CALL TO ORDER . Meeting called to order by Chairperson Muston at 6:00 p.m. 2: APPROVE MINUTES OF THE MAY 19, 2005, REGULAR MEETING AND PUBLIC HEARING. Motion by Dottie Kaminski to approve the Minutes of May 19, 2005. Second by Paul Berner. The motion carried. Ayes: Kaminski, Berner, Barrera, Meharg, Linscomb, and Muston Nays: None Abstain: None 3. OPEN PUBLIC HEARING TO RECEIVE CITIZEN INPUT REGARDING SPECIAL CONDITIONAL USE PERMIT #SCU05-006 FOR THE PROPERTY LOCATED IN THE 1200 BLOCK OF SOUTH 13T" STREET ONE BLOCK SOUTH OF FAIRMONT PARKWAY. THE PROPERTY IS FURTHER DESCRIBED AS LOTS 1 THRU 32 OF BLOCKS 1136,1137, ABANDONED ALLEYS BETWEEN THESE BLOCKS, PORTION OF 14T" STREET BETWEEN WEST K STREET AND WEST L STREET, TOWN OF LA PORTE, JOHNSON HUNTER SURVEY, ABSTRACT 35, HARRIS COUNTY, TEXAS. THE APPLICANT, RANDALL JONES, SEEKS APPROVAL OF A SPECIAL CONDITIONAL USE PERMIT FOR THE PROPOSED DEVELOPMENT OF "HOME PORTE STORAGE" WITH CLIMATE CONTROL, BOAT/RV STORAGE, AND CAR WASH. Chairperson Muston opened the public hearing at 6:00 p.m. A. STAFF PRESENTATION Planning Director, Wayne Sabo, presented staffs report. The applicant, Randall Jones, has requested a special conditional. use permit to develop a climate controlled mini- storage, boat/RV storage, and car wash facility in the 1200 block of S. 13t" St. The proposed plan is different from the General Plan and Special Conditional Use Permit #SCU04-006, previously submitted and approved by Council on June 14, 2004. The previous project included commercial/retail, offices, as well as mini-storage. The new project is a typical storage project with a car wash. B. PROPONENTS Price Blalock, Partner, addressed the Commission. Mr. Blalock confirmed the exterior aesthetics of the storage facility would remain the same as was previously proposed. CONSIDER RECOMMENDATION TO CITY COUNCIL REGARDING SPECIAL CONDITIONAL USE PERMIT #SCU05-006 FOR PROPERTY LOCATED IN THE 1200 BLOCK OF SOUTH 13T" STREET ONE BLOCK SOUTH OF FAIRMONT PARKWAY. THE APPLICANT, RANDALL JONES, SEEKS APPROVAL OF A SPECIAL CONDITIONAL USE PERMIT FOR THE PROPOSED DEVELOPMENT OF "HOME PORTE STORAGE" WITH CLIMATE CONTROL, BOAT/RV STORAGE, AND CAR WASH. Motion by Paul Berner to recommend to City Council, approval of Special Conditional Use Permit #SCU05-006 for property located in the 1200 Block of South 13th Street, one block south of Fairmont Parkway, with; the following special conditional use permit conditions: 1. This SCUP. is specifically for a proposed development on Blocks 1136 & 1137. 2. Developer will work with the City to address the drainage corridor and realignment of 12tH Street ROW. 3. Additional landscaping shall be required along K Street right-of-way. 4. South 13th Street should be extended to and through the proposed development consistent with PICM. 5. Utility extension or paved area over drainage corridor will be the responsibility of the owner/developer. 6. Enhance the building facade so that it blends with the existing commercial to be architecturally and aesthetically pleasing. 7. Detention basin shall be screened and landscaped in compliance with required screening and landscaping provisions per Section 106-444(a) of the Code of Ordinances. 8. Provide an irrigation system to ensure that all landscaping is properly maintained by the owner/developer. 9. Ensure that maximum lot coverage does not exceed 40%. 10. This permit does not become valid until a Development Site Plan is submitted to the City; reviewed and approved in accordance with the requirements of the Development Ordinance. 11. The Developer shall comply with all other applicable laws and ordinances of the City of La Porte and the State of Texas. 12. The applicant may not expand the current development and use (mini-warehouse and car wash) into any remaining tracts under his ownership or control and is only permitted to develop commercial/retail activities in the commercial reserve in Block 1136 as outlined in the General Plan and in Block 1135. Any development in the stated tracts must conform to uses permitted in the General Commercial Zoning District per the Zoning Ordinance. Any deviation of use will require a new Special Conditional Use Permit and General Plan. Second by Dottie Kaminski. The motion carried. STAFF REPORTS Mr. Sabo reported the following: Comprehensive Plan Review Committee had initial meeting. The Committee plans to meet again on June 30, July 18, and scheduled Mondays during the month of August. Upon completion of the review, the Committee will forward its recommendations to the Planning & Zoning Commission for consideration. Proposed Rural Large Lot District Town Hall Meeting was held on June 9 at the Lomax Elementary School Cafeteria. Comments collected will be brought back to the Commission for a workshop. In addition, the Planning and Zoning Commission must approve the design. • The overall plan is to be developed in two phases. In Phase 1, a 20' high sound wall has been constructed along the south property line to avoid adverse impact on the adjacent residential properties. • Phase II will include all the site work, parking lot, drives, water main, and landscape improvement. • The zoning permit and a building permit for the construction of sound wall have been issued by the City on July 6, 2004. • The Port of Houston Authority completed Phase I of the proposed development, the construction of sound wall, in February 2005. • The water main extension project is scheduled to be advertised in October 2005, so that construction can start in March 2006 and be completed in August 2006. • The construction of the facility (buildings, pavement, etc.) in Phase II project is scheduled to be submitted to the City for review upon approval of the architectural facade by the Planning and Zoning Commission. This project will be advertised in November 2005 so that construction can start in May 2006 and be completed in May 2007. Recommendation: Staff reviewed the design and building elevations for the Port's Pre-Check Facility and found that the Port has upgraded the design of these buildings from the standard used for other buildings on Barbour's Cut Terminal. Erect a sound wall constructed with a "rough" texture to decrease the likelihood of graffiti and to increase the likelihood that vines/greenery will attach to the wall. 8. Adhere to the provisions and details shown in facilities lighting plan. Ensuring that all illumination occurs on site and does not affect nearby residences. 9. Enhance the building fagade so that it is architecturally and aesthetically pleasing. The Planning and Zoning Commission must approve the design. 10. Prohibit the overnight parking of trucks at the facility between 6 pm and 6 am. 11. Hours of operation shall be no earlier than 7 am and no later than 6 pm. 12. Pay the public hearing costs. 13. Comply with all other applicable laws and ordinances of the City of La Porte and the State of Texas. Failure to begin construction within 12 months after issuance or as scheduled under the terms of a special conditional use permit shall void the permit as approved, except upon an extension of time granted after application to the Planning and Zoning Commission. If construction is terminated after completion of any stage and there is ample evidence that further development is not contemplated, the ordinance establishing such special conditional use permit may be rescinded by the City Council, upon its own motion or upon the recommendation of the Planning and Zoning Commission of the City of La Porte, and the previous zoning of the entire tract shall be in full effect on the portion which is undeveloped. Apri121, 2005: Planning and Zoning Commission held workshop on proposed regulations for Large Lot District. June 9, 2005: Town Hall meeting held at Lomax Elementary School Cafeteria to receive citizens' comments on proposed Large Lot District. At the conclusion of this meeting, the committee set April 21, 2005, for the presentation to the Planning and Zoning Commission in a workshop format and recommended using a town hall meeting to disseminate the proposal to the citizens At the April 21St workshop, the Planning and Zoning Commission conducted the workshop regarding the proposed regulations and boundaries for the creation of a Large Lot Zoning District. The Commission directed that the City Staff conduct a public hearing to gather citizen input prior to formally considering the Large Lot Committee's recommendations. The proposed regulations are described below in comparison with the existing City of La Porte Zoning Ordinance. Where the proposed regulations are the same as the existing ordinance, the fact is indicated along with the appropriate Section of Chapter 106, Zoning.
