Planning and Zoning Commission Minutes of January 16, 2014 Richard Warren, Helen LaCour, Phillip Hoot, Lou Ann Martin, Mark Follis, Danny Earp, Les Bird, and Hal Lawler Doretta Finch Assistant City Manager Traci Leach, Planning Director Tim Tietjens, Assistant City Attorney Clark Askins, and Office Coordinator Peggy Lee Dottie Kaminski and John Zemanek Meeting called to order by Chairman Hal Lawler at 6:02 p.m. 2. Roll Call of Members. Commissioners Warren, LaCour, Hoot, Martin, Follis, Earp, Bird, and Lawler were present for roll call. 3. Consider approval of October 17, 2013, meeting minutes. Motion by Commissioner Martin to approve the October 17, 2013, meeting minutes. Second by Commissioner Warren. Motion carried. Ayes: Commissioners Warren, LaCour, Hoot, Martin, Follis, Earp, Bird, and Lawler Nays: 4. Consider approval of November 21, 2013, meeting minutes. Motion by Commissioner Warren to approve the November 21, 2013, meeting minutes. Second by Commissioner LaCour. Motion carried. Ayes: Commissioners Warren, LaCour, Hoot, Martin, Follis, Earp, Bird, and Lawler Nays: S. Open Public Hearing to receive input on Special Conditional Use Permit Request #13-91000003 for a 6.00 acre tract out of 24.32 acres described as "Reserve J" Block 3, Port Crossing, William P. Harris Survey, Abstract 30, & Johnson Hunter Survey, Abstract 3S, La Porte, Harris County, Texas. PTCAA Texas LP, dba Pilot Travel Centers, on behalf of Port Crossing Land LP, property owner, seeks to develop a truck travel facility with appurtenant restaurant facilities within a Planned Unit Development zone at the northwest corner of SH 146 and Wharton Weems. Chairman Lawler announced there would be no public hearing or action on Special Conditional Use Permit Request #13-91000003, due to the applicant terminating their request. Planning Director Tim Tietjens requested the applicant's written communication with staff be entered into the record, which read as follows: Planning and Zoning Commission Minutes of January 16, 2014 Page 2 of 3 "As a follow up to our conversation this morning, we have decided to terminate our transaction for now with Pilot. As such, please remove this item from tonight's P&Z agenda..." —Pete Harmon A. Staff Presentation There was no staff presentation. B. Applicant Presentation There was no applicant presentation. C. Public Comments There were no public comments. D. Question and Answer There were no questions. 6. Close Public Hearing The public hearing was not conducted. 7. Consider recommendation to City Council on Special Conditional Use Permit Request #13- 91000003. No action was taken on Special Conditional Use Permit Request #13-91000003. S. Discuss subcommittee review of Zoning Ordinance (Chapter 106 of the Code of Ordinances). Subcommittee Chairman Follis reported continued progress with the Chapter 106 updates while Subcommittee Member Hoot provided a brief overview of the group's work. 9. Discuss assignment of definition for fill dirt material. Planning Director Tim Tietjens provided Commissioners a copy of the City's Fill Dirt Application packet, which included a sheet titled Exhibit A to Ordinance 1444-A. Since fill dirt is not currently defined by ordinance, Mr. Tietjens suggested the Commission consider creating a definition for fill dirt that could be added as an additional note to Exhibit A to Ordinance 1444-A. The following definition for fill dirt was provided by Staff as a basis to begin discussion: Fill dirt is defined herein as inert soil material derived from the earth which is used to fill in a depression in the ground or elevate property, artificially changing the grade or elevation of real property. It is natural subsoil or topsoil of small granular size material that may also contain sand and clay, but is specifically devoid of contaminants or man-made materials, as well as materials that are used otherwise to form an improved surface for vehicular traffic (i.e. concrete, rebar, asphalt crushed aggregate, etc.) Planning and Zoning Commission Minutes of January 16, 2014 Page 3 of 3 Commissioners requested the definition be revised to allow two types of fill permits: Fill Dirt Permits and Fill Material Permits. Fill Dirt Permit: for residential zones (R-1, R-2, & R-3) excluding Large Lot, and may include up to 5-10% man-made material and aggregate not exceeding 1%" in size. Fill Material Permit: for Large Lot, Commercial, and Industrial zones with a specification yet to be determined. Conditions for fill material shall include: • Drainage plan per Fill Permit Details Graph (included in application packet) • Statement and sketch acknowledging future land use • No parking designation on administrative record • Double fines for violations 10. Administrative Reports There were no administrative reports. 11. Commission Comments on matters appearing on agenda or inquiry of staff regarding specific factual information or existing policy. • Commissioner Martin hoped everyone had a great holiday and is looking forward to the new year. • Commissioner Warren wished everyone a happy new year and is enjoying working with the subcommittee. • Chairman Lawler thanked the members for their time and encouraged the group to email Planning Staff with any questions they may have about the fill dirt discussion. 12. Adjourn Motion by Commissioner Bird to adjourn. Second by Commissioner LaCour. Motion carried.
