Meeting called to order by Chairman Lawler at 6:05 p.m.
Chairman Lawler noted Commissioner Les Bird was absent and David Janda (All. 1) would be a
voting member.
2. Consider Approval of the February 19, 2009, Regular Meeting and March 05, 2009, Special
Called Meeting Minutes.
David Janda recommended changes to the Minutes.
Motion by Paul Berner to approve the Minutes of February 19, 2009, and March 5, 2009 with the
following corrections:
February 19, 2009
· Item 6.A, paragraph 4.- correct spelling of "beautification"
· Item 6.C, paragraph 3 - correct spelling of "boundary"
· Item 8, - Delete last sentence of first paragraph: "David Janda made a competing
motion to add the residency or business owner of the design professional and

Add: David Janda commented that the Architect/Landscape Architect and Design

3. Open public hearing to receive citizen input on Rezone Request #R08-003 for approximately 14
acres of land located at 1400 North 10th Street, further described as TR 27 of Block 27, TR 28 of
Block 28, Nebraska Syndicate and TR 3 in the Enoch Brinson Survey, Abstract 5, Volume 65,
Page 175, H.C.D.R., La Porte, Harris County, Texas. Troulon Realty Ltd., & Oak Park, LLC. seek to
rezone the property from Business Industrial (BI) to Planned Unit Development (PUD).

A. Staff Presentation
Staff's report was presented by Masood Malik, Cit~ Planner. The applicant, Troulon
Realty Ltd., and Oak Park, LLC. of 1400 North 10t Street, have requested a rezone
from Business Industrial (BI) to Planned Unit Development (PUD). The property is
located east of State Highway 146 frontage road (formerly 10thStreet), west of 8th
Street, north of "L" Street and south of Union Pacific. Staff recommended approval of
the rezone request with an understanding that any further development would require
a Special Conditional Use Permit.

6. Consider approval of a General Plan for the Preserve at Taylor Bayou.
Masood Malik presented staffs report. The preserve at Taylor Bayou is an ongoing project. The
property is located at the southeast corner of State Highway 146 and McCabe Road. Several
years ago the City approved a General Plan and a Special Conditional Use Permit for this project.
Previously the Commission granted two one-year extensions. The applicant requested a third
extension last year, which the Commission denied. The General Plan shows two phases with
nine sections. Phase one shows section five as an apartment complex; section one as a
townhome and section six is commercial retail. In Phase two, section two has single family
development, section four has single family patio home, section three is retention pond, section
eight is a nature preserve, and section nine is a roadway.
A review letter was sent to the project engineer on March 03, 2009, that outlined items to be
addressed.
No revised site plan was received.
Deborah Mason addressed the Commission. Ms. Mason gave a brief rundown of the project and
was confident they would be able to work with the City on the list of outstanding items. She
described the detention plans for the project. Ms. Mason responded to questions from the
Commission regarding drainage/detention, traffic study, entrances, and if the multifamily project
was subsidized.

7. Open public hearing to receive citizen input on Special Conditional Use Permit #SCU09-
002 for property located along McCabe Road and State Highway 146, further described as
107:1: acre tract in the W.P. Harris Survey, Abstract 30; La Porte, Harris County, Texas.
Eddie Dutko, General Partner, Land Holding Corporation, seeks approval of Special
Conditional Use Permit for development of the Preserve at Taylor Bayou within a Planned
Unit Development (PUD) zone.
Chairman Lawler opened the public hearing at 7:43 p.m.
Motion by Dottie Kaminski to table both the public hearing and the recommendation to City Council
regarding Special Conditional Use Permit #SCU09-002 for property located along McCabe Road
and State Highway 146, as shown in Item 9. Second by Paul Berner. Motion carried.

10. Open Workshop to discuss the following provisions:
A. Site Plan Expiration.
Staff has noticed that several site plans have been approved but applications for permits have
not been filed with the City. Due to changes in codes and other pertinent laws or ordinances of
the City, the development conditions and circumstances may not be the same as at the time of
the site plan approval. Staff suggested a time limitation or validity of site plan approval for a
period of 1-year. After expiration, the site plan approval would be deemed void and the
developer would need to submit a new certified site plan for the proposed development.
The Commission agreed there should be a one-year limit placed on site plan approvals.
B. Sexually Oriented Businesses
Masood Malik gave staffs report. Staff has reviewed Chapter 90 of the Code of Ordinances
and the material received at the APA Conference in February. Staff believes there is sufficient
enforcement of Sexually Oriented Businesses through Chapter 90. Staff analyzed the
provisions of Chapter 106 (the Zoning Ordinance) and found that footnote (G) is incorrect as it
guides to provision "Noise" which is irrelevant, Footnote (G) should be corrected to show "g",
which determines the location of adult oriented businesses.
After a discussion by Staff and Commission members, Clark Askins, City Attorney
recommended Staff bring the item back for a workshop. Mr. Askins asked staff to include a
draft remodel of the ordinance and materials as back up for the workshop.
The Commission agreed to workshop an amendment for Sexually Oriented Businesses.

Appendix E
During the Commission's special called meeting on March 05, 2009, questions arose about
development site plans and Appendix E of the Development Ordinance. The purpose of this
review is to evaluate the checklist, requirements, and a comparison with neighboring cities.
Section 4.08 of the Development Ordinance outlines procedures for preparing and obtaining
approval for developments within the City. In addition, Section 4.09 outlines submission
requirement and approval process for Major Development Site Plans. For both major and
minor developments, the development site plan is drawn accurately to scale with exact
dimensions and accompanied by all other required documentation. Development site plans
contain sufficient detail for an evaluation of the proposed development. Complete
instructions for preparing development site plans are contained in Appendix E (copy
attached).
Appendix E of the Development Ordinance describes criteria for the preparation of the site
plan and other information required to be submitted for approval. Development site plans
may be prepared by a Texas registered Engineer or Surveyor. Site plans contain graphic
contents, dedication statements and certificates on the face of the site plan.
Site Plans
The site plan review process with the City is a two-step process. The first step in the
process includes the review and approval of the proposed plan by the Staff and/or Planning
and Zoning Commission. The second step in the site plan process includes the plan review
by the Building Official at the time of permitting. This step is detailed in the Building
Inspection Section.
The purpose of the first step in the site plan process is to determine whether a proposed
development complies with the codes and ordinances of the City. The site plan drawing in
this step depicts the density, height, and setbacks of a proposed project relative to the site
itself, along with preliminary information on drainage, utilities, landscaping, sidewalk,
parking, driveways, accessibility of the site to emergency vehicles and other aesthetic and
functional site issues.
The site plans in the process typically show the existing and proposed conditions on the
tract(s) including:
· Building footprints

. Driveways
. Landscaping
. Parking
. Screening
. Building setbacks
. Sidewalks
. Utilities
. Surrounding land uses
· Any other information required to determine compliance with all applicable City
regulation
The applicant needs to submit five copies of the major development site plan and one copy
of all required documentation to the department for review at least two weeks prior to the
date at which Commission review is requested. The Commission is the approving authority
for all major development site plans. Following review of the major development site plan,
the Commission shall, within thirty days of the filing date, take action to either Approve,
Conditionally Approve, or Disapprove the site plan as filed.

This appendix to the La Porte Development Ordinance
prescribes criteria for the preparation of Development Site
Plans and the information which must be submitted therewith.
Development Plats may be prepared by any qualified planning
consultant but must be certified by the owner and by a
Texas-registered engineer or land surveyor.

MEETINGS
Role of the Chairman. The function of the chairman is to provide leadership to the group.
He/She has certain duties and responsibilities that must be performed.
a. Insure that the meeting is conducted in accordance with established rules.
b. Maintain order and bring the group to a conclusion on the matters before it.
The Agenda. The agenda should always be prepared ahead of time and copies given to all
Board, Commission or Committee members ahead of time if possible. If non-members
attend the meeting, they should also be provided with an agenda.
The agenda should be prepared by the department director or staff person assigned to the
Board, Commission or Committee. All Boards, Commissions and Committees are subject
to the Open Meetings Act and their agenda must be properly posted in a public place, at
least 72 hours prior to the meeting.
Generally, the first order of business on the agenda is the reading, correcting and passing of
the minutes from the last meeting. Next are matters properly listed on the agenda, followed
by reports from staff or committees.
Robert's Rules of Order. Meetings of Boards, Commissions and Committees are
generally conducted under standard parliamentary rules as outlined in Robert's Rules of
Order. This handbook contains a quick reference chart for frequently used Robert's Rules
of Order.
Public Hearings Public Hearings are open forums that allow the public an opportunity
to express their opinion on a specific issue related to the City of La Porte. Public Hearings
are generally conducted in the following manner;
a. The Chairman of the Board or Commission formally opens the Public
Hearing.
b. Proponents (those in favor) of measure speak first.
c. Opponents (those against) speak second.
d. After hearing all who wish to comment on the issue, the proponents are
allowed to give rebuttal and summarize their position, and then the Chairman
formally closes the Public Hearing.

e. Members of the Board, Commission or Committee may ask questions at
anytime, of any witness. Board, Commission or Committee members are
encouraged to ask questions even after the hearing is closed. After the
Public Hearing is closed, members of the public may speak ONL Y in answer
to a question asked by a member of the Board, Commission or Committee.
f. If a Public Hearing drew a large number of interested Citizens, a time limit
for individual speakers may be set by the Board or Commission before the
Public Hearing.
g. The Chairman may use his/her judgement about how strictly this format is
followed.
Quorum. A quorum is the minimum number of members needed to officially conduct
business. The quorum is generally established by the ordinance, resolution, or other
document that establishes the Board, Commission or Committee. Where no statement on
the quorum number exists the quorum is the majority of the members.
Signing the Minutes/or the Meeting. The :Minutes of Decision-Making Boards and
Commissions MUST be signed by either the Chairman and/or the Secretary once the
:Minutes are approved by the members of the Board or Commission.

FOOTNOTES TO TABLE OF ROBERT'S RULES OF ORDER
1. An affirmative vote on this motion cannot be reconsidered.
2. Undebatable when the motion to be amended, reconsidered., or rescinded IS
undebatable.
3. Constitutions, By -Laws, and Rules of Order before adoption are in every respect
main motions and may be amended by majority vote. After adoption they require
prior notice and 2/3 vote for amendment.
4. Standing Rules may be amended at any time by a majority vote if previous notice
has been given, or by a 2/3 vote without notice.
5. If resolutions or propositions relate to different subjects which are independent of
each other, they must be divided on the request of a single member, which may be
made when another has the floor. If they relate to the same subject and yet each part
can stand alone, they may be divided only on a regular motion and vote.
6. Undebatable ifmade when another question is before the assembly.
7. The objection can be made only when the question is first introduced., before debate.
A 2/3 vote must be opposed to the consideration in order to sustain the objection.
8. Negative vote on this motion cannot be reconsidered.
9. Cannot be reconsidered after a vote has been taken under it.
10. Opens to debate main question when latter is debatable.
