trees (evergreen with foliage year round).
➢ Construct sound wall with a heavy texture to decrease the likelihood of graffiti
and to increase the ability of vines to attach to the wall

➢ Enhance the building facade to avoid "concrete block" look.
➢ Prohibit overnight parking of trucks within the facility.
B. BURCHFIELD DEVELOPMENT - MUNDO LA PORTE
Ms. Goodwin presented a summary of the proposed Burchfield development known as
Mundo La Porte
Lee Burchfield addressed the Commission: Mr. Burchfield has been working with Eddie
Dutko to develop a multi -family complex along SH146 @ McCabe Rd. The special
conditional use permit that was approved for the previously proposed development has
expired. Mr. Burchfield has been in contact with the Corps of Engineers about the
environmentally sensitive issues in the area. A conceptual layout of the complex was
distributed.
The Commission voiced concern that, as proposed, 418 units exceed the 180-unit
maximum established in the new multi -family regulations. Mr. Burchfield indicated it
would not be economically feasible to develop the project with 180 units, but hoped this
issue would not prohibit development.
IX. STAFF REPORTS
Ms. Goodwin reported on the following matters:
➢ The Planning & Zoning Subcommittee met on April 7`s. Their next meeting will be April
2r at 4:15 PM in the Planning Dept. Conference Room.
➢ The Land Use Map will be presented for City Councils consideration on April 28`h All
Commission Members are encouraged to attend the meeting.

Background: The property in question consists of 2.25-acres described as lots 1 thru 30,
block 716, Town of LaPorte, as per H.C.D.R Volume 58, Page 461,
Johnson Hunter Survey, Abstract 25, City of La Porte, Harris County, Texas.
The subject tract has existing buildings used as office and shop. The facility
has been used for light manufacturing since the mid 1980's. The subject
property is within the vicinity of major commercial and industrial businesses
in LaPorte. The property is surrounded by Industrial Container Services and
Gulf State Protective Coating, Inc. to the north, Spencer Highway to the
south, Pfeiffer & Sons (Electrical Contractors) on the east and CSI
Vegetation Management Specialist on the west.
The applicant is primarily engaged in the heat treating of metal products
(SIC# 3398). This process involves a large 20' overhead crane that moves
along a rail. The process occurs outside and is visible to the public. The
applicant wants to expand the business by adding another crane on the site.
Staff discussed the several options with the applicant. In the first scenario,
involves numerous non -conforming issues associated with this site: several
buildings encroach into the front and side setbacks, the front fence
encroaches into the front setback, existing parking does not provide a
backing isle, landscaping is deficient, and heat treating is a non -conforming

use in BI. In order to expand this non -conforming use, the applicant must
apply to the Zoning Board of Adjustment. The applicant decided against this
approach.
The applicant looked at another option: rezone. Using this scenario, the
applicant would ask to rezone the property from BI to LI; however, the SIC
#3398 is an unlisted use in the industrial use table requiring a special
conditional use permit. Staff determined that the use would fit as conditional
in LI and would possibly be allowed in HI. The rezone to LI would alleviate
some of the non -conformities; i.e. setbacks and allow his operation to bring
another crane on site. If the zone change is approved, the applicant's other
non -conformities must be resolved.. The applicant may still have to go to the
Zoning Board of Adjustment.
Analysis: The City is composed of numerous types of development, which are closely
interrelated and interdependent with one another. With careful consideration
and planning, this interrelationship may be beneficial to the whole
community.
The relationship of the applicant's proposal to the Comprehensive Plan
needs to be emphasized as much as possible. In considering this request,
Staff reviewed the following elements of the Comprehensive Plan.
Land Use — The City's Land Use Plan indicates this area developing with
commercial industrial uses. These uses are typically not as intense as the
industrial land use which is where the applicant's request would be
catergorized.
Conformance of a zoning request with the land use plan is one consideration
among several criteria to be considered in approving or denying a rezoning
application. Other criteria may include:
• Character ofthe surrounding and adjacent areas;
• Existing use of nearby properties, and extent to which a land use
classification would be in harmony with such existing uses or the
anticipated use of the properties;
• Suitability of the property for the uses to which would be permissible,
considering density, access and circulation, adequacy of public facilities
and services, and other considerations;
• Extent to which the designated use of the property would harm the value
of adjacent land use classifications;

• Extent to which the proposed use designation would adversely affect the
capacity or safety of that portion of the road network influenced by the
use;
• Extent to which the proposed use designation would permit excessive air
pollution, water pollution, noise pollution, or other environmental harm
on adjacent land use designations; and,
• The gain, if any, to the public health, safety, and welfare due to the
existence of the land use designation.
Whereas the surrounding uses are also commercial, light manufacturing, and
industrial in nature, none are as intense as the applicant's use. If the
applicant's- request is granted, a Special Conditional Use Permit (SCUP) is
required. The Commission could require specific conditions regarding
landscaping, limits to ingress and egress, and fagade design features on the
project. However, these changes would only apply to this use. If the property
is sold and the new owner finds a use that is allowed by right in the LI
district, these restrictions or other restrictions could not be imposed.
Transportation — The property in question has one of its side approximately
250 feet frontage along Spencer Highway. The main entrance to the site is
along 16' Street, which is a designated truck route. The proposed expansion
may increase truck traffic to the area. Spencer Highway, a primary arterial
with 100-ft. right-of-way, should accommodate the traffic generated by this
development. However, additional study would be required to determine if
additional driveways would be needed and to determine the extent of the
increase in truck activity to the site.
Utilities — Currently, the site has sufficient water and sewer facilities to
serve this development. It will be applicant's responsibility to provide any
structures or improvements necessary to accommodate increased demand of
water and sanitary sewer. Storm water management is also an issue that will
be carefully reviewed with the site development. However, public
infrastructure should not be adversely affected with this designated change
Conclusion:
Based on the above analysis, staff finds the requested change is not
compatible with the zoning and uses of nearby properties. The change from
Business Industrial to Light Industrial (LI) with a Special Conditional Use
Permit (SCUP) would impact future development within the area by moving. .
away from the intent of the Comprehensive Plan.
In reviewing this request the Commission should consider the following:

• There was no apparent error in assigning the present zoning
designation to the tract in question.
• There have been no changes in the area that warrant a change to the
zoning designation.
• The applicant's requested zoning conforms with the present zoning
of the surrounding properties.
• Furthermore, the requested designation is compatible with the goals
and objectives of the City's Comprehensive Plan.
Options available to the Commission are:
• Recommend to Council approval of this rezoning request from BI to
LI with SCUP.
• Recommend to Council denial of this rezoning request from BI to LI
with SCUP.
• Table this item for further consideration by the Commission.

106-521(a), Table A, are prohibited and constitute a violation of this chapter.
(c) Footnotes. All permitted uses in industrial zones must meet the following minimum
performance. standards. If requested by the enforcement officer, all applications for building
permits must include a certification from a registered engineer that verifies compliance with
these performance standards. Where applicable, all permitted uses in industrial zones must
meet and be in compliance with the appropriate federal, state, or local regulations.
A. Lighting and glare. Any lighting used shall be arranged so as to deflect light away from
any adjoining residential zone or from public streets. Direct or sky -reflected glare,
where from floodlights or from high temperature processes such as combustion or
welding shall not be directed onto any adjoining property. The source of lights shall be
hooded or controlled in some manner so as not to light adjacent property. Bare
incandescent light bulbs shall not be permitted in view of adjacent property or public
right-of-way. Any light or combination of -lights which cast light on a public street shall
not exceed one footcandle (meter reading) as measured from the centerline of such
street. Aay light or combination of lights which casts light on residential property shall
not exceed 0.4 footcandles (meter reading) as measured from such property.
B. Radiation and electrical emissions. No activities shall be permitted that emit dangerous
radioactivity beyond enclosed areas. There shall be no electrical disturbance adversely
affecting the operation at any. point of any equipment other than that of the creator of
such disturbance.

Requested Use: Entry Pre -check Facility
Background: This site consists of 20.7 acres located on East Barbour's Cut
Boulevard. The city limits of La Porte lines run parallel to the property
line along Barbour's Cut Boulevard. The Port of Houston Authority's
container facilities are located on the north of the said property across
Barbour's Cut Boulevard. At the site in question, the Port of Houston
Authority is proposing a truck pre -check facility with a combined total
of 14 truck lanes. The facility would have two entry points and an exit
gate along Barbour's Cut Boulevard.
The Planning and Zoning Commission, during its December 19, 2002
meeting, held a public hearing to receive citizen comments regarding
rezone request by the Port of Houston Authority. The Commission
recommended to Council approval of this rezone from Business
Industrial (BI) to Planned Unit Development (PUD). City Council
approved your recommendation at their January 13, 2003 meeting.
The purpose of the PUD zoning district is to provide for the
development as an integrated coordinated unit as opposed to traditional
parcel -by -parcel, piecemeal, sporadic, and unplanned approach to
development. The PUD zoning assigned to this tract is to a great extent
based on the large amount of undeveloped, unsubdivided acreage
located in this area. The PUD development requirements are an
effective means to ensure that development of this tract would be in
accordance with the sound planning guidelines.

The development in a PUD zoning district requires that an application
for a general plan or site plan shall be filed and processed
simultaneously with the Special Conditional Use Permit. Upon
approval of the plan and SCUP, the Port would be authorized to
submit a Major Development Site Plan.
Analysis: In addition to performance standards, there are a number of development
standards that are specified by the Zoning Ordinance. These standards
are applicable to all P.U.D. developments. Section 106-659 of the Code
of Ordinances establishes the following criteria for review of the
development projects within a P.U.D. zoning district:
Land Use — The City's Comprehensive Plan shows this area
developing with industrial uses. The existing land uses of nearby
properties are primarily industrial (the Port Authority's main facility);
however, there are single-family residences south of the undeveloped
"E" Street right-of-way.
In general, high intensity uses should be adjacent to each other. When
higher uses abut residential uses buffering must occur to protect the
health, safety, and general welfare of neighborhoods.. As a part of the
Port's site plan, they will incorporate a berm, landscaping, and a
masonry wall to protect the adjacent residential from the activities of the
proposed pre -check facility. In addition, the undeveloped wooded "E
Street" right-of-way will remain in tact.
Transportation — Being located along Barbour's Cut Boulevard, a
primary arterial road and major truck route, provides more than
adequate accessibility for circulation of truck traffic. There should be
very limited impact on traffic flow within the vicinity even after full
implementation ofthe proposed project.
The two private drives and truck parking areas will be designed and
constructed in conformance with City Standards. Since trucking
movement is the primary function of the facility, access management
and circulation should be the top priority while designing the project.
Driveways connecting directly onto the roadway should be minimized
to avoid traffic congestion and other delays caused by turning
movements for the eighteen -wheelers entering and exiting the facility.
In addition, the pre -check facility will lessen the amount of time trucks
spend idling on Barbour's Cut Blvd. This results in fewer NOx being
released in the air.

Topography — This area is relatively flat and stable and should not be
an obstacle to this type of development.
Utilities and Drainage — Public facilities and services are sufficient to
handle the supply of potable water and fire protection in the area. In
addition, provisions will have to be made to ensure that sufficient utility
extensions are made to serve this development. Storm water drainage
will require on -site detention to mitigate any adverse impacts associated
with this proposed development.
Landscaping / Screening - Barbour's Cut Boulevard is the main truck
route to and from the Barbour's Cut Terminal facility. As a result,
numerous trucking services related businesses are located along this
corridor. There is a small residential zoned undeveloped area to the
southeast of the property across North "E" Street. An unimproved
ROW adjacent to this property can serve as a buffer between trucking
activities along Barbour's Cut Boulevard and residential area. In
addition, the proposed development will be screened from the
neighboring residential with a proposed landscape berm along south
property line. In addition, the Port is planning an integrated themed
landscape along Barbour's Cut Boulevard.
Conclusion:
Based on the above analysis, staff recommends approval of the plan for
this 20.7 acres tract and the Special Conditional Use Permit with the
following conditions:
• Development abutting "R_2" zoning district shall be screened and
landscaped in compliance with required screening and landscaping
Ordinance of the City. In addition, a separate plan is required at the
time of site plan submittal and the building permit application.
• Applicant requests an 18 months time line instead of 12 months. In
return, applicant shall submit a proposed schedule of construction.
The construction schedule shall indicate the approximate starting
date and the completion date of the project.
• A statement from the owner/developer specifying the type of
property control and maintenance of detention basin system shall be
noted on the plan.
Options available to the Commission are:
• Recommend to Council approval of this SCUP with additional
conditions.
• Recommend to Council denial of this SCUP.

Request: Approval of General Plan for 107 acre tract and Special Conditional Use
Permit for acre tract.
Requested By: Mr. Lee H. Burchfield, Burchfield Development, L.P.
Requested For: A 107-acre tract out of the W. P. Harris Survey, A 30, LaPorte, Harris
County, Texas. This property is further described as being located in the
1200 Block of McCabe Road.
Present Zoning: 16 acres Planned Unit Development (PUD), 12 acres Low Density
Residential (R 1), and 1.35 acres Neighborhood Commercial (NC)
Requested Use: Multi -Family Residential
Background: This property is located at the southwest corner of SH 146 and McCabe
Road. It is bounded on the east by Shady River Subdivision and on the south
by Shoreacres. Over the three years ago, the Commission and Council
approved a General Plan and Special Conditional Use Permit (SCUP) for
this location. In 2001, a one year extension was granted; however, no
construction occurred and the permit expired in November 2002.
The owner, Eddie Dutko, and applicant/developer, Lee Burchfield,
submitted a General Plan and applied for a SCUP in December 2002. During
the Commission's April 17, 2003 meeting, Mr. Burchfield presented his
proposed General Plan. During the presentation, Mr. Burchfield provided the
lay out of 400+ units situated on 28 acres. The proposed development
included an 4-acre detention pond/water feature surrounded by jogging trails,
and play areas.
Development in a PUD zoning district requires that a General Plan (for the
entire proposed project) and a Special Conditional Use Permit (SCUP) be
submitted and processed simultaneously. Upon approval of the General Plan
and SCUP the applicant would be authorized to submit a Major
Development Site Plan. The Site Plan will be reviewed and acted upon by
the Commission. Approval of the Major Development Site Plan would
allow the applicant to submit building plans for review and then begin
construction of the project.
Analysis: Section 106-659 of the Code of Ordinances establishes the following
criteria for review of development projects within a PUD zoning district:
• Uses — Review of the City's Land Use Plan indicates this 107-acre
area was envisioned as developing as low density residential with a
small comer for commercial uses. Although this proposed

development is not considered to be low -density residential, the
developer argues that the Commission should consider the entire 107
acre tract which yields dwelling units per acre that is comparable to
low density residential. In addition, Mr. Burchfield stated that the 77.5
acre Conservation Easement would serve as a buffer between their
proposed development and surrounding properties.
Nonetheless, Staff and the Commission should look for sufficient open
space, adequate parking, and a good mix of recreational amenities to
ensure that this high -density residential development will meet the
needs of the residents.
• Streets — The proposed development is located at the corner of SH 146
and McCabe Road The developer is proposing only one entrance/exit off
McCabe Road. To improve circulation, an additional entrancelexit off
SH 146 should be added. In addition, right turn lanes would also lessen
the potential for congestion along McCabe and SH 146. These measures
will also be beneficial as traffic congestion could be compounded with
the addition of other low and high -density residential developments just
north of this project.
• Topography — This area is relatively flat and stable and should not be an
obstacle to this type of development.
• Density — Staff utilized the Land Use Plan as a guide. With the
designated land use as Low Density Residential and applying a
development ratio of 4.8 units per acre (Section 106-333) to 107 acres,
Mr. Burchfield feels the property could yield approximately 514 single-
family units. This current plan designates only 28 acres to be developed
as residential. Applying a density of 16 units per acre, this yields 448
units. Fairmont Oaks Apartments (188 units, approx 13 acres) has a
density of approximately 16 units per acre.
• Utilities — There are sufficient water distribution facilities along McCabe
Road to supply potable water and fire protection to this proposed project.
Provisions will have to be made to ensure that sufficient utility
extensions can be made to serve this development. Sanitary sewer
service is not readily available to this site. There is a sewer force main
located along the south line of this property that transports sewer to the
Gulf Coast Waste Disposal Authority plant.
This General Plan shows a 25' x 25' lift station site adjacent to McCabe
Road and Taylor Bayou. A tie-in can be made to the nearby City of La
Porte's Lift Station #12, and the owner/developer will be responsible for
its maintenance.

The City prepared a long-term sanitary sewer master plan for providing
sewer service to unserved areas of southeast LaPorte. The plan calls for
a lift station to be placed at the southwest corner of McCabe Road and
Taylor Bayou (A 104-00-00). As the area develops, the City plans to
construct a sanitary sewer system for this area. This will require the
developer to dedicate land at McCabe and Taylor Bayou. Once the
system is operational, the developers temporary lift station shall be
abolished.
• Drainage — This property lies within the Taylor Bayou Watershed.
There are not sufficient channel improvements to directly receive storm
water runoff from this project. However, the plan shows that storm
water will be managed using a 4-acre detention -basin system.
• Zoning — Currently, of 28 acres needed to develop this project, only 16
are zoned PUD; the balance is R-1. Multi -family development is allowed
in the PUD but is not allowed in R 1. The developer must seek a rezone
to PUD or R 3 to develop multi -family units on these 12 acres.
Multi -family regulation — Recently the Commission and City Council
adopted new multi -family development regulations. The regulations
established new requirements for open spacefrecreation and amenities,
maintenance, spacing requirements of multi -family developments for
each other, _ 180 unit maximum, 14 units per acre density, and
ingresslegress. When development in the PUD district occurs, the
Commission is allowed to follow the regulations of the district the
development could be built; however, the PUD allows for some
flexibility and creativity. Therefore, strict adherence to the
aforementioned requirements is not necessary.
Recommendation: Based on items discussed under Analysis, Staff requests further directions
from the Commission Additional information and details need to be
discussed with the owner/developer. These items/conditions are listed below:
1. The owner/developer must receive a rezone to PUD or R 3 on 12
acres currently zoned R 1. This would result in the project having 28
acres that could be developed as multi -family instead of only 16
acres.
2. The overall density of the project shall not exceed 16 dwelling
units per acre.
3. The applicant must adhere to the terms and regulations provided
for multi -family development except for the following: units per
acre, 180-unit limit, and 1000' spacing requirement.

4. The applicant/developer shall be responsible for the maintenance
of the 77.52 Conservation Easement.
5. The public shall have access to the Conservation Area using trails
that are constructed and maintained by the applicant/developer.
6. Provide an irrigation system to ensure that all landscaping and
screening is properly maintained by the owner/developer.
7. The owner/applicant must construct a lift station and dedicate an
easement to the City at Taylor Bayou and McCabe for the City's
future regional lift station.
8. The developer will construct a second entrance from State
Highway 146.
9. The developer shall contribute to traffic calming devices/tools (i.e.
right turn lane) to ensure that traffic congestion does occur as a
result of his project.
10. The applicant must show evidence of bonding insurance or
participate in a federal "reserve fund mechanism" that establishes
an account for the sole purpose of maintenance to the project. This
fund is for the lifetime of the project. .
Options available to the Commission are:
• Recommend to Council approval ofthis SCUP.
• Recommend to Council approval of this SCUP with additional
conditions.

Permit Conditions:
1. The overall density of the project shall not exceed 16 dwelling units per acre.
2. The applicant must adhere to the terms and regulations provided for multi -family development
except for the following: units per acre, 180-unit limit, and 1000' spacing requirement.
3. The applicant/developer shall be responsible for the maintenance of the 77.52 Conservation
Easement.
4. The public shall have access to the Conservation Area using trails that are constructed and
maintained by the applicant/developer.
5. Provide an irrigation system to ensure that all landscaping and screening is properly maintained by
the owner/developer.
6. The developer will construct a second entrance from State Highway 146.
7. The developer shall contribute to traffic calming devices/tools (i.e. right turn lane) to ensure that
traffic congestion does occur as a result of his project.
8. The applicant must show evidence of bonding insurance or participate in a federal "reserve fund
mechanism" that establishes an account for the sole purpose of maintenance to the project. This
fund is for the lifetime of the project.
9. The applicant will pay the public hearing costs.
10. The Developer shall comply with all other applicable laws and ordinances of the City of La Porte
and the State of Texas.
Failure to begin construction within 12 months after issuance or as scheduled under the terms of a special
conditional use permit shall void the permit as approved, except upon an extension of time granted after
application to the Planning and Zoning Commission.
If constriction is terminated after completion of any stage and there is ample evidence that further development
is not contemplated, the ordinance establishing such special conditional use permit may be rescinded by the
City Council, upon its own motion or upon the recommendation of the Planning and Zoning Commission of the
City of La Porte, and the previous zoning of the entire tract shall be in full effect on the portion which is
undeveloped.

Legal Description: A 37.8 acres of land, being TR 8 as 21.21 acres and TR 3A as 16.6 acres,
out of the Enoch Brinson Survey,, Abstract 5, Harris County, Texas and
further described in the deed recorded in the Harris County Clerk's File No.
V384795, LaPorte, Harris County, Texas.
Present Zoning: Business Industrial (BI) & Light Industrial (LI)
Land Use: Commercial/Industrial
Background: Applicant is platting 37.8 acres of land into 3 Blocks, 15 lots, and 1 Reserve
for a Business Industrial Park along Sens Road in the City of La Porte (See
Exhibit ).
Analysis: Owner/Developer plans to develop the tract for industrial uses. The
developer will construct streets and a storm drainageldetention system that
will connect with the regional systems in accordance with the policies of the
City and Harris County Flood Control District. In addition, staff reviewed
the following elements of the Comprehensive Plan in relation to the
applicant's proposed development.
Land Use: The City's Land Use Plan indicates this area envisioned as
developing commercial industrial uses. The zoning and use of the nearby
properties is also commercial and industrial in nature. The current land use
and development pattern conforms to the proposed use. Furthermore, the
development within the subject tract should not have any'adverse impact
on the surrounding area.
Streets: The plat shows a U-shaped park with a proposed streets right-of-
way of 60'. All streets within this subdivision are classified as collector
streets with a 60/32 designation (right-of-way/pavement width). The
primary function of these streets is to provide access to the proposed
business park predominantly used by heavy truck traffic; therefore, these
streets should be designed and constructed in conformance with stricter
standards than ordinary streets. The developer may use AASTO's or
Harris County's design standards. If the developer does not use these

suggested standards and designs the streets to his standards, then the
owner is solely responsible for maintainence.
Utilities: Public facilities and services are sufficient to handle the supply of
potable water and fire protection in the area. In addition, provisions will
have to be made to ensure that sufficient utility extensions are made to serve
this development. The proposed plan shows a 30'x30' lift station site
adjacent to Sens Road. The dedication of this site may be negotiated in the
utility extension agreement. Storm water drainage shall be managed by an
on -site detention basin reserve (3.427-acre) located to the northeast corner
of the subdivision.
Conclusion and
Recommendation: Staff reviewed the Preliminary Plat and found it to be in accordance with the
Development Ordinance of the City. Staff recommends approval of the
Preliminary Plat with the following conditions:
• The 20' wide "future right-of-way" shown along Sens Road should be
noted as dedicated easement to the City of LaPorte.
• Final construction drawings shall indicate off: site drainage
improvements to ensure proper drainage of the adjacent property.
• Final Plat and construction drawings shall provide details showing 12'
perimeter around the detention basin.
• Add a the following statement on the plat, "If the developer opts to build
streets to his standards, then the maintenance will be sole responsibility
of the owner/developer."
• Detention pond will be the sole responsibility of the owner/developer.
Options available to the Commission are as follows:
• Approval of the Preliminary Plat, as filed. This will authorize the
developer to proceed with the final plat submittal.
• Conditional approval of the Preliminary Plat as filed. This will require
the developer to address the conditions and resubmit the Preliminary
Plat.
• Disapproval of the Preliminary Plat as filed. This will require the
developer to file a new Preliminary Plat.
