HomeMy WebLinkAbout05-15-14 Regular Meeting of the Planning and Zoning CommissionPlanning and Zoning Commission Minutes of May 15, 2014 Commissioners Present: Richard Warren, Helen LaCour, Phillip Hoot, Mark Follis, Les Bird, and Hal Lawler Commissioners Absent: Doretta Finch, Lou Ann Martin, and Danny Earp City Staff Present: Planning Director Tim Tietjens, City Planner Eric Ensey, and City Attorney Knox Askins 1. Call to order. Meeting called to order by Chairman Hal Lawler at 6:02 p.m. 2. Roll Call of Members. Commissioners Warren, LaCour, Hoot, Martin, Follis, Earp, Bird, and Lawler were present for roll call. 3. Consider approval of meeting minutes: January 16, 2014. Motion by Commissioner Bird to approve the January 16, 2014, meeting minutes. Second by Commissioner Hoot. Motion carried. Ayes: Commissioners Warren, LaCour, Hoot, Follis, Bird, and Lawler Nays: 4. Consider approval of a Preliminary Plat for the Bayside Crossing subdivision; a single family residential development consisting of 73 lots on 17.2135 acres located north and west of the intersection of Spencer Highway and Sens Road (Applicant: Beazer Homes). Planning Director Tim Tietjens introduced Eric Ensey as the new City Planner. City Planner Eric Ensey presented Staff's Report for a request by Beazer Homes for approval of the Preliminary Plat for Bayside Crossing subdivision located north and west of Sens Road and Spencer Highway. Commissioner Hoot asked if a traffic study had been performed. Alan Mueller with Gromax Development, representing Beazer Homes, confirmed that a traffic impact analysis had been completed and a copy was submitted to the City. The study indicated a single entrance for the subdivision was acceptable, with no mitigation measures required. Commissioners discussed traffic patterns associated with the development. It was suggested there be a stipulation with the homeowners' association that addresses street parking in the cul-de-sacs in order to ensure mobility of school buses, fire trucks or other large vehicles. Motion by Commissioner Hoot to disapprove without prejudice, the Bayside Crossing Preliminary Plat, subject to the necessary corrections as noted in Staff's Report. Second by Commissioner LaCour. Discussion or other action regarding current and potential provisions related to hotels/motels. Planning Director Tim Tietjens initiated discussion on a request by City Council for the Planning and Zoning Commission to review and provide a recommendation on possible distance locations for hotels/motels and their proximity to residential uses. Commissioner Hoot expressed concern with obsolescence of structure, so he suggested design standards for hotels/motels, including larger ceiling heights and rooms sizes to help with redevelopment of the property should the building be utilized in the future for a different purpose. Commissioners recommended City Council take into account the following when considering possible amendments to the City's hotel/motel provisions: • The Commission was not in favor of imposing distance requirements between hotels/motels. • Consider amending the Code of Ordinances, Section 106-441, Table A, Footnote 4, from "adjacent to" to "within 250 feet" and require a special conditional use permit for any hotel/motel development within 250 feet of any residential development. This would also apply to hotels/motels that may develop within the industrial zones, since uses in the GC zoning district are also allowed in the industrial zones. 6. Discuss creation of a Mixed Use Zone District for inclusion in the Chapter 106 Zoning Ordinance Review. City Planner Eric Ensey provided an overview for the proposed Mixed Use Zoning District, which the Chapter 106 review subcommittee has been working on for inclusion with the Chapter 106 amendments. Mr. Ensey described the Mixed Use District as generally an area where mixes of commercial and residential uses are allowed in the same building. The areas suggested for mix use zoning are the circle parcels adjacent to Sylvan Park near the bay front. Commissioners discussed the pros and cons of allowing mixed commercial and residential uses within the same parcel. Commissioner Hoot requested City Attorney Knox Askins look into whether or not the City could require commercial specifications for a low density residential use. Chairman Lawler allowed for input from the audience. Judy Neiuwenhaus, and her husband Roelof, reside upstairs of their downstairs business located at 319 E. Main Street. The Neiuwenhaus's also own property in one of the circle parcels being discussed for mixed -use zoning. Due to its current zoning, the couple has been unable to either build a home or to sell the property. Mrs. Neiuwenhaus thanked the Commission for working towards changes that would help them utilize their property. Planning and Zoning Commission Minutes of May 15, 2014 Page 3 of 3 7. Update on progress of Chapter 106 Zoning Ordinance Review. City Planner Eric Ensey reported the Chapter 106 review subcommittee is approximately 90% complete with their review. Staff anticipates all changes to be drafted and ready for the Commission's review by late summer. Subcommittee members mentioned a few of the remaining issues that need to be finalized prior presenting the full set of amendments to the Commission. S. Administrative Reports As a follow-up to the fill dirt discussion from the previous meeting, Planning Director Tim Tietjens reported the City Engineer is working on a definition for fill material that will be presented for the Commission's consideration. 9. Commission Comments on matters appearing on the agenda or inquiry of staff regarding specific factual information or existing policy. While Commissioners congratulated Commissioner Hoot on his election to the school board and welcomed Eric Ensey to the City Staff, there were no comments on matters appearing on the agenda or inquiries of staff regarding specific factual information or existing policy. 10. Adjourn Motion by Commissioner Warren to adjourn. Second by Commissioner LaCour. Motion carried.
