1. CALL TO ORDER.
Meeting called to order by Chairperson Muston at 6:02 p.m.
2. OPEN WORKSHOP TO DISCUSS ALLOWABLE USES AND PROPOSED BOUNDARY LINES
FOR COMMERCIAL RECREATION (CR) ZONING DISTRICT WITHIN THE CITY OF LA
PORTE.
Chairperson Muston opened the workshop at 6:02 p.m.
Masood Malik presented staff's report on proposed allowable uses and boundary lines for the
Commercial Recreation Zoning District. Mr. Malik reminded the Commission about a letter from
Mr. Walter Johnson they received in their packet. In the letter, Mr. Johnson, a long time La Porte
resident and President of Amegy Bank, expressed his support for the Commercial Recreation
District and similar successful efforts by Houston Mayor Bill White's Discovery Green project.
Staff and Commission Members discussed the proposed boundaries for the District Commission
Members agreed the proposed boundaries were appropriate and directed staff to move forward
with the boundaries as presented.
Staff and Commission Members held a lengthy discussion regarding proposed allowable uses for
the District. Commission Members requested staff provide them with the SIC classifications for
eight of the proposed uses, prior to the next meeting:

5. COMMISSION COMMENTS
Commission Member Hal Lawler suggested a possible future workshop to discuss landscaping
requirements. He spoke briefly about wanting the City to encourage Developers to include more
large trees in their landscaping plans.

General Commercial (GC)
The applicant is platting 4.3565 acre tract to create a commercial reserve' A'
for existing facility known as Underwood Self Storage. A subdivision plat
was approved to build a mini-storage facility on a 4.00 acre tract of land
along Underwood Road near Spencer Highway. Later on, the applicant
purchased 0.3565 acre tract abutting the subdivision between the storage
facility and the shopping plaza. Mini-storage/warehousing in a General
Commercial zone is classified as Conditional Use per Code of Ordinances.
City Council approved Special Conditional Use Permit #SCU04-010 on
August 23, 2004.
Underwood Self Storage, a mini-storage/warehousing facility is located
just north of Underwood Plaza and Gringo's Restaurant along Underwood
Road. The property is within proximity to the major retail commercial
developments and residential in the rear. The existing land uses are
primarily commercial (grocery store, restaurants, drug store, beauty shop,
insurance company, and other miscellaneous shops).
Exxon/Mobil Pipeline runs diagonally through the existing facility along
Underwood Road.. The parameters of this easement allow only access to
owned land via a paved driveway. Landscaping and screening is required
adjoining residential properties to the rear in compliance with Section 106-
444(a) of the Code of Ordinances. All landscaping and screening shall be
maintained by the owner/developer. Any outside storage shall be screened
from public view.
Staff finds the requested plat satisfies applicable provisions of the State
Law and City Ordinances. Staff recommends approval of the replat of
Underwood Self Storage.

Commercial Recreation (CR) District

The City's Code of Ordinances recognizes the Commercial Recreation (CR) Zoning
District, however, its boundaries, uses and regulations have not yet been established. In
addition, no area has been designated as Commercial Recreational (CR) zoning district
on the City's Official Zoning Map.
At the March 20, 2008 Planning and Zoning Commission workshop and regular meeting,
staff gave a presentation, which provided background information on past and current
plans and concepts that support activities in Commercial Recreation (CR) Zoning
District. Later, the Planning and Zoning Commission, at the April 17, 2008 meeting,
requested staff to schedule a workshop to discuss allowable uses and proposed boundary
lines for the Commercial Recreation (CR) Zoning District.
During a special called workshop meeting on April 30, 2008, staff presented a proposed
boundary map and list of uses permitted in the CR Zoning District. The Commission
agreed in principal with the suggested boundaries and has questions about several of the
permitted uses for the CR zoning district. At the conclusion, the Commission asked staff
to provide detailed description of the permitted uses identified during the presentation.
Staff complied and sent the required information prior to the public hearing.
The purpose of the Commercial Recreation zoning district is to enhance and diversify the
recreational and economic opportunities that compliment the natural and cultural
attractiveness of the area without significant adverse affect on environmental and natural
features, cultural or historic resources and their settings, and other significant resources of
Sylvan Beach and the Bayfront. The CR zone allows mixed use developments, which
provide a mixture of visitor-oriented and full-time accommodations, including a variety
of residential, recreational, and commercial facilities.
Proposed Boundaries:
Proposed boundaries for this district include the area east of Park Avenue between south and
north Circle Drives, east of Bayshore Drive between Sylvan Beach Boat Ramp and Little
Deer Creek. Proposed boundary map is attached as Exhibit .
Currently, Section 106-441, Table A, Commercial Uses, lists several uses either
conditional or not permitted in the Commercial Recreational (CR) zoning district. In
addition, Section 106-443, Table B, Commercial Area Requirements, contains no
regulations for the CR District.

Conclusion & Recommendation:
In order to clarify the Planning and Zoning Commission, City Council's intentions, goals
and objectives of the La Porte Comprehensive Plan, it is the intent to establish procedures
and standards for developing a CR District while ensuring that all applicable land use
requirements are achieved and available resources are used productively and efficiently.
Actions available to the Commission are as follows:
. Recommend to Council approval for proposed amendments to the Code of
Ordinances pertaining to Commercial Recreation (CR) zoning district, adopt
boundaries, uses, area regulations, and rezone from Medium Density Residential
(R-2), High Density Residential (R-3), and Neighborhood Commercial (NC) to
Commercial Recreation (CR) District.
. Recommend to Council approval of a revised version of the above.
. Recommend to Council denial for the above amendments.
. Table this item for further consideration by the Commission.
