Meeting called to order by Chairperson Muston at 6:00 p.m.
2. APPROVE MINUTES OF THE JULY 21, 2005, WORKSHOP AND REGULAR MEETING.
Motion by Dottie Kaminski to approve the Minutes of July 21, 2005. Second by Doretta Finch.
The motion carried. Hal Lawler, Alt. 1, was not present for the vote.

3. CONSIDER FINAL PLAT FOR PROPOSED GREEN CREST TO BE LOCATED ALONG
NORTH "L" STREET NEAR UNDERWOOD RD.
Staff presentation was given by Masood Malik, City Planner. The applicant is requesting
approval of a final plat for proposed Green Crest Subdivision to be located along North "L" Street
near Underwood Rd, further described as a 13.877 acre tract out of lots 411 and 412, La Porte
outlots, Volume 1, Page 33, H.C.M.R. in the Nicholas Clopper Survey, Abstract No. 198 and the
Enoch Brinson Survey, Abstract No.5, La Porte, Harris County.
The proposed 54 lot subdivision is in accordance with Ordinance 1444 as well as Chapter 106 of
the City Code of Ordinances. Traffic should easily be accommodated by North "L" Street and
Underwood. Per Section 12.03 of the City Development Ordinance, cash will be accepted from
the Developer in lieu of a parkland dedication to the City. The City recommends the approval of
the final plat, as noted in Staffs report.
Motion by Nick Barrera to approve the final plat for proposed Green Crest Subdivision. The
following items must be addressed prior to recordation of the final plat:
. All public improvements complete at site and approved by the City.
. The developer is responsible for installation of sidewalks along both sides of all public
streets within the subdivision and along east and west right-of-way line of North "L" Street
up to the end of the subdivision line.
Second by Dottie Kaminski. The motion carried.

4. OPEN WORKSHOP TO DISCUSS PROPOSED REGULATIONS REGARDING LARGE LOT
RURAL DISTRICT.
Wayne Sabo, Director of Planning, presented an informal recommendation by the staff containing
some changes to the current requirements for large lots which address some major concerns
highlighted by the first public hearing on the large lot district as follows:
. Change the current 100' lot width restriction to 90'.
. Change the current 45' accessory building height restriction to 35'.
. Keep the controls on visible storage, per section 106-773 of the City Code of Ordinances.
. Proposed S.C.U.P. requirement for FFA and other similar programs.
Sidney Grant presented information for the minority opinion, which is not in favor of creating the
Large Lot District. Below are the main points the minority opinion emphasizes:
. 1 acre minimum lot size could possibly land lock lots with no frontage on a public right-of-
way.
. People who bought the land with the intent of selling and subdividing will lose a major
investment.
. The Large Lot District will be detrimental to the City's tax base.
Cecille Paschal spoke in support of creation of a Large Lot District. Below are the main points
emphasized by those in favor of the creation of a Large Lot District:
. Fears escalating property taxes without creation of a Large Lot District would prohibit
current residents financially in maintaining their current way of life.
. Per ordinance, residents with land use inconsistent to the surrounding area could be
required to build 25 feet back from the actual fence line of their property, eliminating
property that could otherwise be used for grazing animals.
The City requests guidance from the Committee to set a public hearing date in order to present a
formal recommendation to be approved to go to City Council.

7. COMMISSION COMMENTS
The Committee approved the City's informal recommendation and asked that the City prepare a
formal recommendation to be presented at the public hearing next regular meeting.

. The applicant is requesting approval of a Final Plat for proposed
Fairmont Park East Section Twelve to be located on both sides of

. During the March 17, 2005, meeting, the Planning and Zoning
Commission approved a preliminary plat for Fairmont Park East,
Section 12.
. Proposed subdivision has 65 lots, 3 blocks, and a restricted reserve for
detention. Block 1 with 26 lots is on the east of Farrington Blvd. Blocks
2&3 with 39 lots are located to the west of Farrington Blvd. In addition,
a restricted reserve for detention is just adjacent to the Big Island slough.
. The proposed subdivision abuts Fairmont Park Central to the north and
some commercial developments to the south along Fairmont Parkway.
. The adjacent properties are zoned low-density residential except
commercial along Fairmont Parkway.
. The area is earmarked for residential uses in the Land Use Plan.
. Streets/roads may have adequate capacity to handle the traffic generated
by this proposed development.

recommends approval of the Final Plat with the following considerations in

above are complied. This will authorize the developer to begin

ReQuested For: A 14.94 acre tract out of the William M. Jones Survey, Abstract No. 482,
Harris County, Texas.

Back2round: The subject tracts are approximately 15 acres of land out of W. M. Jones
Survey, A-482, La Porte, Harris County, Texas. The property is located
along both sides of Farrington Boulevard just south of Fairmont Park,
Section 2. The 9.786 acre tract is bounded by single-family residential
subdivision (Fairmont Park Central Section 2) on the north, commercial uses
to the south along Fairmont Parkway, east with Farrington Boulevard, and
adjacent to the Big Island Slough on the west. The 5.159 acre tract is
bounded by Fairmont Park Central Section 2 to the north, adjacent to
existing commercial uses and unrestricted reserves along Fairmont Parkway
on the south, and west on Farrington Boulevard.
The proposed subdivision has 65 lots, 3 blocks, and one detention reserve.
Block 1 with 5.159 acres has 26 lots on the east of Farrington Boulevard.
Block 2 and 3 with 8.2119 acres have 39 lots to the west of Farrington
Boulevard. A 1.5741 acre restricted reserve for detention area is adjacent to
Big Island Slough (BI06-00-00) with 150'ROW.
. . /Earlier, the developer applied for a zone change request with the City in
F~bruary, 2005. The public hearing for Rezone Request #R05-001 was held
at the February 17, 2005 meeting of the Planning and Zoning Commission.
City CO\.!;l1cil at their March 14, 2005 meeting, approved the Commission's
,,' recommendations for rezoning of the said tracts from General Commercial
(GC) to Low-Density Residential (R-l).
The Planning and Zoning Commission, at the March 17, 2005, meeting,
approved the preliminary plat for the Fairmont Park East, Section 12.

AnaIvsis:
Section 4.03 and Appendix D of the City's Development Ordinance establish
review criteria for major subdivisions. Staff also used criteria in the City's
Zoning Ordinance and Comprehensive Plan to review this project.
Land Use - The project's proposed residential use conforms to the character
of the surrounding land uses and the Low-Density residential (R-I) zoning
district. Properties adjacent to the site are overwhelmingly residential with
some commercial properties along Fairmont Parkway.
TransportationlInterior Circulation - The proposed project is situated
approximately 200' north of Fairmont Parkway and just south of the
Fairmont Park Subdivision Section 2. The main access to the proposed
subdivision is along Farrington Blvd., which has 80' of Right-of-Way
(ROW). Fairmont Parkway, a primary arterial with 250' of ROW, may
accommodate the traffic generated by this development.
The proposed subdivision will have internal streets with 50' of ROW. The
western portion (blocks 2&3) layout creates two points of access off
Farrington Boulevard. While, eastern portion (block 1) has a dead end street
to this proposed development.
Sidewalks - As a part of the plan approval, the developer needs to construct
sidewalks along both sides of all public streets within the subdivision and
along east and west right-of-way of Farrington Blvd. towards the end of the
subdivision lines to the north and south with Fairmont Parkway.
Parks and Recreation - Section 12.0 of the City's Development Ordinance
requires the developer to provide on site open space and recreational space
or fees in lieu of parkland to the City. Per the Ordinance, an area of land
dedicated to the City for parkland purposes shall equal one acre for each 160
proposed dwelling units. This subdivision has 65 lots. Dedication of
parkland less than one acre in size is prohibited per Section 12.03 of the
Development Ordinance. Therefore, money in lieu of parkland dedication is
applicable. The nearest park facility is the Fairmont Park in Section 2 along
Farrington Boulevard at Collingswood Drive. This facility serves the parks
and recreation needs of several neighborhoods within a 1 to 2 mile radius.
The proposed subdivision will be well served by this facility.
Utilities - There are sufficient water and sewer facilities in the vicinity to
provide services to this proposed development. The developer is responsible
for providing all necessary public infrastructure or improvements necessary
to accommodate the subdivision's water and sanitary sewer needs. The
design and construction of all water and sewer systems shall be in
conformance with the City's Development Ordinance.

Drainage - Storm water design and management are the issues resolved
carefully with the developer of the proposed subdivision. The proposed
section is adjacent to the Big Island Slough. Currently, a 10' drainage
easement is retained through the proposed subdivision and out falling into
Big Island Slough. A 1.5741 acre tract to the west is reserved for detention
area. The detention area's size and capacity are reviewed to ensure that it
will adequately serve the proposed development. The developer shall
provide all the necessary infrastructure required for proper drainage
including storm water inlets within the subdivision.
Conclusion and
Recommendation:
The Final Plat is in accordance with the City's development regulations.
Staff recommends approval of the Final Plat. The following items need to be
addressed prior to the recordation of the Plat:
. All construction improvements are complete at site.
. Furnish approval letter from the Harris County Flood Control District
(HCFCD) for the drop structure into the Big Island Slough.
'. Sidewalks shall be installed along both sides of all public streets and
along east and west right-of-way of Farrington Blvd. towards the end of
the subdivision lines to the north and south with Fairmont Parkway.
. Payment of $342.68 shall be made to the City for street sign installation.
. Payments of $2,596.32 and $3,450.00 shall be made to the City for
streetlights installation and I-year service cost respectively.
. Payment of $11,375.00 shall be made to the City in lieu of parkland
dedication.
Options available to the Commission are as follows:
. Approval of the Final Plat withholding signature and recordation until
the above are complied. This will authorize the developer to begin
construction of subdivision improvements.
. Disapproval of the Final Plat and supporting documents as filed. This
will require the developer to file a new Final Plat with the required
documents.

Summary:
. This project has an approved General Plan and SCUP. The current submittal is a Preliminary Plat for
proposed development known as Preserve at Taylor Bayou..
. The subject property is located at the southeast comer of McCabe Road at SH 146 near Taylor Bayou.
. The property being platted consists of approx.42 acres out of 107 acres tract located south of McCabe Road
and the easterly right-of-way line of State Highway 146.
. The applicant is proposing single-family residential, multi-family, townhouses, and commercial
development at this site. Corresponding densities meet densities allowed by the strict compliance of
Chapter 106 (Zoning).
. The current proposal still intends to dedicate a 65 acre nature preserve.
. The plan also shows two points of entrance/exit along McCabe Road.
. The applicant has stated that funding for the said project is in place. The funding for the trails will be
determined once a decision is made about ownership of the Nature Preserve. Harris County has expressed
an interest in the Preserve dedication.
. A new lift station is proposed near the east end of the property and McCabe Road in accordance with the
City's sanitary sewer master plan for this area. Army Corps of Engineers has issued a preliminary opinion.
. It is anticipated that the proposed development will be hooked up to the new 24" trunk main going north for
sanitary sewer.
. The Environmental Assessment and Traffic Impact Analysis studies have been completed for the said
project.
Recommendation:
Based on the above analysis, staff believes there are some outstanding issues still to be resolved. The developer
will need to coordinate with the north side development in the area of utility planning and the preserve
dedication. Should the Commission wish to approve the Preliminary Plat in its present format, we recommend
the following conditions:
. Final Plat and Construction drawings shall indicate all infrastructure and site drainage improvements to
ensure adequate capacity and proper site drainage.
. Developer is responsible for installation of sidewalks along both sides of all right-of-ways within the
complex, east and west sides along McCabe Road towards the end of the subdivision line.
. Developer must secure a maintenance bond, according to the City's multi-family provisions, or seek an
approved alternate showing evidence of bonding insurance or participate in a "reserve fund
mechanism" that establishes an account for the sole purpose of maintenance to the apartment project.
This fund is for the lifetime of the project.
. Detention ponds ownership and maintenance by the HOA shall be stated on the fmal plat.

Consideration of Preliminary Plat approval for 107.19 acre tract
Mr. Robert Burchfield, Burchfield Development, L.P.
A 107.19-acre tract out of the W. P. Harris Survey, A-30, La Porte, Harris
County, Texas. This property is further described as being located in the
1200 Block of McCabe Road.
Planned Unit Development (PUD)
Single-Family large lots , Single-Family small lots, Townhouses, Multi-
Family Residential, and Commercial.
This property is located at the southeast comer of SH 146 and McCabe
Road. It is bounded on the east by Shady River Subdivision and on the south
by the City of Shoreacres. This is an on going project presented to the
Commission and Council several times. Earlier this year, the Commission
and Council approved a General Plan and Special Conditional Use Permit
#SCU05-004 for this development.
Now, the developer has submitted a Preliminary Plat with an approved
concept. The salient features of the plat are as follows:
. Single-Family Large Lot - 34 lots, 7.08 acres (4.8 du/a allowed)
. Single-Family Small Lot - 44 lots, 7.34 acres (6 lots/acre allowed)
. Townhouses - 8 units, 0.80 acre (10 units/acre allowed)
. Multi-Family-180 units, 12.86 acres (14 units/acre allowed)
. Commercial- 1.29 acre (zoned Neighborhood Commercial)
Being in a PUD zoning district, the applicant submitted a General Plan (for
the entire proposed project) and a Special Conditional Use Permit (SCUP).
Upon approval of the General Plan and SCUP by City Council, the applicant
is authorized to proceed with the platting and development plans for the site.
Section 106-659 of the Code of Ordinances establishes the following
criteria for review of development projects within a PUD zoning district:
. Uses - Review of the City's Land Use Plan indicates this 107-acre
area was envisioned as developing as low density residential with a
small comer for commercial uses. The significant portion of this
proposed development is considered to be low-density residential. In
addition, 65 acre tract is a nature preserve or conservation easement
serving as a buffer between the proposed development and
surrounding properties.

. Streets - The proposed development is located at the comer of SH 146
and McCabe Road The developer is proposing two points of
entrance/exit off McCabe Road. These common access drives serve an
entire development and Nature Preserve. Traffic analysis study was
submitted for this development including nature preserve and
commercial tract.
The study mentions the future TxDOT Highway 146 improvements,
but concludes no impact on the study or development. The study gives
a cursory mention of other developments but generalizes a 5% annual
growth and takes that factor into the estimates for the survey. That
rate is average for the HGAC region although local estimates can be
much higher. The growth, according to the study, will not have a
significant impact on the development or the traffic flow in relation to
level-of-service ratings because of the limited access between McCabe
Road and SH l46 now and in the future.
. Topography - This area is relatively flat and stable and should not be an
obstacle to this type of development. The site for this development does,
however, split Flood Zone X to the west and Zone AE to the East.
· Density - Staff utilized the Land Use Plan as a guide with the designated
land use as Low Density Residential. In previous conversations, the
applicant stated that due to changes in legislation, he received
notification from the Army Corps of Engineers that more acreage of this
project could be developed. There are 34 single-family standard lots
proposed for 7.08 acres with a development ratio of 4.8 units per acre.
Single-family small lots with 44 lots on 7.34 acres equal to 6 lots per
acre. Eight units of townhouses on 0.80 acre come out to be 10 units per
acre. A 180-unit multi-family residential development yields 12.86 acres
with a density allowed by ordinance 14 units per acre (Section 106-333).
. Utilities - There are sufficient water distribution facilities along McCabe
Road to supply potable water and fire protection to this proposed project.
Provisions will have to be made to ensure that sufficient utility
extensions are made to serve this development. Sanitary sewer service is
not readily available to this site, and must be coordinated with the
development to the north, Lakes at Fairmont Greens.
The City prepared a long-term sanitary sewer master plan for providing
sewer service to areas of southeast La Porte. The master plan calls for the
elimination of a lift station # 12 and new lift station to be constructed near
the comer of intersection of Al 04 and McCabe Road. Utility plans must
be coordinated with the City Staff.

Conclusion!
Recommendations:

The project engineer agreed with a plan for taking the sanitary sewer
flow north through the Lakes at Fairmont Greens, a proposed subdivision
off SH 146. Based upon the preliminary studies, the Preserve at Taylor
Bayou, if hooked up to the new 24" trunk main going north for sanitary
sewer would represent 32% of the total anticipated capacity.
Coordination and contribution shall be required for the system upgrade
to handle both developments with each developer and the City being
expected to share the prorated cost of construction.
. Drainage - This property lies within the Taylor Bayou Watershed. The
City has a master drainage plan for the Taylor Bayou Watershed. The
plan calls for regional detention for this area. Efforts should be made to
work with the developer north of McCabe Road towards the
implementation of this master drainage plan.
The channel improvements to Taylor Bayou are not designed to directly
receive storm water runoff from this project. The Preliminary Plat,
therefore, shows that storm water will be detained using basin system in
both detention ponds to regulate run-off. Outfalls have to be determined
and coordinated with the Army Corps of Engineers and the Harris
County Flood Control District. The copies of the permits must be
presented to the City. The detention ponds need to be including within
the perimeter boundaries of the proposed development.
Nature Preserve -The Army Corps of Engineer permit states that the
dedication of approximately 65 acre nature preserve is to be made to the
County/City. The City of La Porte remains a party to facilitate any
dedication. This issue may be coordinated and approved in a separate
dedication instrument.
Staff reviewed the Preliminary Plat and found it to be in accordance with the
Development Ordinance of the City. Recognizing some difficult issues,
Staff and the developer created a preliminary development proposal.
Should the Commission wish to approve the Preliminary Plat in its present
format, staff recommends the following:
. Final Plat and Construction drawings shall indicate all infrastructure and
site drainage improvements to ensure adequate capacity and proper site

The property in question consists of llA8-acres being a part of 24.88 acres

On August 17, 1989, the Planning and Zoning Commission considered
approval of the Rezone Request #R89-005. The request asked for the
rezoning of Blocks 416, 417, 418, and 419; Town of La Porte tracts;
bounded by North Broadway on the west, East Madison on the north, East
Adams on the south and an abandoned Southern Pacific rail spur on the east;
to Planned Unit Development (p.D.D).
The City Council at its September 11, 1989 meeting, passed and approved
Ordinance 1501-K, which authorized the P.U.D. zoning of the said property
with an underlying CommerciallIndustrial land use for this area. This
designation was found to be compatible with the goals and objectives of the
Comprehensive Plan.
Recently, ,P&O Cold Logistics have filed for fence permit with the City.
Proposed fence is to be six feet high type In industrial chain link fencing
with 1 foot barbed wire making fence seven feet high overall. The reason for
a fence around the entire facility is driven by a need to protect the property
and to comply with guidance currently being postured by the US Customs
and USDA.
As per current zoning map of the City, the entire property lies within the
boundaries of three different zones (pUD, BI, and R-2). As such, different
criteria would apply in corresponding zoning classifications with appropriate
regulations. While reviewing the subject request, staff discussed the
following options:
. Setbacks & fencing requirement
. Rezoning
The first option requires 50' front setback in Business Industrial zoning
district. In addition, barbed wire fence cannot commence less than seven feet
above grade in an industrial district. On the other hand, fence along the
property line common with residential is subject to residential district
regulations. In order to erect the fence as proposed, the applicant must get
approval from the Zoning Board of Adjustment.
The second option is to request for the zone change. The tract in question
comprises 24.88 acres, of which approximately 4.1620 acres are zoned R-2,
7.3186 acres zoned BI, and 13.40 acres as PUD. If rezoned, the tract will be
combined with one zoning designation. The purpose of this district is to
provide for the grouping of land parcels for development as an integrated
unit as opposed to traditional parcel by parcel and unplanned approach to
development. It provides flexibility of site design through conditional use
provisions. It is further intended that planned unit developments are to be

characterized by central management, common use of parking, detention,
maintenance of open spaces or other facilities, and efficient distribution of
various land uses.
The applicant looked at the second option of rezone to Planned Unit
Development (PUD). Using thls scenario, the applicant is requesting to
rezone the property from BI & R-2 to PUD; where, existing use of the
facility is a permitted use and fencing would be allowed in accordance with
the applicable ordinances.
Analvsis:
The relationship of the applicant's proposal to the Land Use Plan and
Comprehensive Plan needs to be emphasized as much as possible. In
considering this request, Staff reviewed the following elements of the
Comprehensive Plan.
Land Use - The City's Land Use Plan indicates this area developing with
commercial and industrial uses. Conformance of a zoning request with the
land use plan is one consideration among several criteria to be considered in
approving or denying a rezoning application. Other criteria may include:
. Character of the surrounding and adjacent areas;
. Existing use of nearby properties, and extent to which a land use
classification would be in harmony with such existing uses or the
anticipated use of the properties;
. Suitability of the property for the uses to which would be permissible,
considering density, access and circulation, adequacy of public facilities
and services, and other considerations;
. Extent to which the designated use of the property would harm the value
of adjacent land use classifications;
. Extent to which the proposed use designation would adversely affect the
capacity or safety of that portion of the road network influenced by the
use;
. Extent to which the proposed use designation would permit excessive air
pollution, water pollution, noise pollution, or other environmental harm
on adjacent land use designations; and,
. The gain, if any, to the public health, safety, and welfare due to the
existence of the land use designation.
Facility Uses/Operations - Review of the City's Land Use Plan indicates
that this area is envisioned as a Commercial/Industrial use. The first phase of
the present facility was completed in 1991. In the first phase, there is a large
cargo building with existing loading docks as well as a rail spur for the flow

of goods. The existing building and truck parking/employee parking areas
were built in the BI and PUD zoned area. The detention pond and setback
areas are located in an R-2 zone. There is plenty of freight parking on
existing concrete pavement to the east of the building. The phase two was an
expansion of existing storage/warehouse building, which consists of multi
temperature freezer storage areas with static storage racks. As per project
description, it was designed to house refrigerated shipping and receiving
docks and deslatting areas. A computerized central ammonia refrigeration
system was installed for the facility.
The desi~ included two penthouses on the roof, located near the center of
each cold storage room. These penthouses contain the refrigeration heat
exchanger (evaporators) equipment. The evaporators are the system
components that circulate air and extract heat from the refrigerated spaces.
The evaporators are equipped with fans to provide circulation of cold air
throughout the refrigerated rooms.
The overall height at the ridge of the building is 45ft. It includes two small
penthouse structures near the ridgeline, approximately 960 sq.ft., (3% of the
total building), is minimal in comparison to the overall size of the building.
The top of the penthouse is approximately 12ft. above the height of the
proposed roofline. These penthouses are mechanical in nature (non-habitable
area) and are in compliance with Section 106-772 of the Ordinances.
Streets - All streets and alleys within the boundaries of this development
have been closed by the City Ordinance# 1693, 1694, and 1694 A. Being
located near the comer of North Broadway and Barbours Cut Boulevard, it
provides more than adequate accessibility for circulation of traffic. The main
access to the facility is through two drive entrances along N. Broadway.
Truck Parking - There are numerous times when trucks (tractor/trailer rigs)
are parked in front of the existing warehouse facility along the shoulders of
N. Broadway. This item was discussed with other staff members from
different departments with the consensus being that most of the parked
trucks are associated with the warehouse facility. This item has been
discussed with the applicant and in fact applicant is committed to alleviate
this problem. It is staff s recommendation that an appropriate on-site refuge
be provided to keep these trucks from parking on the side of the road. The
applicant's proposed remedy of NO PARKING signs along N. Broadway
will help but will not solve this problem. If the trucks do not have a proper
place to park on-site, they could end up parking at another inappropriate
location. The final solution will be addressed during the development site
plan process.

Utilities and Drainage - There is a sufficient water distribution facility in
the area to supply potable and fire protection to this facility. The
development has an existing dry pipe sprinkler protection system for the
warehouse/storage building. This dry pipe or double-interlock pre-action
system and large drop ceiling sprinklers is approved by the City. An existing
detention basin is to handle the flow of the storm water runoff from the
development. The detention basin has been designed to accommodate 100%
development of the total site.
Security Fencing - This facility is both U.S. Customs Bonded Warehouse
and a USDA Import and Export Inspection Station, adherence to guidance
issued by the US Customs and USDA is of paramount importance to the
continuation of operations of this facility. In addition, it has experienced
several incidents at this facility that warrant the expenditures to further
secure the property against unauthorized intrusions. P&O Cold Logistics will
secure and post no trespassing signs all around the perimeter of the property.
The City of La Porte Police Department has provided assistance for
enforcing all applicable no trespassing ordinances pertaining to P&O
Logistics property.
As, P&O Cold Logistics does not support uninvited persons entering the
premises without appropriate permission, installation of security fence
would be necessary. A type III industrial chain link fence shall be installed
all around the perimeter of the property. Two of the drive entrances will be
equipped with type I industrial double swing gates, security controlled access
and emergency service access.
Conclusion:
Based on the above analysis, staff finds the requested change is compatible
with the present zoning and uses of nearby properties. The change from
Business Industrial (BI) and Medium Density Residential (R-2) to Planned
Unit Development (PUD) would not negatively impact future development
within the area. Furthermore, it is not contrary to the intent of the
Comprehensive Plan.
From the information provided by the applicant, this request would appear to
be based solely on a desire to secure the property and consolidate the subject
tract into a PUD zoning district. Creating a unified PUD zone at this location
would not run contrary to the intent of the Comprehensive Plan and could
well compromise the viability of the remaining undeveloped property.

Staff recommends approval of this request and suggests that the applicant to
install privacy slats to the fence and provide landscaping on the embankment
of the detention pond in the rear adjacent to the residential zoning district
and restrict access to North Broadway.
In reviewing this request the Commission should consider the following:
. There was no apparent error in assigning the present zoning
designation to the tract in question.
. There has been no sufficient degree of change in or around the area
in question to render the present zoning designation inappropriate.
Options available to the Commission are:
. Recommend to Council approval of this rezoning ,request.
. Recommend to Council denial of this rezoning request.
. Table this item for further consideration by the Commission.

Background:
March 3, 2005: Large Lot Committee formed final recommendations on regulations and
boundaries governing creation of a Large Lot District.
April 21, 2005: Planning and Zoning Commission held workshop on proposed regulations for
Large Lot District.
June 9, 2005: Town Hall meeting held at Lomax Elementary School Cafeteria to receive
citizens' comments on proposed Large Lot District. (Graphics and maps were displayed at
several stations throughout the cafeteria. City Staff was available at each of the locations to
provide information and answer questions.)
On July 21,2005, the Planning and Zoning Commission held a workshop for the
proposed Large Lot Zoning District, and discussed citizen's input gathered during the
Town Hall Meeting on June 9, 2005, at the Lomax Elementary School. The Commission
has reservations about some of the recommendations made by the Large Lot Committee.
The citizens also voiced their concern at the Town Hall meeting. The Commission
directed staff to assess and make suggestions for the following issues:
. Minimum lot width 100'
. 45' height proposed for accessory buildings
. No control proposed for outside equipment storage
. Rules for Grazing Animals
August 18, 2005, as directed by the Planning and Zoning Commission, staff put up

RE: Large Lot Committee Recommendations
Dear Ms. Muston:
On March 3, 2005, the Large Lot Committee formed their final recommendations on regulations and
boundaries governing the creation of a Large Lot Zoning District. At the conclusion of this meeting,
the committee set April 21, 2005, for the presentation to the Planning and Zoning Commission in a
workshop format and recommended using a town hall meeting to disseminate the proposal to the
citizens
At the April 2151 workshop, the Planning and Zoning Commission conducted the workshop regarding
the proposed regulations and boundaries for the creation of a Large Lot Zoning District. The
Commission directed that the City Staff conduct a public hearing to gather citizen input prior to
formally considering the Large Lot Committee's recommendations. That hearing was conducted on
June 9, 2005.
All input has been considered and the Large Lot Committee is pleased to present the majority's final
recommendation together with City Staff modifications. The proposed regulations are described below
in comparison with the existing City of La Porte Zoning Ordinance. Where the proposed regulations
are the same as the existing ordinance, that fact is indicated along with the appropriate Section of
Chapter 106, Zoning. Committee proposed changes are indicated in red. Further Staff
recommendations are in green:

Rules and Regulations and designed to be placed on a permanent foundation system consistent
with the above requirements. Such industrialized house or building must bear a T.D.L.R.
approved decal or insignia permanently affixed to each transportable section or component of
each industrialized house or building to indicate compliance with the state standards. An
industrialized house or building is not a mobile or manufactured home as defined herein.

Landscaped means adorned or improved by contouring land and placing thereon live
flowers, shrubs, trees, grass, wood, stone, and ponds or streams.
Light truck means any truck, as defined in this chapter, with a limited manufacturers rated
carrying capacity. This definition is intended to include those trucks with such rated carrying
capacity being not in excess of one ton, panel delivery trucks and carryall trucks.
Loading berth means a parking area provided for commercial motor vehicles, designed
for the receipt or distribution by such vehicles of materials or merchandise to or from the use to
which such parking area is accessory.
Lot area per dwelling unit means the lot area required for each dwelling unit located on a
building lot.
Lot, corner means a building lot situated at the intersection of two existing or proposed
street rights-of-way, the interior angle of such intersection not exceeding 135 degrees.
Lot coverage means the area under roof on any given lot.
Lot, depth means the mean horizontal distance between the front lot line and the rear lot
line of the building lot measured within the lot boundary.
Lot, interior means a building lot other than a comer lot.
Lot line means a boundary of a building lot.
Lot line, front means that boundary of a building lot which is the line of an existing or
dedicated street. Upon comer lots either street line may be selected as the front lot line providing
a front and rear yard are provided adjacent and opposite, respectively to the front lot line.
Lot line, rear means that boundary of a building lot which is most distant from and is, or
is most nearly parallel to the front lot line.
Lot line, side means any boundary of a building lot which is not a front lot line or a rear
lot line.
Lot of record means an area of land designated as a lot on a plat of a subdivision recorded
pursuant to statutes of the state with the county clerk or an area of land held in single ownership
described by metes and bounds upon a deed recorded or registered with the county clerk.
Lot, residential large means a homesite for a single-family home that is comprised of at
least one acre (43,560 square feet). Minimum lot width shall be 90 feet.

Subdivision V MH Manufactured Housing District
Sec. 106-411. Purpose.
(a) The MH manufactured housing district is intended to provide for manufactured housing
communities, (parks, subdivisions, or condominiums). Within such developments, manufactured
housing communities (with such additional uses and occupancies as are permitted herein) may be
established subject to the requirements and limitations set forth in these and other regulations.
Other residential and supporting uses may also be permitted in such districts.
(b) It is intended that such manufactured housing communities shall be so located, designed, and
improved as to provide a desirable residential environment, protection from potentially adverse
neighboring influences, protection for adjacent residential properties, access for vehicular traffic
without traversing minor streets in adjoining residential neighborhoods, and accessibility
equivalent to that for other forms of permitted residential development to public facilities, places
of employment, and facilities for meeting commercial and service needs not met within the
manufactured housing community.

(h) It shall be unlawful for any person to leave, stand, or park a commercial motor vehicle, pole
trailer, semi-trailer, shipping container, trailer, truck (other than a light truck as defined herein),
or a truck tractor on any property zoned for residential use. Boats or recreational vehicles parked
or stored in a rear yard are not subjected to the restrictions imposed by this section.
(i) No accessory uses or equipment except for air conditioning structures or condensers may be
located in a required side yard except for side yards abutting streets where equipment is fully
screened from view.
G) Large Lot District. Refer to Section 106-416. Special Regulations
Sec. 106-742. Domestic livestock.
(a) Domestic livestock (cattle, horses, hogs, sheep, goats, chickens, and geese) are a
permitted accessory use on lots in excess of 43,560 square feet, provided that all domestic
livestock as defined above be restrained no closer than 25 feet from property that is not devoted
to the keeping of domestic livestock, and provided further that said domestic livestock be kept in
a concentration that is less than or equal to:
(1) Two cows per acre.
(2) Two horses per acre.
(3) Two hogs per acre.
(4) Two sheep or goats per acre.
(b) In any event, the total for the above referenced grazing animals (Le. sheep, goats, hogs, cows,
or horses) shall be cumulative. In the event of fowl, no specific concentration is established
herein, but in no event, shall the cumulative concentration of fowl be such as to create a health
hazard. The requirements of section 34-126 et seq. shall apply in any event.
(c) The keeping of livestock or fowl for the purpose of breeding for sale, whether engaged in as a
primary or accessory activity, shall be considered a conditional use as specified by section 106-
331, Table A.
Sec. 106-743. Breeding kennels (dogs and cats only).
Breeding kennels for dogs and cats only, are a permitted accessory use on lots in excess
of 43,560 square feet, provided that all of such kennels are licensed according to section 14-81 et
seq., and any amendments or additions thereto. Provided further that all animals must be boarded
in enclosures located no closer than 100 feet from any property line. The requirements of section
34-126 et seq., and any amendments or additions thereto shall apply in any event.
Sec. 106-744. Bed and breakfast.
(a) A bed and breakfast shall be operated by resident homeowners.
(b) A bed and breakfast shall conform to the requirements of section 106-334.
(c) Parking shall be provided in accordance with the requirements of section 106-839.

I teach agriculture in a local school district where I also serve as the FF A advisor. This
community is a lot like La Porte. There are several neighborhoods, a few local
businesses, a couple of grocery stores, and an area that resembles Lomax where houses
are built on acreage and house livestock animals. This is only my second year to teach
here and since I still reside in Lomax, I am not completely familiar with the history of the
community, but my students are always talking about the growth they have, seen take
place just since they were in Kindergarten. Because of the growth that has taken place in
this small city, many of my students will not get the opportunity to raise livestock
through FFAas they wanted to do. Why? Many of them used to live in an area where
, they were surrounded by land and used to be able to have whatever animals they wanted.
Land owners have since built houses, moved into the area and complained about the
animals. Because of the change in their community, my students were forced to give up
the life that they were familiar with in order to pacify their new neighbors. Now that they
are in high school and a member of our FF A chapter, they would love to get involved in
livestock again but they don't have that opportunity because it was taken from them
several years ago. I would hate to see the students of our community one day miss out on
the opportunities of raising livestock because the land has been taken away from them.
I have been blessed to have been raised in Lomax where I was able to raise livestock
through the La Porte FF A and 4-H all throughout my school years. My parents used
these livestock as tools to help me develop into the person I am today. I have learned
compassion for the sick and old. I have learned patience with the young and stubborn. I
have learned to take responsibility for the animals that rely on me for their every health
need. I have learned the cycle of life and that sometimes the cycle is all too short. I pray
that I will be given the opportunity to raise my children in the Lomax that I know today
and that they too will have the chance to learn the life lessons that I have learned through
livestock.

. Because of the community in which I have been raised, I was given numerous
opportunities throughout my school years that my friends never got the chance to
experience. I have raised livestock since I was in the third grade and continue to raise
and show pigs on the national level. Through this extracurricular activity, I was able to
pay my own way through college and have money set aside to put toward my first house
upon graduating from Texas A&M. .
Because of the lifestyle I had while growing up, I have decided to major in agricultural
science where I have plans of one day teaching agricultural science and FF A at the
secondary level. I know that I would not be where I today if it weren't for being raised in
the Lomax Area where I was given every opportunity to interact with God's creatures on
a daily basis.
My biggest fear is that one day I will have children who will not have the same
opportunities. I fear that one day Lomax will be full of neighborhoods and inhabitants
who do not support our lifestyle. I want security in knowing that Lomax is going to be
protected.

I am in FAVOR of granting this request for the following reasons:
I am the third generation of my family to live in my current house. I have seen numerous
housing additions added to our small "country-like" community throughout the years. I
have heard rumor that there is another one in the making. This infuriates me. My
grandparents chose this community because of the large acres of land. They wanted a
. place where they could raise their children and grandchildren without being crowed by
neighbors. My grandparents have since moved to a town with more of a country
atmosphere and I have taken over the house. When moving into this house, I had every
intention of raising my children here. I love the fact that they can be involved in the 4-H
and FF A programs and raise livestock without complaints from the neighbors. I am
slowly beginning to see that vision fade because of the congestion of people that seem to
. be buying small plots of land and building homes. I would like to see the creation of the
Large Lot District take place to ensure that Lomax will still be Lomax when I begin
raising my family.
