CONSIDER AUTHORIZING MAYOR TO EXECUTE SANITARY SEWER SERVICE CONTRACT WITH SPENWICK - Mr. H. Carlos Smith was recognized and stated that when Creekmont, Fairmont Park and Glen Meadows is completely built out, the sewer plant will be at capacity and was not in favor of the Commission contracting with Spenwick or anyone else. C There was a brief discussion and comments by the representative from Busch, Hutchison, the City Administrator and the Mayor regarding the commitment the City had made in the past to handle Spenwick s effluent; further that they were in the process of obtaining a grant due to this commitment. It was further determined that La Porte expects to receive funding of Step II and Step III grant funds in the next two to~ three years. Motion by Commissioner Tomerlin, seconded by Commissioner Kibodeaux to authorize the Mayor to execute the Sanitary Sewer Service Contract with Spenwick. ADMINISTRATIVE REPORTS - None. + + + .. ., + • • AGREEMENT THE STATE OF TEXAS X X COUNTY OF HARRIS '.X This Agreement.made and entered into by and between the City of La Porte, a Municipal Corporation of Harris County, Texas, hereinafter called "City", and the Spenwick Place Municipal Utility District, a conservation and reclamation district of Harris County, Texas, hereinafter called "Spenwick", W I T N E S S E T H: WHEREAS, the City of La Porte owns and operates sanitary sewerage treatment facilities, including mains and laterals, adjacent to Spenwick; and WHEREAS, Spenwick is desirous of constructing within in its district boundaries, a sanitary sewerage collection system, and transporting the effluent therefrom to City for sewerage treatment purposes; and WHEREAS, Spenwick is located within the exclusive extra- territorial jurisdiction of City for future annexation purposes, and it is contemplated by the parties that Spenwick will . eventually be annexed by City and made a part of City's corporate boundaries; and WHEREAS, City is agreeable to receiving sanitary sewerage collections from Spenwick, for the purposes of treatment, under the terms and conditions of this Agreement: NOW, THEREFORE, for and consideration of the premises and the mutual covenants herein contained, it is agreed by and between the parties as follows: I. Spenwick will take necessary steps to complete the design, engineering, financing, and construction, of a sanitary sewerage collection system, to serve approximately 200 residential and ., • -2- • small commercial connections within Spenwick's corporate boundaries. Spenwick shall construct necessary sewer mains to a point of delivery on City's existing sanitary sewerage collec- tion system, which point of delivery shall be selected by City's engineers, with approval by Spenwick's engineers, and shall be located in the western portion of City's Fairmont Park sub- division. City will accept delivery of Spenwick's sanitary sewerage (but not including any industrial waste) not to exceed a maximum average flow capacity of 90 thousand gallons per day, at such point of delivery, for treatment at City's Fairmont Park sanitary sewerage treatment facilities. II. The parties hereto recognize that Spenwick presently has in operation its own water supply and distribution system, and this agreement does not contemplate that City will furnish Spenwick with fresh water. This Contract shall be effective upon the approval hereof by the governing bodies of each party hereto, and shall continue in force for a period of 20 years, terminating September 30„ 1998; provided, however, this Agreement shall be subject to termination by either party hereto upon two (2) years prior written notice. III. Each party to this Agreement agrees to keep, maintain and operate its sanitary sewerage collection and treatment facilities, as the case may be, in accordance with the then current laws, rules, and regulations, of the State and Federal authorities having jurisdiction thereof. In addition, Spenwick agrees to operate its sanitary sewerage collection facilities in accordance with then current City of La Porte ordinances applicable thereto, including but not limited to, the City of La Porte's industrial waste ordinance, and in keeping with the standards promulgated by the American Water Works Association. C • • -3- IV. The Parties recognize that the water distribution system in operation by Spenwick is presently not an individually metered system. Therefore, it is agreed that the basis of the charges by City to Spenwick hereunder, shall be 150$ of Spenwick's pro- rata portion, based on metered output, of City's actual total costs of sanitary sewerage treatment. City's actual cost of treatment per thousand gallons shall be determined by taking the total cost of operation, maintenance, and replacement attribut- able thereto, divided by the total gallonage treated. Such cost determination shall be made by City, based upon its most recent fiscal year audit, effective the first day of the calendar year immediately following the end of City's fiscal year. It shall be the responsibility of Spenwick to handle all billings and collections from its own customers. City will render its bill to Spenwick on the last business day of each service month, based upon the formula contained in this paragraph, and such bill shall be payable by Spenwick to City, without discount, on or before the 25th day of the following calendar month. Spenwick shall be liable for payment to City based on connections certi- fied to be in service, regardless of whether Spenwick collects the same from its own customers. V. Provisions for Metering - Spenwick will install at its cost, and City shall operate and maintain as a part of the system, the necessary equipment and devices of standard type for properly measuring all sewage discharged into the 'system. Spenwick shall have access to such metering equipment at all reasonable times for inspection and examination, but the reading, calibration and adjustment thereof shall be done only by employees or agents of City, and Spenwick shall have access to the record books kept by City at its office during reasonable business hours. i '. ~ ~ • • ' -4- Calibration of Meter - Not more than three times in each year of operation, City shall calibrate the meter provided by Spenwick, if requested in writing by Spenwick to do so, in the presence of a representative of Spenwick. The parties shall jointly 'observe any adjustments which are made to the meter in case any adjustment is found to be necessary. Inaccuracies of Meter - If, upon any test, the percentage of inaccuracy of any meter is found to be in excess of five percent (5~), registration thereof shall be corrected for a period of time extending back to the time when such inaccuracy began, if such time is ascertainable; and if such time is not ascertainable, then for a period extending back one-half (1/2) of the time elapsed since the date of the last calibration, but in no event further back than a period of six (6) months. If, for any reason, any meters are out of service or out of repair so that the amount of sewage discharged cannot be ascertained or computed from a reading thereof, the amount of sewage discharged during the period such meters are out of service or out of re- pair shall be estimated by City's engineer and agreed upon by the Parties hereto on the basis of the best data available. VI. The Parties hereto recognize and agree that the rates to be charged hereunder, are fair and proper and that such rates recognize the fact that City's sanitary sewerage treatment facilities have been constructed, and in the future will be re- constructed and enlarged, partially with the use of City of La Porte tax funds, and from the proceed of bond sales by the City of La Porte, which will be repaid by tax funds, and that the property within Spenwick's boundaries is not subject to taxation by the City of La Porte. The Parties recognize that the rates charge by City to its customers within its boundaries, do not fully pay for the cost of such service, and that the capital investment in such facilities is provided by tax funds. • • -5- .. In the event that Spenwick fails to tender payment of charges hereunder, when due, such charges shall be subject to an immediate ten percent penalty. If such charges remain unpaid for 60 days after notice to Spenwick by City in writing of such default, such charges shall accrue interest at the rate of 10 percent per annum, and City shall have the privilege of sus- pending its acceptance of delivery of Spenwick's sanitary sewerage into its system, which remedy shall be in addition to any other remedy available to City. VII. Spenwick agrees to establish, maintain, and collect ade- quate sanitary sewerage rates to pay its necessary costs of operation of its system, and its charges to City hereunder. VIII. The Parties hereto recognize that City's Fairmont Park sewerage treatment plant has a rated capacity of 580 thousand gallons per day and that in excess of one-half of such capacity is now being used by City to serve its present customers in the Fairmont Park area. The Parties hereto further recognize that City's first obligation is to provide service to customers and future customers within its own corporate boundaries, and that it, therefore, must limit its agreement hereunder to treat Spen- wick sewerage, to a maximum average flow capacity of 90 thousand gallons per day of sewerage flowing from Spenwick into City's system. Spenwick agrees that it will not issue any further sewer tap permits for buildings commenced after July 1, 1978, without the prior written consent of City. Spenwick shall have full responsibility in connection with all waste handled by its sewerage collection facilities, and Spenwick agrees to save and hold the City harmless from all claims, demands and causes of action which may be asserted by anyone on account of the transportation, delivery and disposal of said waste while they are in the process of being handled by Spenwick's facilities. ~~ ~ • i ., . i ', -6- IX. The unit of measurement for sewerage hereunder shall be gallons, U. S. Standard Liquid Measure. X. Title to all sewerage put into the system under this Agreement shall pass to City at the point of entry. XI. Each party hereto shall be solely responsible for the construction, upkeep, maintenance, repair, and operation of its facility, on its side of the point of entry. XII. Force Majeure - (a) If for any reason of "force majeure" either party hereto shall be rendered unable wholly or in part to carry out its obligations under this agreement, other than the obligation of Spenwick to make the payments required under the terms hereof, then if such party shall give notice and full particulars of such reasons in writing to the other party within a reasonable time after the occurrence of the event, or cause relied on, the obligation of the party giving such notice, so far as it is affected by such "force majeure", shall~be suspended during the continuance of the inability then claimed, but for no longer period; and any such party shall endeavor to remove or overcome such inability with all reasonable dispatch. The term "force majeure" as employed herein shall mean acts of God, strikes, lock-outs or other industrial disturbances, acts of public enemy, orders or actions of any kind of the Government of the United States or of the State of Texas or any civil or military authority, insurrections, riots, epidemics, landslides, lightning, earth- quakes, fires, hurricanes, storms, floods, washouts, droughts, arrests, restraints of government and people, civil disturbances, explosions, breakage or accident to dams, machinery, pipelines, or canals or other structures, on account of any other cause not i ~ • • I • t ' , ~ ~ I ' i ~7 -/- reasonably within the control of the party claiming such inability. It is understood and agreed that the settlement of strikes and lock-outs shall be entirely within the discretion of the party having the difficulty, and that the above requirement that nay "force majeure" shall be remedied with all reasonable dispatch shall not require the settlement of strikes and lock-outs by acceding to the demand of the opposing parties when such settle- ment is unfavorable to it in the judgment of the party having the difficulty. No failure of the City to meet any obligation by reason of "force majeure" shall relieve Spenwick from its~obliga- tions to make the payment required under the terms hereof. (b) No damages shall be recoverable from City by reason of the causes above mentioned. (c) It is expressly recognized by Spenwick that City may be compelled to make necessary alterations, repairs or extensions of new or additional facilities from time to time during the life of this contract and any suspension of service to Spenwick due to such operation shall not be cause for claim of damage on part of the City, provided all reasonable effort is used by the City to provide Spenwick with service in accordance with this contract. In such case, City shall give Spenwick as much advance notice as may be practicable of the suspension or curtailment of service and of the estimated duration thereof. XIII. Any notice, request, demand, statement, or bill provided for in this agreement shall be in writing and shall be considered to have been duly delivered when sent by registered mail, addressed to the then current business address of the Parties, as the case may be, except that routine communications may be sent by ordinary mail, and except that either Party, by the filing of an appropriate written notice to the other may specify some other individual to whom communications thereafter are to be addressed. ' '• r • • -8- XIV. The Parties hereto agree that if any of the provisions of the agreement contravene, or are held invalid under the laws of this State, same shall not invalidate the whole agreement, but it shall be construed though not containing that particular provision and the rights and obligations of the Party shall be construed and inforse accordingly: XV. This contract shall be performable in Harris County, Texas. IN WITNESS WHEREOF the Parties hereto, acting under authority of their respective governing bodies, have caused this agreement to be duly executed in several duplicate originals. We wish to retain this permit in the light of the enclosed copy of a letter from the Texas Department of Health, Review and Wastewater Branch, Division of Water Hygiene- which indicates that the City of La Porte does not have adequate capactiy to treat the sewage from this project. The project is under construction, with a permit issued by Harris County, prior to annexation by the City of La Porte. The owners of this project have an agreement with Spenwick Place Municipal Utility District in which this project is located to accept the sewage from the project and to furnish the project with potable water. The City of La Porte is accepting the Spenwick Place M.U.D. Sewage for treatment, under contract, and are furnishing the District with potable water on an emergency basis. We are in complete agreement with the regional concept of wastewater collection and treatment, and are trying to comply with this concept in transporting our sewage to Spenwick Place M.U.D. If, in fact, the City of La Porte does not have adequate capactiy to handle the sewage flow from this project, we would then revert to a treatment plant under the permit issued, on a temporary basis, until such time as the City of La Porte could construct adequate facilities to handle the sewage flow from this project. ~ ~ • J 'f • r' H. Page 9c of 11, item 8 of the permit contains provisions for permit modification which would encourage development of area- wide wastewater collection and treatment. The site for the proposed Las Palmas Mobile Home Community is now located within the corporate limits of the City of La Porte, Texas. On December 28, 1983, the City Council of La Porte passed Ordinance No. 1393 (copy attached), annexing certain territory to the City, which includes the proposed Las Palmas Mobile Home Community. Future wastewater discharges produced by those annexed areas will be treated by the wastewater treatment facilities of the City of La Porte, and the previously authorized permits will no longer be required. However, it should be pointed out that the future development of this property is now subject to the terms and provisions of all codes and ordinances of the City of La Porte, including the City's Comprehensive Zoning Ordinance. The property is now zoned R-1 Residential, a classification which does not permit construc- tion or operation of a mobile home park. Additional Monitoring by Pezmittee If the permittee monitors any pollutant at the location(s) designated herein more frequently than required by this permit using approved analytical methods as specified above, the results of such monitoring shall be included in the calculation and reporting of the value required in the Discharge Monitoring Report Form (EPA No. 3320-1). Such in- creased frequency shall also be indicated. 7. Records Retention All records and information resulting from the monitoring activities required by this permit including all records of analyses performed and calibration and maintenance of instrumentation and recordings from continuous monitoring instrumentation shall be retained for a minimum of three (3) years or longer if requested by the Fegional Administrator of the Environmental Protection Aoency or the Texas Department of Water Resources. PART II A. MA23AGEMENT REQUIREMENTS 1. Change in Discharge All discharges authorized herein shall. be consistent with the terms and conditions of this permit. The discharge of any pollutant identi- fied in this permit more frequently than or at a level in excess of that authorized shall constitute a violation of the permit. Any anti- cipated facility expansions, production increases, or process modifica- tions which will result in new, different, or increased discharges of pollutants must be reported by submission of a new applicatior, or, if such changes will not violate the effluent limitations specified in this permit, by notice to the permit issuing authority of such clianyes. Following such notice, the permit may be modified to specify and limit any pollutants not previously limited. 2. Noncompliance Notification If, for any reason, the permittee does not comply with or will be unabl_ to comply with any daily maximum effluent limitation specified in this permit. the permittee shall provide the Regional Administrator anc~ tine Texas Department of Water Resources with the following information, in writing, within five (5) da}~s of becoming aware of such condition: a. A description of the discharge and cause of noncompliance; and b. Facilities Operation The permittee shall at all times maintain in good working order and operate as efficiently as possible all treatment or control facilities or systems installed or used by the permittee to achieve compliance with the terms and conditions of this permit. Adverse Impact The permittee shall take all reasonable steps to minimize any adverse impact on the waters to the State of Texas resulting from noncompliance with any effluent lim?tations specified in this permit, including such accelerated or additional monitoring as necessary to determine the nature and impact of the noncomplying discharge. 5. Bypassing Any diversion from or bypass of facilities necessary to maintain com- pliance with the terms and conditions of this permit is prohibited, except (i) where unavoidable to prevent loss of life or severe property damage, (ii) where excessive storm drainage or runoff would damage any facilities necessary for compliance with the effluent limitations and . prohibitions of this permit, or (iii) where authorized under a program of preventive or corrective maintenance as approved by the Environmental Protection Agency or the Executive Director, Texas Department of t9ater Resources. The permittee shall promptly notify the Regional Administrator and the Department of Water Resources in writing of each such diversion or bypass. 6. Removed Substances Solids, sludges, filter backwash, or other pollutants removed from or resulting from treatment or control of wastewaters shall be disposed of in a manner such as to prevent any pollutant from such materials from entering the waters of the State of Texas. 7. Transfer of Ownershi or Control In the event of any change in control or ownership of facilities from which the authorized discharges emanate, the permittee shall notify the succeeding owner or controller of the existence of this permit by letter, a copy of which shall be forwarded to the Regional Administrator and the Texas Department of Water Resources. 3. Availability of Reports Except for data determined to be confidential under Rule 156.01.01.013, Rules of the Department, Section 26.139 of the Water Code and Section 30ts of the Act, all reports prepared in accordance . with the terms of this permit shall be available for public inspection at the offices of the Texas Department of Water Resources and the Regional Administrator. As required by the Act, effluent data shall not be considered confidential. Knowingly making any false statement on any such report may result in the imposition of cri.s,inal and/or civil penalties. 9. Permit Modification After notice and opportunity for a hearing, this permit aay be modified, suspended, or revoked in whole or in part during its term for cause including, but not limited to, the following: a. Violation of any terms or conditions of this pex~rit; b. Obtaining this permit by misrepresentation or fzilure to disclose fully all relevant facts; or c. A change in am• condition that requires either a temporary or permanent reduction or elimination of the authorized discharge. 5. Civil and Crimina~. Liability Except as provided in F•ermit conditions on "Bypassing" (Part II, A-5) and "Power Failure" (Part II, A-7), nothing in this permit shall be construed to preclude the institution of any legal action nor•relieve the permittee from any responsibilities, liabilities, or Penalties established pursuant to any applicable State law or regulation under autl~oric:y preserved by Section 510 of the Act. 7. Oil and Hazardous Substance Liabilitti~ Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the permittee from any responsibilities, liabilities, or penalties to which the permittee is or may be subject under Section 311 of the Federal Water Pollution Control Act Amendments of 1972. 8. State and Federal Laws Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the permittee from an res liabilities, or penalties established pursuant to any applicablelState~ or Federal law or regulation. 9. Property F.i. hts The issuance of this persrit does not convey any property rights in either real or personal property, or any exclusive privileges, nor does it authorize an}~ injury to private property or any invasion of personal rights, nor any infringement of Federal, State, or local laws or regulations. 10. For the purpose of Fart I of this permit, the following definitions shall • apply in lieu of those under "Part I, Section C, 'Monitoring and Reporting "', where limitations are expressed in concentration: a. The "daily average"concentration means the arithmetic average (weighted by flow value) of all the daily determinations of con- centration made during a calendar month. Daily determinations of concentration made using a composite sample shall be the con- centration of the composite sample. When grab samples are used, the daily determination of concentration shall be the arithmetic average (weighted by flow value) of all the samples collected during that calendar day. The "daily average" for fecal coliform bacteria is the geometric mean of the values for all effluent samples col- lected during a calendar month. b. The "daily maximum" concentration means the daily determination of concentration for any calendar day. The "daily maximum" for fecal coliform bacteria is the geometric mean of the values for all ef- fluent samples collected during a calendar day. 2. For the purpose of Part III of this permit, the following definition shall apply: Grab sample Duality means the quality determined by measuring the concentration in milligrams per liter, parts per million or other appropriate units of measurement in a single grab sample of the discharge of a defined waste. 3. When three, four or five consecutive grab samples have been collected at various times on separate days by the same entity, the existence of con- centrations of an}• specific pollutant in more than two samples in excess of the value shorn for the specific pollutant in Column 1 of Table 1, Part III of this permit, is a violation. Each failure to comply with the above requirement for a specific pollutant fs a separate violation except the case where the pollutant parameters involved are expressions of the same characteristic of the effluent. Each grab sample containing pollutants in excess of the concentrations shown for such r••~ilutent in Column 2 of Table 1, Part III of t:-is permit, is a viola ion. tact; fa~~ure to comply with the above requirement for a specific pollutant is ~ separate viola ion except the case where the pollu- tant parameters involve•~ are expressio^~ of the same characteristic of the effluent. Power Failure The permittee is responsible for maintaining adequate safeguards to prevent the discharge of untreated or inadequately treated wastes during electrical power failures either by means of alternate power sources, stzndby generators or retention of inadequately treated effluent. Should the treatment works not include the above capabilities at time of permit issuance, the permittee must furnish within 120 days to the permitting authority, for approval, plans for such facilities and an implementation schedule for their install- ation. 5. The pH limitation is not subject to averaging. 6. These sewerage facilities shall be operated and maintained by a sewage plant operator holding a valid certificate of competency issued under the direction of the Texas Department of Health. 7. This permit is granted subject to the policy of the Department to encourage the development of areawide waste collection, treatment and disposal systems. The Commission reserves the right to amend this permit in accordance with applicable procedural requirements to require the system covered by this permit to be integrated into an areawide system, should such be developed, to require the delivery of the wastes authorized to be collected in, treated by or discharged from said system, to such areawide system; or to amend this permit in an}• other particular to effectuate the Department's policy. Suci, amendments may be made when the changes required are advisable for water quality control purposes and are feasible on the basis of waste treatment technology, engineering, financial, and related considera- tions existing at the time the changes are required, exclusive of the loss of investment in or revenues from any then existing or proposed waste collection, treatment or disposal system. 9. Items stamped N.P.D.E.S. REQUIREMENTS ONLY do not apply to this permit and are retained in this pera;it to preserve the form and numbering system of a National Pollutant Discharge Elimination System permit. The items stamped N.P.D.E.S. REQUIREMENTS ONLY in this permit were secured from a standard U. S. Environmental Protection Agency permit format existent in February, 1974, and they may or may not be identical to the requirements or conditions of the actual N.P.D.E.S. permit appli- cable to the facility covered by this permit. It is necessary to examine the issued N.P.D.E.S. permit authorizing discharge to determine the actual N.P.D.E.S. requirements. 10. A flow measuring device and readily accessible sampling point shall be provided by the permittee. 11. Reporting requirements pursuant to Rules 156.19.15.001-.010 of the Lepar'tnent and any additional effluent reporting requirements contained in the permit are suspe:,ded from the effective date of this permit until plant start-up or discharge, whichever comes first, from the facility described by this perulit. The permittee shall provide written notice to the Austir. and District Office of the Department forty-five (45) days prior to plant start-up or anticipated discharge. 12. The sludge from the treatment process shall be digested, then hauled to a disposal site approved under the provisions of the State Solid Waste Disposal Act, Article 4477-7. The permittee shall keep records of all residues (screenings, slurries, sludges and other solids) removed from the sewage treatment plant site. Such records will include the following information: 1) Volume of residue dispcsed 2) Date of disposal ' 3) Identity of hauler 4) Location of disposal site 5) Method of final disposal The above records shall be maintained on a monthly basis and be available at the plant site for inspection by authorized representatives of the Department for at least two years. Additional definitions of words or phrases used in this permit are as follows: 1. The term "Act" means the Federal Water Pollution Control Act, as amended, Public Law 92-500 (33 USC 1251 et seq), 2. The term "Environmental Protection Agency" means the U. S. Environmental Protection Agency. 3. The term "Administrator" means the Administrator of the U. S. Environmental Protection Agency. 4. The term "Regional Administrator" means one of the Regional Administrators of the U. S. Environmental Protection Agency, 5. The term "National Pollutant Discharge Elimination System" (hereinafter referred to as "NPDES") means the system for issuing, conditioning, and denying permits for the discharge of pollutants from the point sources into the navigable waters, the con- tiguous zone, and the oceans, by the Administrator of the Environmental Protection Agency pursuant to sectior: 402 of the Federal Water Pollution Control Act, as amended. 6. The term "applicable effluent standards and limitations" means all State and Federal effluent standards and limitations to which a discharge is subject under the Act, including, but not limited to effluent limitations, standards of performance, toxic effluent standards and prohibitions, and pretreata-ent standards. 7. The term "applicable water quality standards" means all water quality standards to which a discharge is subject under the Act and which have been (a) approved or per- mitted to remair. in effect by the Administrator following submission to him pursuant to section 303 (a) of the Act, or (b) promulgated by the Administrator pursuant to section 303 (b) or 203 (c) of the Act. 8. The term "sewage" means human body wastes and the wastes from toilets and other receptacles intended to receive or retain body wastes. 9. The term "grab sample" means an indiviZusl san-~le collected in less than 15 minutes. 12. These planning materials describe the construction of a water distribution system and a sewage collection system to serve a 361 unit mobile home community near La Porte, Texas. It is our understanding that water for this community is to be supplied by the Spenwick Place Municipal Utility District and that wastewater is to be treated at the City of La Porte sewage treatment plant (T.D.W.R. Permit No. 10206-01). Based upon a July 1, 1981, sanitary survey of the Spenwick Place Municipal Utility District water plant, said District appears to be deficient in several areas and not capable of supplying this mobile home community. To determine if any significant improvements have been made to this system since our last survey, we have contacted our Regional Office in Rosenberg and requested that a representative resurvey, the water system as soon as itineraries will permit. Until the results of the survey have been made available, we will not be in a position to approve any additional connections to that system. Since self reporting data concerning the City of La Porte sewage treatment plant appears to indicate that the plant is nearing its hydraulic loading capacity, we would also appreciate confirmation from the City that it has sufficient reserve capacity to handle sewage generated by this mobile home community. • .. t ,~ Mr. H.
