PLANNING AND ZONING COMMISSION
MINUTES OF SEPTEMBER 20, 2007

1. CALL TO ORDER.
Meeting called to order by Chairperson Muston at 6:00 p.m.
2. CONSIDER APPROVAL OF JULY 19, 2007, MEETING MINUTES.
Motion by Dottie Kaminski to approve the Minutes of July 19, 2007. Second by Claude Meharg.
The Motion carried.

3. CONSIDER FINAL PLAT FOR INTERPORT DISTRIBUTION CENTER.
Due to a possible conflict of interest regarding this item, Commissioner Nick Barrera abstained from
participation in discussion and action.
Masood Malik, City Planner, presented staffs report. The plat consists of three reserves and one
block along Bay Area Boulevard, totaling 87.908 acres, within the Bayport Industrial District. Mr.
Malik reported Staff has reviewed the plat and found it complies with subdivision ordinance
requirements.
Robert Lin, of Lin Engineering, was present to address Commission questions.
Wayne Sabo, Planning Director, stated an Industrial District Agreement, a Water Service
Agreement, and a Sanitary Sewer Service Agreement are required for this development.
Motion by Hal Lawler to approve the Final Plat for Interport Distribution Center located along Bay
Area Blvd. Second by Dottie Kaminski. The Motion carried.
Ayes: Kaminski, Meharg, Finch, Linscomb, Muston, and Lawler

4. OPEN PUBLIC HEARING TO RECEIVE CITIZEN INPUT ON SPECIAL CONDITIONAL USE
PERMIT REQUEST #SCU07-008 FOR 0.8272 ACRE TRACT OF LAND IN THE W.J. PAYNE
SUBDIVISION, W.M. JONES SURVEY, ABSTRACT 482, LA PORTE, HARRIS COUNTY,
TEXAS, AS REQUESTED BY DEBBIE STYRON AND DEANNE BERRY, FOR PROPOSED
DEVELOPMENT OF AN EVENT CENTER TO BE LOCATED AT 10515 SPENCER HIGHWAY
WITHIN LA PORTE MUNICIPAL AIRPORT PROPERTY.
Chairperson Muston opened the public hearing at 6:08 p.m.
A. STAFF PRESENTATION
Mr. Malik presented staffs report. Applicants Debbie Styron and Deanna Berry have
requested a special conditional use permit to develop a multi-purpose event center at
10515 Spencer Highway, within the La Porte Municipal Airport property.
Notification of the public hearing was mailed to five property owners located within 200' of
the proposed development. The City received one response in favor of the request.
Mr. Malik and Mr. Sabo answered questions from the Commission. Staff recommended
approval of the special conditional use permit.
Chairperson Muston noted there was an error in one of the permit conditions. "Stripping"
of the parking lot should be changed to read "striping" of the parking lot.
B. PROPONENTS
The applicant, Deanna Berry, of 706 Briar Creek, addressed the Commission. There was
discussion regarding use of the concrete area on the north side of the building. Ms. Berry
stated it was her understanding they were allowed to utilize it, but restricted to only the
concrete areas, which includes the concrete area beyond the four-foot fence.
C. OPPONENTS
Mike Keplinger, of 10339 Catlett, addressed the Commission. Mr. Keplinger had
concerns about excessive noise and parking. He wanted to make sure there are City
ordinance provisions in place to address those issues and that the City was not relying on
airport regulations.

6. CONSIDER RECOMMENDATION TO CITY COUNCIL REGARDING SPECIAL CONDITIONAL
USE PERMIT REQUEST #SCU07-008 FOR 0.8272 ACRE TRACT OF LAND IN THE W.J.

Motion by Nick Barrera to recommend to City Council, approval of Special Conditional Use Permit
#SCU07-008 for development of a multi-purpose event center at 10515 Spencer Highway, within
the La Porte Municipal Airport property, with the following conditions:

. This Special Conditional Use Permit is specifically limited for an event center at 10515 Spencer
Highway.
. Striping of the parking lot shall be required and layout plan be submitted to the City to determine
adequate parking.
. Outdoor activities shall be restricted to the parking area and concrete pavement on the north
side of the building.
. No outside lights, balloons or play equipment shall be allowed.
. The gate adjacent to the hanger will be kept closed and locked at all times.
. No vehicles shall be allowed inside the fenced area except for activities associated with the
aviation activities.
. Any new signage requires a separate sign permit from the City.
. The roofed-over structures on the property shall not accumulatively exceed the current lot
coverage or maximum (40%).
. Height of the building shall remain the same.
. Hours of operation shall not extend beyond 1 :00 a.m.
. Exterior building design standards, if proposed, shall be approved by the City.
. Landscaping shall be maintained by the applicants/tenants of the property.
. Lease agreement, duly approved by the City Attorney, shall be filed with the City. A certificate of
occupancy shall be required.
. The Developer shall comply with all applicable laws and ordinances of the City and the State
of Texas.
Second by Dottie Kaminski. The Motion carried.

7. OPEN PUBLIC HEARING TO CONSIDER REPLAT OF MORADA BY THE BAY (FORMERLY
GARFIELD APARTMENTS) LOCATED ALONG 200 GARFIELD BOULEVARD.
Chairperson Muston opened the public hearing at 6:25 p.m.
Chairperson Muston indicated the address 200 Garfield is incorrect and should be researched to
determine the correct address.
A. STAFF PRESENTATION
Mr. Sabo presented staff's report. Applicants and property owners, Joe and Mario
Navarro, have requested a replat of 1.828 acres into one block, four common reserves,
and 16 townhomes (single lot configuration). The replat has been submitted in
accordance with an agreement between the City and the property owners. Mr. Sabo
answered questions from the Commission. Staff recommended approval of the replat
with conditions.
No responses were received from the 10 public hearing notices mailed to property
owners located within 200' of the subject tract. One of the notices was returned
undeliverable.
B. PROPONENTS
Joe Navarro, of 6126 Roberta Place, Stockton, California, addressed the Commission.
During discussion with the Commission, Mr. Navarro provided the following information:

. Demolition should begin upon receipt of final plat. Weather permitting, and upon
completion of demolition and leveling, they should be able to begin the project within 60
days.
. Investment to date is approximately $500,000-$600,000. Loans for demolitionlleveling
will require an approved final plat.
. Building concept is three-story with bottom floor to include a long garage for storage of
boats, recreation vehicles, etc. and the top floor with a view of the bay.
C. OPPONENTS
No opposition was presented.
8. CLOSE PUBLIC HEARING
Chairperson Muston closed the public hearing at 6:46 p.m.
9. CONSIDER APPROVAL OF THE REPLAT FOR MORADA BY THE BAY TO BE LOCATED AT
200 GARFIELD BLVD.
Motion by Nick Barrera to approve the Replat of Morada By the Bay with the following conditions:
. Submit utility schematic for the subdivision. Show the nearest fire hydrant and include utilities
routing.
. Flood Plain Development Permit shall be applicable. Indicate B.F.E. and fumish an elevation
certificate prior to building permit issuance.
. A copy of the subdivision covenants and restrictions shall be submitted to the City for the City
Attorney's approval.
. Landscaping will be provided at site as per City's requirement.
. Add a note on the plat that all shared drives are private and shall be maintained by the
owner/developer.
. Intemal sidewalks installation will be the sole responsibility of the owner/developer.
. Payment of $12,928.00 must be paid to the City in lieu of parkland dedication.
Second by Dottie Kaminski. The Motion carried.

10. OPEN PUBLIC HEARING TO RECEIVE CITIZEN INPUT ON AN AMENDMENT TO THE ZONING
ORDINANCE BY AMENDING SECTION 106-742, CODE OF ORDINANCES, RELATED TO THE
ALLOWABLE CONCENTRATION OF DOMESTIC LIVESTOCK PER ACRE.
Chairperson Muston opened the public hearing at 6:52 p.m.
A. STAFF PRESENTATION
Mr. Sabo presented staffs report. The Planning & Zoning Commission and Staff were directed
by City Council to review the possibility of increasing the number of animals per acre allowed by
ordinance. Currently, two grazing animals are allowed per acre. Staff researched the subject
and for comparison, checked ordinance provisions of neighboring cities.
A workshop was held on July 19, 2007, where there was a consensus of the Commission to
maintain the current regulations.

Staff recommended the current use requirements for allowable numbers of grazing animals
remain intact.
The Commission further discussed this item.

12. CONSIDER RECOMMENDATION TO CITY COUNCIL REGARDING AN AMENDMENT TO THE
ZONING ORDINANCE BY AMENDING SECTION 106-742, CODE OF ORDINANCES, RELATED
TO THE ALLOWABLE CONCENTRATION OF DOMESTIC LIVESTOCK PER ACRE.
Motion by Dottie Kaminski to recommend to City Council, that the current allowable concentration of
domestic livestock per acre remain in tact. Second by Nick Barrera. The Motion carried.

13. ADMINISTRATIVE REPORTS
Mr. Malik reported the following:
. Commission Members attending the APA Conference will leave on October 17.
. The regular scheduled meeting date for October is the 18th; Commission Members agreed to
change the date to October 11, to avoid a conflict with the APA Conference.
. Value Place Hotel - near completion; due to open end of October.
· Quality Inn Hotel - building permit issued.
· Fairmont Shopping Center - site plan approved.
. Candlewood Suites (4-story hotel with 111 rooms) - site plan close to approval.
· Advance Auto Parts - new development
Mr. Sabo updated the Commission on the work being done to address drainage problems
throughout the City, including the creation of a Flooding and Drainage Sub-committee, which has
already begun to meet.
Mr. Sabo reported a traffic study has been finalized, whereby TXDOT has agreed to place
signalization at the Wharton Weems/SH 146 intersection.
14. COMMISSION COMMENTS
In Mr. Barrera's survey experience performing drainage studies, he has observed debris blocking
manholes and storm inlets. He inquired about the City's maintenance schedule for checking for
blockages. Chairperson Muston also suggested educating the public better.

Chairperson Muston inquired about the possibility of placing a protected crossing area on
Broadway for senior pedestrians traveling from Churchill Place to the Sr. Center.
Hal Lawler inquired about landscaping requirements for new developments along SH 225. Mr.
Sabo stated the City cannot require landscaping if we do not have an industrial district agreement
with the company_

Permit Conditions:
1. This Special Conditional Use Permit is specifically limited for a portable office building at the above property.
2. A building permit shall to be obtained from the City.
3. Building placement should not cause any obstruction to any aviation activities.
4. No activities involving the storage, utilization, or manufacturing of materials or products shall be permitted.
5. Any new signage requires a separate sign permit from the City.
6. A copy of the certificate of insurance needs to be submitted to the City.
7. Lease agreement, duly approved by the City Attorney, shall be filed with the City.
8. A certificate of occupancy shall be required.
9. The Developer shall comply with all applicable laws and ordinances of the City and the State of Texas.
Failure to occupy the building within 12 months after issuance or as scheduled under the terms of a special
conditional use permit shall void the permit as approved, except upon an extension of time granted after
application to the Planning and Zoning Commission.
If contract or agreement is terminated after completion of any stage and there is ample evidence that further
development is not contemplated, the ordinance establishing such special conditional use permit may be rescinded
by the City Council, upon its own motion or upon the recommendation of the Planning and Zoning Commission of
the City of La Porte, and the previous zoning of the entire tract shall be in full effect on the portion which is
undeveloped.
