Members Absent: Kirby Linscomb Jr., and Richard Warren. City Staff Present: Assistant City Manager, Traci Leach; City Planner, Masood Malik; City Attorney, Clark Askins; and Planning Assistant, Shannon Green. 1. Call to order Meeting called to order by Chairman Hal Lawler at 6:03p.m. Chairman Hal Lawler announced Sulzer Inc. withdrew Rezone Request #11- 92000003. 2. Consider approval of March 17, 2011, meeting minutes. Motion by Les Bird to approve the regular meeting minutes of March 17, 2011. Second by Dottie Kaminski. Motion carried. Ayes: Hal Lawler, Les Bird, Dottie Kaminski, Danny Earp, David Janda, Doretta Finch, and Lou Ann Martin. Nays: None Abstain: None 3. Open Public Hearing to receive citizen input on Rezone Request #11- 92000002, for the property located at 801 North 16 Street, further described as TRS A & 1A, Block 1, Nebraska Syndicate, Johnson Hunter Survey, Abstract No. 35, Harris County, Texas. Brolyn Petri of Chemical Lime, seeks to have this property rezoned from Light Industrial (LI) to Heavy Industrial (HI). Chairman Hal Lawler opened the public hearing at 6:05pm. A. Staff Presentation Masood Malik, City Planner, gave staff's report. Three public hearing notices were mailed to property owners within 200' of the subject property. No responses were received. B. Proponents There were none. C. Opponents There were none. D. Proponents Rebuttal There were none. 4. Close Public Hearing. Chairman Hal Lawler closed the public hearing at 6:14pm. 5. Consider recommendation to City Council regarding Rezone Request #11- 92000002 for the property located at 801 North 16 Street from LI to HI. Motion by Dottie Kaminski to recommend to City Council, approval of Rezone Request #11- 92000002. Second by Lou Ann Martin. The motion carried. Open Public Hearing to receive citizen input on Rezone Request #11- 92000003, for vacant property owned by Sulzer Inc. located at 11518 Old La Porte Road, further described as TRS 333B & W 168ft. of Lot 348, E 168ft. of Lot 348 & TR 333A, and 347 A -2 & 347A -A1, situated in the Enoch Brinson Survey, Abstract No. 5, Harris County, Texas. Billy Coleman of Sulzer Inc., seeks to have this property rezoned from Large Lot (LL) to Light Industrial (LI) for Turbo Expansion services. Mark Follis, Sulzer Inc. representative requested to withdraw the zone change from consideration at this time. No action was taken on this item. 7. Consider Major Development Site Plan for proposed Sens Road Distribution Center to be located at 1445 Sens Road. Masood Malik, City Planner, gave staffs report. Dan Zoch of the Carson Company, spoke in favor of the request. Mr. Zoch informed the Commission the warehouse will look a lot like Port Crossing. Carson Company currently has a tenant committed for 75% occupancy of the facility at this time. Motion by Les Bird to approve the Major Development Site Plan for the proposed Sens Road Distribution Center to be located at 1445 Sens Road. Second by Doretta Finch. Motion Carried. Ayes: Hal Lawler, Les Bird, Dottie Kaminski, Danny Earp, David Janda, Doretta Finch, and Lou Ann Martin. Nays: None Abstain: None 8. Administrative Reports The kick -off meeting for the Comprehensive Plan Update is tentatively scheduled for May 16 There may be a Special Called Planning and Zoning meeting on May 17 Staff received a proposed development request for a Chevron Service Station at Fairmont and Bay Area Blvd. The applicant is planning to add a restaurant. 9. Commission Comments Dottie Kaminski asked staff about the abandoned Ice vendor project on Broadway. Staff will inquire with Inspections Division and get back with the Commission. A. Site Plan Staff Report Major Development Site Plan June 21, 2011 Port Modal Centre Requested By: Christopher P. Brissette, P.E. c/o Clay Development & Construction, Inc. Requested For: 14.8252 acres being TR 27 of Block 27, TR 28 of Block 28, Nebraska Syndicate and TR 3, being situated in the Enoch Brinson Survey, Abstract 5 Volume 65, Page 175, H.C.D.R., La Porte, Harris County, Texas. Location: 1400 State Highway 146 North Land Use Map: Commercial Industrial Uses Requested Use: Office Warehouse — rail served Present Zoning: Planned Unit Development (PUD) Background: Applicant is proposing a 292,500 sq.ft. office /warehouse & distribution center along feeder road of State Highway 146 North. The subject property is located to the east of State Highway 146 frontage road (formerly 10 Street), west of 8 Street (unimproved right -of -way) north of `L' Street (now Harris County Flood Control drainage channel), and south of Union Pacific Railroad (formerly Southern Pacific). Proposed site is located closely to the Barbour's Cut Terminal and Bayport Expansion Terminal, two primary container terminals for the Port of Houston Authority (POHA) in the southeast Harris County. In addition, the property is within the vicinity of commercial and industrial facilities in the area near upper Galveston Bay. Under the terms of Development Ordinance 1444, the proposed development will require a major development site plan. This is based on the size of the development being in excess of 10 acres. Analysis: Land Use — The City's Land Use Plan indicates this area developing with commercial industrial uses. Previous use of the property as RV /Trailer Park was considered to be pre - existing and nonconforming. Trailer park is now abandoned and land has been cleared of all structures. Current owner is proposing a rail - served office warehouse facility at this site. Port Modal Centre Site Plan Page 2 of 3 Transportation - The property in question has approximately 1000 feet of frontage along the State Highway 146 North feeder road, which should accommodate traffic generated by future development. Two pints of access along frontage road should help prevent traffic delays and disperse the impact of additional traffic on the roadways. In addition, railroad transportation will be available to this facility to the north. Highway Corridor Standards — One of the goals of the Comprehensive Plan is to include consideration of landscaping, additional setbacks, visual attractiveness and the preservation of green spaces along the major highway corridors. The subject property is located near the entrance gateway to La Porte. Future development in this area should enhance the entrance corridor to the City to establish a regional identity. Special Use Performance Standards — Exterior building design standards of 100% masonry /glass products shall be applicable to proposed project along major thoroughfare. With a Planned Unit Development district, building setbacks, lot coverage, and facade requirements will have positive aesthetic impacts at the entrance corridor to La Porte. Having said parameters in place, proposed development will not negatively impact the corridor enhancement plans for State Highway 225 and State Highway 146. Utilities and Drainage — Currently, the site has sufficient water and sewer facilities to serve this development. It will be the applicant's responsibility to provide any structures or improvements necessary to accommodate increased demand of water and sanitary sewer for proposed development. Abandonment of underlying utilities was an issue which has been resolved. A 12" water line and 6" sanitary sewer force main relocation work is completed at site. Stormwater management and drainage issues have been reviewed with the site development plan. The subject site abuts F101 channel to the east and south. Harris County Express Review and TxDOT approval are granted for the driveways along State Highway 146. North 8 Street Closing /Abandonment — Application for the closing and abandonment of North 8 Street is being processed and appraisal is underway. Once administratively complete, it will be submitted for City Council's final action and will be incorporated into the plat. Economic Development — The proposed project represents a significant positive impact to economic development within the City of La Porte. The site will be developed as office /warehousing and distribution center. Ultimately, the development is estimated to have a very positive impact on both the City and school district in terms of property tax revenues. Port Modal Centre Site Plan Page 3 of 3 Conclusion/ Recommendation: Staff has reviewed the major development site plan for the Port Modal Center and found it complies with the Development Ordinance. The site plan is recommended for approval with the condition: • Stormwater permit with permanent control features shall be required prior to the issuance of building permit. Options available to the Commission are as follows: • Approve the Major Development Site Plan as filed; • Conditionally approve the Major Development Site Plan as filed, provided, the reasons for such conditional approval are stated in writing and a copy of the statement is signed by the Chairman of the Planning and Zoning Commission. • Disapprove the Major Development Site Plan as filed, provided, the reasons for such disapproval are stated in writing and a copy of the statement is signed by the Chairman of the Planning and zoning Commission. Concrete & Asphalt Streets (Cost Estimates) Staff Report June 21, 2011 Concrete & Asphalt Streets (Cost Comparison) At the March 17, 2011 meeting, the Commission held a workshop to review the City's official truck route map and discuss possible additions of new truck routes along South 16 Street north and south of Fairmont Parkway (see map attached). The Commission directed staff to prepare cost estimates and furnish a cost benefit analysis for the reconstruction of those streets both concrete & asphalt. Staff has calculated projected value of developed and undeveloped properties along these rights -of -way, which is as follows: Developed: Total Property 1,405,600 S.F. or 32 acres HCAD Value $8,966,650.00 Average Assessed value $6.37 per s.f. Undeveloped: Total Property 844,700 S.F. or 20 acres HCAD Value $497,054.00 Average Assessed Value $1.70 per s.f. The Engineering Division has prepared cost estimates for those streets (Exhibit A). Staff has calculated projected revenues of $34,586 per year based on the HCAD appraised value of developed and undeveloped properties along these rights -of -way (Exhibit B). The schedule of costs and benefits for the project is as follows: Construction Cost for Concrete Pavement $694,672.44 (50 -year life time) $694,672 - 34,586 = 20 years to payoff w/o interest Construction Cost for Asphalt Pavement $1,063,764.12 (1 time construction cost + resurface every 7 years) $1,063,764 - 34,586 = 30 years to payoff w/o interest Planning & Zoning Commission June 21, 2011 Page 2 of 2 Cost Benefit Analysis: Based on the current and projected revenues, value of developed and undeveloped properties as of now is $4,871,581. The City of La Porte's taxes equal $34,586. Future values and taxes, assuming full developed properties, equal $9,423,701 and $66,906 respectively.
