CALL TO ORDER. Meeting called to order by Chairperson Muston at 6:00 p.m. 2. ADMINISTER OATH OF OFFICE TO REAPPOINTED MEMBERS, DOTTIE KAMINSKI, PAUL BERNER AND ALTERNATE MEMBER HAL LAWLER. Clark Askins, Assistant City Attorney, administered the oath of office to reappointed members Paul Berner and Alternate Member Hal Lawler. Dottie Kaminski was not present at the meeting. 3. CONSIDER APPROVAL OF OCTOBER 11, 2007, MEETING MINUTES. Motion by Doretta Finch to approve the Minutes of October 11, 2007. Second by Hal Lawler. The Motion carried. Ayes: Nays: Abstain: Finch, Muston, Barrrea, Berner, Meharg, Lawler and Bird None None 4. CONSIDER REQUEST TO WITHDRAW PRELIMINARY PLAT FOR LAKES AT FAIRMONT GREENS, SECTION 9. Mr. Malik reported that due to a change in the land plan, the Developer has requested the approval for Preliminary Plat for Lakes at Fairmont Greens, Section 9, be withdrawn. The Commission accepted the request for wilthdrawal. 5. CONSIDER 2ND ONE-YEAR EXTENSION REQUEST FOR SPECIAL CONDITIONAL USE PREMIT #SCUOS-OOS FOR PRESERVE AT TAYLOR BAYOU. Mr. Malik presented staff's report. Project Engineer, Deborah Mason, on behalf of the owner, has requested a second one-year extension for Special Conditional Use Permit #SCU05-008 with the existing permit conditions. The Commission had concerns regarding the need for an additional extension. After discussion, the Commission agreed to approve the request. Motion by Paul Berner to approve 2nd One-Year Extension Request for Special Conditional Use Permit #SCU05-008 with the existing permit conditions. Second by Les Bird. The motion carried. OPEN PUBLIC HEARING FOR A REPLAT OF PPG - LA PORTE PLANT LOCATED ALONG SOUTH 16TH STREET AND FAIRMONT PARKWAY. Chairperson Muston opened the public hearing at 6: 1 0 p.m. A. STAFF PRESENTATION Planning and Zoning Commission Minutes of January 17, 2008 Page 2 of 3 Masood Malik presented staff's report. PPG - LaPorte Plant is located along South 16th Street and W. Fairmont Parkway. The applicant has requested a replat of 32.1849 acres of land. Public notices were mailed to 12 property owners located within 200' of the subject property. The City did not receive any responses from the mail-out. Staff recommended approval of the replat. B. PROPONENTS None. C. OPPONENTS None. 7. CLOSE PUBLIC HEARING. Chairperson Muston closed the public hearing at 6:31 p.m. 8. CONSIDER APPROVAL OF THE REPLA T FOR PPG-LA PORTE PLANT LOCATED ALONG SOUTH 16TH STREET AND FAIRMONT PARKWAY. Motion by Nick Barrera to approve the Replat for PPG, La Porte Plant, located along South 16th Street and Fairmont Parkway. Second by Paul Berner. The motion carried. Ayes: Nays: Abstain: Muston, Finch, Barrera, Berner, Meharg, Lawler and Bird None None 9. OPEN WORKSHOP TO DISCUSS REZONING OF TRACTS ALONG FAIRMONT PARKWAY. Chairperson Muston opened the workshop at 6:33 p.m. At the request of the Chairperson, Staff prepared a workshop item to discuss the possibility of rezoning tracts which abut residential neighborhoods along Fairmont Parkway from General Commercial (GC) to Neighborhood Commercial (NC). Mr. Malik reiterated several rezoning benefits that were listed in staff's report: · Attract commercial establishments compatible with residential uses · Create neighborhood friendly atmosphere · Ensure that commercial development is attractive, highly utilized, and without negative influence on adjacent residential uses The Commission discussed the pros and cons of allowable uses in GC and NC zones. 10. CLOSE WORKSHOP Chairperson Muston closed the workshop at 7:19 p.m. 11. ADMINISTRATIVE REPORTS Mr. Malik reported the following: · The Lakes @ Fairmont Greens, Section 1 infrastructure has been completed and the plat will soon be released for recordation. Awaiting drainage/detention system approval from Harris County. . Ongoing construction projects along Fairmont Parkway within the City limits and in the Bayport Industrial District. 12. Site Plan Staff Report February 21, 2008 TREDCO Subdivision Plat Request: Approval of a Plat (1 Commercial Reserve) Requested Bv: Requested For: Location: Baclmround: Analvsis: Tredco, L.P., Owner c/o Century Engineering, Inc. (Representative) 14.7555 acres ofland out of the William M. Jones Survey, Abstract No. 482, La Porte, Harris County, Texas. Bayport Industrial District (La Porte ETJ) Faimlont Parkway near Bay Park Road The applicant is platting 14.7555 acres of land into a restricted reserve for commercial use in the Bayport Industrial District. The property is located within the Extraterritorial Jurisdiction (ETJ) of La Porte, approximately 1,000 ft. west of Bay Park Road and south of Faimlont Parkway. The City of La Porte excludes from the terms, conditions and effects of the La Porte Development Ordinance and all amendments hereto, land included within the boundaries of any Industrial District or Districts within the Extraterritorial Jurisdiction of the City of La Porte. Harris County Public Infrastructure Division/Engineering Department, Harris County Flood Control District (HCFCD), and several other easement holders/agencies will be reviewing this plat. The plat is being presented to the Commission as a courtesy. In addition, the property will be subject to all the rules and regulations mentioned in Exhibit 'c' of the Industrial District Agreement, once approved by City Council (copy attached). Special considerations are a dedication to the City of a 10' wide pedestrian and bicycle easement along company's Fairmont Parkway boundary, landscaping/screening, SigIlage, and driveway along Faimlont Parkway. Once the plat is approved, an Industrial District Agreement (IDA) shall be presented for consideration of approval by City Council. Land Use - The owner/developer plans to develop the tract for commercial uses. Building Lines - The plat shows building lines as Front 50', Rear 25', and Sides 25', recorded in Volume 5920, Page 165, Harris County Deed Records. Utility/Pipeline Easements - A 10' wide private sanitary force main and storm sewer is shown to the west adjacent to 100' wide Exxon Pipeline Corridor. Streets - The facility will have direct access to Fairmon! Parkway, a semi- controlled access highway with 250' wide right-of-way. Proposed site plan shows a 25' wide driveway along Fairmont Parkway. The design standards comply with the City's driveway criteria per Section 106-835 ofthe Code of Ordinances. EXH J B I' T A Tredco 2/21/08 - P & Z Meeting Page 2 of2 Conclusion/ Recommendation: Utilities - City policies, with City Council approval on case by case basis, offer limited water and wastewater service for usual domestic consumption and other limited uses. This is one of the provisions of the water/sewer service agreement. A 12" water line and 21" sanitary sewer main are located along the north side of Fairmont Parkway. If approved by City Council, service will be provided per City policy on water and sewer services outside of the City limits in the Industrial Districts. Storm Water/Drainage System - Company shall provide a storm water management plan approved by Harris County Flood Control District (HCFCD) and the City of La Porte. The owner/developer shall construct and maintain storm water system as a condition of Exhibit 'A' to the water/sewer service agreement. Proposed site plan shows on-site detention area to the south, anticipated outfall is to the Big Island Slough. Landscape/Screening - A 50' wide Exxon Pipeline Corridor Easement is located along the south side of Fairmont Parkway adjacent to another existing 50' wide Pipeline Easement with natural vegetation. Existing trees together with other vegetation and underbrush will provide a thorough and effective visual screening of the development. Site plan shows existing vegetation to remain in place. Exhibit 'c' of the Industrial District Agreement requires City approval of a landscaping/screening plan. Pedestrian & Bicycle Trail Easement - Exhibit 'c' to the industrial district agreement requires a 10' wide pedestrian easement, outside of the pipeline easements, shall be dedicated to the City of La Porte by plat for the entire length of this area along Fairmont Parkway for the development of a hike and bike trail. The plat shows 10' wide City of La Porte hike and bike trail easement south of 50' wide Exxon Pipeline Easement. All planting and landscaping will be maintained by the property owner or developer. Staff recommends support of this development with the understanding that water and sewer services may be obtained with City Council approval of water/sewer service agreement. If the Planning and Zoning Commission wishes to approve the plat, staff suggests the following provisions as a minimum be considered: · Approval of Industrial District Agreement (IDA) and water/sewer service agreement shall be required by City Council. · Landscaping/screening shall be required along Fairmont Parkway. The berm may be landscaped with a combination of trees, shrubs, and ground cover. · Add a note on the plat that detention/drainage system maintenance shall be responsibility of the owner/developer. · Site plan shall conform to Exhibit 'C' of Industrial District Agreement and Exhibit' A' of the water/sewer service agreement. ) L \ X 0 ~ -Uf'ut..L:uu ~:s f-~ !f4 JL:Ce~+- -EXHIBIT CII Page 1. of 3 R.ULES AND ~EGULATIONS Any portion of Land constituting a strip of land 100 I wide and contiguous to either Fairmont Parkway, state Highway 225, or State Highway 146 shall pe subject to the following rules and regulations pertaining to new signage, screening f driveways and median crossovers. These rules and regulations shall apply after the effective date of this Agreement when Company develops or constructs improvements on vacant Land described in Exhibit "A" which is adjacent to Pairmont Parkway, state Highway 225, or State Highway 146. 1. Any sign erected in said 100f strip of land shall be subject to the following provisions: .. One freestanding identification. sign shall be permitted for each side of an industrial establishment that fronts on an improved public right-of-way. .. Freestanding identification signs for single tenant buildings shall not exceed 150 square feet in area. .. One freestanding identification sign for identifying multiple businesses is allowable at the intersection of improved public rights-of-way. .. Freestanding identification signs for multiple businesses shall not exceed 350 square feet. .. Freestanding identification signs shall not exceed 45 feet in height. .. Minimum setback for sign construction shall be ten (10) feet from property lines. 2. When Land adjacent to said 100 I strip is developed, the initial SOl of said strip beyond any existing pipeline easement contiguous to either Fairmont Parkway, State Highway 225, Dr State Highway 146 shall be screened by one of the following techniques: a) Leaving in place existing trees, vegetation, underbrush, etc. to provide a thorough and effective visual screening of the development. Existing trees shall, together with other vegetation and underbrush, create a continuous visual screen. 14 -EXHIBIT en Page 2 of 3 b) The use of earthen berms with approximately 3: 1 side slopes, 50' wide at the base and s, high. The berms may-be landscaped with a combination of trees, shrubs, and grou-'I'ld coyer. All berms and landscaping will be maintained by the property owners. c} A screening planr to be approyed by the city, that includes a combination of trees, shrubs, and ground cover that after 5 years growth will be at least 20 feet in height and shall, together with shrubs and ground cover, create a continuous visual screen. Provided, however, in public utility easements or rights-or-way, the vegetation shall be installed and maintained in a m~Jner which is acceptable to the public utility company, and does not interfere with the operation and maintenance of the public utility facilities. The pedestrian easement shall not be within any pipeline facility, except for necessary crossings. 3. Driveways opening from said strip of land onto State Highway 225 or State Highway 146 shall be subject to the rules and regulations of the Texas Department of Transportation and provisions of the City's Code of Ordinances, whichever is more restrictive. CaMP A.NY shall provide additional improvements as specifically set forth below. These agreements represent contractual undertakings of CaMP ANY, undertaken to induce CITY to sell water to COMPANY pursuant to the terms of the Water Service Agreement and/or Sanitary Sewer Service Agreement and this addendum. Said additional improvements undertaken by COMP ANY are an integral part of the consideration by CaMP ANt for obtaining the provision of water and/or sanitary sewer service from CITY. 1) STORl\1WATERPLAN: For new development CaMP ANY shall provide a Storm Water Management Plan that is approved by Harris County Flood Control District and CITY. COMP A.~ shall construct and maintain any storm water system as a condition of continued water and/or sewer service. 2) BEAUTIFICATION EFFORTS: COMP ANY shall submit a Landscaping Plan subject to approval by CITY. COMP ANY shall install and maintain landscaping along its existing developed frontage as per approved Landscaping Plan as a condition of continued water servIce. EXHtBi r "} )
